COLORECTAL CANCER AWARENESS MARCH 2018

WHEREAS, colorectal cancer is third most commonly diagnosed cancer and the second most common cause of cancer deaths for men and women in the United States and ; and

WHEREAS, colorectal cancer affects men and women equally it is estimated there will be over 140,000 new cases with a death rate of over 50,000; and

WHEREAS, every 3 minutes, someone is diagnosed with colorectal cancer and every 10 minutes someone dies from colorectal cancer; and

WHEREAS, four cancers account for 51.4% of new cancer diagnoses in Somerset County and 45.2% of all deaths, colon cancer accounts for over 10% of all cancer cases and deaths in the county; and

WHEREAS, in Somerset County 30 individuals are diagnosed with cancer each week, ten individuals die of cancer each week and the annual incidence has increased; and

WHEREAS, only 39 percent of colorectal cancer patients have their cancers detected at an early stage; and

WHEREAS, the survival rate of individuals who have early stage colorectal cancer is 90 percent which is why there are over one million colon cancer survivors in the United States however 5 percent of those diagnosed later will have cancer spread to other organs; and

WHEREAS, if the majority of people in the United States age 50 or older were screened regularly for colorectal cancer, the death rate from this disease could plummet by up to 70 percent; and

WHEREAS, colorectal cancer is preventable, treatable, and beatable in most cases; and

WHEREAS, the Regional Chronic Disease Coalition has joined the National Colorectal Cancer Roundtable initiative “80% by 2018 and Beyond” to substantially reduce colorectal cancer along with its partners are encouraging residents to get screened and incorporate a healthy diet, including fiber and whole grains, to reduce the risk of developing cancer. They also remind residents to talk to your doctor about getting screened as the vast majority of cancer deaths can be prevented through early detection.

NOW THEREFORE, I, Patrick Scaglione, Director of the Somerset County Board of Chosen Freeholders, do hereby claim March 2018 as: Colorectal Cancer Awareness Month and urge all citizens to get regular screenings to help save lives.

NATIONAL WOMEN’S HISTORY MONTH March 2018 NEVERTHELESS SHE PERSISTED: Honoring Women Who Fight All Forms of Discrimination Against Women

WHEREAS, women of every race, class, and ethnic background have made historic contributions to the growth and strength of our Nation in countless recorded and unrecorded ways; and

WHEREAS, women have played and continue to play critical economic, cultural, and social role in every sphere of the life of the Nation by constituting a significant portion of the labor force working inside and outside of the home as well as providing the majority of the volunteer labor force of the Nation; and

WHEREAS, women were particularly important in the establishment of early charitable, philanthropic, and cultural institutions in our Nation and served as early leaders in the forefront of every major progressive social change movement; and

WHEREAS, women have served our country courageously in the military; and

WHEREAS, women have been leaders, not only in securing their own rights of suffrage and equal opportunity, but also in the abolitionist movement, the emancipation movement, the industrial labor movement, the civil rights movement, and other movements, especially the peace movement, which create a more fair and just society for all; and

WHEREAS, the Somerset County Commission on the Status of Women will be joining the Nation in celebrating Women’s History Month and will center on women in Somerset County.

NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of the County of Somerset does hereby proclaim the Month of March 2018 as Women’s History Month in Somerset County and honors the theme “NEVERTHELESS SHE PERSISTED: Honoring Women Who Fight All Forms of Discrimination Against Women” by urging all citizens of Somerset County to join in the numerous celebrations scheduled for Somerset County.

CELEBRATING WOMEN IN PUBLIC OFFICE DAY MARCH 19, 2018

WHEREAS, the month of March is Women’s History Month and celebrates the significant contributions women of all races, ethnicities, and backgrounds have made to the world; and

WHEREAS, women play a critical role in the vitality and diversity of our communities and are essential to ensuring Somerset County is well-represented; and

WHEREAS, while the twentieth century was a pivotal time of growth for women entering politics, women remain underrepresented in male-dominated fields, and thus, providing opportunities to support women in public office is imperative; and

WHEREAS, recognizing women in public office will bring awareness to the fundamental necessity of their work and will inspire other young people to serve their communities.

