This council meeting is being held during the COVID-19 emergency declaration and is being conducted as a virtual meeting in accordance with Ohio’s Open Meetings Laws as amended by H.B. 404. Council Rule 49, requiring the attendance of the Mayor and director of all departments at council meetings is waived for this and any other virtual council meetings held under amended H.B. 404.

The meeting of the Council was called to order at 3:02 p.m. with the President of Council, Kevin J. Kelley, in the Chair.

Ordinances and Resolutions

First Reading Emergency Ordinances Referred

An ordinance is a City law written and enacted by City Council. Ordinances govern the actions, responsibilities and tax dollars of residents, businesses, organizations, city departments and visitors in Cleveland. Ordinances can be written and passed to address issues about housing, safety, public services, employment, the City budget and economic development. Many ordinances authorize the City to spend money on contracts and projects that support the mission of the City of Cleveland.

Ordinances are effective 30 days after passage. Emergency ordinances take effect immediately upon the Mayor’s signature or 10 days after passage.

Under the Charter, legislation cannot be passed until it has been read on three separate days, unless this requirement is dispensed with by a two-thirds vote of the Council. This is known as passing legislation “under suspension.” Ordinances may be passed under suspension after either the first or second reading.

If not passed under suspension after the first reading, the legislation is then sent to the appropriate City departments for review.

Ordinance No. 99-2021

An emergency ordinance to amend Section 133.29 of the Codified Ordinances of Cleveland, Ohio, 1976, as amended by Ordinance No. 503-08, passed April 13, 2009, relating to golf course rates.

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That Section 133.29 of the Codified Ordinances of Cleveland, Ohio, 1976, as amended by Ordinance No. 503-08, passed April 13, 2009, is amended to read as follows:

Section 133.29 Golf Course Rates

The Director of Parks, Recreation and Properties Public Works is authorized to collect the following rates at municipal golf courses, provided, however, that the fees regarding banquet room rental at Highland Park may be amended from time to time by the Board of Control:

(a) Regular rates. To qualify for City Residency rates, a player must reside in the City of Cleveland and verify residency by providing photo identification and one other item determined by the Commissioner of Recreation to be acceptable proof.

(1) For City residents: Monday-Friday Weekends 9 holes $11.50 $13.00 $12.00 $14.00 18 holes $22.00 $24.00 $23.00 $25.00

(2) For non-City residents: Monday-Friday Weekends 9 holes $12.50 $14.00 $13.00 $15.00 18 holes $24.00 $26.00 $25.00 $27.00

(b) Senior rates: (Applicable before 3:00 p.m. Monday through Friday and after 3:00 p.m. on weekends and holidays). To qualify for senior rates, a player must be at least sixty (60) years old and must provide positive photo identification. To also qualify for City Residency rates, a player must reside in the City of Cleveland and verify residency and age by providing photo identification and one other item determined by the Commissioner of Recreation to be acceptable proof.

(1) For City residents: Rate 9 holes $ 8.00 $9.00 18 holes $15.00 $16.00

(c) 18-Hole Special Rate: (Applicable before 3:00 p.m. Monday through Friday and after 3:00 p.m. on weekends and holidays). To qualify for the discounted green fee, a player would be required to rent a riding cart.

(1) For City residents: Rate Regular $18.00 Senior $14.00

(2) For non-City residents: Rate Regular $20.00 Senior $16.00

(d) (c) Junior rates: (Applicable before 3:00 p.m. Monday through Friday and after 3:00 p.m. on weekends and holidays). To qualify for junior rates, a player must be eighteen (18) years old or younger and must provide positive photo identification. To also qualify for City Residency rates, a player must reside in the City of Cleveland and verify residency and age by providing photo identification and one other item determined by the Commissioner of Recreation to be acceptable proof.

(1) For City residents: Rate 9 holes Free 18 holes $ 8.00 Free

(2) For non-City residents: Rate 9 holes $ 9.00 $10.00 18 holes $17.00 $18.00

(e) (d) Winter rates: To qualify for City Residency rates, a player must reside in the City of Cleveland and verify residency by providing photo identification and one other item determined by the Commissioner of Recreation to be acceptable proof. The Commissioner of Recreation shall determine, based on weather and course conditions, the dates during which winter rates shall be in effect.

(1) For City residents: Rate 9 holes $ 10.00 18 holes $19.00

(2) For non-City residents: Rate 9 holes $ 11.00 18 holes $21.00

(f) (e) Additional 9 holes. Players under categories listed above who purchase a 9-hole ticket and wish to play an additional 9 holes may do so by presenting the 9-hole ticket to the cashier within three hours from the time of purchase and paying the additional amount required to equal the 18-hole rate.

