Safety and Rights Society (SRS) has been conducting a yearly survey on workplace deaths since its establishment in 2009 and has been publishing a report based on the survey. It is a pleasure that finally we are publishing the report on 2014’s incidents, which is the fourth in the series since SRS’s initiatives.

The present report includes information on workplace deaths (as well as injuries that took place in the same incident that resulted in the deaths) throughout 2014 by monitoring 26 newspapers (15 national and 11 regional) some of which has been double checked through onsite investigations.

This publication also includes the text of National Occupational Health and Safety Policy 2013 that we hope to be useful for those working in the area of workplace safety and health.

The report includes information only on deaths as a result of workplace activities and does not include details of workers who die from other means (through political protest or house fires etc).

3 About Safety and Rights Society

Safety and Rights Society is a local NGO concerned with improving workplace and work- related safety in Bangladesh, and assisting those injured or at risk of injury, to enforce their rights under the law.

Though Safety and Rights has a particular focus on labour rights, it is also concerned with wider public safety issues involving transport, drugs and other consumer products as well as other wider human rights issues.

Bangladesh Worker Safety Programme

Safety and Rights’s main programme is at present the Bangladesh Worker Safety Programme (BWSP). This programme, started in 2006 by the UK based Centre for Corporate Account- ability, is now run by Safety and Rights.

BWSP aims to improve the health and safety conditions faced by workers in Bangladesh and to ensure that, following a workplace death and injury, dependent families and injured work- ers receive appropriate compensation according to the law. Its focus is particularly on those in the country’s ‘industrial’ and ‘service’ sectors

It works to improve conditions by:

- undertaking research to obtain a better understanding of the occupational health and safety situation in Bangladesh, including the numbers and circumstances of deaths and injuries and the necessary changes in workplace practices - promoting the reform of health and safety legislation in Bangladesh so that it offers ap- propriate protection to workers; - assessing the activities of the Inspectorate of Factories and Establishments and other regulatory bodies with the aim of seeking improvements in how they seek compliance with, and enforcement of the law. - providing information and guidance to employers so that they understand their health and safety obligations and the steps they need to take to fulfill them; - offering health and safety management training to employers; - assisting trade unions in raising health and safety concerns with employers and enforce- ment bodies; - filing strategic public interest litigation in the High Court of Bangladesh with the aim of ensuring that state bodies comply with their constitutional and legal requirements to

4 provide workers with safe and healthy conditions at work

- Working to ensure the effectiveness of National Industrial Health and Safety Council and the implementation of National Health and Safety Policy

It assists dependent families and injured workers gain compensation by

- monitoring national and regional newspapers for reports of workplace deaths - investigating the circumstances of workplace deaths and contacting dependents to de- termine whether they need assistance with compensation (together with BRAC Human Rights and Legal Services Programme) - obtaining information about workplace injuries through research at hospitals - informing employers of their obligation to pay compensation in relation to specific deaths and injuries and filing cases in the Labour Court where necessary (together with BLAST)

6 Chapter-1 Introduction

This report provides details of workplace deaths that took place in Bangladesh in 2014 in the manufacturing, construction, service, agricultural and transport sectors and analyses the incidents by sector, cause, age of the deceased, and location of the incident.

Information about the deaths was obtained by monitoring 15 national papers and 11 regional papers (from the Districts of , , , and .)

Kinds of deaths monitored

This report focuses on deaths of workers at the workplace arising out of issues relating to occupational safety and health and concerned with the management of the work. In this re- port (unlike in our first report), we have tried to collect details of transport workers (drivers or conductors and helpers working in vehicles) who have died in the course of their work. However, the report does not include deaths of workers travelling to or from work as these deaths primarily raise issues of road traffic safety rather than occupational health and safety.

The report also does not include deaths of workers as a result of police, or other kinds of violence or in incidents outside of the workplace – as none of these relate to occupational health and safety issues.

This report focuses on industrial and service sector deaths – but it does include details of certain agricultural deaths (where the newspaper reports clearly indicate a workplace safety issue). Very few agricultural sector deaths are reported in the newspapers.

Deaths at sea are excluded since whilst there are many reports of missing seamen – it is very difficult to know whether these have anything to do with the management of health and safety issues, and in addition, further press reports often fail to indicate whether or not the workers have died or survived.

Accuracy of the Information

The prime source of this information is from monitoring deaths that are reported in national, and some regional, newspapers. Relying on this data creates two problems. The first problem is that newspaper reports almost certainly do not reflect, by a high margin, the actual number of workplace deaths that have taken place.

The second problem concerns the accuracy of the newspaper reports themselves. To what extent, can we be sure that the correct facts about the deaths have been reported in the news-

7 papers? Working with BRAC’s Human Rights and Legal Services, we have investigated 99 cases of the total deaths reported in this year and these show, interestingly, that in the great majority of the cases, the key information contained in the papers was accurate – though it was not unusual for there to be some small errors in the spelling of the names of the de- ceased, the incident address and the circumstances of the death. In a few cases, we found that some deaths were not work-related or the location of the death could not be identified.

