EX10.4 CITY OF VAUGHAN To construct, reconstruct, erect or place a building or structure on Lot 3, 4, Concession 3, Marita Payne Park, 2 Glen Shields Avenue, in the City of Vaughan, Don River Watershed as located on the property owned by the City of Vaughan. The purpose is to undertake emergency works to replace an existing 12.2m long pedestrian bridge with a similar bridge using the existing abutments. The existing bridge has been deemed unsafe for pedestrian use. A Letter of Advice (LOA) will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO). 53

28 RATIONALE The subject property falls within TRCA’s approved master plan for acquisition for the Rouge River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of the subdivision, TRCA staff established the limits of the open space lands (i.e. Part 1 on 65R-34182) on the Oak Ridges Moraine which is comprised primarily of valleylands. The subject property also contains a tributary to the Little Rouge Creek. This tributary has been identified as potential Redside Dace habitat, a species protected under the Endangered Species Act, 2007. The tributary is also designated as a Hydrologically Significant Feature by the Oak Ridges Moraine Conservation Plan.

TAXES AND MAINTENANCE Based on preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2014 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

RECOMMENDATION

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the Regional Municipality of Peel (Region of Peel) to convey certain lands and a permanent easement for the road widening of Gore Road from Queen Street to Regional Road 50;

AND WHEREAS it is the opinion of TRCA that it is in the best interest of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with the Region of Peel in this instance;

THEREFORE LET IT BE RESOLVED THAT TRCA-owned lands containing 0.70 hectares (1.74 acres), more or less, being Part of Lot 2, Concession 9, Northern Division (Geographic Township of Toronto Gore) designated as Part 7 on Part 43R-34881 be conveyed to the Region of Peel for the widening of Gore Road from Queen Street to Regional Road 50 in the City of Brampton, Regional Municipality of Peel;

THAT a permanent easement containing a total of 0.0017 hectares (0.0044 acres), more or less, be granted to the Region of Peel for hydro pole anchor in connection with the widening of Gore Road from Queen Street to Regional Road 50 in the City of Brampton, Regional Municipality of Peel in the City of Brampton, Regional Municipality of Peel, being Part of Lot 2, Concession 9, Northern Division (Geographic Township of Toronto Gore) designated as Part 8 on Part 43R-34881;

BACKGROUND The Region of Peel’s Long Range Transportation Master Plan identifies widening Gore Road from a two-lane rural road to a four-lane urban road to accommodate the needs of a growing city.

The Region of Peel has requested a land conveyance of 0.70 hectares (1.74 acres) for the widening of Gore Road and a permanent easement of 0.0017 hectares (0.0044 acres) for a hydro pole anchor. Further, the Region of Peel requires approximately 0.0164 hectares (0.040 acres) for a temporary easement during construction.

The subject TRCA-owned lands were expropriated from Christopher J. & Dorothy L.Graham on June 4, 1962 and Victor S. & Gladys A. Creech on December 11, 1963 for the Claireville Dam and Reservoir Project.

Plantings All lands disturbed by construction will be stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material as part of TRCA staff review.

A plan illustrating the land conveyance and permanent easement is attached.

RECOMMENDATION THE EXECUTIVE COMMITTEE RECOMMENDS THAT contract PMO13-04 for the interior and exterior alterations at the Swan Lake Residence (1229 Bethesda Road) be awarded to Berkim Construction Inc. at a total cost not to exceed $1,728,350.00, plus 20% contingency, plus HST, subject to receipt of all necessary approvals, permits and funding, it being the lowest bid meeting Toronto and Region Conservation Authority (TRCA) specifications;

THAT the contract be subject to terms and conditions satisfactory to TRCA staff and, as necessary, solicitor;

THAT should staff be unable to negotiate a mutually acceptable tender agreement with the above-mentioned contractor, staff be authorized to enter into contract negotiations with other contractors, beginning with the next lowest bidder meeting TRCA specifications;

AND FURTHER THAT authorized officials be directed to take the necessary action to implement the contract including the signing and execution of documents;

BACKGROUND On July 31, 2008, TRCA acquired 1229 Bethesda Road (Swan Lake) from Ralph and Linda Hollander. The property consists of a 20.45 hectares (50.54 acres) rectangular shaped parcel of land which includes a two storey, 6,000 square foot, stone exterior finished single family residence, triple detached garage and a nine acre kettle lake, said land being Part of Lot 5, Concession 2, Town of Richmond Hill, Regional Municipality of York.

37 With its close proximity to the Lake St. George Field Centre (LSGFC) and being situated within the Oak Ridges Moraine, the potential uses for the property will meet various TRCA programming and operational needs. Currently, TRCA Education staff has engaged in discussions with potential partnership groups regarding the use of the Swan Lake building and lands for innovative teaching education programs; outdoor and experiential education teacher training; summer camp programs; laboratory schools (learning and application); and training facilities. The addition of TRCA staff resources and volunteers to support these uses will improve outdoor and environmental learning opportunities for elementary, secondary and post-secondary students within the Toronto region. The opportunity to partner with TRCA at Swan Lake, while still being able to access the amenities at LSGFC, will help expand TRCA's user groups and provide much needed outdoor classroom accommodations in the fast-growing community of Richmond Hill.