(g) Group, promotion and other reduced rates. Effective until January 1, 2010, the Director of Parks, Recreation and Properties subject to Board of Control approval, is authorized to establish and collect group, promotional, and other reduced rates at municipal golf courses in amounts that do not exceed the per person rates listed in division (a) through (f) of this section.

(h) Tent Rental: $230.00

(i) (f) Banquet Room Rental at Highland Park.

(1) All rental rates for the banquet room shall be set by the Board of Control, which shall include rental schedules for City residents and non-City residents.

(2) Rental rates shall be based on a four (4) hour period, which will include at no charge up to one (1) hour before the event for set-up and up to one (1) hour after the event for clean-up. Any events, not including the above- referenced set-up and clean-up times, exceeding the four (4) hour period, shall be charged for each additional hour, or portion of an hour, used. Rental rates for the room, including additional charges for exceeding the four (4) hour period, shall be set by the Board of Control. The banquet room closes at 12:00 a.m. on Friday through Sunday and Holidays and at times determined by the Commissioner of Recreation on Monday through Thursday. All events shall end one-half hour before the facility closes. The City's Concessionaire shall be used exclusively to provide food and beverages for all catered events, unless the Director approves the use of an independent caterer. All beverages, including alcoholic beverages, shall be purchased from the City or the City's Concessionaire. Security is to be provided through the Village of Highland Hills Police Department and it is the responsibility of the group renting the banquet room to arrange and pay for such security, as billed by the Village of Highland Hills Police Department.

(3) Rental of the banquet room for golf outings. The golf outing must conclude one-half hour before the golf course closing time. Events exceeding the four (4) hour rental period described above, are subject to additional charges. If the event is to be catered by the City's Concessionaire, the rental fee for the room for a maximum period of four (4) hours, shall be included in the caterer's per- person meal cost.

(4) Golf leagues established for the season at Highland or Seneca Golf courses Course may use the banquet room at no charge once per golf season. Events shall be held Monday through Friday and shall conclude by 5:00 p.m.

(j) (g) Net proceeds from fees collected at the Highland and Seneca Golf Courses Course shall be expended for facility improvements at the golf courses.

Section 2. That existing Section 133.29 of the Codified Ordinances of Cleveland, Ohio, 1976, as amended by Ordinance No. 503-08, passed April 13, 2009, is repealed.

Section 3. That this ordinance is declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

Ordinance No. 100-2021

By Council Members: Brancatelli and Kelley (by departmental request)

An emergency ordinance designating certain property situated in both the City of Cleveland and the City of Warrensville Heights as a joint economic development zone; authorizing the Mayor of the City of Cleveland to sign a Joint Economic Development Agreement with the City of Warrensville Heights; and authorizing the Directors of Economic Development, Public Works and Capital Projects to execute any necessary documents.

WHEREAS, the City of Cleveland (the “City”) and City of Warrensville Heights are both municipal corporations and political subdivisions in and of the State of Ohio, and share territorial municipal jurisdiction of property owned by Tremco Co. consisting of approximately 11.7267 acres, and commonly known as Permanent Parcel Nos. 143-11- 024, 143-12-097, 143-12-096, 762-09-011 and 762-09-001 which are all part of the original Warrensville Township Lot 83 and 84 and are more fully depicted in the proposed Joint Economic Development Agreement set forth in the file mentioned below (the “Property”); and

WHEREAS, Section 715.691 of the Revised Code provides that two or more municipal corporations may enter into a contract whereby they agree to share in the costs of improvement, and/or receipt of municipal income taxes for an area located in one or more of the contracting municipal corporations that they designate a joint economic development zone for the purpose of facilitating new or expanded growth for commercial or economic development in the State; and

WHEREAS, the City and Warrensville Heights desire to enter into an Agreement providing for the joint commercial development of the Property to maximize the total, long-term economic benefits to both the City and Warrensville Heights, which benefits shall include shared income tax revenues derived from new job creation; and

WHEREAS, this Council has determined that the optimal long-term benefit for the City from the use of the Property will be achieved, and the best interests of the residents of the City will be served by its entering into this Agreement with Warrensville Heights; and

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That this Council designates the Property as a joint economic development zone for the use and development of Property, and the income tax sharing, with Warrensville Heights.