Incident 25: 28 Dec 2014, Hobiganj, Transport Death of Kutub Uddin (30) Kutub Uddin, an auto-rickshaw driver, died in a road accident when the auto-rickshaw collided head on with a pickup-van at Jonotar Bazar of Gaznai union of Nobiganj upazila.

Incident 26: 28 Dec 2014, Laksmipur, Construction Death of Md. Shahin Md. Shahin was crushed to death when he was unloading sand from a truck at Panpara in . He was rushed to Laksmipur Sadar Hospital where the duty doctor declared him dead.

Incident 27: 28 Dec 2014, Chittagong, Transport Death of Ohab Ali (50) Ohab Ali, a pickup-van driver, died in a road accident when the pickup-van collided with another vehicle at a bypass road of Sitakunda upazila. He was rushed to CMCH where the duty doctor declared him dead.

38 38 Chapter-3 Analysis of Deaths Newspaper Survey Report on Workplace Deaths January-December of 2014

Background After the devastating fire at Tazreen fashion and building collapse of the Rana Plaza building, ‘workplace safety’ has become an issue discussed extensively. After these incidents, it was hoped that employers, workers and government authorities would take concerted actions to improve workplace safety conditions in Bangladesh.

Unfortunately, however, though there has been no major incident since the Rana Plaza collapse, workers continue to die at an alarming level, though the level appears to be less this year compared to the last four years.

Safety and Rights’ newspaper based survey involving 15 national and 11 regional newspapers showed that this year, 320 workers have died in workplace accidents. in 2013, 376 workers died (excluding the 1134 confirmed Rana Plaza deaths) in 2012, the figure was 378 (excluding the 112 deaths caused by the Tazreen factory fire- 112); in 2011, the figure was 388; in 2010 the figure was 383;

in 2009 the figure it was 265; and in 2008 number it was 320.

These figures are likely of course to be a significant under-estimate of the actual numbers, since most or many workplace deaths are not likely to be reported in newspapers.

Analysis of deaths in first half of 2014 (Jan-June) We have analysed these deaths by looking at the following issues: - the number of deaths and numbers of separate incidents resulting in the deaths; - the district where the death took place; - the sector in which the death took place; - in relation to the manufacturing and services sector, the ‘sub-sector’ in which the death

39 39 took place; - the month of the year when the death took place; - the ages of the workers who died; - the gender of the workers; and - the cause of deaths.

Table 1 shows that in 2014 there was a total of 271 incidents that resulted in 320 deaths.

The table also shows that about 29 percent of the deaths (92) took place in Dhaka district. A sizeable number of deaths are also reported in Chittagong (51), Gazipur (19), Narayanganj (16), Barisal (9), Comilla (9) and Sylhet (8) - a scenario that is very similar to previous years, since these places are also host to a high concentration of SME and large industries.

41 41 Table 3 shows the number of deaths was highest in the Construction sector followed by Service, Manufacturing and Transport sector.

Though the total number of workers involved in manufacturing compared to the construction sector is higher, the number of deaths is higher in the construction sector, suggesting that there are significant risks in this sector.

Table 4 shows that garment/textile (20 deaths), rice mills (10 deaths), steel/re-rolling mill (6 deaths) ceramic (4 deaths), brick field (3 deaths), stone crashing (3 deaths) and ship breaking/ building (3 deaths) were the most common locations for deaths in the manufacturing sector.

Table 5 shows that in the service sector, day labourers suffered the highest number of deaths (28) followed by port workers (7), electricity supplier (5), Shops (5) and small engineering workshops (4). It is significant that this year seven workers died in different ports of Chittagong (4), Mongla (2) and Jessore (1).

Table 7 shows that the age distribution of workers who died in 2014. It is notable that about 47% of the workers who died were 30 years or younger, and most of the worker who died were under 40 year of age.

Table 8 shows that the vast majority of workers who died were male – 306 out of 320. Only 14 female works died in 2014. In percentage terms, about 96% workers who died were male and only 4% were female.

Table 9 shows that the number of deaths in the second quarter (April-June) was the highest (107 deaths) of all the quarters; in the first quarter, 51 workers died; in the third quarter, 81 workers died; and in the fourth quarter it was also 81 workers. The table also shows that the highest number of deaths took place in May (41).

Summary of Findings

- The number of workplace deaths identified was 320 in the year of 2014, which is significantly less than the numbers in the last four years, which were at around 380. - More than 95% of the deaths involved male workers; - The highest percentage of deaths involved workers between 21 and 30 years of age; - The highest number of deaths are in Dhaka district - with Chittagong, Gazipur and Narayanganj having significant numbers; - The highest number of deaths was in the construction sector; - The highest number of manufacturing deaths took place in garments along with rice mills, brickfield and steel/re-rolling mill; - Electrocution, falls from height, building/wall/roof collapse, fire, explosion and suffocation were the most common causes of deaths.
