The Second Vatican Council taught in no. 10.4 of its Dogmatic Constitution on Di- vine Revelation (Dei Verbum) (1965) that “Scripture, Tradition, and the teaching authority of the Church, in accord with God’s most wise design, are so linked and joined together that one cannot stand without the others, and that all together and each in its own way under the action of the one Holy Spirit contribute effectively to the salvation of souls.” This sentence offers a particularly organic description of the relationship of these three things that reflects a development from selected preconciliar thought. In his 1950 encyclical Humani Generis, Pope Pius XII presented Scripture and Tradition as “sources” of revelation entrusted to the Magisterium. He did not explain their relationship or discuss a theology of Tradition. Gerardus Van Noort’s seminary manual Dog- matic Theology said the sources of revelation “mix” in the Magisterium which interprets them. The Council asserted a mutual interdependence of the three. It offered a more dy- namic notion of tradition, one associated with a view of revelation as God’s self-disclosure. This view resembled those of Yves Congar, Karl Rahner, and Joseph Ratzinger. The Council presented Scripture and Tradition as expressions of one Word, served by the Magisterium. Dei Verbum 10.4’s teaching was incorporated by Pope John Paul II into his encycli- cal On the Relationship of Faith and Reason (Fides et Ratio) (1998) Ch. 5. Dei Verbum had identified Scripture and Tradition as the rule of faith in no. 21. John Paul II citesDei Verbum 10.4 in support of a teaching that the unity among them and the Magisterium constitutes the rule of faith. This teaching, along with the encyclical’s recalling of intellectual issues related to belief, a major preconciliar concern, suggests that John Paul II perceived a unity between these points and the Council’s emphasis upon a view of revelation as Divine-self disclosure. The Second Vatican Council taught that Divine Revelation is communicated through Scripture, Tradition and the Magisterium.1 The Council’s Dogmatic Constitution on Divine Revelation (Dei Verbum) described the interrelationship of these three means of communication as follows:2 It is clear, therefore, that sacred tradition, Sacred Scripture, and the teaching authority of the Church, in accord with God's most wise design, are so linked and joined together that one cannot stand without the others, and that all together and each in its own way under the action of the one Holy Spirit contribute effectively to the salvation of souls (§ 10). What is this interrelationship of Tradition, Scripture and the Magisterium? This dissertation answers this question by: (1) examining selected writings about Revelation, Tradition, Scripture and the Magisterium in the period prior to Vatican II; (2) considering the teaching of Dei Verbum in regard to the mediation of Revelation through Tradition, Scripture and the Magisterium; (3) examining the post-conciliar teaching of Pope John Paul II in his encyclical, Fides et Ratio, On the Relationship of Faith and Reason (1998). The primary focus of this dissertation is Revelation, God’s self-disclosure to the human race. After the immediate events of divine disclosure,.

Weston College N His recent encyclical letter, Hurnani generis, of Aug. 12, 1950, the I Holy Father reproves those who "reduce to a meaningless formula the necessity of belonging to the true Church in order to achieve eternal salvation."1 In the light of the Pope's insistence in the same encyclical letter on the ordinary, day-by-day teaching office of the Roman Pontiffs, it will be useful to select from the infra-infallible but authentic teaching of the Popes some of the abundant material touching the question of the mediatorial function of the Church in the order of salvation. The Popes, to be sure, do not speak and write after the manner of theo­ logians but as pastors of souls, and it is doubtless not always easy to transpose to a theological level what is contained in a pastoral docu­ ment and expressed in a pastoral method of approach. Yet the authentic teaching of the Popes is both a guide to, and a source of, theological thinking. The documents cited are of varying solemnity and doctrinal importance; an encyclical letter is clearly of greater magisterial value than, let us say, an occasional epistle to some prelate. It is not possible here to situate each citation in its documentary context; but the force and point of a quotation, removed from its documentary perspective, is perhaps as often lessened as augmented. Those who wish may read them in their context, if they desire a more careful appraisal of evidence.

Some French writers have asserted that France is envisaged. For instance, the Parisian weekly, UObservateur politique, tconomique et litteraire, published in the issue of August 31, 1950, an article entitled, "L'Encyclique contre les nouveautes franchises." And Robert Barrat states confidently: "No one is deluded about 'Humani Generis' in France. It is France and certain currents of French theological thought to which this encyclical refers."1 Readers who are able to keep abreast of the theological writings of the day are aware that such reports are superficial. Theories condemned in the encyclical have appeared not only in France, but in Germany, Belgium, England, Italy, Spain, and elsewhere. Even in the United States, where a pioneering spirit in theological speculation is not very conspicuous, some of the repudiated opinions, for example, those dealing with evolution, polygenism, and the gratuity of the super­ natural, have found favor. Nor should anyone suppose that only certain members of two great religious orders are called to account. Tendencies reproved in the encyclical have been fostered by philosophers and theologians of various orders and congregations, of the diocesan clergy, and also of the laity.2 The encyclical did not take the Catholic world by surprise.

The Church rejuvenates in the power of the Gospel and the Spirit continually renews her, builds her up, and guides her “with hierarchical and charismatic gifts”.[1] The Second Vatican Council has repeatedly highlighted the marvelous work of the Holy Spirit that sanctifies the People of God, guides it, adorns it with virtue, and enrichens it with special graces for her edification. As the Fathers love to show, the action of the divine Paraclete in the Church is multiform. John Chrysostom writes: “What gifts that work for our salvation are not given freely by the Holy Spirit? Through Him we are freed from slavery and called to liberty; we are led to adoption as children and, one might say, formed anew, after having laid down the heavy and hateful burden of our sins. Through the Holy Spirit we see assemblies of priests and we possess ranks of doctors; from this source spring forth gifts of revelation, healing graces, and all of the other charisms that adorn the Church of God”.[2] Thanks to the Church’s life itself, to the numerous Magisterial interventions, and to theological research, happily the awareness has grown of the multiform action of the Holy Spirit in the Church, thus arousing a particular attentiveness to the charismatic gifts by which at all times the People of God are enriched in order to carry out their mission.

MORELAND† Christian Legal Thought is a much-anticipated contribution from Patrick Brennan and William Brewbaker that brings the resources of the Christian intellectual tradition to bear on law and legal education. Among its many strengths, the book deftly combines Catholic and Protestant contributions and scholarly material with more widely accessible sources such as sermons and newspaper columns. But no project aiming at a crisp and manageably-sized presentation of Christianity’s contribution to law could hope to offer a comprehensive treatment of particular themes. And so, in this brief essay, I seek to elaborate upon the treatment of the principle of subsidiarity in Catholic social thought. Subsidiarity is mentioned a handful of times in Christian Legal Thought, most squarely with a lengthy quotation from Pius XI’s articulation of the principle in Quadragesimo Anno.1 In this proposed elaboration of subsidiarity, I wish to broaden the discussion of subsidiarity historically (back a few decades from Quadragesimo Anno to the pontificate of Leo XIII) and philosophically (most especially its relation to Leo XIII’s revival of Thomism).2 Statements of the principle have historically been terse and straightforward even if the application of subsidiarity to particular legal questions has not.