Section 2. That the Mayor of the City of Cleveland is authorized to enter into an Agreement on behalf of the City with Warrensville Heights, the terms of which are substantially outlined in, and which agreement is for an area described in, File No. 100- 2021-A, which shall not be materially changed except by subsequent action by Council. The Agreement shall also require that the City of Cleveland receive at least 54.0% of the gross income taxes levied and collected (less reasonable expenses associated with the collection of said taxes) on incomes earned in the Property.

Section 3. That the Mayor, the Directors of Economic Development, Public Works, Capital Projects and/or Law, are authorized to take such other actions and to execute and deliver such other agreements, instruments, certifications and documents as may be required by the Agreement, or, if permitted but not required, that are necessary or appropriate to promote or fulfill the transactions contemplated by the Agreement and the purposes to be served thereby, or to protect the interest of the City of Cleveland.

Section 4. That this ordinance is declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

Ordinance No. 101-2021

An emergency ordinance authorizing the Director of Public Works to enter into one or more contracts with City Year, Inc. to perform community service work and to collaborate with various non-profit agencies for a period of one year.

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That the Director of Public Works is authorized to enter into one or more contracts with City Year, Inc. to perform community service work and to collaborate with non-profit agencies for a period of one year, in an amount not to exceed $75,000.00, payable from Fund No. 01-7004-6380, RQS 7004, RL 2021-3.

Section 2. That this ordinance is declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

Ordinance No. 102-2021

An emergency ordinance authorizing the Director of Public Safety to enter into one or more contracts with the International Association of Chiefs of Police to conduct training through a Faculty Development Workshop and to provide mentoring and instruction through Leadership in Police Organization training, for the Division of Police, Department of Public Safety.

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That the Director of Public Safety is authorized to enter into one or more contracts with the International Association of Chiefs of Police to conduct training through a Faculty Development Workshop and to provide mentoring and instruction through Leadership in Police Organization training in the aggregate amount of $62,600, for the Division of Police, Department of Public Safety. The contract or contracts shall be paid from Fund No. 01-6002-6320, RQS 6002, RL 2021-10.

Section 2. That this ordinance is declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

Ordinance No. 103-2021

An emergency ordinance authorizing the Director of Public Works to employ one or more professional consultants to provide security services at various indoor and outdoor recreation facilities, including but not limited to, recreation centers, outdoor pools and various surrounding play areas, for a period not to exceed one year.

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That the Director of Public Works is authorized to employ by contract or contracts one or more consultants or one or more firms of consultants for the purpose of supplementing the regularly employed staff of the several departments of the City of Cleveland in order to employ one or more professional consultants to provide security services at various indoor and outdoor recreation facilities, including but not limited to, recreation centers, outdoor pools and various surrounding play areas, for a period not to exceed one year. The selection of the consultants for the services shall be made by the Board of Control on the nomination of the Director of Public Works from a list of qualified consultants available for employment as may be determined after a full and complete canvass by the Director of Public Works for the purpose of compiling a list. The compensation to be paid for the services shall be fixed by the Board of Control. The contract or contracts authorized shall be prepared by the Director of Law, approved by the Director of Public Works and certified by the Director of Finance.

Section 2. That the cost of the contract or contracts authorized shall be paid from Fund No. 01-7004-6380, RQS 7004, RL 2021-4.

Section 3. That this ordinance is declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

An emergency ordinance approving the report of the Assessment Equalization Board on objections concerning estimated assessments with respect to the continuation and expansion of the Improvement District and the new plan to provide public services for the District; determining to proceed with the plan; adopting and levying the assessments; and authorizing the City of Cleveland to enter into an agreement with the Downtown Cleveland Improvement Corporation.

WHEREAS, under Resolution No. 910-2020, adopted December 2, 2020, the Assessment Equalization Board (the “Board”) was appointed to hear and determine all objections concerning the estimated assessments under Resolution No. 713-2020, adopted September 11, 2020 (the “Resolution of Necessity”), to provide for public services benefitting the Downtown Cleveland Improvement District (the “District”); and

WHEREAS, the Board has filed its report with this Council as to its determination of the objections; and

WHEREAS, this Council deems the report proper in all respects; and

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That the report of the Board, appointed under Resolution No. 910-2020, adopted December 2, 2020, is approved and placed in File No. 104-2021-A, along with the final assessments for the District, as equalized by the Board.

Section 2. That it is determined to proceed to provide for the plan for public services benefitting the District (collectively, “District Services”), as established in the Resolution of Necessity.

Section 3. That the District Services shall be performed under the provisions of the Resolution of Necessity, and consistent with the plans, specifications, profiles and assessments approved and filed in the office of the Clerk of Council.

