941 ZALMAN PRODUCTION (DO NOT DELETE) 12/17/2016 4:35 PM ELEPHANTS IN THE STATION HOUSE: SERIAL CRIMES, WRONGFUL CONVICTIONS, AND EXPANDING WRONGFUL CONVICTION ANALYSIS TO INCLUDE POLICE INVESTIGATION1 Marvin Zalman* Matthew Larson** ABSTRACT In this article we advocate that the study of miscarriages of justice be expanded to view the entirety of police crime investigation as a source of wrongful convictions. We set this proposal in a framework of how the inductive innocence paradigm was developed and analyze how the term “causation” is used in legal, scientific and case analysis. We then explore a subject not yet addressed by wrongful conviction scholarship but that may confront an investigator: whether an unsolved crime is the work of a serial criminal and whether a suspect is the serial criminal. We examine a convenience sample of forty-four exonerees convicted of crimes committed by thirty serial criminals. The analysis is aimed at opening up a discussion of the kind of complexity that investigators face in hard-to-solve cases. 1 We thank Sam Gross and the National Registry of Exonerations’ staff for providing case files. * Professor, Department of Criminal Justice, Wayne State University. ** Assistant Professor, Department of Criminal Justice, Wayne State University. 941 941 ZALMAN PRODUCTION (DO NOT DELETE) 12/17/2016 4:35 PM 942 Albany Law Review [Vol. 79.3 I. • The War of Souls Volume Two
® THE WAR OF SOULS VOLUME TWO Margaret Weis and Tracy Hickman 1 An Accounting Nightmare o rham Ta rgonne was having a bad day. His accounts would not balance. The diffe r ence in the totals was paltry, a matter of a few steel. He could have made it up with the sp a r e change from his purse. But Tar gonne liked things to be neat, ord e r l y . His rows of figures should add up. There should be no d i s c repancies. Yet here he was. He had the various accounts of moneys coming into the knights’ coffers. He had the various accounts of moneys going out of the knights’ coffers, and there was a diff e rence of twenty-seven steel, fourteen silver, and five coppers. Had it been a major sum, he might have suspected embezzlement. As it was, he was certain that some minor func- tionary had made a simple miscalculation. Tar gonne would have to go back through all the accounts, redo the calculations, track down the error . An uninformed observer, seeing Morham Targonne seated at his desk, his fingers black with ink, his head bent over his accounts, would have said that he was looking on a loyal and dedicated clerk. The uninformed observer would have been wrong. Morham Targonne was the leader of the Dark Knights of 1 DRAGONLANCE The War of Souls Neraka and there b y, since the Dark Knights were in control of several major nations on the continent of Ansalon, Morham Tar- gonne held the power of life and death over millions of people.
