Printed in Belgium 3 FOREWORD When the Amsterdam Treaty entered into force on 1 May 1999, cooperation measures hitherto in the Schengen framework were integrated into the European Union framework. The Schengen Protocol annexed to the Amsterdam Treaty lays down detailed arrangements for that integration process. An annex to the protocolspecifies what is meant by ‘Schengen acquis’. The decisions and declarations adopted within the Schengen institutional framework by the Executive Committee have never before been published. The GeneralSecretariat of the Councilhas decided to produce for those interested a collection of the Executive Committee decisions and declarations integrated by the Councildecision of 20 May 1999 (1999/435/EC). -

European Treaty Series - No. 25 EUROPEAN AGREEMENT ON REGULATIONS GOVERNING THE MOVEMENT OF PERSONS BETWEEN MEMBER STATES OF THE COUNCIL OF EUROPE Paris, 13.XII.1957 Migrationsrecht.net www.migrationsrecht.net 2 ETS 25 – Movement of Persons, 13.XII.1957 _________________________________________________________________________________________________ The governments signatory hereto, being members of the Council of Europe, Desirous of facilitating personal travel between their countries, Have agreed as follows: Article 1 1 Nationals of the Contracting Parties, whatever their country of residence, may enter or leave the territory of another Party by all frontiers on presentation of one of the documents listed in the appendix to this Agreement, which is an integral part thereof. 2 The facilities mentioned in paragraph 1 above shall be available only for visits of not more than three months' duration. 3 Valid passports and visas may be required for all visits of more than three months' duration or whenever the territory of another Party is entered for the purpose of pursuing a gainful activity. 4 For the purposes of this Agreement, the term “territory” of a Contracting Party shall have the meaning assigned to it by such a Party in a declaration addressed to the Secretary General of the Council of Europe for communication to all other Contracting Parties. Article 2 Migrationsrecht.net To the extent that one or more Contracting Parties deem necessary, the frontier shall be crossed only at authorised points. Article 3 The foregoing provisions shall in no way prejudice the laws and regulations governing visits by aliens to the territory of any Contracting Party. Article 4 This Agreement shall not prejudice the provisions of any domestic law and bilateral or multilateral treaties, conventions or agreements now in force or which may hereafter enter into force, whereby more favourable terms are applied to the nationals of other Contracting Parties in respect of the crossing of frontiers. -

The ministers and State secretaries hereby agree to set the political goal of applying the 1990 Schengen Convention as of 1 December 1993. 2. The ministers and State secretaries note that the following preconditions have been fulfilled: — the common manual; — the arrangements for issuing the uniform visa and the common consular instructions on visas; — the examination of applications for asylum; — the airports, as agreed in the declaration of the ministers and State secretaries of 19 June 1992. Great progress has been made in respect of the other preconditions, which have already been fulfilled to such an extent that the said application ought to be possible as of 1 December 1993. -

Austria – Valid passport or expired within the last five years. – Official identity card. Belgium – Belgian passport, valid or expired within the last 5 years. – Official identity card. – Official identity card issued to a Belgian national, having the force of an immatriculation certificate, by a Belgian diplomatic or consular agent abroad. – Identity certificate with photograph issued by a Belgian Local Authority to a child under 12 years of age. – Identity paper without photograph issued by a Belgian Local Authority to a child under 12 years of age. This document will only be accepted in the case of children travelling with their parents. – Valid alien's identity card, issued by the competent authorities of the country of residence, for Belgians lawfully residing in France, Luxembourg and Switzerland, and stating that the bearer is of Belgian nationality. – Provisional identity card. Cyprus – valid passport of the Republic of Cyprus, – valid national identity card, – valid laissez-passer. Finally, two sections are left blank-one dealing with fiscal provisions, the other dealing with penal provisions. Quite plainly these are not the least important, but go beyond the mandate of Professor Sanders at the present moment. It will, therefore, be seen that this draft is an attempt to provide a comprehensive company law for a European company and it sets out to be acceptable to all the member States, as well as to be a new departure which might lead to the establishment of a single company law inside the Community. As this may one day extend to the rest of Europe and even beyond, it will be easy to appreciate its importance. The difficulties and the arguments which it is bound to provoke will result in a very useful examination of the draft and will allow of no easy or rapid solution. It may well be, however, that in the long run it will be the only effective way in which a harmonisation of company law can be achieved. DENNIS THOMPSON. FREEDOM OF MOVEMENT AND THE TRAVEL DOCUMENT IN BENELUX WITHIN Benelux territory there operates a model system of free movement of persons which can well serve as an example of co-operation for other States. The Benelux countries have through the years taken a liberal outlook towards human mobility. Before looking at the present-day position, the past efforts of co-operation to reduce obstacles to freedom of movement to Belgium, Luxembourg and the Netherlands are worth examination. -

Alternative ID arrangements policy Please note: This policy only applies to examinations taken at a Pearson VUE test centre and does not apply to examinations taken via OnVUE remote proctoring 1.1 Rationale Candidates can occasionally be unable to present the accepted forms of identification on the day of their test. CFA UK is committed to preventing these problems causing delays for well-prepared candidates. This policy describes the procedure in place to allow candidates to verify alternative forms of photographic identification in order to sit the exam at a convenient time. 1.2 Currently candidates are able to provide the following original forms of identification 1.2.1 Pearson VUE test centres: 1.2.1.1 For candidates taking an examination in the UK: A currently valid signed Passport of any country containing the candidate’s photograph and signature. * A currently valid UK Driving Licence (full or provisional) that carries the candidate’s photo and signature. * *Note: If the candidate presents a biometric type of the above identification which does not allow for a signature, they must present a second form of ID which contains their signature. For example: Current, original European Union (EU) only government issued identity card. Current, original government issued National ID card for any country in the European Union (EU). Current Credit/Debit or bank card. 1.2.1.2 For candidates taking an examination outside the UK: A currently valid signed Passport of any country containing the candidate’s photograph and signature. * A valid National Identity card from an EU country.
