Fatal Charades: Roman Executions Staged As Mythological Enactments* FATAL CHARADES: ROMAN EXECUTIONS STAGED AS MYTHOLOGICAL ENACTMENTS* By K. M. COLEMAN (Plates I-II) Tertullian,illustrating the sacrilegiousnature of pagan religion,records that in an auditoriumhe saw a person being burned to death in the role of Hercules and anotherbeing castrated as Attis;both of theseexamples he adduces to substantiatehis assertionto his pagan audience that 'criminalsoften adopt the roles of your deities' ('et ipsos deos vestros saepe noxii induunt').1 The practice that Tertullian here deplores is the subject of this paper: the punishmentof criminalsin a formalpublic display involvingrole-play set in a dramatic context; the punishmentis usually capital. This practice,which I term 'fatalcharades', has provokedoccasional comment fromscholars: some have been horrifiedand repelledby the gruesomeincongruity2 of the elementof make-believe,others have stressedthe theatricalityat the expense of the realism;3a few have recognized these displays for what they were;4 but no comprehensivesurvey of the evidence exists.5I shall begin by reviewingthe aims of the Roman penal system,and demonstratehow public displaysprovided an oppor- tunityto exact punishment.Against this backgroundI shall examine evidence for thesecharades, and in conclusiontry to offersome explanationsfor their emergence in the earlyEmpire. I. PENAL AIMS The paragraphsthat follow sketch the most importantassumptions that underlie Roman modes of punishment;the distinctionsdrawn here betweenvarious aims are frequentlyartificial, since an individual penalty and the legislation governingit usuallyserve a complexof purposes ratherthan a discreteaim. While no single sociological model seems to fitancient society,a briefoutline of the leading schools of thoughtwill neverthelessshow thateach can illuminatesome aspect of the Roman penal system. The traditionalreformist view7 saw the eighteenth-centurydevelopments as an enlightenedstep away fromthe primitiveretributive practices of previouseras: as we shall see, a retributivebasis is veryprominent in Roman penal practice.In the I930S the perspectivebegan widening,and stresson economicfactors set punishmentin the broader contextof societyas a whole:8the demand for brutal public entertainment will be seen to act as a 'marketforce' in the selectionof punishmentat Rome. The revisionists9have questioned the eighteenthcentury's avowed aims of combining deterrencewith reform;they have insisted upon the necessity of studying the institutionof punishmentalong withother social institutionsdesigned to modifythe behaviourof 'aberrant'elements in society(asylums etc.), and have produceda model of oppressiveand exploitativeauthoritarianism to replace the 'reformist'humanitar- ian view: the increase in cognitionesas a mode of trial under the empire, and the increasingidentification of the emperor'sperson with the sanctityof the state,clearly point in this direction.Most recently,counter-revisionist voices have warned that a model mustbe developedthat can accountfor the co-operative function of all levelsin societyin informallyregulating dispute and outlawingdeviance in the community:10 here the participationof the audience in the amphitheatredemands a modificationof the authoritarianmodel. Hardingand Ireland have respondedto the counter-revisionistcall by expanding the studyof punishmentto includetechniques of social controlthat lie outsideformal legal processes,thereby interpreting punishment as the manifestationof disapproval by membersof a society(or its rule-enforcingauthorities) when thatsociety's norms are violated; adducing examples froma broad historicaland geographicalspectrum, theystress the importanceof culturalcontext in determiningpenal aims and methods, so that the historyof punishmentis not seen as a chronologicaldevelopment from 'primitive'to 'civilized' but ratheras a constantlyadjusting balance of techniquesof social controldetermined by the physicalresources, moral basis, and beliefsystem of any given society.Shifting the spotlightoff state-enforced punishment, Harding and Ireland highlightother areas in society capable of imposing sanctions,and stress especially that penalties of degradation,sometimes entailing a public spectacle of punishment,are a 'pervasivepenal practice':11this view of punishmentas a productof culturalautonomy has obvious advantagesin the studyof a societylike Rome which differedradically in its economy,value system,and social hierarchyfrom those post- Enlightenmentwestern societies on whose penal practicesmodern sociologistshave based theirmodels of punishment. Most of these negative views is based on the fact that the Romans created and used a great variety of painful and severe penalties, very often accompanied by different kinds of torture or disgrace1. Although such opinions derive from legal and literary sources, occasionally in their context a very important factor seems to be missing. Sometimes in the process of evaluation of foreign or historical legal systems researchers make a mistake and use modern standards, both legal and moral, and from this point of view they proclaim their statements. This incorrect attitude may lead to ascertainment that no legal system before 20th century should be judged positively in this aspect. However, the goal of this paper is not to change those statements, as they are based on sources, but rather to give examples and to underline some important achievements of Roman crimi- nal law which, sometimes forgotten or disregarded, should be considered in the process of its historical evaluation. 1 The most cruel are definitely aggravated forms of death penalty, such as crucifixion (crux), burning alive (vivi crematio), throwing to wild animals during the games (damnatio ad bestias), throwing to the sea in a sack with ritual animals (poena cullei). As soon as someone was convicted of patricide they would be blindfolded as they were unworthy of the light and taken to the Field of Mars outside Rome. There they were stripped naked and whipped with rods. The convicted criminal would then be sewed up in a sack and thrown out to sea. This was so he would not die on Roman soil and pollute the earth with his evil. Later on a serpent was also sewed up into the sack with him, and still later an ape, a dog and a cockerel were added. Death by crucifixion and damnatio ad bestias were usually watched by the public.

