DDE/181/14 Confirmation and Adoption of Minutes Minutes of Meeting of Dundrum Area Committee (EHC) held on 7th May 2014 were CONFIRMED and ADOPTED.

DDE/182/14 Proposed Disposal of Freehold Interest in Three Plots of Council owned Land in Ballyogan, to Horse Racing Ireland and Leopardstown Race Course, Leopardstown, Co.

The County Development Plan 2010-2016 has a specific local object (No. 87) to provide a car park to link in with Foxrock Village on lands owned by Horse Racing Ireland.

In order to achieve this specific local objective the Council commenced discussions with Horse Racing Ireland in relation to the acquisition of a site on which a car park could be constructed. The proposed car park site is located on lands at Foxrock Village and measures circa 4,345.81 square metres as shown outlined in red on Drawing No. PL-14-196. In the course of discussions, Horse Racing Ireland indicated that they would be willing to transfer the proposed site for a car park to the Council, in exchange for the Council disposing of three plots of land at Ballyogan, Co. Dublin to Horse Racing Ireland. Two of these plots, as shown outlined in red on Drawing Nos. PL-14-197 and PL-14-198, form part of residue lands left over after the completion of the South Eastern Motorway Scheme and are no longer required by the Council. The third plot of land as shown outlined in red on Drawing No. PL-14- 199 is part of larger parcel of land acquired from the Holy Ghost Fathers for Housing.

Protracted negotiations took place between the Council’s Valuer and a Valuer appointed by Horse Racing Ireland but agreement was not reached as there was a significant difference in the balancing payment which each of the respective valuers considered were due to their client.

To progress the matter Council Management met with Horse Racing Ireland and in the interest of the future economy of Foxrock Village, the ongoing deficiencies in relation to car parking in the area and the specific local objective (No. 87) in the County Development Plan 2010-2016, it was agreed in principle that the Council would dispose of the 3 plots of land at Ballyogan, Co. Dublin.

The 3 plots of land are shown as outlined in red on Drawing No. PL-14-199 measuring 4,006.32 sq. metres, Drawing No. PL-14-198 measuring 861.80 sq. metres and Drawing No. PL-14-197 measuring 1,580 sq. metres to Horse Racing Ireland, in exchange for the acquisition of a plot of land by the Council measuring circa 4,345.81 sq. metres as shown outlined in red on Drawing No PL-14-196 from Horse Racing Ireland.

This proposal is subject to the approval of the Board of Horse Racing Ireland and the Elected Members of the Council.

There are services located on two of the plots of the land being disposed of by the Council. In this regard the Council will require wayleaves to be retained as shown highlighted in yellow on Drawing Nos. PL-14-199 and PL-14-197 in order to be able to access services.

The other relevant Council Service Departments have no objection to the proposed exchange of lands.

Having regard to the decision taken the Chief Valuer has agreed the following terms and conditions:

a. That the exchange of lands outlined at paragraph b and c below is on the basis that no compensation is payable by either party.

b. That Dún Laoghaire-Rathdown County Council shall dispose of its interest in the 3 plots of land as shown outlined in red on attached drawings; Drawing Nos. PL-14-197, PL- 14-198 and PL-14-199, subject to the retention of wayleaves highlighted in yellow on Drawing Nos. PL-14-197 and PL-14-199 to access services.

c. That Dún Laoghaire-Rathdown County Council shall acquire the Freehold Interest or equivalent in the plot of land shown outlined in red on the attached Drawing No. PL- 14-196.

d. That Horse Racing Ireland shall retain access to its property, via a right of way over a public roadway to be provided for on part of the lands to be acquired at Foxrock Village (shown coloured yellow) on attached Drawing No. PL-14-196. Note: The Council will not consider granting a right of way through the car park as part of this transaction. e That each party shall be responsible for its own costs in this matter.

f. That all outstanding charges, rates and taxes and all other outgoings on the properties are cleared prior to completion of the transaction.

g. That no agreement enforceable by law is created or intended to be created until exchange of contracts has taken place.

It is proposed to dispose of the Council’s Interest in the 3 plots of land as shown outlined in red on Drawing Nos. PL-14-197, PL-14-198 and PL-14-199 to Horse Racing Ireland subject to the retention of Wayleaves as set out above.

If the Committee has no objection in principle to this proposed disposal, a report will then be submitted to a future meeting of the County Council subject to the provision of Section 211 of the Planning and Development Act 2000 and in accordance with the requirements of Section 183 of The Local Government Act 2001.

DDE/185/14 SOCIAL HOUSING UNITS AT THE GRANGE Councillor R. Humphreys “To ask the Chief Executive what steps can be taken to seek funding to acquire social housing units at The Grange, Dublin 18?”

“The Council’s housing construction and acquisition programme is funded and approved by the Department of Environment, Community and Local Government. The current approved construction programme for 2015/2015 does not include any provision for the acquisition of social housing units at The Grange.”

DDE/186/14 SPENDING ON HALTING SITES IN STILLORGAN WARD

Councillor J. Madigan “To ask the Chief Executive what was the spend on halting sites in the Stillorgan ward in the last three years and how many families have been housed on these sites?”

“The Dún Laoghaire-Rathdown Traveller Accommodation Programme 2014-2018 shows both the existing and proposed sites for Traveller specific accommodation (both halting site & grouped housing) in the DLR administrative area. Currently there are three proposed sites in the Stillorgan Ward –Bird Avenue, UCD & Mount Anville Road. However, there are no existing halting sites or grouped housing schemes in that Ward area and therefore no spend.”

DDE/189/14 DLR LEISURE SERVICES AND TOTAL FITNESS FACILITY Councillor C. Curran “To ask the Chief Executive to use whatever means at her disposal to request DLR Leisure Services to investigate the viability of the Total Fitness facility in Sandyford, to be operated under the control DLR leisure Services and to provide a report on their finding by the end of the year?”

“The Chief Executive Officer of DLR Leisure Services will be written to and asked to investigate the feasibility of adding Total Fitness Sandyford to their current operations.

A copy of this letter will be issued to the Councillor.”

