  • Resignations and Removals: a History of Federal Judicial Service-And Disservice-1789-1992
RESIGNATIONS AND REMOVALS: A HISTORY OF FEDERAL JUDICIAL SERVICE-AND DISSERVICE-1789-1992 EMILY FIELD VAN TASSEL- Thomas Jefferson's dismay over the failed impeachment of Supreme Court Justice Samuel Chase in 1805 led him later to complain that "impeachment is not even a scarecrow."1 Subse- quent events have proven Jefferson wrong. Although the full panoply of the impeachment process has been used rarely, its existence has given Congress an impressively big stick to wield in persuading miscreant judges to leave the bench.2 Since Jefferson's time, our experience has suggested two important conclusions about judicial discipline and removal. The first is that investigations, threats of investigations, and threats of impeachment can be very powerful tools in inducing judges to resign from office voluntarily. The second is that these tools have a great potential for misuse. Judicial independence is a core value supported by the constitu- tional structure of the federal judiciary. The appointment process, salary protection, and removal mechanism are all means to ensure that federal judges be independent and impartial in their decision- t Visiting Associate Professor, Widener University School of Law. This Article is dedicated to the memory of my brother, Dirck Van Tassel. An earlier version of this Article was prepared as a report to the National Commission onjudicial Discipline and Removal, while I was Associate Historian with the Federal judicial History Office of the Federal Judicial Center. The views and conclusions expressed in this Article are my own and do not necessarily represent the views of the FederalJudicial Center, which, on matters of policy, speaks only through its Board.

To sign on to this letter as an individual with ties to UW: https://bit.ly/DecrimUWind To sign on to this statement on behalf of an organization (RSO, academic unit, etc) , please go to: https://bit.ly/DecrimUWorg Decriminalize UW #GeorgeFloyd #CharleenaLyles #JTWilliams #TommyLe #ShaunFuhr #MannyEllis As members of the University of Washington (Seattle) community, we call on President Ana Mari Cauce and Provost Mark Richards to take immediate action to ensure the health and safety of people on campus, particularly Black and other persons of color, by protecting them from police violence by 1) the Seattle Police Department and 2) the UW Police Department. The national Movement For Black Lives has given the UW community an invitation to uphold our values of justice, equity, and anti-racism, and immediately divest from the Seattle Police Department (SPD) to protect our Black community members. In 2011, The US Department of Justice investigated SPD and found a pattern of excessive and unconstitutional force, which forced the City into a consent decree. The City is seeking to be released from the agreement despite repeated lack of accountability for police killings of Black residents -- most recently, Charleena Lyles and Shaun Fuhr.1 We bear witness to the ongoing harms that police violence enacts against Black lives. In the interests of public health and safety, we call on the University of Washington to divest from and cease any contracts with the Seattle Police Department. Specifically, we call on UW to break all ties (both informal and formal in the form of contracts, agreements, and MOUs) with Seattle Police Department by taking the following steps: 1) Immediately stop handing over people detained by UW Police Department to SPD custody.2 1 This statement was correct when the petition launched on June 2, 2020.

  • Inventory Acc.12092 Papers of the Family of Skene of Rubislaw Related
Inventory Acc.12092 Papers of the family of Skene of Rubislaw related Scottish families, and the family of Sir Walter Scott National Library of Scotland Manuscripts Division George IV Bridge Edinburgh EH1 1EW Tel: 0131-466 2812 Fax: 0131-466 2811 E-mail: [email protected] © Trustees of the National Library of Scotland This collection consists of more than 3000 documents, dating from the 1420s to 1980s, mainly relating to the family of Skene of Rubislaw (near Aberdeen). At its centre are the papers of James Skene (1775-1864), artist and friend of Sir Walter Scott. Skene corresponded with notable individuals in the cultural circles of his day and was connected with such organizations as the Royal Institution, the Society of Antiquaries of Scotland, the Royal Society of Edinburgh, the Institute for the Encouragement of the Fine Arts in Scotland, the Board of Trustees for Manufacturers, and the Bannatyne Club, among others. The archive was formerly in the possession of Major P.I.C. Payne, of Minehead, in Somerset, who acquired the material by purchase from various sources. Some of Major Payne’s own papers relating to the collection from the 1960s, 70s and 80s are included (folders 102-107). Major Payne provided individual descriptions of a portion of the earlier Skene family papers (folders 1-10). These descriptions are listed in the Appendix to this inventory. Folder 10 includes some letters of James Skene himself. Other related families (folders 22-36) include Moir of Stoneywood (the family of James Skene’s mother, Jane), the Forbes family (that of Skene’s wife, Jane, daughter of Sir William Forbes of Pitsligo), Russell of Aden, Keith of Ludquhairn, Gordon of Balgown, Ramsay of Invernellie and Peterhead, and Skene of Halyards and Curriehill.
