2016 Petitions Report PP 2019/0095 STANDING ORDERS COMMITTEE OF TYNWALD FIRST REPORT FOR THE SESSION 2018-2019 PETITIONS FOR REDRESS STANDING ORDERS COMMITTEE OF TYNWALD FIRST REPORT FOR THE SESSION 2018-2019: PETITIONS FOR REDRESS There shall be a Standing Orders Committee of the Court to carry out the duties imposed upon it by Standing Orders 6.8 and 9.1, and to make recommendations to the Court for the revision of Standing Orders. 6.8 (1) The person presiding under Standing Order 3.29 shall, on receipt of a Petition for Redress refer the petition to the Standing Orders Committee. (2) It shall be the duty of the Standing Orders Committee to examine every Petition for Redress to ascertain whether it is in order, and report to Tynwald. 9.1 (4) Any Member dissatisfied by a determination of the President may refer the principle of the issue involved to the Standing Orders Committee which shall report thereon to Tynwald. The powers, privileges and immunities relating to the work of a committee of Tynwald are those conferred by sections 3 and 4 of the Tynwald Proceedings Act 1876, sections 1 to 4 of the Privileges of Tynwald (Publications) Act 1973 and sections 2 to 4 of the Tynwald Proceedings Act 1984. PETITIONS FOR REDRESS PRESENTED IN 2019 1. The 25 Petitions for Redress reproduced at Appendix 1 were presented at Tynwald assembled at St John’s on 5th July 2019. We have considered these in the light of the relevant Standing Orders. 2. We note that all but three are in order. We continue to encourage petitioners to seek the advice of the Clerk of Tynwald in a timely fashion in order to ensure that their petitions comply with Standing Orders. We also draw attention to the revised Guidance for Potential Petitioners at Tynwald Hill (PP No 2017/0022) issued by the Office of the Clerk of Tynwald in February 2017. 3. The petition of Mr Leonard Trevor Cowin in relation to the appointment of the Tynwald Commissioner for Administration and whether this was unlawful is not in order by reason of Standing Order 6.11(d), which provides that a Petition for Redress must not refer to any matter the substance of which has been determined by Tynwald in the current session. 4. The petition of Mr Alan Jones and others representing Peel Town Commissioners in relation to the actions of the registration officer in removing names from the electoral register is not in order because it is a matter which could have been referred to the High Court by way of Petition of Doleance. The petitioners note that they are time barred from making such a petition but Standing Order 6.11(c) refers to a specific case which could be adjudicated upon by the High Court unless the petition shows that it 1 was not reasonable to expect the petitioner to resort to the High Court. Running out of time does not justify using Tynwald to adjudicate on matters which are properly within the province of the High Court or other tribunal. 5. The petition of Mr Courtney Heading in relation to the HPV vaccine is not in order by reason of Standing Order 6.6(1), which provides that a Petition for Redress may be presented on behalf of a petitioner but that such authorisation shall appear on the petition. There is no such authorisation on the petition. 6. J P Watterson S C Rodan D J Ashford D C Cretney G D Cregeen R K Harmer L L Hooper K Sharpe CC Thomas 7th July 2019 4 Appendix 1 Petitions for Redress presented in 2019: full text 5 6 [Signed by M E Blenkinsop-French] 7 8 IN TYNWALD 5th July 2019 To the Honourable Members of the Tynwald Court The humble petition of Mark Jason Cleator Lyonville Stuggadhoo Marown Isle of Man IM4 2AJ Sheweth that Whereas the Manx Government, in failing to adopt The Land Registration Act 2002 as enacted by the UK Government has enabled vexatious and regular application of the law known as Adverse Possession (the occupation of land to which another person has title with the intention of possessing it as one's own), resulting in the legalised theft of land. As demonstrated below, in 1984 the Isle of Man Attorney General concluded that the limitation period for land applies equally to land which is the subject of a trust. The Manx Government, by accepting this opinion without performing further checks as to wider implications (through considering the position of the adjacent Isle or any of the other common law jurisdictions) did fail to ensure the fairness of the relevant Acts of Tynwald. An Act of Tynwald, which enables a person to claim Adverse Possession of land held under a trust, against a life tenant who is not factually in possession of the land, is simply wrong. Similarly, an Act of Tynwald which enables the confiscation of land held in trust on behalf of children or others using Adverse Possession, by implying that the limitation period has run even before the children or others had actually taken possession of their property is also clearly injudicious and in want of reform. The Isle of Man Limitation Act 1984 has allowed just such situations to arise, and this has enabled the theft of property from rightful owners or their heirs and assigns. It is not possible to protect the assets and interests of said persons and consequentially their rightful property is stolen with the Isle of Man Government's agreement and consent. The failure of the Isle of Man Government to ensure the protection of the Manx people has and will continue to lead to property of rightful owners being acquired by others through the use of such Acts of Tynwald and the Manx Courts. It is also the case that as the UK law, which prevents the adverse possession of land which is held in trust does not apply on the Isle of Man, such omission is causing clear and continuous hardship. In addition, Article 1, Protocol 1 of the European Court of Human Rights states that "every person has the right to the peaceful enjoyment of their property".