Presently TRCA's office accommodations at the Boyd Centre is over capacity requiring the use of a portion of the cafeteria as temporary office space. Additional office space at Swan Lake will aid in resolving this situation. The second floor of the building will be renovated for TRCA office space to accommodate 27 staff from Stewardship and Outreach Education and Education Services. This new office space will reduce crowding at a number of other TRCA office locations and allow for improved community/educational programming in this part of TRCA's jurisdiction. Two large meeting spaces will be made available and will provide new collaboration space for use by TRCA staff, as well as TRCA's wide range of public and private sector partners, and address increasing demand for meeting space at TRCA's other office locations and facilities, including Lake St. George Field Centre. The Centre for Innovation in Conservation will allow TRCA and partner organizations to access a unique environment away from the normal distractions of office meeting rooms and seek innovative, collaborative solutions to key challenges related to conservation and city building.

In order to provide the accommodations and services required to carry-out these ventures, TRCA is proposing to conduct a complete building retrofit and renovation as part of a building change of use from its current single family residence to an educational classroom/training and office facility. The building will meet Ontario Building Code (OBC) requirements through upgrades, renovations and repairs to the building envelope (interior and exterior) and its operational systems due to its increase in occupancy. The major retrofit items include roof deficiencies (chimneys); windows and doors; safety features such as fire protection, emergency access routes; barrier free accessibility (washrooms); parking spaces; HVAC and septic systems; and broadband infrastructure.

As part of the Swan Lake Residence retrofit, TRCA engaged MC Architects to lead a team of engineers to undertake a facility assessment and conceptual redesign of the Swan Lake Residence. The purpose of the assessment and design was to provide a framework for major renovations and system retrofits that meet OBC requirements for architectural, mechanical, structural and electrical upgrades to re-purpose this building from its historic residential usage to one that meets the current and future needs of TRCA. As part of these works, a magnitude of costs for the project was developed during the design development phase that determined a value of approximately $1.6 million for the proposed construction activities. At Authority Meeting #3/13, held on April 26, 2013, Resolution #A60/13 approved the renovation and retrofit of the Swan Lake residence and entering into an agreement with the York Region District School Board (YRDSB) and YMCA of Greater Toronto for the use of a portion of the building for the Swan Lake Outdoor Education Centre.

38 RATIONALE Request for Pre-Qualification (RFPQ) for general contractors was advertised on-line with biddingo.com on April 10, 2013 and closed on April 24, 2013. The work includes, but is not necessarily limited to, the supply of labour, material, supervision and equipment to perform the prescribed scope of work. The general contractor will coordinate all construction activities to facilitate this change in use.

General contractors interested in pre-qualifying were advised of the criteria for evaluation, including:  completeness of submission;  past experience in the renovation of older buildings of similar size;  past experience with the proposed scope of work;  ability to meet construction schedule milestones;  ability to coordinate work by others; and  experience dealing with projects with construction budgets in the range of $1 to $2 million.

Bidders were required to submit a bid bond of 10% of the contract price at the time of the tender submission.

The pre-qualifying documents were reviewed by the selection committee made up of TRCA staff that have extensive backgrounds in new building and retrofit construction projects. The proposals were evaluated using the following criteria being met in order to receive a tender package:  CCDC 11 (Canadian Construction Documents Committee) Contractor's Qualification Statement;  company experience and background in similar works;  experience of suggested personnel for this project;  project record over the past five years; and  references focusing on firms history of project control and experience.

Based on the evaluation process, tender documents were made available to the following nine general contractors:  Ameresco Canada Inc.;  Berkim Construction Inc.;  P&C General Contracting;  Pre-Eng Construction Ltd.;  Silver Birch Contracting Ltd.;  Steelcore Construction Ltd.;  Struct-Con Construction Ltd.;  Vema Corp; and  W.S. Morgan Construction Ltd.

All but one of the pre-qualified companies attended a mandatory site meeting on May 14, 2013.

39 Tenders closed on May 23, 2013 and were opened by the Tender Opening Committee at the May 24, 2013 Authority Meeting with the following results:

Having previously pre-qualified the bidders, TRCA staff evaluated the tenders on the bid prices and the ability to complete the project within the specified construction window. The bids prices came in higher than the previously approved amount of $1.6 million. This was partially due to OBC requirements for fire access routes and new hydro services being revised during the late stages of the design phase and was not fully accounted for in the initial estimate. As opposed to new building construction, building retrofits of this magnitude can have unforeseen construction issues in meeting OBC requirements. Further, after analyzing the bid prices and conferring with bidders it was determined that the current construction market is very active with many construction projects being tendered for this summer. Having the three lowest bids being separated within approximately $70,000 of each other, staff is confident that the bids are still very competitive. Based on this evaluation, staff recommends that Contract PMO13-04 be awarded to Berkim Construction Inc. for the total cost not to exceed $1,728,350.00, plus a 20% contingency, plus HST, as they are the lowest bidder that meets TRCA specifications.

FINANCIAL DETAILS Funds are available within TRCA's Major Facilities Retrofit budget from TRCA's municipal funding partners in account #006-35 with approximately $360,000 being contributed by YRDSB and YMCA for development of the outdoor education centre.

General operating costs, including heat, hydro, grounds maintenance and IT services are estimated at $150,000 annually with $35,000 being recovered through shared cost arrangements with the YRDSB and YMCA and the remaining operating costs being available in future operating budgets from TRCA's municipal funding partners.

RECOMMENDATION

THAT Toronto and Region Conservation Authority (TRCA) execute the 2013 work plan agreement with the Greater Toronto Chapter of the Canada Green Building Council (CaGBC) to December 31, 2013;

THAT TRCA continue to work with the Greater Toronto Chapter to deliver the initiatives in accordance with the signed Memorandum of Understanding with the Canada Green Building Council;

AND FURTHER THAT authorized TRCA officials be directed to take the action necessary to implement the agreement.

