Any person aggrieved by an order of Court. the Central Government under section 18 of this Act, may, within a period of sixty days from the date of communication or receipt of the order, file an appeal to the High Court on any question of fact or law arising out of such orders, and upon such appeal the High Court may, after hearing the parties, pass such orders thereon as it thinks proper:
Provided that the High Court may, if it is satisfied that the appellant was prevented by sufficient cause from filing an appeal within the said period, allow it to be filed within a further period not exceeding sixty days.
Explanation.-In this section, "High Court" means the High Court of a State or Union territory in which the property referred to in section 18 is situated.".

SITUATION DUE TO ABOLITION OF SCHEDULED CASTE SUB-PLAN AND TRIBAL SUB-PLAN AND NON-ALLOCATION OF BUDGET IN PROPORTION TO POPULATION
ी पी.एल. पुिनया (उ र देश): महोदय, आज़ादी के समय म अनुसूिचत
जाित/जनजाित के लगभग 95 फीसदी लोग िबलो पॉवटीर् लाइन थे। इसको दूर करने
के िलए अनेक योजनाएँ बनीं। बाबा साहेब डॉ. भीमराव अ बेडकर ने 26 नव बर, 1949
को, जब संिवधान सभा की आिखरी बैठक हो रही थी, उसम कहा था िक हमारे िलए,
आगे आने वाली सरकार के िलए सामािजक और आिर्थक गैर-बराबरी एक िवशेष
चुनौती होगी और इसको जब तक ज दी से ज दी खत्म नहीं िकया जाता, गैर-बराबरी
खत्म नहीं होती, अन्यथा इससे पीिड़त लोग इस संवैधािनक यव था को ध्व त कर
द गे। 1980 म इंिदरा जी ने शै ू ड का ट्स सब- लान एवं टर्ाइबल सब- लान की
योजना शुरू की थी। उसके िहसाब से एससी-एसटी की िजतनी आबादी है, उसके
अनुपात म बजट एलोके ट िकया जाएगा और उसके माध्यम से उनको डायरेक्ट लाभ
पहुँचाने वाली योजनाओं की फं िंडग होगी। लेिकन बड़े अफसोस की बात है िक अभी
2017-18 के बजट म , इस के न्दर्ीय बजट म , एससी सब- लान, टर्ाइबल सब- लान का

कांसे ट खत्म कर िदया गया है और यह कहा गया िक हमने 52,393 करोड़ रुपये
आवंिटत िकये ह । लेिकन 2014-15 म यह 50,000 था, िजसको घटाकर 30,000 कर
िदया। उससे आगे यह 38,000 हुआ और उसको ये कहते ह िक हमने इतना बढ़ा िदया।
यह तो उसके लगभग बराबर है। जो ू है, यानी शै ू ड का ट्स का बजट 16.6
परस ट होना चािहए और शै ू ड टर्ाइब का 8.6 परस ट होना चािहए, उसके िहसाब से
पूरा गैप है और के वल 2.50 परस ट बजट इसम आविटतं िकया गया है, जो बहुत ही
शमर्नाक बात है। म जानना चाहूँगा िक शै ू ड का ट्स सब- लान का जो बकाया है,

CONCERN OVER MANNER OF FORMATION OF GOVERNMENTS IN GOA AND MANIPUR DISRESPECTING PEOPLE’S MANDATE

Sir, elections are held in a parliamentary democracy and the people give
their mandate. And, after the results are declared, the mandate is accepted
and respected by all. In the recent Assembly elections, the voters have

big victory in the State of Uttar Pradesh. We are equally proud and happy
that in the sensitive border State of Punjab, the voters have given a massive
mandate to the Indian National Congress to form the Government. Sir,
again, in a sensitive border State of Manipur, which has seen turbulence and
insurgency in the past, the Indian National Congress has emerged as the
single largest party with 28 MLAs and with assured support, the incumbent
Chief Minister was in a position to form the Government. In the State of
Goa, where the Ruling Party was in office, the Indian National Congress
emerged as the single largest party. Now, there is an established position
under law and under Constitution;-- I know, my friends on the other side will
not agree,--and the fact is that there are two Judgements of the
Constitution Bench of the Supreme Court. A nine-Judge Bench and a five-

student, a dalit student, studying in JNU. How could he take such extreme
step of losing his life, Sir? What is happening in our country? What is
happening in the Central universities in India? Why is there discrimination

