NOTICE IS HEREBY GIVEN by the Board of Directors that Sealed Bids will be received by the Toledo-Lucas County Port Authority for:

Construct Air Carrier Apron - Contract 2 Construct Contaminated Stormwater Handling Facilities at the Toledo Express Airport (AIP Project No. 3-39-0077-50)

“Sealed bids will be received by the Toledo-Lucas County Port Authority at its office at the Toledo Express Airport, 11013 Airport Highway, Box 11, Swanton, Ohio, 43558 until 1 :30 p.m. local time on Friday, August 6, 2004 for the referenced construction project and shall be publicly opened and read aloud immediately thereafter at the office of the Airport.” A Pre-Bid Meeting will be held in the Port Authority Conference Room located at the Toledo Express Airport at 11013 Airport Highway, Swanton, Ohio 43558 at 1:30 p.m. on Wednesday, July 28, 2004. Following the Pre-Bid Meeting, a walk-through of the project may be conducted.

The Contract Documents, including the Plans and Specifications, Instructions to Bidder, and Forms of Proposal, Contract, and Contract Bond are on file at the office of the Port Authority at 11013 Airport Highway, Box 11, Swanton, Ohio 43558; at the offices of the Engineer, CMT - North America, 600 N. Plans and Specifications, including all documents necessary for submitting a bid, may only be obtained in person by prospective Bidders at the offices of the Airport for a fee of $100.00 per set. No fees will be refunded.

Proposals must be submitted on the form furnished by the Authority, and must contain the name of every person interested therein, a list of all proposed subcontractors, and a statement of qualifications demonstrating financial responsibility and technical ability to perform the work. Proposals shall be accompanied by a Proposal Bond, with satisfactory surety, a cashier’s check, or a certified check on a solvent bank, in an amount not less than 10 percent (10%) of the total amount bid for the work, specifying the Toledo-Lucas County Port Authority as the Obligee, as guarantee that in case the contract is awarded to him, he will within fifteen (15) days thereafter, upon receipt of written notice of award, execute such contract and furnish a satisfactory performance bond. Upon failure to do so, he shall forfeit the deposit as liquidated damages and acceptance of the bid will be contingent upon the fulfillment of this requirement by the bidder.

Prior to the award of contract, the successful bidder will be required to furnish a satisfactory Contract Bond.

Any bid may be withdrawn prior to the scheduled closing time for receipt of Bids; however, the bids may not be withdrawn for a period of ninety (90) days after the scheduled opening time.

The Port Authority reserves the right to reject any or all Bids and to waive technicalities as to changes, alterations, or reservations, and to make the award to the best interest of the Port Authority.

NB-1 The work to be done under this contract includes the furnishing of all labor, material, equipment, tools, and all associated work necessary for the Construct Air Carrier Apron - Contract 2 Construct Contaminated Stormwater Handling Facilities at the Toledo Express Airport for the Toledo-Lucas County Port Authority. The work includes, but is not limited to:

Base Bid: Above-ground storage tank farm with two (2) steel 250,000-gallon vertical, roofed storage tanks. Valve vault with associated piping, valves, and flow meters. Electrical equipment building with pump controls and a total organic carbon (TOC) analyzer. Tank farm site work to include utility work, final grade, access pavement, and perimeter fencing. Terminal Pump Station with two (2) 1300 GPM submersible pumps, associated piping, and an aircraft rated precast wet well. The Port Authority reserves the right to limit the work by the partial or total elimination of work items, without limitation and without change in unit price, so as to perform the maximum amount of work without overextending the available funds.

The successful bidder will be required to pay at least minimum wage rates, predetermined by the Secretary of Labor, which are included in the Contract Documents.

The proposed Contract is subject to the non-discrimination clause prescribed by Executive Order 11246 on May 8, 1978, and to the Equal Employment Opportunity requirements of the Federal Aviation Regulation Part 152. The Bidder must supply all the related information required by the Contract Documents.

The Bidder shall make good faith efforts, as defined in Appendix A of 49 CFR Part 23, Regulation of the Office of the Secretary of Transportation, to subcontract 18% of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals (DBE). Individuals who are refutably presumed to be socially and economically disadvantaged include women, Blacks, Hispanics, Native Americans, Asian-Pacific Americans, and Asian-Indian Americans.