NOW, THEREFORE, BE IT PROCLAIMED the Somerset County Board of Chosen Freeholders does hereby proclaim March 19, 2018 as Celebrating Women in Public Office Day and call upon the people of Somerset County to unite as we support the success of women in public office and observe every March 19th with appropriate activities, events, and programs.

Freeholder Walsh and several Somerset County elected officials accepted the above two Proclamations. AMERICAN RED CROSS MONTH MARCH 2018

WHEREAS, In 2017, the American Red Cross saw a record-breaking year of challenging domestic and international response efforts and through the support of its volunteers, in just 45 days, the Red Cross responded to six of the largest and most complex disasters of 2017 including back-to-back hurricanes, the deadliest week of wildfires in California history, and the horrific mass shooting in Las Vegas also responding to nearly 50,000 home fires in 2017, providing casework assistance to help 76,000 families recover; and

WHEREAS, In New Jersey, the Red Cross responded to more than 820 local disasters last year, assisting nearly 1,900 New Jersey families who were displaced by home fires, installed 10,600 free smoke alarms and reached thousands with fire safety information through the Home Fire Campaign as well as providing an average of 4,000 military family case services every year and collecting an average of 90,000 units of blood from our generous blood donors; and

WHEREAS, THE month of March is dedicated to all those who support the American Red Cross mission to prevent and alleviate human suffering in the face of emergencies.

NOW, THEREFORE, BE IT PROCLAIMED I, Patrick Scaglione, Director of Somerset County Board of Chosen Freeholders, do hereby proclaim March 2018 as American Red Cross Month in Somerset County and encourage all residents to support this organization and its noble humanitarian mission.

BOND ORDINANCE PROVIDING AN APPROPRIATION OF $14,465,148 FOR VARIOUS IMPROVEMENTS AND PURPOSES FOR AND BY THE COUNTY OF SOMERSET, NEW JERSEY, AND AUTHORIZING THE ISSUANCE OF $13,741,891 BONDS OR NOTES OF SOMERSET COUNTY FOR FINANCING PART OF THE COST THEREOF

BE IT ORDAINED, BY THE BOARD OF CHOSEN FREEHOLDERS OF THE COUNTY OF SOMERSET, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS:

SECTION 1:

The improvements described in Section 3 of this bond ordinance (the “Improvements”) are hereby authorized to be undertaken by the County of Somerset, New Jersey (the “County”) as general improvements. For the said Improvements there is hereby appropriated the amount of $14,465,148 including the sum of $723,257 as the down payment (the “Down Payment”) for the Improvements required by the Local Bond Law of the State of New Jersey, constituting Chapter

2 of Title 40A of the New Jersey Statutes, as amended and supplemented (the “Local Bond Law”). The Down Payment is now available by virtue of provision in one or more previously adopted budgets for down payments or capital improvement purposes.

SECTION 2:

In order to finance the cost of the Improvements not covered by the application of the Down Payment, negotiable bonds of the County are hereby authorized to be issued in the principal amount of $13,741,891 pursuant to the provisions of the Local Bond Law (the “Bonds”). In anticipation of the issuance of the Bonds and to temporarily finance said improvements or purposes, negotiable bond anticipation notes of the County are hereby authorized to be issued in the principal amount not exceeding $13,741,891 pursuant to the provisions of the Local Bond Law (the “Bond Anticipation Notes” or “Notes”).

SECTION 3:

(a) The Improvements authorized and the purposes for which obligations are to be issued hereunder, the estimated cost of each Improvement, the appropriation therefore and the estimated maximum amount of Bonds or Notes to be issued for each Improvement are as set forth in Exhibit 1 attached hereto.

(b) The estimated maximum amount of Bonds or Notes to be issued for the purpose of financing a portion of the cost of the Improvements is $13,741,891.