DDE/190/14 REVENUE FROM CONCERTS Councillor C. Curran “To ask the Chief Executive to provide a breakdown of all revenue generated or expected to be generated from the Marlay Park concerts of this year. Furthermore, could she also provide details of how these funds are expected to be spent, both from a capital, repair & operational perspective and to signify how much of the gross revenue will be re-allocated to Marlay Park and its environs?”

DDE/191/14 ALLOTMENTS IN BALLYOGAN ESTATE Councillor C. Curran “To ask the Chief Executive, what attempts have been made to install allotments for use by residents in Ballyogan Estate?”

“The Parks Department and Community Department had extensive discussions with residents and community groups in Ballyogan regarding a possible community garden (community allotments) in an area at the rear of dwellings at Ballyogan Lawn/Ballyogan Crescent (beside the noise wall abutting the M50 motorway).

However, in the final analysis there was little support for the proposal as it was feared anti- social activity might be a problem and the matter was not pursued.” DDE/192/14 TRIMMING OF BUSHES AND TREES Councillor C. Curran “To ask the Chief Executive if the bushes and trees could be trimmed in the laneway running from Glencairn, via Orby, to Levmoss as the trees are beginning to cover the street lights?”

“This request has been passed on to the Public Lighting Section who will arrange for the trees and vegetation to be trimmed back in due course.”

DDE/194/14 UPDATE ON RESURFACING ON BIRD AVENUE Councillor P. Hand “To ask the Chief Executive for an update on the resurfacing on Bird Avenue and the construction of the new granite wall at the Marist Fathers (C.U.S)?”

“Road reconstruction of Bird Avenue has been deferred due to pending watermains rehabilitation works by Irish Water. It is hoped to include it in the 2015 Programme subject to completion of the works to the watermains.”

DDE/195/14 REPAIR OF FOOTPATH OPPOSITE GRANGE WOOD Councillor P. Hand “To ask the Chief Executive to repair the footpath opposite Grange Wood?”

“Following clarification of the issue being raised and a subsequent inspection of the area, it appears that the location where repairs are required is in the cycle track adjacent to the entrance to the Estate.

It was noted on the inspection of the location that there was evidence that one of the Statutory Utility Companies had carried out works there and that the subsequent reinstatement had failed.

The Roads Control Unit who issue and enforce licences for any works carried by the Utility Companies is pursuing the matter with the relevant Company.”

DDE/197/14 REMOVAL OF TREE AT TANEY AVENUE Councillor P. Hand “To ask the Chief Executive to have the tree removed at (address supplied) as it is dangerous?” “This tree has been inspected. It is part of the perimeter planting in the open space and is healthy growing specimen. No action is required at this time on the tree.”

DDE/198/14 TRIMMING OF LARGE TREE AT BROADFORD CLOSE Councillor P. Hand “To ask the Chief Executive to have the large tree outside (address supplied) trimmed?”

“This tree has been added to our 2014/2015 Winter pruning tree list.”

DDE/199/14 EXPANSION OF ENCLOSED DOG AREA IN DEERPARK Councillor J. Madigan “To ask the Chief Executive to expand the enclosed dog area in Deerpark to include one of the wooded areas near the existing enclosure?”

“The dog off leash area in Deerpark was meant to be a small area in a relatively small park. To expand it further would involve enclosing more trees and this would not be desirable from a Parks management point of view.”

DDE/200/14 RESURFACING OF MERVILLE ROAD Councillor J. Madigan “To ask the Chief Executive to resurface all of Merville Road rather than the present patch up being done at present?”

“Merville Road is being considered for inclusion on the 2015 Road Restoration Programme. It is currently being surveyed in order to produce the appropriate contract documentation. No work is underway on this road at present.”

DDE/201/14 WHEELCHAIR AND PUSHCHAIR ACCESS FROM WHITEBEAM ROAD TO CLONSKEAGH LINEAR PARK Councillor J. Madigan “To ask the Chief Executive to provide wheelchair and pushchair access from Whitebeam Road to Clonskeagh Linear Park in circumstances where no such access is presently in existence and when will this be carried out?”

“This question is passed on to Traffic Section, Transportation & Water Services Department for attention.”

DDE/202/14 REMOVAL OF WEEDS AND DEAD TREES AT LAKELANDS Councillor J. Madigan “To ask the Chief Executive to remove, cut or spray the weeds at the back of Lakelands shops and remove and/or replace all dead trees and stumps in the entire Lakelands estate?”

“We intend cutting back the undergrowth under the trees. This will tidy up the area and remove the weeds. This will tidy the area, remove weeds and manage the area to the back walls of houses in a more formal way.”

DDE/203/14 EFFECTIVE WAY TO ADDRESS FOX INCREASE IN DUNDRUM/BALLINTEER Councillor C. Martin “To ask the Chief Executive if she has sought professional advice and assistance from relevant and appropriate bodies to ascertain and address in a safe and effective way the increasing emergence and proliferation of foxes in the Dundrum/Ballinteer area?”

“The National Parks and Wildlife Service is the appropriate body to deal with all wildlife issues including foxes. The Council have no responsibility in this matter.”

DDE/204/14 AGREEMENT IN RELATION TO MARLAY PARK CONCERTS AND EVENTS Councillor C. Martin “To ask the Chief Executive what is the current arrangement/agreement in place between Dún Laoghaire-Rathdown County Council and MCD Productions (and/or all concert organisers) in relation to concerts and events held in Marlay Park including written terms and conditions, the duration of the current agreement, the provision of an ongoing consultation and evaluation process (if any) and the numbers of events/concerts currently permitted each year?”

“The Marlay Park Concerts have recently been reviewed and a comprehensive report on the 2014 Concerts will be presented to the Members at this evening's Dundrum Area Committee Meeting.”

DDE/205/14 UPGRADING OF WASTE GROUND BESIDE LEOPARDSTOWN RISE Councillor L. McCarthy “To ask the Chief Executive to please upgrade the area of waste ground beside Leopardstown Rise (this area played host to an illegal encampment a few years ago)?”

