The governments signatory hereto, being members of the ,

Desirous of facilitating personal travel between their countries,

Have agreed as follows:

Article 1

1 Nationals of the Contracting Parties, whatever their country of residence, may enter or leave the territory of another Party by all frontiers on presentation of one of the documents listed in the appendix to this Agreement, which is an integral part thereof.

2 The facilities mentioned in paragraph 1 above shall be available only for visits of not more than three months' duration.

3 Valid and visas may be required for all visits of more than three months' duration or whenever the territory of another Party is entered for the purpose of pursuing a gainful activity.

4 For the purposes of this Agreement, the term “territory” of a Contracting Party shall have the meaning assigned to it by such a Party in a declaration addressed to the Secretary General of the Council of Europe for communication to all other Contracting Parties.

To the extent that one or more Contracting Parties deem necessary, the frontier shall be crossed only at authorised points.

Article 3

The foregoing provisions shall in no way prejudice the laws and regulations governing visits by aliens to the territory of any Contracting Party.

Article 4

This Agreement shall not prejudice the provisions of any domestic law and bilateral or multilateral treaties, conventions or agreements now in force or which may hereafter enter into force, whereby more favourable terms are applied to the nationals of other Contracting Parties in respect of the crossing of frontiers.

Article 5

Each Contracting Party shall allow the holder of any of the documents mentioned in the list drawn up by it and embodied in the appendix to this Agreement to re-enter its territory without formality even if his nationality is under dispute.

Article 6

Each Contracting Party reserves the right to forbid nationals of another Party whom it considers undesirable to enter or stay in its territory.

Article 7

Each Contracting Party reserves the option, on grounds relating to ordre public, security or public health, to delay the entry into force of this Agreement or order the temporary suspension thereof in respect of all or some of the other Parties, except insofar as the provisions of Article 5 are concerned. This measure shall immediately be notified to the Secretary General of the Council of Europe, who shall inform the other Parties. The same procedure shall apply as soon as this measure ceases to be operative.

A Contracting Party which avails itself of either of the options mentioned in the preceding paragraph may not claim the application of this Agreement by another Party save insofar as it also applies it in respect of that Party.

Article 8

This Agreement shall be open to the signature of the members of the Council of Europe, who may become Parties to it either by:

a signature without reservation in respect of ratification;

b signature with reservation in respect of ratification followed by ratification.

Instruments of ratification shall be deposited with the Secretary General of the Council of Europe.

This Agreement shall enter into force on the first day of the month following the date on which three members of the Council shall, in accordance with Article 8, have signed the Agreement without reservation in respect of ratification or shall have ratified it.

In the case of any member who shall subsequently sign the Agreement without reservation in respect of ratification or shall ratify it, the Agreement shall enter into force on the first day of the month following such signature or the deposit of the instrument of ratification.

Article 10

After entry into force of this Agreement, the Committee of Ministers of the Council of Europe may invite any non-member State to accede to it. Such accession shall take effect on the first day of the month following the deposit of the instrument of accession with the Secretary General of the Council of Europe.

Article 11

Any government wishing to sign or accede to this Agreement which has not yet drawn up its list of the documents mentioned in Article 1, paragraph 1, and appearing in the appendix, shall submit a list of such documents to the Contracting Parties through the Secretary General of the Council of Europe. This list shall be considered to be approved by all the Contracting Parties and shall be added to the appendix to this Agreement if no objection is raised within two months of its transmission by the Secretary General.

The same procedure shall apply if a signatory government wishes to alter the list of documents drawn up by it and embodied in the appendix.

Article 12

The Secretary General of the Council of Europe shall notify members of the Council and acceding States:

a of the date of entry into force of this Agreement and the names of any members who have signed without reservation in respect of ratification or who have ratified it;

b of the deposit of any instrument of accession in accordance with Article 10;

c of any notification received in accordance with Article 13 and of its effective date.

Article 13

Any Contracting Party may terminate its own application of the Agreement by giving three months' notice to that effect to the Secretary General of the Council of Europe.

In witness whereof the undersigned, being duly authorised thereto, have signed this Agreement.

Done at Paris, this 13th day of December 1957, in English and French, both texts being equally authentic, in a single copy which shall remain deposited in the archives of the Council of Europe. The certificate of birth is not sufficient for the incontestable identification of the minor who holds it. Furthermore, minors must carry an identity card or be accompanied by an adult carrying a passport on which the minor appears. In accordance with the provisions of Article 7, paragraph 1, of the European Agreement, the Belgian Government is obliged to suspend with regard to Turkey the provisions of Article 1, paragraphs 1 and 2, of the Agreement. Consequently, the Belgian Government has decided to introduce an obligation for Turkish nationals to obtain a visa as from 1 November 1980. I have the honour to inform you that on 15 March last, the Ministry of the Interior has decided to introduce a provisional identity card for Belgians. This will be delivered to Belgians who do not have a passport, who wish to travel to a country where a passport is not required and whose new format identity card (in conformity with Resolution (77)26 of the Council of Europe) had been lost or destroyed in the days preceding the travel.