(c) The estimated cost of the improvements is $14,465,148, which amount represents the initial appropriation made by the County. The excess of the appropriations made for each of the Improvements over the estimated maximum amount of Bonds or Notes authorized to be issued therefore is the Down Payment.

SECTION 4:

All Bond Anticipation Notes issued hereunder shall mature at such times as may be determined by the Chief Financial Officer of the County (the “Chief Financial Officer”); provided that no Note shall mature later than one year from its date. The Notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer. The Chief Financial Officer shall determine all matters in connection with Notes issued pursuant to this ordinance, and the signature of the Chief Financial Officer upon the Notes shall be conclusive evidence as to all such determinations. All Notes issued hereunder may be renewed from time to time subject to the provisions of Section 8(a) of the Local Bond Law. The Chief Financial Officer is hereby authorized to sell part or all of the Notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The Chief Financial Officer is directed to report in writing to the Board of Chosen Freeholders of the County at the meeting next succeeding the date when any sale or delivery of the Notes pursuant to this ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the Notes sold, the price obtained and the name of the purchaser.

SECTION 5:

The capital budget of the County is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, Department of Community Affairs, State of New Jersey is on file with the Clerk of the Board of Chosen Freeholders and is available for public inspection.

SECTION 6:

The following additional matters are hereby determined, declared, recited and stated:

(a) The Improvements described in Section 3 of this bond ordinance are not current expenses, and are capital improvements or properties that the County may lawfully make or acquire as general improvements, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby.

(b) The average period of usefulness of the Improvements, within the limitations of the Local Bond Law, taking into consideration the respective amounts of all obligations authorized for the several purposes, according to the reasonable life thereof computed from the date of the Bonds authorized by this bond ordinance, is 12.29 years.

(c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the Office of the Clerk of the Board of Chosen Freeholders and a complete executed duplicate thereof has been filed in the office of the Director, Division of Local Government Services, Department of Community Affairs, State of New Jersey. Such statement shows that the gross debt of the County, as defined in the Local Bond Law, is increased by the authorization of Bonds and Notes provided in this bond ordinance by $13,741,891 and the obligations authorized herein will be within all debt limitations prescribed by the Local Bond Law.

(d) An aggregate amount not exceeding $2,500,000 for items of expense listed in and permitted under Section 20 of the Local Bond Law is included in the estimated cost of the Improvements, as indicated herein.

SECTION 7:

Any funds received from time to time by the County as contributions in aid of financing the purposes described in Section 3 of this Ordinance shall be used for financing said Improvements by application thereof either to direct payment of the cost of said Improvements or to the payment or reduction of the authorization of the obligations of the County authorized therefore by this Bond Ordinance. Any such funds received may, and all such funds so received which are not required for direct payment of the cost of said Improvements shall, be held and applied by the County as funds applicable only to the payment of obligations of the County authorized by this Bond Ordinance.

SECTION 8:

The full faith and credit of the County are hereby pledged to the punctual payment of the principal of and interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the County, and the County shall be obligated to levy ad valorem taxes upon all the taxable property within the County for the payment of the obligations and the interest thereon without limitation of rate or amount.

SECTION 9:

This Bond Ordinance constitutes a declaration of official intent under Treasury Regulation Section 1.150-2. The County reasonably expects to pay expenditures with respect to the Improvements prior to the date that County incurs debt obligations under this Bond Ordinance. The County reasonable expects to reimburse such expenditures with the proceeds of debt to be incurred by the County under this Bond Ordinance. The maximum principal amount of debt expected to be issued for payment of the costs of the Improvements is $13,741,891.

SECTION 10:

This bond ordinance shall take effect 20 days after the first publication thereof after final adoption, as provided by the Local Bond Law.

