AT A GLANCE The German Basic Law stipulates clearly that "the Federal Republic of Germany is a democratic and social federal state" and that "except as otherwise provided or permitted by this Basic Law, the exercise of state powers and the discharge of state functions is a matter for the Länder". The Bundesrat has a total of 69 full Members and the same number of votes. The Bundesrat is composed of Members of Länder governments and not of directly elected Members. Since elections in the 16 German Länder take place at different times, the political composition and the majority in the Bundesrat often changes. It is in fact the executive power of the Länder, which is represented in the Bundesrat. The Länder governments do not need a formal parliamentary mandate for their voting behaviour for individual acts in the Bundesrat. 2.     Newsletter 16 vom 10.05.2019 Einigkeit und Recht und Freiheit! Der Ministerpräsident des Bundeslandes Thüringen Bodo Ramelow (Die Linke) hat am Donnerstag, den 9. Mai 2019 in einem Interview mit der Rheinischen Post die Forderung nach einer neuen Nationalhymne erhoben. Zum einen wecke das Lied in ihm „das Bild der Naziaufmärsche von 1933 bis 1945“, die er nicht ausblenden könne. Zum anderen gebe es für die dritte Strophe des Deutschlandliedes in Ostdeutschland deutlich weniger Rückhalt als im Westen. Der Vorschlag Ramelows rief geteilte Reaktionen hervor. Deutliche Kritik kam von Seiten ostdeutscher CDU-Politiker wie dem Ministerpräsidenten des Freistaates Sachsen Michael Kretschmer oder dem CDU-Spitzenkandidaten in Thüringen Mike Mohring. Auch die SPD-Ministerpräsidenten Manuela Schwesig (Mecklenburg-Vorpommern) und Dietmar Woidke (Brandenburg) lehnten den Vorstoß ab. Zustimmend äußerte sich hingegen der thüringische SPD-Politiker Tiefensee. Meine Meinung „Einigkeit und Recht und Freiheit für das deutsche Vaterland! Danach lasst uns alle streben brüderlich mit Herz und Hand! Einigkeit und Recht und Freiheit sind des Glückes Unterpfand: Blüh im Glanze dieses Glückes, blühe, deutsches Vaterland! Als der deutsche Dichter August Heinrich Hoffmann von Fallersleben diese und zwei weitere Strophen seines Deutschlandliedes in einer Augustnacht des Jahres 1841 ersann, war Deutschland für ihn ein ferner Ort, ein Land der Sehnsucht. Zum einen räumlich, denn er hielt sich damals auf der Insel Helgoland auf, die seinerzeit unter britischer Herrschaft stand. Zum anderen gab es damals kein geeintes Deutschland. Anders als viele Nationalstaaten in Westeuropa war Deutschland immer noch ein in viele Kleinstaaten zersplittertes Territorium. Diese Einzelstaaten waren überwiegend monarchisch geführte polizeistaatliche Regime, die mit allen Mitteln versuchten, einen liberalen und parlamentarisch organisierten Nationalstaat zu verhindern.

    Developments Freedom of Speech for Public Officials vs. the Political Parties’ Right to Equal Opportunity: The German Constitutional Court’s Recent Rulings Involving the NPD and the AfD By Thomas Kliegel Abstract Public Officials are bound by the fundamental rights when they are acting in their political function. Acting as such they cannot, in general, claim the freedom of speech for themselves as normal citizens do. If they give statements regarding other political parties they have to abide by the principle of neutrality. Statements that could be understood as negative will be – especially if they are made during the election process – a violation of the right of political parties to equal opportunity, which is an indispensable element of the free and open process of forming popular opinion. The delineation of whether a public official is appearing as such, as a “party politician” or “private individual” can, however, be difficult and it is the obligation of the public official to leave no doubt about the role he is exercising. Different from any other public official the Federal President needs not comply with the principle of neutrality. He has a broad margin of assessment and only transgresses his legal boundaries if he violates the integrative task of his office in an arbitrary manner.     EXTREMIST HUBS Key Findings: • CEP has identified 10 areas (neighborhoods, cities, and states) in North America, Australia, and Europe of particularly concentrated or heightened extremist activity. • In four of the 10 cases CEP examined, community leaders and government officials have identified high unemployment rates—particularly among youth—as a cause of radicalization. • Among other solutions, local and national governments have sought to boost cooperation between law enforcement and community groups in order to stem radicalization. These efforts are—as in the case of Minnesota—sometimes viewed with suspicion by local communities. Executive Summary: Thousands of people from Europe and North America have left their homes to fight alongside al- Qaeda and ISIS. Others have stayed behind to carry out attacks in France, Belgium, the United Kingdom, the United States, and other countries in the name of extremist ideologies. Media and government officials have traced these foreign fighters and lone wolves to specific areas. CEP’s Extremist Hubs resource examines a list of the neighborhoods, cities, and states that Western news outlets, mayors, and other government officials have labeled as “hotbeds of extremism” or “extremism hubs.” CEP also included areas that are reported hotbeds of far-right, ethno-nationalist extremism. This resource is not exhaustive, but is instead meant as an overview of some of the areas that have populated terrorism-related news in recent years. Each profile includes a summary of recent extremist-related activity and the reported origins of the area’s designation as a so-called hotbed. In some cases, national or local governments have taken action to curb extremism in these neighborhoods.