BACKGROUND As a founding partner of the CaGBC, TRCA has worked closely with the CaGBC on several initiatives since the Council was first established in 2003. The Council's mission is to "lead and accelerate the transformation to high-performing, healthy green buildings, homes and communities throughout Canada." TRCA has provided ongoing support in their work towards this mission, which is well-aligned with TRCA's vision for The Living City.

The Authority first formalized this relationship by approving the establishment of a Memorandum of Understanding (MOU) between TRCA and CaGBC. By entering into the MOU, TRCA agreed to work in partnership with CaGBC on various initiatives focused on increasing the uptake of green building practices and promoting sustainable community development in the GTA. At Authority Meeting #3/10, held on April 30, 2010, Resolution #A54/10 was approved as follows:

THAT Toronto and Region Conservation Authority enter into a Memorandum of Understanding with the Canada Green Building Council.

The purpose of the MOU was to formalize the working relationship between the two organizations and to establish priorities. Among the many roles and responsibilities outlined in the MOU, was the condition for TRCA to support and advocate for local funding opportunities and to work closely with the Greater Toronto Chapter (GTC). In 2010, 2011 and 2012, TRCA and GTC developed and executed annual work plan agreements which identified key activities and initiatives to be completed in each calendar year.

41 At Executive Meeting #4/12, held on June 1, 2012, approval was granted for TRCA to carry-out the annual work plan agreement with the GTC. Resolution #B75/12 was approved as follows:

THAT Toronto and Region Conservation Authority (TRCA) continue its existing agreement with the Greater Toronto Chapter of the Canada Green Building Council (CaGBC) to December 31, 2012;

THAT TRCA continue to work with the Greater Toronto Chapter to deliver the initiatives in accordance with the signed Memorandum of Understanding (MOU) with the Canada Green Building Council (CaGBC);

AND FURTHER THAT authorized TRCA officials be directed to take the action necessary to implement the agreement.

RATIONALE The following is a list of initiatives that will be completed in 2013, in part, with the grant provided by TRCA to the Chapter.

1. Municipal Engagement and Knowledge Sharing

Municipal Leaders Forum Ontario Green Policy Hub The Municipal Leaders Forum (MLF) brings together municipal leaders in the southern Ontario region (including Peel Region and the City of Toronto) to share knowledge on green building policy and practice issues at the municipal level. With the support of TRCA and the Ontario Power Authority (OPA), MLF created and launched the Ontario Green Policy Hub (OGPH), an online searchable resource of the most innovative and best policy practices that promote and develop sustainable built environments by Ontario municipalities.

Successfully launched in 2012, the OGPH requires ongoing resources for its operation and maintenance in order to stay current and relevant.

2. Strengthening Green Building Knowledge and Awareness

The Greater Toronto Chapter’s principal goal is to serve the needs of its members and supporting organizations. In meeting this goal, the Chapter strives to deliver value in a variety of formats that include large annual events and smaller education events.

In 2013 the Chapter will deliver:

Annual Events Four large scale Chapter events (150-200 attendees), whose focus is on networking/awareness amongst the green building community.

Events will include:  Spring Open – a celebration of green buildings and launch of Green Doors Open (part of Doors Open Ontario).  Summer BBQ – to be held in a location with green building features that will allow for the incorporation of tours and discussion of the building’s special green features.  September Boat Cruise – waterfront cruise offers both networking and an education opportunity with regard to waterfront developments.

42  Fall Legacy Gala – includes new awards program recognizing innovation in LEED (Leadership in Energy and Environmental Design) projects across southern Ontario.

Education Events  National Workshops (13 events) – the Chapter is now responsible for the entire administration and delivery of national workshops requiring additional administrative, operational and marketing resources.  Chapter Education:  LEED Breakfast Series: the Chapter has created a new LEED Breakfast Series (4) starting in April of 2013. This series is focused primarily on issues related to LEED and is designed to engage and inform building owners, operators and managers.  Educational Outreach: expanding Chapter partnerships within the GTA and across southern Ontario.  Webinars: the Chapter is setting up regular webinars on green building topics of interest for our Chapter Members and network. This new program requires content development and administrative support; especially as we redevelop our website to allow attendees to pay for and access recordings (Chapter Members will be able to access recordings for free). Topics may include: LEED Canada for Neighbourhood Development, Construction Waste Management and introductions to green building and LEED accreditation.

As the Chapter strives to increase its educational capacity, TRCA funding will go toward the creation, coordination, marketing and delivery of these events, including content development and market research.

Additional Green Initiatives

Green Doors Open The goal of Green Doors Open is to promote awareness of specific green buildings in communities across Ontario and engage the public in the impact of green buildings and the benefits they provide. This in turn supports the goal of increasing the proportion of buildings in Ontario that integrate green energy, energy and water conservation actions, and other green features.

This initiative requires the following support:  an intern dedicated to the project;  ongoing maintenance of an online interactive map showcasing green building projects and partners;  incorporation of Green Doors Open into the Ontario Doors Open website;  an increase in the inclusion of green buildings into Doors Open tours across Ontario for 2013.

Thank You Campaign Launched in 2012, the Thank You Campaign is designed to applaud the efforts of individuals and organizations that have made a contribution to the sustainable built environment, and connect the Chapter to organizations that are making a difference. By sending out emailed and printed “Thank You” cards, GTC will acknowledge individuals and companies for achieving their LEED credential or building green and welcome them to both our network and the Chapter. It is anticipated that the Chapter will achieve a number of objectives through the development and implementation of this campaign: 43  opening of conversations between individuals and the Chapter on green mandates;  increase brand identity;  increase sponsor exposure.