AUTHORIZING EXECUTION OF SHARED SERVICES AGREEMENT BETWEEN THE COUNTY OF SOMERSET AND BRIDGEWATER TOWNSHIP FOR MILLING AND PAVING OF TWELVE TOWNSHIP ROADS TOWNSHIP OF BRIDGEWATER, SOMERSET COUNTY

WHEREAS, the County of Somerset and Bridgewater Township are desirous of entering into a Shared Services Agreement for the Milling and Paving of Twelve Township Roads; and

WHEREAS, the Shared Services Agreement sets forth and apportions various duties, responsibilities, and obligations of the parties for this project, as well as requiring the County to provide all necessary services for engineering design, construction inspection and open public bidding for the project and requiring Bridgewater Township all other tasks associated with the completion of the project; and

WHEREAS, the Agreement(s) further apportions responsibility between the County and Bridgewater Township for certain expenses and costs associated with the project; and

WHEREAS, the terms and conditions of the Shared Services Agreement are set forth in the Agreement, copy of which is on file with the Deputy Clerk of the Board of Chosen Freeholders; and

WHEREAS, this Resolution shall take effect immediately upon adoption and publication in accordance with the law.

NOW, THEREFORE, BE IT RESOLVED by the Somerset County Board of Chosen Freeholders that the Director and Deputy Clerk of the Board of Chosen Freeholders are hereby authorized to execute the Shared Services Agreement for milling and paving of twelve Township Roads between the County of Somerset and Bridgewater Township, as well as any documents which may be necessary to effectuate said agreement, and the Administrator is authorized to execute any and all documents necessary to effectuate and complete the project.

WHEREAS, the County of Somerset properly advertised seeking Requests for Proposals in accordance with N.J.S.A. 19:44A-20.4, et seq.; and

WHEREAS, the Chief Financial Officer of Somerset County has certified in writing the availability of funds for the purposes set forth in this Resolution, such certification on file in the Office of the Deputy Clerk of the Board, and such funds are provided for in the duly adopted budget of the County of Somerset, line item $28,000.00 (13-293-00-050-802-000 and $5,000 (04-215-162-14-454-815); and

WHEREAS, there exists a need for special litigation counsel and labor counsel in the County of Somerset on an as needed basis for Year 2018; and

WHEREAS, Oxford Title Services, 25 W. Main Street, Somerville, NJ 08876 has submitted a proposal to perform the aforesaid services; and

WHEREAS, Oxford Title Services, 25 W. Main Street, Somerville, NJ 08876 is a Professional Services Firm affording professional title insurance services of the type and nature required to properly carry out the aforesaid and their particular abilities and capacities have been previously demonstrated in work in Somerset County and are recognized by the Office of the Administrator and by the Somerset County Board of Chosen Freeholders.

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Somerset as follows:

1. That the Director and Deputy Clerk of the Board of Chosen Freeholders of the County of Somerset are hereby authorized to enter into a contract with Oxford Title Services to perform the aforesaid professional services and to be compensated in accordance with the fee schedule on file with the Deputy Clerk of the Board. Total amount of this contract covering all fees, costs and disbursements not to exceed $28,000.00 to be approved as to form and content by County Counsel.

WHEREAS, the Division of Mental Health and Addiction Services, New Jersey State Department of Health allocated the total sum of $490,697.00 under the authority of P.L. 1989 Chapter 51; and

WHEREAS, the County filed the application and contract with the State of New Jersey Department of Health for the total of $490,697.00 and required match of $64,773.00 for the period of January 1, 2018 and December 31,2018 on August 22, 2017 through Resolution 17-622; and

WHEREAS, the Chief Financial Officer has certified in writing the availability of funds for the purposes set forth in this resolution such certification on file with the Deputy Clerk of the Board and such funds are provided for in the dually adopted budget of the County of Somerset, line item (02-213-18-327-613-280) $388,217.00; and

WHEREAS, as the County released and RFP for the solicitation of application County Comprehensive Alcoholism and Drug Abuse Funding Contract: CY-COM- 0013-16 on November 17, 2015 in accordance with competitive contracting (40A:11-4.1 et. seq.), with a submission date of December 8, 2015 for grant funding; and WHEREAS, LACADA approved a spending plan through the CCP on November 19, 2015 for the third year of four years the subcontracts for January 1, 2018 through December 31, 2018 to provide a continuum of care for Somerset County residents in need of substance use disorder services; and