“This is an area of approx. 2,000 sq. metres and there would be considerable difficulty and issues around upgrading it. The surface of the old Leopardstown Road runs through the site and it has been broken up and left in mounds on parts of the site to prevent further unauthorised occupation of the lands. It is considered that considerable resources would be required to upgrade it and there are no such resources available to undertake the work at present.

However, arrangements are being made to have the vegetation at the boundary of site adjoining the footpath and cycle track cut back and a small area inside that boundary also.

The longer term solution to this issue would involve an examination of the future use of the lands and this would need to be the subject of further investigation and reports to this Area Committee.”

DDE/206/14 REPORT ON PROPOSED BMX TRACK AT MARLAY PARK Councillor L. McCarthy “To ask the Chief Executive for a progress report on the Marlay Park proposed BMX track?”

“Plans for a BMX track at Marlay are being drawn up with a view to bringing the proposal to Part 8 stage. Due to shortages of technical staff in the Parks Department, it has not been possible to have this matter progressed earlier.

Unfortunately, this means the original time line proposed for the project will not be adhered to. The body who administer the sportnation grant for this project is being informed of this shortcoming.”

DDE/207/14 STANDARD OF GRASS CUTTING AT ST. PATRICK'S PARK Councillor L. McCarthy “To ask the Chief Executive to please investigate complaints from residents in St. Patrick's Park, Sandyford Hall, Kilgobbin Heights and Leopardstown Rise regarding the standard of grass cutting during the latter part of this season?”

“We are satisfied with the overall maintenance programme of grass cutting with our contractors. However, there was some slippage in the mid part of the season. This was addressed and there is now a second dedicated mower to the west contract which has improved matters. Nonetheless we are continually monitoring the mowing patterns to make sure grass cutting remains as per the contract arrangements.”

DDE/208/14 PRUNING OF TREE AT SANDYFORD DOWNS Councillor N. Richmond “To ask the Chief Executive to prune the tree outside (address supplied)?”

“This tree has been added to our tree pruning list and will be dealt with during the 2014/2015 pruning season.”

DDE/209/14 REMOVAL OF TREE AT BALLINTEER Councillor N. Richmond “To ask the Chief Executive to remove the tree outside the footpath at (address supplied) where the roots are protruding through the footpath?”

“We have examined this tree and will not be removing it in the current season. The tree is a healthy sycamore tree and at present not posing a problem to its surroundings.”

DDE/210/14 ALTER SPORTS CLUBS USAGES OF PITCHES IN MARLAY PARK Councillor N. Richmond “To ask the Chief Executive if there are plans to alter sports clubs usages of pitches in Marlay Park particularly clubs that currently use the pitches for training as well as matches?”

“There are no plans to alter the usage of pitches at Marlay Park. Clubs have licences to play games but training is prohibited on pitches.”

DDE/211/14 PLANTING OF TREES AT COLLEGE PARK WAY Councillor N. Richmond “To ask the Chief Executive to plant trees in front of the fencing at the green space adjacent to College Park Way?”

“In conjunction with local residents, the Parks Department have planted a staggered line of trees at this location on the open space under the control of the Parks Department. This mixed species includes cherry and Spanish chestnut which will grow into specimens that will screen the road margins. Lands outside the open space wall are not under the control of the Parks Department.”

DDE/212/14 ADJUSTING OF SHADES ON M50 MOTORWAY LIGHTS Councillor N. Richmond “To ask the Chief Executive to ask the NRA to adjust the shades on the motorway lights on the M50 adjacent to College Park as the light is causing annoyance to nearby residents?”

“This matter has been referred to M50 Concession Ltd. for their consideration and direct reply.” DDE/213/14 INCREASE HEIGHT OF FENCING AROUND MUGA IN BELARMINE Councillor N. Richmond “To ask the Chief Executive to increase the height of the fencing surrounding the MUGA in Belarmine?”

“The area referred to as Belarmine is still under the ownership of the developer. We will look into the request with them before the area is taken into charge.”

DDE/214/14 FIXING OF PATH AT LAKELANDS CRESCENT Councillor B. Saul "To ask the Chief Executive to fix the path outside (address supplied) as two elderly people in the two houses are affected by this path?"

DDE/216/14 PUTTING REDESDALE ROAD ON THREE YEAR ROAD IMPROVEMENTS SCHEME Councillor B. Saul “To ask the Chief Executive to consider putting Redesdale Road on the Three Year Road Improvements Scheme. From the junction with Glenabbey Road to Trees Road, the surface has nearly worn away due to the heavy traffic usage going to and from Deerpark?"

“The thin layer macadam treatment to Redesdale Road has debonded in places. However, the concrete road under this layer is structurally sound and no works are planned for this location.”

DDE/217/14 REPAIRING OF DAMAGE TO SEWER AT GLENABBEY ROAD Councillor B. Saul "To ask the Chief Executive to repair the damage done by road contractors working for the Council to the sewer outside (address supplied). A request was previously sent and Drainage said they would get the Roads Department to fix it?"

“There is no evidence of work on the sewer to 30 Glenabbey Road. A new matrix box has been installed and the permanent reinstatement has been carried out. The matter will be further investigated to establish the extent of the problem with the sewer and what works may be required to rectify it.”

DDE/218/14 Review of Marlay Concerts 2014 It was Proposed by Cllr. B. Saul and Seconded by Cllr. L. McCarthy and AGREED that the below agenda items be taken together when all other agenda items had been dealt with:

Agenda Item no 41 – Councillor S. Nic Cormaic “That this Area Committee, given the high volume of Marlay Park concerts this year, and the ensuing havoc it creates for residents living around Marlay Park, restrict the number of Marlay Park concerts, for which it grants licences, to 3 per year.” Agenda Item no 43 – Councillor L. McCarthy “That the Chief Executive would please present a report of all complaints associated with this summer’s Marlay Park concerts for information and discussion as soon as possible.”

Agenda Item no 44 – Councillor C. Martin “That the Chief Executive should conduct an assessment and review of the current arrangement of staging concerts/events in Marlay Park including carrying out a thorough consultative process with all stakeholders especially with Residents Associations and residents who reside in close proximity to Marlay Park, indicating a time frame for same, with a view to presenting a report to Members with conclusions and recommendations for the Council to consider.”