I appeal to the Government to take note of this mysterious death. Go for a thorough probe, investigation and find out what led the dalit scholar to take such a step? We will have to look at long-term issues like the dalits’ admission policy which is discriminatory, which is preventing the entry of dalit students, tribal students, OBC students and minority students. After Rohit Vemula,
Sir, all these incidents are happening in our country. When Rohit Vemula died, the whole country rose in protest. There was a demand for a legislation against discrimination. It was considered to be an institutional murder. What about this, Sir? Who knows what were the circumstances! Why such things should happen? I am not pleading only for the dalit students. Even if any student commits such a suicide, or dies in such a way, it saddens us. They are the future of our country. They are students. Why should they take such extreme steps? Are we not concerned? Is this Parliament not concerned? Is this democracy not concerned? I am asking you; I am asking the

It is because one of his friends said that he cannot get into college because
his English was not good. He sat in the library for one year, worked hard
and made sure that he got into the institution. Why would a student with
this kind of determination, who struggled all through his life to become a
scholar, end up like this? There is another student, Umar Khalid, the Bhagat
Singh Ambedkar Students’ Association activist, who has said, and I would
like to quote him, “Our universities are being turned into graveyards for the
oppressed.” Is this the state of affairs which we want to continue in this
country?

father of the boy, and I have met with the guardian of the boy.

SHRIMATI NIRMALA SITHARAMAN (CONTD.): I had also spoken to all student leaders present there. Hon. Member, Shri Tiruchi Siva, was also there. Other hon. Members from other parties were also there. It is true that, within 48 hours, the FIR which was to be filed had not been filed. But, now, after we all sat there and heard everybody's voice -- father, guardian, student leaders and friends of the boy -- very clearly directed the police, as per instructions from the hon. Home Minister, that by 12 o' clock the FIR should be filed and a copy should be given to father, guardian and to any number of students who would want a copy of it.
Sir, I would just take one minute to explain that students and also well- wishers asked us as to why the Scheduled Caste and Scheduled Tribes
(Prevention of Atrocities) Act could not be invoked in the FIR which is yet to be filed. The FIR will be filed, hopefully, by 12 o' clock. Police had given an answer. But, however, invoking that amended Act, it is possible for police not to wait for a complaint specifically to state as to who has been abusing him. It is possible to state that, yes, there was an atrocity committed and that is what has been suggested to police. This is one thing.

Secondly, Sir, questions have been raised as to why abetment to suicide has not been touched. The FIR has not yet been filed; everything is discussed and there is a lot of communication gap about which I take this opportunity to explain. Sir, why has abetment to suicide not been invoked?
Why has police still not filed an FIR? We did ask, in front of everybody, police as to why they would not want to consider that clause? Police said that unless a doubtful expression is stated somewhere in the complaint they may not, as per rules, be able to put that section of IPC into it. But, we have asked, in a general fashion, to put it without naming anybody, because, after all, it was seen by many. We do not know. The inquiry will have to establish whether it was a suicide, where it had happened, what is the provocation and everything else. Subject to inquiry, we have asked police to make sure that these two sections are invoked and FIR is filed.
Many hon. Members have spoken about many larger issues. Sir, a
mention has also been made about Thorat Committee. It is not a
Committee which we have appointed. It has been there for some time.
Recommendations of Thorat Committee and recommendations of other
related Committees have not been considered and taken up for improving

Minister, told students that statements prepared by Professors, teachers or well-wishers or relatives or student-friends be given to police -- many of them consider that it is not specific to this incident, but it has a bearing on the well-being of students particularly from the disposed class -- and suggested police to receive and register them as statements relating to this complaint. That is also happening. Therefore, what I want to assure all hon.
Members here is: I have discussed and reported back to the hon. Home
Minster after visiting AIIMS this morning. I spent about one-and-a-half hours with all of them. I have given a detailed Report to the hon. Minister and he has clearly told me to assure the House that everything which is being put into the police complaint in terms of larger and incident-based statements will all be given a serious consideration.
We are interested in making universities a better place for students, particularly who come from difficult and socially deprived sections, so that universities become a better place for them to study and be comfortable with.