WHEREAS, the LACADA recommends the award of the following services: ● Adult Detoxification and Rehabilitation for $227,019.00 to Carrier Clinic ● Outpatient Continuum of Care for $93,923.00 to Somerset Treatment Services ● Women’s Halfway House for $28,227.00 to Daytop Village of NJ at Crawford House ● Adolescent Early Intervention (SBIRT) for $39,048.00 to Somerset Treatment Services

WHEREAS, the County of Somerset did advertise for said services on the County website, www.co.somerset.nj.us, in the Star Ledger and in the Courier News on December 14, 2017, and

WHEREAS, four (4) sealed proposals was received, opened and read for Consulting Services to complete the Somerset County Bicycle and Pedestrian Facilities and Trails Plan Study – Contract CY-COM-0050-18, on January 23, 2018 at 2:30 p.m. prevailing time; and

WHEREAS, the Evaluation committee included representatives of the Somerset County Planning Division, Somerset County Engineering Division, Transportation Planning Authority; NJ Transit and the New Jersey Department of Transportation, which committee, recommends that WSP USA, 2000 Lenox Drive, Lawrenceville, NJ 08648 is qualified to provide the services of this type and nature to carry out the required consultant services, said evaluation report is filed with the Deputy Clerk of the Board.

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Somerset as follows:

That the Director and Deputy Clerk of the Board of Chosen Freeholders of the County of Somerset are hereby authorized to enter into a contract with Dewberry Engineers, Inc. for Modification No. 1 for $291,766.84 of additional money for Construction Administration and Inspection Services for the Replacement of Bridge No. G0701 South Main Street (CR 533) over Royce Brook, Borough of Manville, Somerset County. Amendment to be approved as to form and content by County Counsel for a new contract total covering all fees, costs and disbursements, not to exceed $616,176.34.

2. That the engagement of the above named have been in conformance with a Fair and Open Process for Exempt Service exception, Local Public Contract Law, N.J.S.A. 40A:11-5 (1) (a) (i) Professional Services.

3. Neither party shall be responsible for any resulting loss or obligation to fulfill duties as specified in any of the terms or provisions of this Agreement if the fulfillment of any term or provision of this Agreement is delayed or prevented by any revolutions, insurrections, riots, wars, acts of enemies, national emergencies, strikes, floods, fires, acts of God, or by any cause not within the control of the party whose performance is interfered with which by the exercise of reasonable diligence such party is unable to prevent or in the event the County of Somerset is unable to obtain funding for the project

WHEREAS, the County of Somerset desires to enter into a Cooperative Service Agreement (18-7234-8083-RA) with the United States Department of Agriculture (USDS) Animal and Plant Health Inspection Service (APHIS) Wildlife Services (WS) to conduct direct management activities to reduce safety risk to human health and property damage associated with Canadian Goose on Somerset County properties; and

WHEREAS, the Chief Financial Officer of Somerset County has certified in writing the availability of funds for the purposes set forth in this Resolution, such as certification on file with the Deputy Clerk of the Board, and such funds are provided for in the duly adopted budget of the County of Somerset, line item 01-201-26-011-455-290 - $5,000.00; and

WHEREAS, the County of Somerset and United States Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) Wildlife Services (WS) have proposed the execution of a Cooperative Service Agreement, a copy of which is on file in the Office of the Freeholder Board of the County of Somerset.