DDE/220/14 ERECTING ADDITIONAL OR IMPROVED SIGNAGE IN BALLAWLEY PARK It was PROPOSED by Councillor Richmond and SECONDED by Councillor McCarthy

“That the Chief Executive erects additional or improved signage in Ballawley Park advising patrons that dogs should be kept on a leash and that bikes should not be used as the existing signage is worn and insufficient.”

DDE/221/14 REQUESTING PARKS DEPARTMENT TO INSPECT LINEAR PARK It was PROPOSED by Councillor Madigan and SECONDED by Councillor Saul

“That the Chief Executive requests the Parks Department to carry out a proper and thorough inspection of the Linear Park in Clonskeagh all the way from the Clonskeagh bridge to the Milltown bridge. This area has become shamefully derelict and unkempt. It is overgrown with nettle, briar, ragworth and strewn with litter. That this report be forthcoming in early course.”

The following Report of the Manager was CONSIDERED

“The open space is a major link between the thoroughfare at Clonskeagh Road and the Milltown Bridge. Grass is cut along this stretch at approximately two week intervals.

The River bank and along the walls, this area is maintained as a bio-diversity area. It was developed in conjunction with our Biodiversity Officer and allows for maintaining bird, butterfly and insect populations.

A litter pick takes place at every grass cut and we will monitor the area to make sure there is no build up of litter in the area.

The parameters of this linear open space are planted with trees and the undergrowth is allowed develop wild flowers. This was developed in conjunction with the Biodiversity Officer at the time. This programme allowed for cover for birds, butterflies and insects to thrive. The pathway for pedestrians is in good order and seats are provided at intervals. Grass along the centre of the open space is cut on a two week rota. Litter is collected at each visit and we will make sure the area is litter free.”

Following a brief discussion during which J. Whittle responded to Members queries it was AGREED that the Parks Section would investigate the matter further.

DDE/222/14 REINSTATING OF ROAD SIGNS AT MULVEY PARK It was PROPOSED by Councillor Hand and SECONDED by Councillor Richmond

“That this Area Committee reinstates the road signs on the large green area at Mulvey Park, stating the one-way system.”

The necessary arrangements will be made between the Traffic and Road Maintenance Sections to ensure that the one-way system in Mulvey Park is fully operational including all necessary signage.

DDE/223/14 DOG OFF LEASH AREA FOR CLONMORE PARK It was PROPOSED by Councillor Saul and SECONDED by Councillor McCarthy

"That the Chief Executive considers a dog off leash area for Clonmore Park as the number of dog related complaints has sharply risen."

The following Report of the Manager was CONSIDERED

“There are no plans at present to put a dog off leash area in Clonmore Park. Up to now all our dog off leash areas have been placed in major parks where we have a Parks staff presence and where maintenance and security of the sites is easier.”

Following a brief discussion during which J. Whittle and T. Langan responded to Members queries, it was AGREED that the area will be monitored by the Dog Warden and will be added to the Paws Patrol Programme.

DDE/224/14 PRUNING OR REMOVING OF TREES AT BALLINTEER It was PROPOSED by Councillor Richmond and SECONDED by Councillor McCarthy

“That the Chief Executive would prune and if necessary remove some of the trees in the laneway that connects Clonlea with Woodpark in Ballinteer as the laneway is extremely dark for pedestrians during the winter months while the fallen leaves are causing a major slip hazard.”

“The position regarding the maintenance of laneways/walkways usually depends on whether or not it has been taken in charge by the County Council. There is a difficulty with the Council undertaking work in areas that are not formally taken in charge. In this case, the necessary arrangements are in hand to establish if the laneway described in the Motion is in charge so that the matter can be further considered.”

Following a brief discussion during which T. Langan confirmed that a further investigation had established that the laneway in question is in charge, it was AGREED that this work will be carried out.

DDE/226/14 Discussion of Review of Marlay Park Concerts 2014

A Review of the Marlay Park Concerts 2014 Introduction A series of single stage concerts were held in Marlay Park on 29th June, 2nd July, 4th July, 10th July and 12th July. The Longitude Festival took place on the 18th, 19th and 20th July.

The concerts were held in Marlay Park, Grange Road. The concerts were licensed by Dún Laoghaire Rathdown-County Council (DLR) and policed by An Garda Síochana who were supported by security personnel engaged by the Promoter.

A number of complaints were received by DLR in regard to the concerts and the purpose of this document is to review these complaints and make recommendations where appropriate.

Background Legislative context and licence The Planning and Development Act, 2000 as amended, Part XVI of the Planning and Development Regulations, 2001, as amended provide for the requirement of a license for the holding of outdoor events.

Section 231 refers to Regulations relating to matters of procedure and administration for applications and for granting of licenses. S.I. no 600 of 2001 and S.I. no 116 of 2012 currently pertain. An event is defined in section 229 of the Act as:

(a) “a public performance which takes place wholly or mainly in the open air or in structure with no roof or a partial, temporary structure and which is comprised of music, dancing, displays of public entertainment or any activity of a like kind, and “

(b) “any other event as prescribed by the Minister under section 241”

Article 183 of the Planning and Development (Licensing of Outdoor Events) Regulations 2001, defines an event as being “an event at which the audience comprises 5,000 or more people shall be an event prescribed for the purposes of section 230 of the Act” Licence application from Festival Republic on behalf of MCD Productions The Council received an application for a license from Festival Republic Limited, on behalf of MCD Productions, on the 4th April, 2014 to hold a series of concerts on 29th June, 2nd July, 4th July, 10th July and 12th July and the Longitude Festival on the 18th, 19th and 20th July.

MCD Productions MCD Productions (MCD) was the promoter of the concert events. A Contract was entered into between DLR and MCD which runs from 8th May 2006 to 30th September 2015.

Festival Republic Festival Republic was engaged by MCD to manage the concerts and the festival. It is a leading full service Event Management Company and it had the responsibility for the overall management of the events in liaison with all of the relevant authorities set out above including An Garda Síochana and the HSE.

