The original timeframe granted by the United Nations was actually shorter. I recall joking in the early sitting days of the Constituent Assembly: ‘Better we draft a 60-article Constitution, given that we only have 60 effective working days.’ Eventually, the timeframe was extended, after some lobbying and public pressure. Following my involvement in the resistance effort that preceded independence, I was again privileged to be a part of the making of my country’s history, in drafting the first Constitution of the Democratic Republic of Timor-Leste. The six-month process of constitutional drafting was a great democratic exercise for many Timorese, despite the differences between the political parties, time constraints and other shortcomings. The author of this book, Dr Annemarie Devereux, who was a direct observer and adviser to the Constituent Assembly during the whole process, captures very well the rich debate in the Constituent Assembly. This book is a testimony to that debate and will serve to enhance the understanding of the debates for future scholars, lawyers and the people of Timor-Leste. In the debates over human rights protections, members of the Constituent Assembly fell into one of two broad groups. The first group (consisting of a majority of members) were quite straightforward in considering the importance of adopting a Bill of Rights within the Constitution. This group was very genuine in the sense that they were motivated by the desire to prevent a repetition of the human rights atrocities faced by Timorese, especially under the illegal Indonesian occupation. They were determined that a human rights vocabulary should be an integral part of the new Constitution. The second group (a minority of members) were concerned with the means of realising those rights, repeatedly asking the question,‘Can the State fulfill all these basic rights for the people?’ Concerns voiced during these debates regarding human rights continue to be echoed today: ‘Povu seidauk hetan be’e mós’ (The people have no clean water); ‘Povu la iha aseso ba saude’ (The people have no healthcare); and ‘Labarik dalan-ibun la hetan protesaun husi estadu’ (Street children are not protected by the state). Notwithstanding these challenges, today we all say that we have to uphold the Constitution, which includes upholding human rights. In spite of minor differences between the members of the Assembly on the unresolved issue of justiciability (that is, whether claims for human rights could be enforced through the courts), most were supportive of the Bill of Rights included in the Constitution. Today we are watching the practice of democracy in Timor-Leste, based on its Constitution. There are gaps here and there, but it is interesting to observe ix Timor-Leste’s Bill of Rights in the years since the Constituent Assembly, how the fulfillment of rights is being reconciled with the various competing priorities facing Timor-Leste. The determination of the members of the Constituent Assembly in adopting the Bill of Rights has meaning only if the State takes the measures necessary to realise those rights. Can the Timorese realise their Bill of Rights and prove wrong the Orwellian statement that ‘some are more equal than others’? Only time will tell. Paradoxically, it was not that the population was directly impacted—indeed, the small half-island nation stands out with only a score or so of cases, and no deaths—but that the oil-dependent economy and the status of financial reserves took a major hit with the collapse of oil and stock prices. In the interest of managing the pandemic, the incumbent prime minister declared a state of emergency, withdrawing his earlier resignation and thus averting a political crisis. Still, as the new eco- nomic realities surrounding oil-related mega-infrastructure projects hit home, we see churn among the concerned ministers and technocrats, amid a major rethink of the way ahead, and with many of the choices invidious in the challenging new economic environment. Fallon, 2009 Abstract This dissertation analyzes the transnational politics of two new or incipient diasporas, the Acehnese and East Tirnorese. It examines their political roles and activities in and across several countries in the West (Europe, North America, and Australia) as well as their impact on the “homeland” or country of origin, during and after armed conflict. It suggests that the importance of diaspora participation in conflict and conflict settlement is not solely or even primarily dependent on the material resources of the diaspora. Instead it is the ideational and political resources that may determine a diaspora’s ability to ensure its impact on the homeland, on the conflict, and its participation in the conflict settlement process. This study adopts a constructivist approach, process-tracing methods, and an analytical framework that combines insights from diaspora politics and theories on transnational advocacy networks (TANs). It concludes that the Aceh and East Timor cases support the proposition that diasporas are important and dynamic political actors, even when they are small, new, and weak. These cases also support the proposition that the political identities and goals of diasporas can be transformed over time as a diaspora is replenished with new members who have new or different ideas, as factions within diasporas gain power vis-à-vis others, and/or as the political partners available to the diaspora in the hostland and internationally change or broaden.

    his three volume publication includes the constitutional documents of all Tcountries in Southeast Asia as of December 2007, as well as the ASEAN Charter (Vol. I), reports on the national constitutions (Vol. II), and a collection of papers on cross-cutting issues (Vol. III) which were mostly presented at a conference at the end of March 2008. This collection of Constitutional documents and analytical papers provides the reader with a comprehensive insight into the development of Constitutionalism in Southeast Asia. Some of the constitutions have until now not been publicly available in an up to date English language version. But apart from this, it is the first printed edition ever with ten Southeast Asian constitutions next to each other which makes comparative studies much easier. The country reports provide readers with up to date overviews on the different constitutional systems. In these reports, a common structure is used to enable comparisons in the analytical part as well. References and recommendations for further reading will facilitate additional research. Some of these reports are the first ever systematic analysis of those respective constitutions, while others draw on substantial literature on those constitutions. The contributions on selected issues highlight specific topics and cross-cutting issues in more depth. Although not all timely issues can be addressed in such publication, they indicate the range of questions facing the emerging constitutionalism within this fascinating region.
