The Public Information Officer/ Headquarters Deputy Tahsildar, O/o.Tahsildar, Thiruporur Taluk,Kancheepuram District. ---- ORDER The appellant Thiru.D.Ravi is present for today’s (20.05.2015) enquiry. The Public Authority is represented by Thiru.Pari, Public Information Officer/ Additional Personal Assistant to Collector (Lands), Kancheepuram District, Thiru.S.Adisheshan, Public Information Officer/P.A. to Revenue Divisional Officer, Chengalpattu, and Thiru.V.Saravanan, Public Information Officer/Headquarters Deputy Tahsildar, Thiruporur Taluk, Kancheepuram District. 2. This Commission by its order dated 22.09.2014 required the District Collector, Kancheepuram to conduct an enquiry in as much as the appellant alleges that there has been land grabbing by certain individuals and he is also one of the victims. The District Collector, Kancheepuram was required to submit his report within two months from the date of receipt of the order. 3. During the enquiry held on 13.01.2015, the Public Information Officer/ Additional Personal Assistant to Collector (Lands), Kancheepuram District stated that the matter was taken up with the District Collector only yesterday, i.e., 12.01.2015 and the enquiry would be conducted as early as possible and report filed before this Commission. He also stated that the delay has occurred initially in the office of the Personal Assistant (General) to the District Collector and thereafter in the office of the Additional Personal Assistant (Lands) to the District Collector. The District Collector, Kancheepuram District has been requested to initiate action against those who are responsible for the delay. 4. During the enquiry held on 19.02.2015, the following orders are passed : “4. The Public Information Officer/ Additional Personal Assistant to Collector (Lands), Kancheepuram District during today’s (19.02.2015) enquiry states that the District Collector has called for an enquiry on 13.02.2015 and the appellant has not turned up for the enquiry. The appellant states that Thiru.Babu, formerly Addl.P.A. to District Collector(Lands), Kancheepuram orally laid certain pre-conditions before attending the enquiry and hence he did not turn up for the enquiry. The appellant states that in the NIC website, the fraudulently issued pattas viz., Patta No.1726 of Mrs.Poongavanam & Patta No.1106 of Mr.Beeda Masthan Rao, still exists and he has downloaded a copy from NIC website on 16.01.2015. He alleges that the Public Information Officers have given false facts before the Commission that the records are set right in the website. The Commission expresses its displeasure should any false statement be given by the Public Information Officers and directs them to update the website immediately and file a report within 15 days from the date of receipt of this order. 5. The Commission places its appreciation on record for the steps taken by the District Collector for conducting an enquiry and for initiating steps to take disciplinary action against the erring officials, who have issued fraudulent pattas, pursuant to the directions of the Commission. The Commission opines that the appellant would do well to present himself before the District Collector during enquiry to air his grievances, which would be the right course of action. 6. The District Collector, Kancheepuram is requested to give one more opportunity to the appellant to appear for enquiry. The appellant shall present himself during the enquiry. The District Collector, Kancheepuram shall conduct the enquiry as early as possible and file the report to this Commission.” 5. As per the orders passed by this Commission on 19/02/2015, the petitioner presented himself before the District Collector on 31/03/2015 and the District Collector has passed an order stating that the original assignment has been cancelled way back in the year 1963. The information which has emanated from the District Collector would certainly have far-reaching consequences. The Public Information Officer states in the enquiry two pattas have been cancelled on the basis that they have been granted by mistake in respect of Government Poramboke land and those mistakes have now been rectified. The petitioner would certainly be entitled to copies of orders of cancellation of the two pattas. The Petitioner would be at liberty to approach the appropriate forum for relief in a manner known to law. The petitioner has expressed his satisfaction as to the extent of information furnished to him. 6. Nothing more that remains to be considered in these appeals. The appeals are closed.
