It specifies procedures for appointment to – and removal from – the post, as well as its respon- sibilities and investigative procedures (see below). • A commission on legalising the illegal economy, appointed by Prime Minister Nikolai Tanaev in August 2002, was tasked with drafting a programme of work under the chairmanship of Deputy Premier Djoomart Otorbaev and Finance Minister Bolot Abdildaev. The plan envisions four principal projects: economic analysis of the shadow economy; identification of fiscal policy measures; labour force policy; and accounting and registration policy. The goal of all four measures is to bring illegal businesses in all economic sectors into legal conformity. The National Statistics Committee has reported that the shadow economy accounts for at least 13 per cent and as much as 40 per cent of GDP. • A nationwide constitutional referendum approved in February 2003 introduced reforms that included the extension of immunity from prosecution for the first president (see below). • President Askar Akaev signed a decree in February 2003 raising judicial salaries by 50 per cent. He called the decision a move to reduce corruption in the court system. • An anti-corruption law was adopted in March 2003 to highlight and prevent corruption, call offenders to account and create a legal and organisational framework for anti-corruption operations.

Study of MEPs Narratives Abstract: In order to better understand the Poland-EU conflict over the rule of law I interviewed selected Polish Members of European Parliament [MEPs] on EU integration in the peak of the controversy in 2018. Drawing from discourse analysis and “practice turn” in European studies I studied the MEPs narratives. They appeared to be deeply rooted in two discourses: neofunctionalism and intergovernmentalism, both considered as domi- nant narratives in the EU studies. As right-wing MEPs were convinced the EU was politically biased, protecting sovereignty played a crucial role in their narratives regarding the rule of law conflict. The European People’s Party [EPP] and Socialists and Democrats [S&D] MEPs emphasized the need to abide by EU rules, but their attitude towards imposing sanctions against Poland was mixed. In the rule of law conflict they didn’t firmly stand byits side as a polity protecting its laws. The notion of sovereignty showed cleavages in their narratives, usually full of belief in the supranational community of values. Keywords: neofunctionalism, intergovernmentalism, European integration, rule of law, European Parliament, Poland Introduction The ten year internal EU crisis has led to deepening the split between more liberal and pro- gressive political groups and their conservative, nationalist and populist opponents (Brack, Startin 2015; Riedel 2015; Vogel, Rodriguez-Teruel 2016). Since 2008 four significant (dis)integration events have taken place in Europe: the recession, migration crisis, Brexit and the growth of illiberal powers (Hooghe, Marks 2019).

THE NOTIONS OF TRUTH AND FALSE - HOOD AS PERSUASIVE DEVICES IN POLISH AND SWEDISH PARLIAMEN - TARY TALK M AGDALENA D OMERADZKA SWPS University of Social Sciences and Humanities , Warsaw ABSTRACT. The article analyses references made to the notion of truth and falsehood in Swedish and Polish parliamentary talk. The results show that despite the mainstreaming of post - structuralism in contemporary society, the notion of truth – the central q uestion of Western philosophy – is still present the parliamentary talk and in the ways in which MPs deliberate and engage in arguments. As the article argues, the MPs deploy discursive strategies exploiting mostly the classical or early modern objective t heories of truth. Seeing truth as the ultimate value makes it expedient as a persuasive device and part of epidei c tic oratory. Apart from the similarities found in the Swedish and Polish parliamentary talk, the article shows differences mainly in how direc tly an accusation of lying can be voiced in the two parliaments. Indeed, truth is no doubt a form of power. Michel Foucault INTRODUCTION Studies of parliamentary talk in a number of countries prove parliamentary discourses to be far from Haberma s’ ideal speech situation (Habermas 1984 ). What is more, with the world - wide debates on the phenomena like post - truth politics, fake news, alternative facts and the role of the new media, the notion of truth in the public and political debate has received new dimensions. The present study does not aim at unveiling the fallacies of argumentation or identifying possible doublespeak.

    POLISH LAW ON RIGHT TO INFORMATION AND CLASSIFICATION Adam Bodnar1 Irmina Pacho2 Helsinki Foundation for Human Rights, Poland May 2011 I. Introduction The Polish classification regime is currently undergoing significant changes and transformations. In January 2011 a new legal act came into force bringing an entirely new system of classification. Such a radical amendment derived from an assumption that the previous law was out-of-date, not adapted to the modern technology and did not comply with current problems of classification. The first twelve months after the new act became binding, it will be a time of transformation. Within this time limit authorities are obliged to introduce executive orders outlining the execution and implementation of the new law completed. Until that moment some of the former classification system’s regulations will still be applicable. Therefore, it is yet too early to determine the consequences of introducing the new classification system, since the effectiveness will have to be verified by future practice. The aim of this paper is to highlight the most important shifts in the law, problems that appeared under previous regulations, as well as the main areas of concern, uncertainty and challenges remaining under the new act. II. Outline of current relevant legal regimes, including significant shifts 1. National legal authority for right to information Among the rights guaranteed in a democratic country is the right to have access to information on the activities of state bodies. The right to information is perceived as having fundamental value, since it enables citizens to participate in public life and, thus, empowers democracy.