Written notification to prescribed bodies As prescribed by Article 189 (1) of S.I. 600, the licence application was circulated to the following prescribed bodies:

Newspaper Notice Notices were published in the Irish Independent on Monday 24th March, 2014 and in the Southside People on Wednesday 26th March, 2014 in regard to the concerts. No submissions were received.

License The Licence for the concerts was issued on the 16th June 2014 by Dún Laoghaire- Rathdown County Council. (Appendix A)

Event Management Plan An Event Management Plan was submitted by Festival Republic and approved by the Council which includes the following key elements:

 Event Management structure and responsibilities  Event Safety Structure  Site structure and facilities  Medical facilities  Stewarding and site security  Traffic Management Plan  Emergency Plans  An environment monitoring programme for before, during and after the proposed event.  Provision for the full clean up of the area and for ant remedial works arising from any damage caused to public property, facilities and amenities associated with the event.

Security Companies Festival Republic engaged two leading security companies to provide security internally and externally at the concerts. There were 420 security personnel and stewards manning events. The security companies engaged were:

Concert Event History in Marlay Park The Marlay Park Concerts started in 2001. Appendix B outlines the concert history in Marlay park from 2001 up to 2014.

Complaints/observations received in relation to the concerts 140 cases were recorded on CRM associated with Marlay 2014. In some instances, the cases contained a number of issues and these issues are summarised in the table below:

Restricted Park access The car park on Grange Road was open to park users throughout the concert period with the exception of concert days when park users were directed to the Car park on College Road. The Park was open to Park users throughout the concert period apart from concert days when the Park was closed at 6 pm. Boland’s Café was accessible throughout the period but on concert days access was restricted.

It is accepted that throughout the period there was restricted access to some parts of the Park and some footpaths restricted on concert days to facilitate the safe management of the event.

In response to complaints from Park users’ circulation routes were improved and additional internal signage was erected to direct park users to the various locations in the Park.

Lack of information provided/received The Council communicated directly with the residents associations, adjacent to Marlay Park, in advance and during the concert events. This has always worked well as the residents associations are active with effective communication channels. A list of these residents associations can be found in appendix C

The Council wrote to the residents in regard to the concert dates and issued parking permits to individual residents. A copy of these letters can be found in appendix D(i) and (ii)

A communications team was set up by the Director of Service Richard Shakespeare overseen by Therese Langan and consisting of Aidan Blighe and Jeanette White. The team met with individual residents and dealt with issues on site before, during and after the concerts had ended. All mobile phone numbers were issued to residents so members of the team were contactable at all times. A help desk was set up and FAQS drawn up to address commonly raised issues and queries. A list of the FAQs can be found in appendix E

All details regarding concerts were co-ordinated by the Council’s Communications Office and information details published on www.dlrcoco.ie

The Gardaí communicated directly with residents in regard to traffic management in place during concert days. A copy of this correspondence can be found in appendix F

Anti-social behaviour An Garda Siochana were responsible for policing within the concert site and it environs. They were supported by MCD who engaged two leading security companies to provide security and stewarding within the concert arena and outside Marlay Park.

The security companies engaged were:

There were 420 security personnel and stewards manning each event

There were extensive preplanning meetings that took place between Festival Republic, DLR and an Garda Siochana in regard to security issues and traffic management issues.

A major Garda policing plan was put in place to cater for the large influx of people into Rathfarnham and to ensure the smooth running of this event.

Gardai, supported by security, manned the following locations

1) Corner of Hermitage Avenue & Grange Road 2) Hermitage Alleyway off Grange Road 3) The Eden House 4) Grange Court alleyway off Grange Road 5) Corner of Highfield Road and Grange Road 6) Corner of Grange Road and Grange Wood 7) Patrolling – Highfield Court to Marlay Grange 8) Patrolling – Sports Grounds and Llewellyn Way 9) Corner of Grange Road and La Touche Court 10) Corner of Grange Road and Pine Valley Avenue 11) Driveway along Grange Road 12) Corner of Stonemasons Way and Heather Lawn 13) A private residence entrance, Grange Road 14) Driveway along Grange Road / cottages 15) Driveway along Grange Road / Pine Valley cottages 16) Roundabout – Stonemasons Way and Bradford Road 17) Patrolling – Llewellyn Park and Llewellyn Way 18) Marlay Grange House 19) Corner of Brehon Field Road and Grange Road / Grangefield 20) Event Control – located in Marlay House

All security issues were co-ordinated through the Event Control Room in Marlay House and any anti social issues that took place outside the Park were dealt with swiftly and efficiently. No serious incidents took place. Traffic/General disruption A comprehensive Traffic Management Plan was prepared for the concerts. The main focus of the plan was to ensure that concert goers could access the venue as quickly and safely as possible while still maintaining traffic flows for regular road users.

The TMP emphasised the use of public transport as the preferred mode of travel to the venue. Use of public transport was emphasised in all marketing material issued by concert promoter, the Council and an Garda Síochana.

Public transport Marathon Travel operated a dedicated bus shuttle from Dublin City Centre to Marlay Park. The coach drop off and pick up locations were accessed via the College Road car park.

Other bus routes operating in the area were Routes 16, 116, 161, 75 and 14 and could be accessed at Taylors Lane at concert end.

Public car parking was provided in the College Road Car Park which also accommodated parking for private coaches.

Plenty of taxis were available on Stonemasons Road and Grange Road. On concert days, access roads to and from the concert venue remained open.

At concert end, the Gardaí closed Grange Road usually for 45 minutes to one hour. The main exits from the concert venue were from the overflow car park and Marlay Park car park on Grange Road and the car park on College Road. Arising from the high volume of pedestrians leaving the venue at the same time, it was necessary to close Grange Road. This meant that residents in housing estates abutting the Park were unable to leave their estates for up to 60 minutes until the pedestrian traffic had significantly cleared.

There was also significant traffic congestion on College Road as bus traffic and cars tried to access the M50 at the same time but this traffic was cleared within one hour. The Gardaí deployed resources on point duty on all accesses to the concerts at Stonemasons Road/Grange Road, Ballinteer Road, College Road/Grange Road and at the car park on College Road to move traffic efficiently.