Section 4. That judicial inquiry into all claims for damages resulting from the District Services filed under law shall occur after completion of the District Services.

Section 5. That the cost of the District Services to be assessed against benefited property shall be assessed in the amount, manner and number of installments as provided for in the Resolution of Necessity, as equalized by the Board.

Section 6. That the final assessments, as equalized by the Board, for the cost of the District Services placed in the file mentioned above and aggregating $25,275,470.00 are adopted and confirmed as final assessments.

Section 7. That the final assessments shall be assessed and levied on the lots and lands benefited and to be charged therewith in the District in proportion to the benefits as described in the Resolution of Necessity.

Section 8. That it is determined that the assessments do not exceed the special benefits resulting from the District Services, and do not exceed any statutory limitation.

Section 9. That the final assessments which have been filed with the Clerk of Council shall remain open to public inspection.

Section 10. That the assessments for the first year shall be billed by and paid to the City of Cleveland’s Division of Assessments and Licenses. All assessments which have not been paid by the specified due date, as well as the subsequent annual assessments, shall be certified by the Commissioner of the Division of Assessments and Licenses to the County Fiscal Officer on or before the certification deadline for the appropriate assessment years, to be placed on the tax duplicate and collected the same as other taxes, as provided by law.

Section 11. That the Clerk of Council is directed to cause a certified copy of this ordinance to be filed with the County Fiscal Officer within fifteen (15) days after the passage of this ordinance, or as otherwise required by Section 319.61 of the Revised Code.

Section 12. That the Clerk of Council is directed to cause notice of the levy of the assessments to be filed with the County Fiscal Officer within twenty (20) days following the passage of this ordinance, or as otherwise required by Section 319.61 of the Revised Code.

Section 13. That the Clerk of Council is directed to cause a notice of the passage of this ordinance to be published once in a newspaper of general circulation in this City.

Section 14. That it is found and determined that all formal actions of this Council concerning the adoption of this ordinance were conducted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were conducted in meetings open to the public, in compliance with all legal requirements.

Section 15. That the Directors of City Planning, Public Safety, and Public Works are authorized, in their discretion, to enter into a contract with the Downtown Cleveland

Improvement Corporation setting forth the terms under which the City will levy an assessment for the District and the use of the proceeds of the assessments levied herein.

WHEREAS, pursuant to Charter Section 115-2, Council has requested and reviewed applications to fill the expired term and has determined, in compliance with the Charter, to appoint the member whose initial four-year term ended February 7, 2021, to a second four-year term; and

WHEREAS, this resolution constitutes an emergency measure for the immediate preservation of public peace, property, health or safety, in that Council must fill the seat of the expired term on the Civilian Police Review Board so that it complies with the Charter, now, therefore,

WHEREAS, the granting of this application for a liquor permit to this high crime area, which is already saturated with other liquor outlets, is contrary to the best interests of the entire community; and

WHEREAS, the applicant does not qualify to be a permit holder and/or has demonstrated that he has operated his liquor business in disregard of the laws, regulations or local ordinances of this state or any other state; and

WHEREAS, the place for which the permit is sought has not conformed to the building, safety or health requirements of the governing body of this County or City; and

WHEREAS, the place for which the permit is sought is so arranged or constructed that law enforcement officers or agents of the Division of Liquor Control are prevented reasonable access to the establishment; and

WHEREAS, the place for which the permit is sought is so located with respect to the neighborhood that it substantially interferes with public decency, sobriety, peace or good order; and

WHEREAS, this objection is based on other legal grounds as set forth in Revised Code Section 4303.292; and

WHEREAS, this resolution constitutes an emergency measure providing for the immediate preservation of the public peace, prosperity, safety and welfare pursuant to Section 4303.26 of the Ohio Revised Code. Council’s objection to said permit must be received by the Superintendent of Liquor Control within 30 days of notification; now, therefore,

An ordinance is a City law written and enacted by City Council. Ordinances govern the actions, responsibilities and tax dollars of residents, businesses, organizations, city departments and visitors in Cleveland. Ordinances can be written and passed to address issues about housing, safety, public services, employment, the City budget and economic development. Many ordinances authorize the City to spend money on contracts and projects that support the mission of the City of Cleveland.

Ordinances are effective 30 days after passage. Emergency ordinances take effect immediately upon the Mayor’s signature or 10 days after passage.

Under the Charter, legislation cannot be passed until it has been read on three separate days, unless this requirement is dispensed with by a two-thirds vote of the Council. This is known as passing legislation “under suspension.” Ordinances may be passed under suspension after either the first or second reading. If not passed under suspension after the first reading, the legislation is then sent to the appropriate City departments for review.