Recently, in a public meeting, a leader of the saffron brigade offered a bounty of rupees one crore for killing Shri Pinarayi Vijayan, the Chief Minister of Kerala. ...(Interruptions)... He also threatened to kill CPM activists of
Kerala and also throughout the country, as it had happened during the
Gujarat genocide. I don’t think that it is an isolated incident. Three months back, the Chief Minister of Kerala was supposed to address a public rally in
Bhopal, organized by some Malayalee organizations. On the protest of the saffron brigade, the Government had advised that the Chief Minister should not attend that programme, by violating the federal principle and the democratic ethos enshrined in our Constitution. Last to last week, the Chief
Minister was supposed to attend a programme at Mangalore. The saffron brigade had called for a hartal. But the people had rejected that call and the programme was very successful. ...(Interruptions)...

Ministers, आठ के आठ लोग हार गए। मेरे ख्याल म गोवा के साइज़ के िहसाब से वहां
इतनी ही कै िबनेट होनी चािहए। गवनर्म ट के िखलाफ इससे ज्यादा म डेट और क्या हो
सकता है? जनता का गु सा और क्या हो सकता है?
मिणपुर म के न्दर्ीय सरकार की तरफ से कांगर्ेस की सरकार को destabilize
करने के िलए पूरे साल कोिशश की जा रही थी। Government of India ने कांगर्ेस की
गवनर्म ट को destabilize करने के िलए हर तरीका इ तेमाल िकया था, इसके बावजूद
भी कांगर्ेस single largest party के रूप म emerge हुई और बीजेपी उससे बहुत नीचे
थी।
माननीय िड टी चेयरमैन साहब, म आपके ध्यान म दो चीज़ लाना चाहता हूं।
िजन दो टेट्स, यूपी और उ राखंड म बीजेपी को massive majority िमली है, अभी
तक वहां चीफ िमिन टर बनाने का उन्ह ने कोई stake claim नहीं िकया है, जबिक
वहां तो यह काम ज दी ही हो जाना चािहए था। वहां तो वे उसी िदन, यानी 11 तारीख़
को ही सरकार बना सकते थे, उनसे कोई न पूछता। लेिकन आज 15 तारीख़ हो गई है
और िपछले एक ह ते से बीजेपी उ राखंड और यूपी म गवनर्म ट बनाने म असफल रही
है। क्या वजह थी िक जहां इनको मेजॉिरटी नहीं िमली, जहां कांगर्ेस को मेजॉिरटी
िमली है, वहां तो उन्ह ने पहले ही िदन से जैसे-तैसे जोड़-तोड़ शुरू कर दी और सु ीम
कोटर् की जो Constitution Bench थी, िजसम से एक ब च म 9 जजेज़ थे और दूसरी
ब च म पांच जजेज़ थे, उनकी उस जजम ट की धिज्जयां उड़ा दीं।

