Establishing 15 IP Tribunals Nationwide, Chinese Courts Further Concentrate Jurisdiction Over IP Matters March 15, 2018 Patent and ITC Litigation China has continued to develop its adjudicatory framework for intellectual property disputes with the establishment of three Intellectual Property Tribunals (“IP Tribunals”) this month. This reform began with the establishment of three specialized IP Courts in Beijing, Shanghai, and Guangzhou at the end of 2014, and has been furthered with the establishment of IP Tribunals in 10 provinces and two cities/municipalities around the country. For companies facing an IP dispute in China, understanding this framework in order to select the appropriate jurisdiction for a case can have a significant impact on the time to resolution, as well as the ultimate merits of the case. Most significantly, through the establishment of these IP Tribunals many Chinese courts have been stripped of their jurisdiction over IP matters in favor of the IP Tribunals. This has led to a fundamental change to the forum selection strategies of both multinational and Chinese companies. The three IP Tribunals established on the first two days of March 2018 are located in Tianjin Municipality, and cities of Changsha and Zhengzhou respectively. This brings the number of IP Tribunals that have been set up across 10 provinces and two cities/municipalities in China since January 2017 to a total of 15. The most unique aspect of the specialized IP Tribunals is that they have cross-regional1 and exclusive jurisdiction over IP matters in significant first-instance2 cases (i.e., those generally including disputes involving patents, new varieties of plants, integrated circuit layout and design, technical-related trade secrets, software, the recognition of well-known trademarks, and other IP cases in which the damages sought exceed a certain amount)3. -

Overview of Hainan Province
Overview of Hainan Province Geographical Location Situated at the southernmost tip of China, Hainan sees Guangdong across the Qiongzhou Strait to the north, Vietnam across theBeibu Bay to the west and Taiwanacross theSouth China Sea to the east. Its neighbors in the South China Sea include the Philippines, Brunei and Malaysia in the southeast and south. The jurisdiction of Hainan covers Hainan Island, theXisha (Paracel) Islands, theZhongsha (Macclesfield) Islands and the Nansha (Spratly) Islands as well as the surrounding maritime areas, making it the largest province in China in terms of area. Hainan covers a land area (mainly including Hainan Island and Xisha, Zhongsha and NanshaIslands) of 35,400 square km (that of Hainan Island reaching 33,900 square km) and has a maritime area of about 2 million square km. With the outline like an oval snow pear, Hainan Island has a total area of 33,900 square km (excluding the satellite islands), the second largest island only next to Taiwan Island. Qiongzhou Strait, located between Hainan Island and Leizhou Peninsula of Guangdong Province is about 18-nautical-mile wide; while Zengmu Ansha in Nansha Islands is the southernmost territory of China. Administrative Divisions By September 2015, Hainan Province had 27 cities and counties (districts), including four prefectural cities, five county-level cities, four counties, six autonomous counties, eight districts, and 21 townships, 175 towns and 22 sub-district offices (totaling 218). 2019 International Religious Freedom Report
CHINA (INCLUDES TIBET, XINJIANG, HONG KONG, AND MACAU) 2019 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary Reports on Hong Kong, Macau, Tibet, and Xinjiang are appended at the end of this report. The constitution, which cites the leadership of the Chinese Communist Party and the guidance of Marxism-Leninism and Mao Zedong Thought, states that citizens have freedom of religious belief but limits protections for religious practice to “normal religious activities” and does not define “normal.” Despite Chairman Xi Jinping’s decree that all members of the Chinese Communist Party (CCP) must be “unyielding Marxist atheists,” the government continued to exercise control over religion and restrict the activities and personal freedom of religious adherents that it perceived as threatening state or CCP interests, according to religious groups, nongovernmental organizations (NGOs), and international media reports. The government recognizes five official religions – Buddhism, Taoism, Islam, Protestantism, and Catholicism. Only religious groups belonging to the five state- sanctioned “patriotic religious associations” representing these religions are permitted to register with the government and officially permitted to hold worship services. There continued to be reports of deaths in custody and that the government tortured, physically abused, arrested, detained, sentenced to prison, subjected to forced indoctrination in CCP ideology, or harassed adherents of both registered and unregistered religious groups for activities related to their religious beliefs and practices. There were several reports of individuals committing suicide in detention, or, according to sources, as a result of being threatened and surveilled. In December Pastor Wang Yi was tried in secret and sentenced to nine years in prison by a court in Chengdu, Sichuan Province, in connection to his peaceful advocacy for religious freedom. -

www.maritimeindia.org South Sea Fleet: The Emerging ‘Lynchpin’ of China’s Naval Power Projection in the Indo-Pacific Author: Gurpreet S Khurana* Date: 10 February 2016 In December 2015, China commissioned Hefei (174) – the third Type 052D guided- missile destroyer into its navy. 1 The warship represents the most advanced surface combatant ever operated by the PLA Navy, and comparable to the best in the world. It is armed with potent long-range missiles like the HHQ-9 (anti-air), the YJ-18 (anti-ship), and the CJ-10 (land-attack).2 This seems incredible considering that until barely a decade ago, China’s navy did not even possess a credible fleet air defence missile system, let alone a land-attack capability. Map – PLA Navy Fleets: Areas of Responsibility 1 Notably, all three Type 052D destroyers are based in PLA Navy’s South Sea Fleet (SSF).3 This is among the latest indicators of the growing salience and strength of this fleet. The SSF is fast becoming the ‘sword arm’ of the PLA Navy that is rapidly amassing distant power-projection capabilities, with major geopolitical and security ramifications, not only for the China’s immediate maritime neighbours in the South China Sea (SCS), but also for the littorals of the Indian Ocean region (IOR). This essay attempts to discern the trends since the rise of China’s naval power in recent decades, and the implications for the Indo-Pacific4 region.