The following issues will be examined for Concerts 2015

 Additional exit routes from the venue will be examined and designated to spread the concentration of pedestrian exit traffic leaving the venue;  Additional and improved signage and public announcements will be provided to designate end of traffic egress routes;  The location of bus parking will be examined with a view to moving it away from College Road.

Lack of security Robust structures and a security plan were put in place to manage security internally and externally. These structures are described in the Event Management Plan. Security was led by An Garda Síochana. Private Security was also provided by Festival Republic led by its Security Co-ordinator. Dún Laoghaire-Rathdown County Council was consulted on all security issues raised and security issues were co-ordinated through the Event Control Room situated in Marlay House which was fully equipped with CCTV security cameras.

There were 420 private security personnel on duty for the events.

A number of meetings took place regarding security over the timeframe of the concerts which discussed all elements of security planning including personnel resources, incidents, and complaints from residents and positioning of security externally. Council staff met with residents on a daily basis and all issues regarding security to estates were dealt with.

Appendix G shows the locations that were secured by Gardaí, private security and stewards.

Fencing and barriers were put in place in the estates outlined below to deter concert goers accessing these estates during and after the event. Open space areas were also secured on Stonemasons Road to avoid concert goers taking short cuts to the concert venue. These access points were manned by the Gardaí and security personnel from Festival Republic. Security was monitored by Dún Laoghaire-Rathdown County Council staff.

During the concert period, security was strengthened as required with additional fencing and barriers and additional security.

Also, security was put in place at the following locations following complaints from residents about non-residential parking and loitering by concert goers.

 Broadford Estate  Grange Court Estate  Kingston Estate

The only residents allowed to access the estates were those with identification but this applied mainly to car users. Residents have asked DLR to consider issuing residents with wrist bands to enhance security in their estates for future concerts.

Non residential parking Illegal and non-residential parking was a significant issue historically. This issue has been addressed as described through the erection of barriers and fencing at estate entrances. There is also a parking permit and identification process to verify entry into the estates which is checked by the Gardaí and security personnel.

It is accepted, however, that some estates in the wider environs experienced non- residential parking and security will be put in place at these locations in 2015.

Duration of concerts and number of concerts The Marlay Concert history is outlined in Appendix A. Concerts have been an annual feature in the Marlay calendar for 14 years. There is a disruptive impact on residents but as can been seen from this report, the Council tries to minimise any of these negative impacts through communications, robust security, allocation of concert tickets to residents associations, allocation of tickets to the classical concerts and the hosting of an annual barbeque. Tickets per event are allocated to residents associations in the area.

The revenue generated from the concerts is invested in Marlay Park and in the projects designed to improve the quality of people living in the area. These projects are outlined in the next paragraph

How revenue raised is used by the Council The revenue generated from the concerts is invested directly in Marlay Park and wider recreational facilities in the area. This revenue has become more important in recent years following the financial downturn which has impacted on the Council’s ability to deliver quality services.

The revenue is invested in:

 Playgrounds in Marlay Park;  Walled Garden;  Golf Course;  Extension to Bolands Café;  Golf Pavilion;  All weather pitches;  Tamplins Cottage;  DLR Events such as Movies in Parks, Classical Concerts, Samhain and other events;  Marlay Market;  Marlay Craft Yard;  Trim Trails;  Removal of laurel programme;  Running track

Noise The Event Licence provided that the music level should not exceed 72dB (A) LAeq, over a fifteen minute period as set out by the Environmental Health Officer, Health Service Executive. A report showing the readings from each of the concerts is shown in appendix H. This Report shows that at the majority of the concerts, the music level is well below 72dB the prescribed noise levels. The concert finish time was set at 11 pm but in general all concerts finished at 10.45 pm.

Littering Festival Republic engaged a competent and experienced contractor (Panda) to carry out waste and litter management in the arena area and the environs outside the concert venue. The concerts do create a significant amount of littering which is unfortunately unavoidable. A waste management plan was put in place for the events. It provided for and executed litter clean ups during and after the events. The litter cleanup covered Kingston to Taylors Grange and Stone Masons Road and the wider environs were also included. The clean ups were monitored independently by the Council Litter Wardens. Any areas that had not been cleaned up was reported to the Event Co-ordinator and action taken. In general, the Litter Warden on duty found that the external areas were litter free by 10 am on the morning following the event. DLR strengthened the removal of litter by deploying road sweepers the morning following the each event.

The Council will engage with residents associations to see how we can improve performance in this area during and following an event. DLR will also provide more litter bins outside the concert venue in 2015.

Commitment to Further Review

This Report was developed for the Dundrum Area Committee Members following representations from the Elected Members. The Council has committed to further consultation with local Residents Groups in September 2014 to further inform this review. In order to ensure that residents do not experience parking difficulties, the Council is issuing 3 Residential Car Parking Permits (enclosed) to households in housing estates adjoining the park.

Please complete the permit by filling in your address & vehicle registration number and display the permit on the dashboard.

We would be obliged if you would display the permits as this will facilitate the Gardaí in carrying out their duties in relation to illegally parked vehicles.

Please retain these permits for each concert as no further permits will be issued.

The Council would like to keep you informed and up to date on the events taking place in Marlay Park this summer.

The current schedule is as follows:

It is intended that the Council keep in close communication with residents to ensure inconvenience and disruption is kept to an absolute minimum.

PARKING PERMITS Parking permits will be issued to all residents in the surrounding area in the coming weeks. Three permits will be issued per household. Please contact the Council at the number above if any resident in your area does not received their permits by the end of June.

TRAFFIC RESTRICTIONS There will be no road closures in the vicinity of Marlay Park on concert dates except for those listed on the attached letter from An Garda Siochana and within local estates. Vehicular traffic will be prohibited from entering local estates in the lead up time to the concert except to those with parking permits.

PARK AND CAR PARK OPENING/CLOSING TIMES Marlay Park will remain open to all visitors as normal except on concert days (see above list). On those dates the park may close early. The Grange Road car park will remain open except on concert days when it will be completely closed. The car park at College Road will remain open at usual times.