WHEREAS, the Chief Financial Officer of Somerset County has certified in writing the availability of funds for the purposes set forth in this Resolution, such certification on file with the Deputy Clerk of the Board, and such funds are provided for in the duly adopted budget of the County of Somerset, line item (01-201-26-011-451-300) not to exceed $15,000.00; and

WHEREAS, the County of Somerset Purchasing Department properly advertised seeking bids for Parts and Repairs for Commercial Lawn, Park, and Golf Course Equipment, on an open-end contract basis with “Availability of Funds Certificate” to be executed by the Director of Financial Services at the time each order is placed; and

WHEREAS, sealed proposals were received, opened and read in public on January 18, 2018 at 2:30 P.M. prevailing time for Parts and Repairs for Commercial Lawn, Park and Golf Course Equipment, Contract #CC-0100-18, Co-operative Pricing Bid #2-SOCCP; and

WHEREAS, three (3) bidders submitted a proposal; and

WHEREAS, the bids were reviewed by the Supervisor of Vehicle and Equipment Maintenance and it was determined that the bids as submitted by Power Place Inc, 297 Route 22 East, Whitehouse Station, NJ 08889; Wilfred MacDonald, Inc., 10 New Maple Ave, Pine Brook, NJ 07058; and Cammps Hardware & Lawn Products, 2168 Route 206, Belle Mead, NJ 08502 meet the requirements of the co-op’s specifications; and

WHEREAS, Wilfred McDonald has since informed the County that they have to withdraw their bid for items 1 (Jacobsen), 14 (Cushman) and 17 (Ransomes Golf) as they are no longer able to offer items 1 (Jacobsen), 14 (Cushman) and 17 (Ransomes Golf); and

WHEREAS, No other bids were received for items 1 (Jacobsen), 14 (Cushman) and 17 (Ransomes Golf), these items shall be rebid.

WHEREAS, in accordance with R.S. 40:33 A-1 the Somerset County Board of Chosen Freeholders adopted a resolution creating the Somerset County Cultural & Heritage Commission on August 2, 1983; and

WHEREAS, by resolution adopted on April 7, 1987 by the Board of Chosen Freeholders, the Somerset County Cultural & Heritage Commission was designated as the official County Arts Agency for the administration of the New Jersey State Council on the Arts Block Grant Funds (now New Jersey State Council on the Arts Local Arts Program Grant); and

WHEREAS, the Chief Financial Officer of Somerset County has certified in writing the availability of funds for the purposes set forth in this Resolution, such certification on file in the Office of the Deputy Clerk of the Board, and such funds are provided for in the duly adopted budget of the County of Somerset, line item 02-213-18-415-902-280; and

WHEREAS, the Somerset County Board of Chosen Freeholders has authorized the distribution of grant applications to municipalities, non-profit organizations and Somerset County in conjunction with the foregoing; and

WHEREAS, the Somerset County Board of Chosen Freeholders has established an application review process which requires the review of applications by the Local Arts Program Panelists, which review has been completed at this time; and

WHEREAS, the Somerset County Board of Chosen Freeholders has reviewed and considered all comments and recommendations of the Local Arts Program Panelists and the Cultural & Heritage Commission and has determined and prepared a list of grant awards and administrative costs as set forth herein.

WHEREAS, the Somerset County Prosecutor’s Office wishes to apply for federal funding of approximately $101,935.00 with an in-kind match of $44,577.00 for an approximate project total cost of $146,512.00 for the project Subaward # V-82-15 (with a duration period of July 1, 2017 to June 30, 2018) under the Victims of Crime Act (VOCA) Grant Program, and

WHEREAS, the Somerset County Board of Chosen Freeholders has reviewed the accompanying application and has approved said request, and

WHEREAS, the project is a joint effort between the Department of Law and Public Safety and the Somerset County Prosecutor’s Office for the purpose described in the application;

1. As a matter of public policy the Somerset County Prosecutor’s Office wishes to participate to the fullest extent possible with the Department of Law and Public Safety.