म 2002 की अपनी बात बताता हूं। उस समय ज मू-क मीर म रूिंलग पाटीर्
National Conference थी और उनके 28 लोग जीते थे, जबिक हमारे 20 लोग जीते थे।
जब गवनर्र से हमने कहा िक हम ओथ िदलवाइए, तो उन्ह ने कहा िक नहीं, सबसे
पहले म एनसी को बुलाऊं गा। म ने उनसे कहा िक एनसी ने कहा है िक हम सरकार नहीं
बनाएंगे, तो उन्ह ने जवाब िदया िक वे कह या न कह , तब भी मुझे पहले उनको ही
बुलाना होगा, बाद म चाहे वे हार जाएं या जीत जाएं। इस सबकी वजह से हमारा पूरा
िस टम जोड़ने म लग गया और 2002 की जगह हमारी सरकार 2005 म बनी। इस एक
वजह से पूरे अढ़ाई साल तक हम चीफ िमिन टर नहीं बन सके , क्य िक गवनर्र ने कहा
था िक जो single largest party है, पहले म उसको ओथ िदलवाऊं गा।
सर, यहां पर सु ीम कोटर् की जजम ट की धिज्जयां उड़ाई जा रही ह , िहन्दु तान
के Constitution की धिज्जयां उड़ाई जा रही ह और गवनर्सर् को इ तेमाल िकया जा
रहा है। हम इसका पूरी तरह से िवरोध करते ह । सरकार को status quo maintain

جلد ہی ہو جانا چاہئے تھا۔ وہاں تو وه اسی دن، يعنی 11 تاريخ کو ہی سرکار بنا سکتے
تھے، ان سے کوئی نہ پوچھتا۔ ليکن آج 15 تاريخ ہو گئی ہے اور پچھلے ايک ہفتے سے
بی۔جے۔پی۔ اتراکھنڈ اور يو۔پی۔ ميں گوورنمينٹ بنانے ميں ناکام رہی ہے۔ کيا وجہ تھی کہ جہاں ان کو ميجورٹی نہيں ملی، جہاں کانگريس کو ميجورٹی ملی ہے، وہاں تو انہوں نے پہلے ہی دن سے جيسے-تيسے جوڑ توڑ شروع کر دی اور سپريم کورٹ کی جو کانسٹی
ٹيوشن بينچ تھی، جس ميں سے ايک بينچ ميں نو ججز تھے اور دوسری بينچ ميں پانچ ججز تھے، ان کی اس ججمينٹ کی ّدھج ياں اڑا ديں۔ ميں 2002 کی اپنی بات بتاتا ہوں، اس وقت جموں و کشمير ميں رولنگ پارٹی نيشنل
کانفرنس تھی اور ان کے 28 لوگ جيتے تھے، جبکہ ہمارے 20 لوگ جيتے تھے۔ جب
گورنر نے ہم سے کہا کہ ہميں اوتھہ دلوائيے، تو انہوں نے کہا کہ نہيں، سب سے پہلے ميں اين۔سی۔ کو بالؤنگا۔ ميں نے ان سے کہا کہ اين۔سی۔ نے کہا ہے کہ ہم سرکار نہيں بنائيں گے، تو انہوں نے جواب ديا کہ وه کہيں يا نہ کہيں، تب بھی مجھے پہلے ان کو ہی بالنا ہوگا، بعد ميں چاہے وه ہار جائيں يا جيت جائيں۔ اس سب کی وجہ سے ہمارا پورا سسٹم جوڑنے ميں لگ گيا اور 2002 کی جگہ ہماری سرکار 2005 ميں بنی۔ اس ايک وجہ
سے پورے ڈھائی سال تک ہم چيف منسٹر نہيں بن سکے، کيوں کہ گورنر نے کہا تھا کہ جو سنگل الرجيسٹ پارٹی ہے، پہلے ميں اس کو حلف دالؤنگا۔

announced Regional Connectivity Scheme (RCS-UDAN) to develop or
upgrade 50 under-served or unserved airports and airstrips to boost the

Aviation Ministry's regional flying scheme Udan. The objective of the scheme was "Ude Desh Ka Aam Naagrik". The scheme ensures
affordability, connectivity, growth and development. It would provide a win-
win situation for all stakeholders. Citizens would get the benefit of
affordability, connectivity and more jobs. The Centre would be able to
expand the regional air connectivity and the markets. The State
Governments would reap the benefit of development of remote areas,
enhanced trade and commerce and more tourism expansion. For
incumbent airlines, there was the promise of new routes and more
passengers and for start-up airlines, there is the opportunity of new and
scalable business. Airport operators will see their business expanding and
so would original equipment manufacturers.
The Maharashtra Government had suggested some small important
stations like Shirdi, Amravati, Gondia, Nasik, Jalgaon, Nanded, Solapur,
Kolhapur, Ratnagiri and Sindhudurg, as these places are important for the
cultural, religious and tourism point of view, where hundreds of Indian and
overseas tourists used to visit. It will further boost the economic
development in these areas as well as the surrounding areas in terms of job