    AUTUMN NEWSLETTER Presidents Letter Dear Friends, You will all have your programmes prepared for the coming season of Branch Meetings, some will have already had meetings by the time you read this letter. I hope your batteries are recharged after such a glorious summer and we are still enjoying some lovely days. This year we think about all the men and women who were involved in the 1st World War one hundred years ago and what sacrifice they gave for our freedom today. There are still many conflicts around the world today and we pray that God will give the leaders of these countries wisdom to realise there are no winners in war only innocent people suffering through no fault of their own. We see just dreadful pictures on our television screens which seem unbelievable that one human being can inflict on another. Please remember all these people in your prayers particular the women and children. We were delighted to celebrate our Founders Day Service at St Matthew`s and Commission our new Chaplain Nigel Cretney. The tent at the Agricultural Show was well used by young Mums and Dads. Our work continues in the Prison with the Crèche and Craft Afternoons and I was privileged to be at the Family Day at the Prison in August wonderful to see children having fun with their parents. I have just returned from a visit to Cashel Ferns and Ossory read a lesson at their Festival Service on the Sunday, now there’s a thought members…. Festival on a Sunday!. I will be going to the Provincial Presidents conference in early October.

    Manx Heritage Foundation Oral History Project Mr Clifford Irving talking with Mr David C Doyle 1997 Mr Doyle: Mr Irving, you were born in Peel on the 24th day of May 1914 and today we are going to try and cover the years 1914-1926 but before we get to the birth could you tell us something about your parents, please? Mr Irving: Yes, like many other young people at that period my father Willie Irving, as he was known in Peel, emigrated to South Africa with his friend George Moore, later of the Raggatt, near Peel, and Member of the Keys for Peel. My mother, a Miss Cottier, joined my father in South Africa where they were married near Kimberley. In fact I was conceived in South Africa. My parents returned to Peel where I was born in my grandfather’s house. My grandfather was Edward Cottier, the draper, and during all my life in Peel I always lived with my grandparents. My parents lived nearby and I probably spent as much time in their house as with my grandparents. It was a very happy situation and especially after my mother died when I was six years old my grandparents were still very anxious that I should stay and live in their house. I had a brother, Frank, who unfortunately died in the past few years. So, between my grandparents and my parents it was a very happy situation. We all got on very well indeed.     Tribute to Dr Edgar Mann, former Tynwald Member The President: Hon. Members, you will be aware that the death of our former colleague, Dr Edgar Mann, occurred a few days ago. Dr Mann served in both the House of Keys and the Legislative Council for some 23 years. From his position as a GP in Laxey, he first entered public service as a Commissioner in the village before standing successfully for the House of Keys in 1976. In his early years, displaying a sharp intellect and an analytical mind, he rapidly earned the confidence of his peers and moved into leading roles in Tynwald, becoming Chairman of the Department of Agriculture and Fisheries and the Finance Board. It was as Chairman of the latter Board that he made what I consider was a crucial contribution to the fortunes of this Island when dealing with the crisis of the SIB collapse. The Finance Board, under his leadership, set about establishing the Financial Supervision Commission. He became its first Chairman in 1983, thus setting in place the beginnings of the regulatory regime to restore the Island’s credibility and set down the foundations which led to the growth of the finance sector, which is and has been such an important part of our economy. Elected first from the other place to this Council in 1985, it was as a Council Member that he led the Government in 1985 and 1986 as Chairman of Executive Council, the cabinet of the day. With ministerial Government due to commence after the Election of 1986, he determined to resign from Council and seek a mandate from the people with a view to continuing his leadership.

Member for Ramsey (Dr Allinson) to move: That leave be given to introduce a Private Member’s Bill to restate, with amendments, the law relating to abortion; and for connected purposes. The Speaker: We turn to Item 7 on our Order Paper, Leave to Introduce. I call on the Hon. Member for Ramsey, Dr Allinson, to move. Dr Allinson: Thank you, Mr Speaker. Dear Hon. Members, 2017 marks 50 years since David Steel brought in legislation which legalised abortion in the UK. It was not until 1995, now 22 years ago, that this Parliament addressed the issue with its own Termination of Pregnancy Act. Since then many things have changed, especially society’s attitudes and expectations. Now is the time for us to bring our legislation up to date and ensure it provides protection and healthcare for the women of this Island. Our laws regarding abortion still rely on the Criminal Code of 1872. Section 71 makes it an offence for a woman to procure her own miscarriage and makes it unlawful for anyone to assist her. The subsequent section 72 makes procuring drugs to induce an abortion a crime with a maximum penalty of eight years’ imprisonment. 1872 saw Ulysses S. Grant become US President after commanding the Union army of Abraham Lincoln in the American Civil War; the Mary Celeste was found mysteriously abandoned in the Atlantic Ocean; and the Jesse James gang was still robbing banks in Kentucky. Over 220 individual sections of this Code have been repealed or amended in the intervening years, but the sections on abortion still stand.