LEED Innovation Awards Currently in the research and development stage, the LEED Innovation Awards are designed to celebrate LEED certified projects that demonstrate an exceptional level of innovation and creativity.

3. Toronto Focus (SAB Magazine supplement)

Toronto Focus In 2013, the Chapter will produce the 5th and 6th editions of their Toronto Focus supplement through SAB Magazine, the Chapter’s primary publication. In this initiative, we engage sponsors, members and community at large to produce a 16 – 32 page supplement that includes green building features and success stories from Toronto and the surrounding region.

TRCA funding will go to supporting staff and funding a part-time intern to manage the writing and coordination of content, sponsorship promotions, advertisements, web-compatibility and distribution.

FINANCIAL DETAILS TRCA will provide financial support to the Greater Toronto Chapter of the CaGBC in the form of a $55,000 grant. These funds are available in account 415-89, provided by the City of Toronto and Region of Peel.

RECOMMENDATION

THAT Contract RSD13-053 for the supply and delivery of approximately 1,690 tonnes of 2-4 tonne stackable armourstone to the Mud Creek Reach 5 Project in the City of Toronto, be awarded to TBG Landscape Inc. for a total unit price of $53.00 per tonne and a total cost not to exceed $89,570.00, plus a contingency of 25% to be expended as authorized by Toronto and Region Conservation Authority (TRCA) staff, plus HST, it being the lowest bidder meeting TRCA specifications;

THAT should TRCA be unable to achieve an acceptable contract with the awarded supplier, staff be authorized to enter into and conclude contract negotiations with the other suppliers that submitted quotations, beginning with the next lowest bidder meeting TRCA specifications;

AND FURTHER THAT authorized TRCA officials be directed to take all necessary actions to implement the foregoing, including the signing and execution of any documents.

BACKGROUND Mud Creek, a tributary of the Don River, is sourced from two separate storm sewer systems south of Moore Avenue. Separated by a berm, Mud Creek continues along the western edge of the before entering a storm sewer, where it drains into the Don River.

The City of Toronto and TRCA have been concerned with the erosion issues affecting Mud Creek for several years. In 2010, a geomorphic assessment of Mud Creek was commissioned by titled Mud Creek Geomorphic Systems Master Plan . Mud Creek was divided into six reaches, each separated by culverts where the creek has been piped underground to accommodate development.

In the winter of 2012 TRCA implemented restoration works at the highest priority area, Reach 1, located at the most downstream limits of the creek adjacent to Evergreen at the Brick Works, using the design recommendations from the aforementioned Master Plan and funding from its 2012 erosion capital budget. Following the success of this project, Toronto Water and Parks, Forestry & Recreation (PF&R) staff asked TRCA to implement restoration works on behalf of the City of Toronto at additional priority areas, the next planned area being Reach 5, which commenced construction in March 2013.

45 The 2-4 tonne stackable armourstone will be used in the construction of the retaining walls and weirs at Reach 5.

Staff inspected stone from Natural Stone Source Ontario, where the available material was of incorrect size and not stackable. An inspection of the product from B-Town Group revealed the size of the stone did not meet specifications and the inspection of product from Limestone & Forestry Products quarry revealed that the stone was cracked and of the incorrect density. Material inspected at the quarry for the fourth lowest bidder, TBG Landscape Inc., was found to meet the specifications in the contract drawings.

46 Based on the bids received and subsequent material inspections, staff recommend that TBG Landscape Inc. be awarded Contract RSD13-053 for the supply and delivery of approximately 1,690 tonnes of 2-4 tonne stackable armourstone for the unit cost of $53.00 per tonne and a total cost not to exceed $89,570.00, plus HST. Contract is subject to a 25% contingency to be expended as authorized by TRCA staff.

The access ramp and shoring system will facilitate the construction of an 18 storey residential tower and 6 levels of underground parking to be constructed on the adjacent property to the west municipally known as 160 Vanderhoof Avenue (Permit # 0201/13/TOR) . The valley slope to be excavated is part of a former municipal landfill site owned by TRCA and managed by the City of Toronto. The subject lands are located west of Leslie Street and south of Eglinton Avenue East.

Control of Flooding: Not applicable

Pollution: Appropriate sediment controls will be installed and maintained throughout all phases of construction.

Proposal: The emergency works proposal is to remove an existing 12.2m long pedestrian bridge that has been deemed unsafe for pedestrian use. It will be removed in one piece by a crane. A new pre-constructed 12.2m long pedestrian bridge will be brought in along an existing pedestrian path. A crane will place the new pedestrian bridge onto the existing footings. No in water works are required. Works are anticipated to take one day. This application seeks to formalize works that have already been approved through the Emergency Works Process. The works were classified as "Emergency Works" because the pedestrian bridge presented an immediate hazard to public safety, and as such, represents a threat of injury to persons, loss of life or loss of property (Conservation Authorities Act ).

Control of Flooding: The proposed bridge will be very similar to the new bridge. No impacts to the storage or conveyance of flood waters are anticipated.

Pollution: Standard erosion and sediment control measures, including silt fencing, will be implemented prior to construction and maintained for the duration of construction, and until the site is stabilized and restored, in order to prevent construction generated sediments from entering the watercourse. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction .

Dynamic Beaches: Not applicable

The purpose is to construct a new 3.5m wide asphalt multi-use pathway within the existing Hydro One corridor north of Finch Avenue East, from Yonge Street to Maxome Drive and Conacher Drive to Pineway Boulevard. No in-water works are associated with this project.

The permit will be issued for the period of October 4, 2013 to October 3, 2015.

The documents and plans which form part of this permit will be listed in a separate report 55 RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The City of Toronto is proposing to construct an asphalt pathway in the Hydro One corridor within a Regulated Area of the Don River Watershed, north of Finch Avenue East, from Bayview Avenue to Pineway Boulevard. The trail is being completed as part of the City of Toronto's Multi-Use Trail Master plan, with the intention of developing a continuos east west trail system. A new watercourse crossing will be constructed immediately east of Maxome Drive under a separate permit. In order to construct the trail 400mm of soil is to be removed and replaced with a 350mm granular base topped with 90mm of asphalt. The edge of the path is to be regraded and sodded. The trail will be constructed primarily at grade, with some culverts located at various low points in the trail to direct surface flows. The proposed alignment will cross the East Don River via an existing bridge structure. Vegetation removals will be required to accommodate the proposed alignment. Vegetation protection and erosion and sediment controls will be installed prior to the commencement of construction. Works are anticipated to be completed during the 2013.

Control of Flooding: The proposed is not anticipated to impact flooding, flood storage or the conveyance of flood waters.

Pollution: Erosion and sediment control measures (silt fence) will be installed prior to construction and maintained for its duration. These measures are being implemented to prevent the release of construction generated sediment into the East Don River. Erosion and sediment control measures have been provided in accordance with TRCA's Erosion and Sediment Control Guideline for Urban Construction (2006).

Dynamic Beaches: Not applicable

Erosion: There are no impacts identified to slope stability or erosion as a result of these works.

Conservation of Land: No in-water works are within the scope of this project.

Plantings Vegetation removals and protection measures are to be completed to the satisfaction of City of Toronto Urban Forestry. All disturbed areas will be restored with non-invasive species to pre-construction conditions or better, upon completion of work.

Policy Guidelines: This proposal complies with Section 4.1.2, New Resource-based Uses, of the TRCA’s Valley and Stream Corridor Management Program.

TOWN OF RICHMOND HILL

EX10.6 SANMIKE CONSTRUCTION LIMITED To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 25, EYS Block 24, Plan 65M-3230, (10665 Bayview Avenue), in the Town of Richmond Hill, Rouge River Watershed as located on the property owned by Sanmike Construction Limited. The purpose is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order facilitate the construction of a 200mm sanitary forcemain associated with a 67-unit townhouse development in the Town of Richmond Hill.

The permit will be issued for the period of June 7, 2013 to June 6, 2015.

RATIONALE The application was reviewed by staff on the basis of the following information:

57 Proposal: The purpose of this application is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order facilitate the construction of a temporary 200mm sanitary forcemain associated with a 67-unit townhouse development in the Town of Richmond Hill. The associated development has been approved by the Ontario Municipal Board (OMB). The proposed works are associated with the construction of the adjacent townhouse development and outfall structure, which were approved by the Executive Committee on May 10, 2013 (CFN 48802, 48804). The temporary forcemain will be installed via trenchless, horizontal drilling, 2.5 metres under a tributary of the Rouge River Watershed south of the proposed development. The servicing scheme for this site involves the current proposal for the construction of the temporary forcemain to Claret Court south of the site and the permanent construction of a sanitary forcemain east of the site as per the approved master servicing scheme for this area. As part of the master servicing scheme, the existing Bayview Avenue waste water collection station on the west side of Bayview Avenue is proposed to be decommissioned by the Town in the future. Once decommissioned, its flows will be directed easterly across the subject lands through the permanent forcemain. The temporary forcemain will service the subject lands and lands immediately to the north until such time that the permanent forcemain and pumping station are constructed by the Town of Richmond Hill on the east portion of the site across Town-owned lands. No impacts to the tributary are anticipated as a result of the proposed construction, however, a mitigation procedure is in place in the event of a frac-out. Based on this trenchless method of construction, there are no geotechnical, ecology, or flooding related concerns with the proposed forcemain. All works will be conducted within the Redside dace fisheries timing window of July 1 to September 15 of any given year. Although there are no fisheries related concerns associated with the proposed forcemain, a Letter of Advice (LOA) on behalf of Fisheries and Oceans Canada (DFO) will be issued with this permit. A temporary easement is required over the forcemain as it will run underneath TRCA-owned land. The granting of the easement is also being considered at the Executive Committee. Once the permanent forcemain is constructed and operational, the temporary forcemain will be decommissioned and restored to the satisfaction of TRCA staff. In addition, an overall restoration plan has been submitted for the valley lands associated with these works and the townhouse development.

The proposed addition is located within a partially paved, partially manicured landscaped area devoid of any vegetation and is surrounded on two sides by the existing building.

76 The addition will be flood proofed to the Regional Storm Elevation plus 0.44 metres (above the typically required 0.3 metre freeboard). Through the Draft Plan of Subdivision for the area (19T-02V12 - Marchesan Subdivision / Seven on the Ridge), the top-of-slope of the valley wall was determined and an appropriate buffer was applied. The buffer was placed into public ownership (TRCA). In addition, a 7.5 metre wide Conservation Easement was placed on the subject property as part of the Draft Plan of Subdivision.

The proposed works are located outside of the Conservation Easement and are located approximately 9 metres away from the top-of-slope. TRCA staff are satisfied that the proposed works are adequately setback from the valley wall and will not have an adverse impact on the valley wall's stability.

