It is intended as a short briefing on the functioning of the Dáil and a simple explanation of specific areas that may be of interest to people operating in the community/NGO sector in attempting to make the best use of the Dáil. This briefing document is produced as a result of the EAPN Focus on Poverty in Ireland project, which started in December 2006. This project aimed to raise awareness of poverty and put poverty reduction at the top of the political agenda, while also promoting understanding and involvement in the social inclusion process among people experiencing poverty. This Guide is intended as an accompanying document to the EAPN Guide to Understanding and Engaging with the European Union. The overall aim in producing these two guides is to inform people working in the community and voluntary sector of how to engage with the Irish Parliament and the European Union in influencing policy and voicing their concerns about poverty and social inclusion issues. -

8 The constituency role of Dáil deputies Michael Gallagher and Lee Komito In Chapter 7 we examined the legislative and scrutinising roles of Dáil deputies. In this chapter we concentrate on a different aspect of the work of TDs, looking at the business on which they spend a lot of their time, namely constituency work. Some people wonder whether constituency work is really part of the duties of a TD at all; after all, the Irish constitution says nothing about it. Yet, judging by the large amount of time it occupies, it seems in practice to be more important in the working life of a TD than narrowly-defined parliamentary duties such as speaking in the Dáil chamber or examining legislation. In most countries, it is taken for granted that parliamentarians will work assiduously to protect and further the interests of their constituents, and that constituency work forms part of an MP’s parliamentary duties rather than conflicting with them, but in Ireland there is a body of opinion that sees a constituency role as aberrant and outdated, labels it ‘clientelism’, or believes that it is taken to excess. We shall ask whether there is anything distinctive about Irish practice in this area, looking at the reasons why TDs do so much constituency work, and then consider the consequences it has for the political system The nature of constituency work In all parliaments, members have both a formal, national, parliamentary role and a local, often more informal, constituency role. In the former they are expected to play a part in legislative business and in monitoring government behaviour, as was discussed in the previous chapter. -

Email: [email protected] www.historyhub.ie School of History and Archives, University College Dublin Page 1 Working Papers in History and Policy, No. 10 2013 Abstract: This paper explores the international and historical justifications for the existence of upper houses, arguing that the function of the Irish upper chamber should remain representative and advisory rather than federal or for safeguarding purposes as in other legislative systems. By altering the composition of the Seanad, it will be argued that the outlook, work, and value of Ireland’s upper house can be transformed significantly. As the referendum on the abolition of Seanad Éireann looms, Irish voters have been faced with a stark choice: keep the present Seanad or abolish it altogether. However, there is a third way. Political reform can be difficult to carry out. However, this working paper outlines in plain terms a vision for a new Seanad and, furthermore, it outlines ways in which simple cost savings can be made that will make reform cost neutral at the very least. The present Seanad lacks vocational voices despite its overtly vocational structure. Furthermore, it displays a lack of trust in the choice of the people. -

Dr. Brian Hunt Preface Purpose of the Monograph The scrutiny of legislation is arguably one of the most important roles discharged by the Houses of the Oireachtas. This monograph aims to examine, for the first time, the various elements and features of the political system which have some impact on the ability of the Houses to scrutinise legislation, and to assess whether the requirements of the Constitution, as regards scrutinising and enacting legislation, are fulfilled by the current arrangements. In this way, it is hoped that this monograph contributes to scholarship on the Houses of the Oireachtas and advances the knowledge and understanding of the workings of the Houses, particularly in regard to their role in scrutinising legislation. Outline of Monograph The scrutiny of legislation is one of the key roles served by any legislature and its importance in an Irish context derives from Article 15.2.1 of the Constitution which provides that the sole and exclusive power of making laws is vested in the Oireachtas. -