NOISE LEVELS In accordance with the licence issued under the Planning & Development Act 2000, the noise level limit for the concerts is 72dba. Both the HSE and MCD will monitor noise levels through daytime sound checks and the evening concerts. Artists who breach these levels will be heavily fined. CONCERT TICKET ALLOCATION As with previous years there will be a limited amount of tickets allocated to your residents association. You will be notified of this allocation in the coming weeks.

As outlined at the start of this letter, it is the Councils intention to minimise disruption and inconvenience to the residents surrounding Marlay Park and we would like to take this opportunity to thank you for your continued assistance and support during these concerts over the last ten years. The income generated from these concerts has contributed towards vast improvements in Marlay Park, namely playgrounds, sports facilities and some of the other events held (e.g. Samhain and Movies in the Park).

Frequently Asked Questions

What dates will the park will be closed this year? Marlay Park will remain open to pedestrian visitors throughout the concert period. There will be restricted access particularly on concert days with some gates closed to the public from the afternoons on. A decision to close the park completely on a concert day will only be made upon the advise of the Gardai and MCD (this has rarely happened).

What dates will the car park be closed? On concert days only

The College Road car park will be open at usual times. It may close early on concert days.

What is the legal status for closing the park? The decision to close the Park will only be taken in consultation with the Gardaí and the Concert Promoter. The decision is not taken lightly to close the park and is made with the welfare of all in mind.

The Council can vary opening/closing times as circumstances require under Section 2 a and b of the Dun Laoghaire Rathdown Park Bye Laws 2003

The concerts also bring much needed revenue which has been used for the playground in Marlay and also for dlr events programme such as Movies at the Park and the Samhain Event which takes place each year.

Why didn’t my estate receive parking permits? The reason no parking permits were issued to your estate is because there will be no Garda presence on your estate.

What estates are getting tickets? As with previous years there will be a limited amount of tickets allocated to your residents association. You will be notified of this allocation at least two weeks prior to the event.

The noise levels are too loud? In accordance with the licence issued under the Planning & Development Act 2000, the noise level limit for the concerts is 72 decibels. Both the HSE and MCD will monitor noise levels through daytime sound checks and the evening concerts. Artists who breach these levels will be heavily fined.

Issues relating to security personnel can be related to the Council staff on duty on that date.

Security Levels The Council engages with the promoters and the Gardaí with regard to adequate levels of security required. Security is deployed in the vicinity of the concert area because of the vast numbers egressing at the one time. The Garda direct people along Grange Road, Stonemasons way, Brehonfield Road and Ballinteer Avenue - depending on the concert goers route home. It is not our intention to provide security measures only in DLR, security/Gardaí were deployed in Eden and Hermitage, both of which are in South Dublin County Council area.

Abusive security staff at park during the day This matter will be dealt with by the company employing the security staff and we will pass on the details to them.

Planning permission for concerts The issue of Licensing Outdoor Events is covered under Part XVI of the Planning and Development Act, 2000. Originally the promoter of an event had to apply at least 18 weeks prior to the event, this changed in April of 2012 to 10 weeks. (PLANNING AND DEVELOPMENT (AMENDMENT) REGULATIONS 2012)

The notice must appear in a National and Local paper as is the case with a Planning Application. The file is sent to prescribed bodies such as An Garda Siochana, HSE, Fire Brigade etc for comment. They must comment within 5 weeks of the date of application. The general public are also entitled to comment/object within the same 5 week period. From there, the Planning Authority examines all reports/comments and issues/refuses the Licence.

Anti Social behaviour The Council works very closely with the Gardaí and the Concert Promoters to ensure that there is a very visible security presence. An Garda Siochana are well versed in this regard and are aware of the expected element. If residents see any anti social behaviour in their area on concert dates they can contact any of the following: a) Your Residents Association (who have direct contact with council staff) b) The Gardai at Rathfarnham Garda Station (01-6666500)

Garda Complaints Any complaints about the behaviour of Gardai (e.g. no access to estates, abuse etc) can contact Rathfarnham station at 6666500. The Garda Helicopter will be deployed on a needs basis and use will be kept to a minimum or avoided if possible. Complaints relating to this should be referred to Rathfarnham Gardai.

Information Regarding Marlay Park Concerts 2014.

Stand alone concerts are to held in Marlay Park on the 29th of June, 2nd of July, 4th of July, 10th of July and 12th of July with an estimated 40,000 patrons on each date. The Longitude Festival is to be held on the 18th, 19th and 20th of July 2014 with an estimated 20,000 patrons on each date.

Gardaí shall be on duty at the entrances to each estate on these dates from approximately 11am until the conclusion of each event to prevent any anti social behaviour and prevent non residents from entering the estates. It is requested that residents on these dates carry in their vehicle a form of identity to prove their address such as a utility bill or driving licence to prevent non residents from parking within the estates.

A number of road closures shall be put in place at the end of the event to safeguard the large volume of pedestrians expected to exit onto the Grange Road.

 Grange Road from the junction with Taylor’s Lane to the junction with Stonemason’s Way shall close to all vehicles at 10.30pm. Traffic will not be allowed to exit any estates or the Lidl car park.  College Road from the junction with Whitechurch Road to the junction with Grange Road shall close to all vehicles at 10.30pm.  Taylor’s Lane from junction with Whitechurch Road to the junction with Grange Road shall close to all vehicles from 10pm to facilitate a large quantity of Dublin Buses.  Stonemason’s Way from the junction with Grange Road to the junction with Barton Road East shall close to all vehicles from 10pm.

Summary The Noise Unit at Dun Laoghaire / Rathdown Co. Council has been requested to perform a noise assessment investigation for the Concerts being held at Marlay Park 2014.

This report details the equipment and measurement methods employed and presents an acoustic analysis of all data collected.

A high quality digital recorder was deployed onsite to take a continuous recording. This unit recorded all sounds for the entirety of the investigation period.

Objectives The technical assessments were carried out:

1. To determine the ambient noise environment and background noise levels at the noise sensitive location(s) (nsl’s) where monitoring has been carried out.