Based upon a site visit conducted by TRCA staff July 22, 2010, the subject property contains an approximate 3.5 Horizontal : 1 Vertical slope which continues past the rear property line. The proposed works will be located a minimum 5 metres from the top-of-slope at its closest point. The area of the proposed works is currently devoid of any significant vegetation and is generally flat. TRCA geotechnical staff are satisfied that the proposed works are adequately set back from the top-of-slope.

This permit is identical to a previously issued permit (Permit No. C-10787, issued September 10, 2010). A new permit is required as these works have not yet been completed and the previous permit expired on September 9, 2012.

81 Proposal: The Owner seeks permission to construct a two storey 188 m2 (2025 square feet) residential dwelling on a lot that is partially within a flood spill area associated with Carruthers Creek. The subject lands are located within the Pickering Beach residential community of the Town of Ajax. Pickering Beach is located to the west of the Carruthers Creek and north of the Lake Ontario shoreline. For a portion of the Pickering Beach neighbourhood, the Regional Storm Flood Plain associated with Carruthers Creek is not contained within the creek valleylands but rather spills into the urban area following a low portion of land in an north-south orientation meeting Lake Ontario separately from the main body of the flood plain. The proposed dwelling will replace an existing residential structure on the same lot and is to be located slightly to the north of the existing residence.

Control of Flooding: All openings on the proposed replacement dwelling have been elevated above the Regional Storm Flood Plain elevation on the lot to ensure flood protection of the dwelling. The removal of the existing dwelling and replacement slightly to the north will have a negligible impact to the control of flooding. TRCA water resource engineering staff have carefully reviewed the application to ensure that there will be no changes to the location and characteristics of the flood plain area on any other private properties as a result of this proposal. The frontage and amenity areas of the lot will remain in the flood plain.

Pollution: The subject lands are located in an urban area and are not adjacent to any natural areas. Accordingly, there are no concerns associated with pollution.

The subject site is located east of Woodbine Avenue and north of Bethesda Road in the Town of Whitchurch-Stouffville. The property is on the Oak Ridges Moraine, within a wetland area of interference, and in proximity to an Area of Natural and Scientific Interest and a Provincially Significant Wetland. This site is a vacant residential lot of record, established many years ago and prior to the adoption of the provincial Oak Ridges Moraine Conservation Plan and TRCA's current development regulation.

Control of Flooding: The site is not within a regional storm floodplain and the proposal will have no impact on the storage and/or conveyance of floodwaters.

Pollution: Appropriate erosion and sediment controls will be installed and maintained throughout all phases of construction.

Erosion: This proposal was previously reviewed as part of a Concept Development Application. During this review process, TRCA staff staked the Top of Bank on August 10, 2012. Further to this, a geotechnical slope stability report has been reviewed and approved by TRCA geotechnical staff. The proposal will be constructed in consideration of the staked Top of Bank and in accordance with the recommendations the geotechnical report.

99 Conservation of Land: At the request of TRCA, the applicant has submitted a Natural Heritage Evaluation which assisted in determining the optional location and appropriate mitigation measures necessary to accommodate the new development reducing impacts to the natural features or the Moraine to the greatest extent possible. The subject property is partially within the valley corridor of a tributary of the East Humber River and partially within a Wetland Area of Interference. Based upon a site visit conducted by TRCA staff on September 28, 2012, the property is very gently sloped (nearly flat) and there is no discernible top-of-slope for this portion of the valley wall. In addition, the subject property is only lightly vegetated along the property boundary. The proposed addition is primarily located over the footprint of the existing attached garage and the deck extension is located within a generally flat, sodded area. All of the proposed works are located outside of the Wetland Area of Interference and no grading works are proposed.

Control of Flooding: The subject property is not located within the Regional Storm Flood Plain. There will be no impacts on the storage or conveyance of flood waters.

Pollution: Sediment control fencing will be erected and maintained for the duration of construction to prevent the transport of sediment into the nearby valley lands.

Proposal: The purpose is to conduct minor grading and landscaping works within a Regulated Area of the Humber River watershed. A watercourse is located along the rear of the subject property and a large portion of the property is within the Estimated Regional Storm Flood Plain of the watercourse. The Estimated Regional Storm Elevation for the property is 257.63 metres above sea level (m.a.s.l.). Based upon a topographical survey provided by the applicant, the existing openings to the dwelling's basement level are at 256.39 m.a.s.l. As such, the existing dwelling is not flood proofed to the Estimated Regional Storm Flood Elevation.

The proposed grading works and landscape works include the construction of a sunken patio area and low retaining walls at the rear of the existing dwelling. The proposed change in grade (approximately 0.5 metres lower) will have no impacts on the storage or conveyance of flood waters and will not increase the risk to the dwelling as the structure is already flood prone and the basement entrance elevations are not being altered. Marigold Creek, a tributary of the Humber River, traverses the subject property. Development limits on the site were previously established in consultation with the TRCA through Official Plan Amendment Application OP.06.002 and Zoning By-law Amendment Application Z.06.005. A permit was also previously approved by the TRCA's Executive Committee on July 9, 2010 to facilitate the realignment and enhancement of the watercourse on the site (Permit No. C-10863, reissued on July 9, 2012 as Permit No. C-120133R).

The current permit will facilitate topsoil stripping within the building envelope and the installation of various erosion and sediment control measures to protect the adjacent natural features. The owner has opted to submit a permit application for these topsoil stripping works in advance of finalizing details for the proposed condominium building and amenity areas, which are subject to Site Plan approval by the City of Vaughan and permit approval by the TRCA.