In contemporary life, where mobile devices exist as pervasive and near-permanent human prostheses, the increasing digitisation of communication and the corresponding embrace of “computationalism” ensure that human conceptions of reality are ir- reversibly mediatised.3 Objectivity spars with emotional appeal, and miscommunication runs rampant in digital discourse. And yet, to castigate online media, and hold it responsible for an unforeseen age of incivility, would be myopic.     CHAPTER 34 Roman Beast Hunts Chris Epplett 1 Introduction While gladiatorial combats and chariot races are perhaps the spectacles most commonly asso- ciated with ancient Rome in modern perception, a third type of spectacle, the venatio (beast hunt), was also popular among Romans. Animal spectacles of one kind or another, in fact, were staged over a longer period of time in Roman territory than gladiatorial contests. A variety of sources attest to the popularity of such events in the Roman world. Writers such as Pliny the Elder and Suetonius often mention especially noteworthy spectacles staged in Rome, including venationes. Inscriptions commemorating games staged by wealthy residents of dozens of different communities demonstrate the ubiquity of animal spectacles over the centuries of Roman rule. Artistic evidence, in particular mosaics from North Africa, leave no doubt that venationes were memorable occasions. Staged animal hunts, typically with aristocrats and monarchs as active participants, were a staple of many societies in Asia and Europe for millennia (Allsen 2006; Kyle 2007: 23–37), so it is not surprising that such events also attracted a wide following in ancient Rome. What is relatively rare in terms of the hunts in Rome is that they did not normally include the direct participation of either rulers or the aristocratic elite.     1 ‘Reality, Paradox and Storytelling in Aulus Gellius’ Narrative of Androcles and the Lion.’ Patricia Watson University of Sydney [email protected] The tale of Androcles and the Lion is best known from Aulus Gellius (NA 5.15), whose account may be summarised as follows: At a venatio in the Circus Maximus, a number of condemned criminals, including the slave Androclus, were brought in to face a particularly ferocious lion. On sighting Androclus, the lion approached and greeted him like a pet dog in an astounding scene of mutual recognition between man and beast. The audience went wild, prompting the presiding emperor to ask Androclus for an explanation. Then Androclus related his story: he had been the slave of the governor of Africa, whose habitual cruel treatment had forced him to flee and take refuge in the desert. Sheltering in a cave, he encountered a lion with a wounded paw, which he treated; thereafter he lived with the lion, sharing its food, for three years, until he tired of his animal-like existence, left, was caught and handed back to his master, who had him summarily condemned to the arena. The lion, explained Androclus, was simply showing gratitude for the benefaction it had received. Yet, (and here’s a strong irony) God’s Temple can only be washed clean with more blood—blood that flies from priestly fingers to splatter God’s Throne in spots of gore ­life blood lost and then kept to save sinners. The ‘keeping’ presages a function and an end; the blood accumulates, as does the sin forgiven, until a certain time when sin and sinners will be no more.

    MUSEUM FRIDAY FEATURE The Roman Games by Benton Kidd, Curator of Ancient Art he Roman Empire was certainly known for its extravagance, and some of its heftier expenditures went Tto the construction of arenas and the spectacles they contained. Variously referred to as the “games” or “blood sports,” they were ludi to Romans and generally featured gladiators, venators, and criminal executions as their main events. Chariot races were held in separate facilities known as circuses. Scholars suggest as many as 135 days annually were devoted to games, often held in conjunction with religious or imperial commemorations. Staged in mammoth amphitheaters by the state or wealthy benefactors, the games were held across Rome’s empire. Among the more well-known were Rome’s Ludi Magni (“Great Games”), which were also said to be the oldest. Celebrated in honor of the god Jupiter, these opulent games unfolded from the 9th to th the 15 of September The amphitheater at El Djem, Tunisia. and featured events such as chariot racing, boxing, wrestling, gladiators, and even Greek drama. Many cities across the Mediterranean have extant remains of great amphitheaters, including El Djem (ancient Thysdrus in Tunisia) where the surviving structure once seated 35,000. The Museum’s small red-slipped jug, a souvenir from a venationes (wild beast hunt), also comes from El Djem. Venators, like gladiators, were trained fighters, but their opponents were wild animals rather than men. Though armed, remarkable venators are known to have strangled animals with bare hands. The jug shows a venator lifting a panther over his shoulders, indicating that he has killed it.