2. To relate the music noise level from the Marlay Park Concerts to the noise conditions set down in the planning application and show a reasonable cause for annoyance or otherwise.

3. To assess if the complaints logged by local residents are justified.

Introduction Marlay Park is located in Dun Laoghaire / Rathdown Co. Council and has been used for 5 music events between the dates of Sunday 29th June and Saturday the 12th July, on a single open air stage.

The condition relating to the event states that “The music noise level should not exceed 72dB (A)LAeq, over a fifteen-minute period, at one meter from the facade of any noise sensitive premises for events being held”.

Description of the Noise Source There is a stone wall approximately 1.5 ~ 2 meters high running along the park boundary between the nearest noise receptor location and the noise source. There is some tall trees and wooded area within the park.

The primary noise nuisance is emitting form the live and recorded music being featured on a single stage, with live music between approximately 18:00 and 23:00.

Description of the Noise Receiver The closest noise sensitive area is mainly to the north of the park and east of the park. Residents living in the area include young and old families. It appears that all the houses have double glazed windows.

There are additional residential areas to the north -east and north-west. Equipment and Measurement Set Up The recorder used during the noise assessment with Hand Held Analyser, Bruel & Kjaer 2250 Light, Sound Level Meter.

Acoustic Consideration Meteorological Conditions Meteorological conditions can have a substantial influence on the propagation of sound and may provide important information for assessing noise compliance and a noise complaint.

Wind speed and wind direction have the potential to affect the noise measurements. An average wind speed of less than 10 knots is the preferred limit when noise measurements are being taken.

The prevailing weather conditions at the time of measurement has been noted and recorded in the report. These occurrences may influence the final noise reading.

The meteorological station located in Casement Aerodrome and is approx. 17km away from the Park and has been used as a detailed weather guide for monitoring purposes

External Influences and limitations Precautions were put into place to minimise outside interference. These include covering microphone with a wind shield to minimise outside interference and pausing the SLM if deemed necessary.

The Grange Road runs to the north and east of the Park. This appears to be a busy road to the north of the park with fewer vehicles using the eastern part of the road.

The M50 motorway runs on an alignment approximately east to west to the south of the Park.

It has been noted that on concert no.3 – no. 5 the FM 104 bus was parked in the Lidl car park, playing loud music from ~ 6pm to 9pm.

Road traffic noise and crowd noise were noted during the course of each monitoring session. These occurrences may influence the final noise reading.

Methodology Noise levels were measured by a competent person(s) for environmental noise monitoring, in accordance with EPA Environmental Noise Guidance Document and International Standard ISO 1996: Acoustics Description and Measurement of Environmental Noise. The ‘worst-case’ sampling position has been identified as Grangewood throughout each monitor session.

Complaints logged for the five Concerts 29.06.14 - A phone query was logged on the 02-07.14 directly to the noise unit from a resident at Hermitage Estate, Rathfarnham. The query was in relation to the noise levels emitting from the concert being held on the 29.06.14. The complainant was advised that monitoring would be carried in their estate during the next concert to ascertain noise levels.

02.07.14 - An official complaint was logged from a resident living at Wyckham Point to the Parks Department. A resident from near Clonlea Estate logged a phone query at the Parks Department in relation to noise levels emitting from the concerts being held at Marlay Park.

04.07.14 - A phone query was made to the Parks Department from a member of Marley Grange Residents Association. They wanted to obtain the noise readings from the concerts being held at the park. The consultant was updated and noise monitoring was recommended to carry out noise monitoring in this estate.

10.07.14 - There was no direct noise complaints logged at the Noise Unit.

12.07.14 – A complaint was logged over the phone from a resident living in the area of Broadford Estate. This complaint was made on the night while the concert was being held. Monitoring was carried out and the noise consultant was informed of the complaint that was logged at the time.

A complaint was logged with the Parks Department from a resident living near Ludford Road in relation to the concert held on 12.07.14. This complaint was logged after the event was held. All complaints and phones query were dealt with by the Noise Unit and /or the Noise Consultant for Festival Republic at the time they were logged. Monitoring has also been carried out in these locations to obtain noise levels when the Concerts were being held at the Park.

Discussion of Acoustic Analysis In carrying out a compliance with the condition setting down the noise limit stating that:

“The music noise level should not exceed 72dB (A) LAeq, over a fifteen-minute period, at one meter from the facade of any noise sensitive premises for events being held”.

There was an exceedance of by 1.8 dBA that occurred on one monitoring session on the 12.07.14. At the time of the monitoring it appears that the wind speed was approx. 11 knots and was coming from a westerly direction. The road traffic and crowd noise may have also been a contributing factor to final decibel reading on this occasion. This may have been a factor to this exceedence.

Conclusions Having given careful consideration to the monitoring reading, the Noise Unit for Dun Laoghaire Rathdown Co. Council has concluded that the noise emitted from the Concert complied with the conditions set down in the planning application for the 16 out of 17 noise monitoring sessions carried out.

“That this Area Committee, given the high volume of Marlay Park concerts this year, and the ensuing havoc it creates for residents living around Marlay Park, restrict the number of Marlay Park concerts, for which it grants licences, to 3 per year.”

It was PROPOSED by Councillor McCarthy and SECONDED by Councillor Saul

“That the Chief Executive would please present a report of all complaints associated with this summer’s Marlay Park concerts for information and discussion as soon as possible.”

It was PROPOSED by Councillor Martin and SECONDED by Councillor Saul

“That the Chief Executive should conduct an assessment and review of the current arrangement of staging concerts/events in Marlay Park including carrying out a thorough consultative process with all stakeholders especially with Residents Associations and residents who reside in close proximity to Marlay Park, indicating a time frame for same, with a view to presenting a report to Members with conclusions and recommendations for the Council to consider.”

Following a detailed discussion during which Richard Shakespeare responded to Members queries, a commitment was given to further consultation with effected local residents groups in September 2014. It was also AGREED that the Report would be published to the Council’s website prior to the additional consultation with residents.

The Report of the Manager was NOTED.

DDE/227/14 Conclusion of Meeting The meeting concluded at 6:30pm