It should also be noted that only a portion of the topsoil stripping activity is regulated by the TRCA. The owner requires approval from the City of Vaughan for those portions of the site not within the TRCA's Regulated Area.

Proposal: The purpose is to conduct operations to remove sediment from Stormwater Management (SWM) Pond 2, in Planning Block 11, in the City of Vaughan. Planning Block 11 is bound by Dufferin Street to the west, Major Mackenzie to the north, Bathurst Street to the east and Rutherford Road to the south. The SWM pond is located within the Bathurst Lindvest residential subdivision (19T-04V05) and outlets to a tributary of the East Don River.

The construction of SWM Pond 2 and its outfall was previously approved by the Executive Committee on May 6, 2005(Permit No. C-05395). The current proposal involves the removal of sediment that has accumulated within the SWM pond since its initial construction. These works are required prior to assumption of SWM Pond 2 by the City of Vaughan.

The works will involve the installation of sediment and erosion controls around the work area. The water levels within the SWM pond will then be lowered and discharged to the adjacent watercourse in a controlled manner to ensure there are no impacts to the natural feature. The sediments from the pond will then be removed and will be legally disposed of off-site. The proposed works are anticipated to take a few weeks, depending on weather conditions.

Proposal: The purpose is to conduct grading works and construct an addition to an existing dwelling within a Regulated Area of the Humber River watershed. The already developed portion of the property is located on a flat tableland peninsula within the valley corridor of a tributary of the East Humber River, the remainder of the property is located along the valley wall. Based upon a site visit conducted by TRCA staff on March 5, 2013, the valley walls surrounding the developed area are relatively steep (approximately 2 horizontal : 1 vertical) and well vegetated.

The proposed main addition includes a new basement area below an at grade open patio area with a cantilevered second storey area above. This addition is located on a flat tableland area which is currently in an already disturbed manicured condition. The proposal does not involve any further encroachment towards the surrounding valley walls over existing conditions and does not result in the removal of any significant vegetation. A second addition is proposed within the footprint and envelope of the existing dwelling through the conversion of a two storey high cathedral ceiling area to an actual two storey floor plan.

TRCA Geotechnical Staff are satisfied that the proposed works are adequately setback from the top-of-slope and will not have an adverse impact on the valley wall.

Control of Flooding: The subject property is not located within the Regional Storm Flood Plain. There will be no impacts on the storage or conveyance of flood waters.

116 Proposal: The Owner seeks permission to undertake works within the Regulated Area associated with Millers Creek in order to construct a residential town house development. The 2.2 hectare (5.4 acre) site is located at the southeast corner of Harwood Avenue and Taunton Road in the urban fringe of the Town of Ajax. A tributary of the Millers Creek flows under the intersection of Harwood Avenue and Taunton Road in a northeast to southwest orientation. A 30m (98.4 ft.) long portion of the creek corridor abuts the development site along with an existing Town of Ajax built recreational trail. To the east of the site is the CP Rail corridor. The site is currently undeveloped and contains a portion of the Regional Storm Flood Plain associated with the Millers Creek tributary. A servicing connection on the west side of Harwood Avenue is also proposed as part of this permit proposal in order to connect the site to municipal services (water and sewage).

Control of Flooding: In order to accommodate the proposed development concept on this site, the Regional Storm Flood Plain associated with the Millers Creek tributary needed to be contained within a corridor composed of the creek, the creek bank and a 10 metre (33 ft) corridor buffer, which includes the recreational trail. This is to be accomplished through site grading design, which will raise the northerly portion of the site adjacent to the corridor above the Regional Storm Flood Plain elevation. A flood plain management report was submitted to TRCA staff in support of the application and has been found to be acceptable following careful review by water resource engineering staff. In terms of stormwater management, Low Impact Development stormwater measures have been incorporated into the plan in order to retain and infiltrate smaller storms on site thereby reducing stormwater volumes that are discharged off-site into the municipal sewer system and ultimately the Duffins Creek watershed.

Pollution: Detailed sediment and erosion control plans have been prepared and submitted in support of the application. The plans, which have been reviewed and found to be acceptable, will isolate the development site from the adjacent creek corridor and will manage storm water on site during construction.

Dynamic Beaches: Not applicable

Erosion: There are no geotechnical or slope stability concerns associated with this proposal.

Conservation of Land: The development proposal will establish a clear creek corridor for the Millers Creek tributary along the 30m (98.4 ft) portion that abuts the site and will provide for a 10 m (33 ft) environmental buffer for the trail and restoration purposes.

118 Proposal: The purpose of this proposal is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the placement of approximately 3,700 cubic metres (approximately 370 truck loads) of topsoil at 4085 King Street, in the Town of Caledon. The proposed works aim to maintain the viability of the farm practice and improve the productivity of existing cash crop operations. Recent works along King Street involved the removal of a culvert that previously provided drainage to a nearby wetland complex. As such, the agricultural lands in this area are often saturated from rain and localized runoff resulting in low crop yield. The proposed fill activity will result in drainage being redirected to the existing road side ditch along the south side of King Street, which is the historic drainage pattern for this area and reduce soil saturation. The area to which this application applies is currently used for farm activity and is void of any significant natural features. Also, the proposed works are located outside of the Regional Floodplain.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose of this application is to facilitate the installation of a 0.6 metre storm sewer associated with a municipal site plan application for the construction of a two storey addition to an existing private school on the subject property. The western boundary of the property abuts a tributary of the Rouge River Watershed. The proposed addition is located on an existing parking lot on tableland, outside of the TRCA's Regulated portion of the property. The proposed stormsewer is located on tableland and sufficiently setback from the top of bank, which is associated with the valley corridor on the western portion of the site. There are no geotechnical, flooding or ecology concerns with this application. Although there are no ecology concerns with this application, a planting plan is provided in order to achieve a net ecological gain with this application.