    Social Communication 59 Volume 2 (2016), pp. 59-71 DOI: 10.1515/sc-2016-0012 POST-DEPENDENCE DISCOURSE IN THE LANGUAGE OF POLITICIANS OF Prawo i SPrawiedliwość and PLATFORMA OBYWATELSKA Kamil Olechowski1 Abstract The aim of this thesis was to analyze the speeches of politicians of the two largest Polish parties: Prawo i Sprawiedliwość and Platforma Obywatelska, using post-dependence theory. The work describes postcolonial and post-dependence theories, presents socially political divisions – in the categories of right wing and left wing politics – and describes the methodological issues of critical discourse analysis. The subject of analysis in the research part of the thesis were politics’ speeches on the following topics: the “Rodzina 500+” programme, terrorist attacks, the dispute with the Constitutional Court in Poland, Brexit and the Smolensk catastrophe. The goal of the anal- ysis was to find the post-dependence discourse features. Key words: post-dependence, politics, discourse Introduction In recent years, postcolonialism is one of the most popular theories within the humanities. Based on the interdisciplinarity and study of discourse, it tries to find in the texts the trace left by the difficult experience of being a subordinate. Originally it was addressed to analyze the discourse concerning the so-called Third World countries, which in their history were the subject of colonization by the Western countries. The theory initiated by Edward Said in his book entitled Orientalism (1995) as- sumes the existence of a number of specific phenomena affecting the mentality and identity of society, which are reflected exactly in a discourse. These are, among others, inferiority complex towards the countries, which in the past dominated over the given community, or mythologized image of a given country before the occupation.

    Full Speed ahead, in reverse gear 10 Years of Polish female MEPs in the European Parliament (2004-2014) in the context of women’s and LGBTQ rights Anna Dryjańska In 2004 Poland’s first European Parliament elections took place. Polish accession to the European Union, the election of female representatives, and existing European legislation raised high hopes for the possibility of legislative improvements for women and LGBT (Lesbian, Gay, Bisexual and Transgender) people. How, then, did the first decade of Polish female representatives in the European Parliament look? Has the presence of Polish women influenced the agenda of the institution? Have there been any issues with legislation concerning equal rights, equal opportunities, and anti-discrimination? Before we answer these questions, let’s take a look at the bare facts. Between 2004 and 2014 (during the 6th and 7th terms of office of the European Parliament) twenty female Polish representatives sat in the parliament. During this time, the female share in the Polish delegation rose from 12.9% (in 2004), through 22% (in 2009) to 23.5% (in 2014). Małgorzata Handzlik (Civic Platform) served as an MEP for two consecutive terms, while Lidia de Geringer de Oedenberg (Democratic Left Alliance - Labour Union) is the only female Polish representative to serve continuously since 2004. 2004 The first Polish elections for the European Parliament were held on the 13th of June 2004. 54 representatives were elected: 47 male and 7 female. That meant that women constituted 12.9% of the Polish delegation. 2 out of 8 electoral committees that managed to cross the electoral threshold contained only male representatives.

    Hanging Portraits of ‘Traitors:’ The Radicalization of the Polish Ethnolinguistic Nationalism Tomasz Kamusella University of St Andrews Nation Above the Law On 25 November 2017, in the city of Katowice, in front of the former Sejm (Regional Parliament) of interwar Poland’s autonomous region of Silesia (Silesian Voivodeship), the far-right nationalist organization ONR (Obóz Narodowo-Radykalny, National Radical Camp) staged a political happening. The ONR is a latter-day reincarnation of the eponymous interwar organization, which due to its radicalism was banned in 1934 in the then openly authoritarian Poland. The current ONR’s displeasure was brought about by the six Polish MEPs (members of the European Parliament). On 17 November 2017, they voted in favor of the European Parliament’s resolution that urges the Polish Parliament and government (both led by the Law and Justice party, PiS, Prawo i Sparwiedliwość) to observe and protect the rule of law in Poland.1 Much of the pro-PiS and other nationalist mass media in Poland vilified the aforementioned MEPs as ‘traitors [of the Polish nation].’ ONR members in Katowice went one step further. They ritually hanged the portraits of ‘traitors’ Michał Boni, Danuta Huebner, Danuta Jazłowiecka, Barbara Kudrycka, Julia Pitera and Róża Thun; and subsequently threw them to the ground and trampled. Police stood by idly. Later the office of prosecutor public refused to investigate this clear-cut incident of hate speech, citing the constitutionally guaranteed freedoms of speech and of expressing political opinions.2 This tradition of ‘execution in effigie’ dates back to late Poland-Lithuania, when the country was being erased from the political map of Europe by the Habsburgs, Prussia and Russia in 1794-1795.3 No Polish citizen with a whiff of elementary school education has any doubts that the ONR members in Katowice intended to effect character assassination and public humiliation of the aforementioned MEPs.