ी नारायण लाल पंचािरया (राज थान) : महोदय, म सदन के माध्यम से क दर् सरकार
का ध्यान जयपुर एयरपोटर् से स बिन्धत एक महत्वपूणर् िवषय की ओर आकृ ट करना
चाहता हूं। वतर्मान म , जयपुर एयरपोटर् पर सभी वीवीआईपी (VVIP) उड़ान एवं
सामान्य यातर्ी उड़ान टिर्मनल -2 से संचािलत की जाती ह । इन दोन कार की उड़ान
के िलए एयरपोटर् पर अलग-अलग यव था नहीं है। इस कारण कई बार सामान्य
याितर्य को असुिवधा का सामना करना पड़ता है। VIP उड़ान के कारण सामान्य

उड़ान को उतरने के िलए अक़सर तीक्षा करनी पड़ती है। इसी कार, कई बार
सामान्य यातर्ी उड़ान के टेक-ऑफ म भी VIP उड़ान के कारण िवल ब हो जाता है।
इसके अितिरक्त, िविश ट यिक्तय की सुरक्षा यव था के कारण सामान्य याितर्य को
असुिवधा का सामना करना पड़ता है।
सामान्य नागिरक को होने वाली असुिवधा को ध्यान म रखते हुए म माननीय
नागिरक उ यन मंतर्ी जी से यह अनुरोध करना चाहूंगा िक जयपुर हवाई अ े पर VIP
टिर्मनल का िनमार्ण करवाया जाए िजससे सभी यातर्ी सुिवधापूवर्क हवाई यातर्ा कर
सक । इस उ े य के िलए एयरपोटर् के समीप भूिम भी उपल ध है और एयरपोटर्
अथॉिरटी की इस भूिम को िकसी अन्य उ े य के िलए योग करने की कोई योजना
नहीं है। इसिलए इस भूिम का योग VIP टिर्मनल के िनमार्ण के िलए िकया जा सकता
है। इस संबंध म राज थान सरकार ारा एयरपोटर् अथॉिरटी से कई बार अनुरोध िकया
गया है। इसिलए म माननीय मंतर्ी जी से अनुरोध करता हूं िक इस संबंध म उिचत

DEMAND FOR TAKING STEPS TO OBTAIN ASSENT OF PRESIDENT ON TWO BILLS OF TAMIL NADU LEGISLATIVE ASSEMBLY REGARDING ADMISSION POLICY IN MEDICAL AND DENTAL COLLEGES IN STATE
SHRIMATI VIJILA SATHYANANTH (TAMIL NADU): Our revered leader,
Puratchi Thalaivi AMMA, had repeatedly emphasized that the introduction of
NEET is a direct infringement on the rights of the State and would cause
grave injustice to the students of Tamil Nadu, who have already been
covered by a fair and transparent admission policy laid down by the
Government of Tamil Nadu, which has been working very well.
The students from poor and weaker sections will be unable to
compete with urban elite students in NEET. The rural students will be put to
great disadvantage because they lack the resources to enroll in training
institutions and access materials available to urban students.
The Tamil Nadu Legislative Assembly has recently passed two Bills for
protecting the existing admission policy for UG and PG admissions in
Medical and Dental colleges. The two Bills have been sent to the

Government of India for obtaining the assent of the President of India under
Article 254(2) of the Constitution of India.
I urge the Government that the approval for the above said two Bills may be accorded immediately and the Presidential assent accorded to enable the Tamil Nadu State to continue its existing system of admission to
Government Medical and Dental colleges in Tamil Nadu.