Control of Flooding: The proposed works are located outside of the Regional Storm Floodplain. As such, no impacts to the storage and/or conveyance of flood waters are anticipated.

Pollution: Appropriate erosion and sediment controls will be installed and maintained throughout all phases of construction.

Dynamic Beaches: Not applicable.

Erosion: There are no geotechnical and/or slope stability concerns anticipated with this application.

The proposed works are located on an existing parking lot and are within the Regional Floodplain associated with , a tributary of the Don River Watershed. The proposed works will be appropriately floodproofed in accordance with TRCA criteria. As such, there are no flooding concerns with this application. In addition, there are no geotechnical or ecology related concerns with this application.

Control of Flooding: The proposed works are located within the Regional Storm Floodplain, however, TRCA staff has confirmed that the proposed works will not impact the storage and/or conveyance of flood waters.

Proposal: The Owner seeks permission in order to undertake grading, filling and landscaping in order to establish the appropriate grades and permanent valley corridor adjacent to the Stouffville Creek corridor. The 11.9 hectare (29.4 acre) subject lands are located in the northeast quadrant of the Community of Stouffville, west of Tenth Line and north of Main Street in the Town of Whitchurch-Stouffville. This portion of the community is currently urbanizing in accordance with the approved Community of Stouffville Secondary Plan and Northeast Quadrant Functional Servicing Study (FSS). The FSS provides for the protection of a Greenlands System composed of the wooded Stouffville Creek corridor on the western edge of the site. This proposal will define the western edge of a the Stouffville Creek Greenlands and will include a trail head and landscaped slope.

Control of Flooding: No works associated with this proposal are located within the Regional Storm Flood Plain. Accordingly the control of flooding is not affected.

125 Pollution: Detailed sediment and erosion plans have been submitted in support of this proposal, which will isolate the work are from the creek corridor.

The 12.3 hectare (30.4 acre) subject lands are located in the northwest quadrant of the Community of Stouffville, west of Ninth Line and north of Main Street in the Town of Whitchurch-Stouffville. This portion of the community is currently urbanizing in accordance with the approved Community of Stouffville Secondary Plan and Northwest Quadrant Functional Servicing Study (FSS). The FSS provides for a 100m (328 ft.) wide Greenlands System corridor to encompass the Little Rouge Creek corridor. This proposal will define the eastern edge of a portion of this corridor on the site and will include a trail head and landscaped slope.

Control of Flooding: All filling will be located outside of the Regional Storm Flood Plain. Minor grading to establish the recreational trail in the valley and restoration landscaping will take place along portions of the flood plain fringe. Accordingly, there are no impacts to the control and storage of flood waters.

Pollution: Detailed sediment and erosion plans have been submitted in support of this proposal, which will isolate the work are from the creek corridor.

The purpose is to conduct minor grading works and construct an inground pool, small outbuilding and deck area within a Regulated Area of the Humber River watershed at 13300 11th Concession in the Township of King.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose is to conduct minor grading works and construct an inground pool, small outbuilding and deck area within a Regulated Area of the Humber River watershed. The majority of the subject property is located within the valley corridor of Cold Creek East. The property is used by the YMCA as a day and night camp for youth.

The proposed works are located on a tableland peninsula along the edge of the valley system. The area formerly contained 3 yurts and is generally flat. Based upon a site visit conducted by TRCA staff on May 6, 2013, the surroundings slopes are relatively well vegetated and have a slope configuration of 3.5 horizontal : 1 vertical or gentler.

The proposed minor grading works consist of slightly lowering the tableland grades (maximum 0.2 metres change) in order to create a more level area to accommodate the pool and deck. The proposed pool is located a minimum 6.0 metres away from the top-of-slope. The proposed outbuilding is located approximately 3.0 metres from the top-of-slope of a very gently slope side of the peninsula (approximately slope configuration of 4 horizontal : 1 vertical or gentler). All of the proposed works are located within an already disturbed area devoid of significant vegetation and no vegetation removals are required to accommodate the development.

TRCA Geotechnical staff are satisfied that all of the proposed works are adequately setback from the top-of-slope and will have no impacts on the stability of the valley wall.

Control of Flooding: The proposed works are not located within the Regional Storm Flood Plain. There will be no impacts on the storage or conveyance of flood waters.

Pollution: Sediment control fencing will be erected and maintained for the duration of construction to prevent the transport of sediment in to the adjacent valley lands.

Dynamic Beaches: Not applicable.

Erosion: TRCA Geotechnical staff are satisfied that the proposed works are adequately setback from the top-of-slope and will not have an adverse impact on the stability of the valley wall.

Conservation of Land: As a watercourse will not be impacted by the proposal, no fisheries concerns will result. There are no other significant natural features on or adjacent to the site that may be negatively impacted by the project.

129 Plantings All disturbed areas will be restored to the existing sodded condition and will not affect any significant natural features.

Policy Guidelines: The proposal is consistent with Section 4.2.2 E) - Property Improvements and Ancillary Structures - of the Authority's Valley and Stream Corridor Management Program.
