The appellant Thiru D.Alfred Selvaraj is absent. The Public Authority is represented by Thiru. C.Sathiyamoorthy, Headquarters Deputy Tahsildar, Thiruporur Taluk Office, Thiruporur, Kancheepuram District. 2. In the R.T.I. Petition dated 1 9.05.2012 filed under Section 6(1) of the Right to Information Act, 2005, the appellant has sought for a copy of true extract of Patta No.269 corresponding to Survey No.67/8C/1D/16, Punjai measuring 6.66 Acres in Krishnankaranai Village, Th iruporur Taluk. In as much as the information sought for by the appellant had not been forthcoming, he preferred First Appeal under Section 19(1) of the RTI Act, 2005 on 02.07.2012. Since the Appellate Authority has also not provided any information, the appellant preferred Second Appeal under Section 19(3) of the RTI Act, 2005 before this Commission on 07.09.2012. The Commission by its order dated 28.12.2012 directed the Public Information Officer to supply the information to the petitioner and report to the Commission by 07.02.2013. However, no reply has been furnished to the appellant and aggrieved by the inaction of the Public Authroity, the appellant has come forward to file a Complaint Petition before this Commission and the said petition has been taken up for today's enquiry. 4. In the course of enquiry today, the Public Information Officer who is the Headquarters Deputy Tahsildar submits that the information sought for by the appellant has been furnished to him by letter dated 11.11.2013. A perusal of the reply would show that the required information has been furnished to the appellant for all the items. The appellant has not chosen to be present for today's enquiry and put forth his case and as such the inference should be that he is satisfied with the information. 5. As per Rule-7 of the Information Commission (Appeal Procedures) Rules, 2012, the appellant shall be present in person at the time of hearing of the appeal and if the appellant for any reason is prevented from attending the hearing, should inform the Commission, the reasons for not attending the hearing in writing in advance before the hearing is taken up. In this case, the Appellant has not complied with the requirements of the said Rule. For this reason alone, the appeal is liable to be dismissed. However, as the PIO has produced a copy of the true extract of Patta No.269 corresponding to the Survey No.67/8C/1D/16, Punjai measuring 6.66 Acres in Krishnankaranai Village, Thiruporur Taluk which had already been sent to the appellant by way of information, nothing more that remains to be considered in this appeal, this appeal is closed.