4. The State Office of Victim Witness Advocacy shall initiate allocations to each applicant as authorized.

WHEREAS, the programs are designed to instruct, including awareness training and hands on participation on the part of the participants so as to become more proficient in executing their responsibilities so as to reduce the chances of employee accidents; and

WHEREAS, the County will extend the opportunity to Municipal employees upon the execution of the Indemnification Agreement between the County of Somerset, the participant and the participating Municipality; and

NOW, THEREFORE, BET IT RESOLVED by the Board of Chosen Freeholders that the Indemnification Agreement be accepted for the participants of the aforementioned Shared Services Training Programs; and

RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR PARTICIPATION IN THE PURCHASE OF FLOOD PRONE PROPERTY

WHEREAS, the Borough of Manville has received funding from FEMA through Grant Award: FMA-PJ-02-NJ-2016-011 in the amount of $1,070,010.00 for the acquisition of the following four flood prone properties:

127 Boesel Avenue, Manville – owned by Jaroslaw Habas

247 North 1st Avenue, Manville – owned by Juan Campos

1114 Saint John, Manville – owned by Ronald P. Frey

1126 Saint John Street, Manville – owned by Michael J. Salvatore

WHEREAS, the Borough of Manville has estimated the cost of acquisition of the above properties to be $1,188,900.00; and

WHEREAS, the Borough requested a FEMA local match from Somerset County through the County’s Municipal Flood Mitigation Funding Program in the amount of $118,890.00 for the Borough’s purchase of the above properties; and

WHEREAS, the County agreed to provide the $118,890.00 from its funds to be dedicated toward the purchase of the Properties by the Borough of Manville; and

WHEREAS, the Borough of Manville and the County of Somerset have agreed to the above properties will be owned and managed by the Borough of Manville; and

WHEREAS, the Borough of Manville and the County have agreed to the terms and conditions of this funding agreement which are set forth in the Agreement For Participation In Purchase of Flood Prone Property attached hereto.

NOW, THEREFORE, BE IT RESOLVED, that the Freeholder Director, Deputy Clerk, County Counsel and necessary County Officials are hereby authorized to execute the “Agreement for Participation in Purchase of Flood Prone Property” a copy of which is attached hereto and made a part hereof.

RESOLUTION AUTHORIZING THE EXTENSION OF LICENSE BETWEEN THE COUNTY OF SOMERSET AND D&R GREENWAY LAND TRUST, INC.

WHEREAS, the County of Somerset has previously entered into a License Agreement with the D&R Greenway Land Trust, Inc., as Licensee, for the use of premises known as the Speiden House, located at 1327 Canal Road, Franklin Township, New Jersey; and

WHEREAS, the current license term expires on February 28, 2018; and

WHEREAS, the License agreement provides an option to extend the term for an additional five (5) year period for said premises; and

WHEREAS, the D&R Greenway Land Trust, Inc., desires to exercise its option to renew the License Agreement with the County of Somerset for an additional five (5) year term;

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Somerset that the Director and Deputy Clerk of the Board of Chosen Freeholders are hereby authorized to execute an Extension of License Agreement with regard to the use of the subject premises located at the 1327 Canal Road, Franklin Township, New Jersey for an additional five (5) year term beginning March 1, 2018 and ending February 28, 2023.

WHEREAS, the Somerset County Prosecutor’s Office is applying for funding of approximately $89,788.00 with County match of $22,447.00 for an approximate project total of $112,235.00 for a project under the Victims of Crime Act (VOCA), Assistance Grant Program #VS-61-15 for the subaward period 10/01/17-09/30/18; and

WHEREAS, Somerset County Board of Chosen Freeholders has reviewed the application on file with the Deputy Clerk of the Board and approved said request; and

WHEREAS, the project is a joint effort between the Department of Law and Public Safety and the Somerset County Prosecutor's Office for the purpose described in the application;

WHEREAS, the Somerset County Prosecutor’s Office is authorized to accept the subaward under the VOCA Program in the total amount of $112,235.00 specifically for the SANE/SART Program.

NOW, THEREFORE, BE IT RESOLVED that by the Somerset County Board of Chosen Freeholders that:

1. As a matter of policy Somerset County wishes to participate to the fullest extent possible with the Department of Law and Public Safety.

2. The Attorney General will receive funds on behalf of all prospective subgrantees.

3. The Division of Criminal Justice shall be responsible for the receipt and review of the applications for said funds.

4. The Division of Criminal Justice shall initiate allocations to each applicant as authorized.