After departmental review, the ordinance is returned to Council for consideration in a public hearing before the appropriate Council Committee(s). Council Members and City departments can recommend changes, or amendments, to the legislation during the hearing process. After the review is complete and any amendments have been made, the legislation is read a second time at a Council meeting. A second reading allows Council Members and the public to hear what changes have been made to the law. Amendments cannot be made after the second reading of the legislation.

BE IT FURTHER RESOLVED that the Director of Finance is authorized to enter into contract with Art of Social Impact Consulting based on its proposal dated August 5, 2020, which contract shall be prepared by the Director of Law, shall provide for the furnishing of the professional services described in the proposal, for a fee of $30,000 for each of the initial one-year term and the optional renewal year, and shall contain such additional provisions as the Director of Law deems necessary to protect and benefit the public interest.

The prevailing salary for this position as established by Ordinance of the Council of the City of Cleveland is $20,800.00 – $79,225.56 per year.

Type

Experience Evaluation: This test will comprise 40% of the applicant’s final grade and will be based on the information and documentation included in the applicant’s application.

Oral Test: This test will comprise 60% of the applicant’s final grade. Applicants will be notified of the time, date and place of the examination via email.

Duties

Under general direction of the Safety Fire Chief/Assistant Chief, directs and coordinates all fire suppression, rescue and medical response actions on his/her watch. Ensures that all other required duties and training are accomplished as required at Cleveland Hopkins and Burke Lakefront Airports. TYPICAL TASKS: 1. Coordinates the daily shift operations with shift supervisors which entails vehicle assignments, alarm room watches and station work details. 2. Prepares fire inspections of fire extinguishers, aircraft refuelers, fuel farms and building pre-fire planning. 3. Coordinates all written reports of the shift. Maintains payroll records, sick time, holiday requests and vehicle inspection reports. 4. Assumes command of all aircraft incidents, fire calls and EMS runs. 5. Oversees training in fire and EMS related topics. 6. Responsible for the operations, discipline and enforcement of regulations, and work of such forces. Performs other job-related duties as required. Follows all operations and safety policies and safe work practices. Attends and participates in operations and safety training classes and demonstrates competence. (Demonstration of competence may be determined by exam.) Wears and properly utilizes safety equipment in accordance with Divisional policy at all times.

Minimum Qualifications

A high school diploma or GED is required. An associate degree in Fire Science, Applied Fire Technology, or related field is required; a bachelor's degree is preferred. Five years of full-time paid experience in the management and administration of fire prevention and protection at an airport facility is required. (Substitution: One year of experience may substitute for each year of education lacking.) Must be able to lift and carry a minimum of 150 pounds. Must be able to pass ten (10) year FAA background check.

Must possess a 200-hour Firefighters Certificate as issued by the State of Ohio. A valid State of Ohio Driver's License is required. Must possess a State of Ohio EMT Paramedic Certificate within two years of appointment. Must currently have legal status as an Airport Safety Supervisor with the City of Cleveland.

Residency Credit

In accordance with the Charter of the City of Cleveland: A person who has had as his/her legal residence in the City of Cleveland for at least one year at the time of filing a Civil Service application, and desires to take an entry-level Civil Service examination, shall, if a passing grade on the written examination is attained, have ten (10) points added to his/her passing score.

Proof of active service or a DD Form 214 must be presented to the Commission at the time of filing application for the examination in which credit is sought in order to qualify for veterans' credit. If the applicant has received an honorable discharge or a general discharge under honorable conditions that applicant shall receive an additional five (5) points added to their raw score on the examination.

Residency Credit

In accordance with the Charter of the City of Cleveland: A person who has had as his/her primary residence in the City of Cleveland for at least one year at the time of filing a Civil Service application, and desires to take an entry-level Civil Service examination, shall, if a passing grade on the written examination is attained, have ten (10) points added to his/her passing score.

In order to receive residency credit, applicants must present the originals OR LEGIBLE COPIES of three different proofs of residency from ONE YEAR AGO* and three different proofs of residency that are CURRENT** (A total of SIX documents) for verification at the time of filing. (“Different” means that an applicant can provide (for example) a bank statement from a year ago, and a current statement for the same bank account, but cannot provide multiple statements from the same account for different months to satisfy the three proofs requirement.

• Driver’s License • Bank Statements • Utility Bills • Mortgage or Lease Agreement • Bills from creditors not listed above