The specifications and modalities governing the issue of this card have been published in the "Moniteur belge" of 3 March 1988. A specimen of this card will be forwarded shortly to the Member States of the Council of Europe by the Diplomatic Representation of Belgium in the States concerned. Pursuant to Article 11 of the Agreement and within the two months delay provided by this provision, the Belgian authorities approve the inclusion, in the scope of application of this treaty, of the following Slovene travel documents :

- valid ordinary passport, - valid diplomatic passport, - valid service passport, - valid group passport.

On the other hand, the Belgian authorities can not accept that the valid identity card and the valid emergency passport be covered by this Agreement. Nevertheless, the later document could be accepted in order to leave the territory of the Benelux countries with a view to returning in Slovenia.

Accordingly, Belgium objects to the list mentioned in the Slovene declaration insofar as it concerns the valid identity card and valid emergency passeport(*).

Following the perpetration of acts of terrorism in Paris in Autumn 1986, the French Government was obliged in September 1986, in a decision of which the Secretariat General of the Council of Europe was notified on 16 September 1986, to suspend application of the European Agreement on Regulations governing the Movement of Persons between Member States of the Council of Europe of 13 December 1957, in accordance with the provisions of Article 7 of that Agreement. Subsequent developments and tighter co-operation in Europe on security and anti-terrorist measures have prompted the French Government to rescind the above-mentioned suspensive measure, with effect from 00.00 hours on 9 December.

This measure applies to nationals of Austria, Cyprus, Iceland, Malta, Norway, Sweden and

Position of the French Government concerning the altered list of documents appended to the European Agreement on Regulations governing the Movement of Persons between Member States of the Council of Europe (ETS 25), submitted by the Kingdom of the (notification No. JJ3299 C Tr./25-11 of 15 December 1994).

In application of Article 11 of this Agreement, the French authorities approve the inclusion within its scope of the following types of travel document:

- national passport - business passport - diplomatic passport - official passport (passeport de service) - refugee's travel document - European identity card - laissez-passer.

The French authorities cannot agree to the alien's travel document being covered by this Agreement. In fact, the Agreement states in its Article 5 that "Each Contracting Party shall allow the holder of any of the documents mentioned in the list drawn up by it and embodied in the Appendix to this Agreement to re-enter its territory without formality even if his nationality is underMigrationsrecht.net dispute". The alien's travel document flagrantly contradicts this provision in stating on its back cover that it "is valid for (re)admission to the Netherlands only if the bearer is in possession of a valid authorisation to stay or settle or of a provisional authorisation to stay in the Netherlands".

Before taking a final decision, the Government has initiated a procedure of bilateral consultation with the Netherlands. Period covered: 14/2/1995 - The preceding statement concerns Article(s) : 11

The Permanent Representation of France has the honour to notify the Secretariat of the Council of Europe, in application of Article 11 of the European Agreement on Regulations governing the Movement of Persons of 13 December 1957 (ETS No. 25), that a provisional identity card has been issued by the French authorities. This card, valid for three months, has been established to respond to an urgent need, whilst waiting for the deliverance of a plastic identity card the production of which necessitates a further delay.

The French authorities ask that this identity document be recognised as a valid identity and travel document to allow access by French citizens to the territory of all States Parties. Period covered: 20/8/1995 - The preceding statement concerns Article(s) : 11

Objection contained in a Note Verbale VM/MS/N( 344/D from the Permanent Representation of France, dated 17 July 1995, registered at the Secretariat General on 18 July 1995 - Or. Fr.

In reply to the notification n( JJ3382C Tr./25-13 of 18 May 1995, the French Government cannot agree that the "laisser-passer" issued by the Dutch authorities shall be included in the Appendix to the European Agreement on Regulations governing the Movement of Persons between Member States of the Council of Europe (ETS No. 25) in its present form.

In effect, this document, or at least one of its variants with a blue cover, may be issued in the Netherlands to foreign nationals, which may pose a problem of (re)admission of some bearers to the Netherlands. In consequence, France could accept this "laisser-passer" only if it were issued by Dutch diplomatic or consular offices to its own nationals deprived of any travel document - in the event of loss or theft - to permit them to return to the Netherlands. The Permanent Representation of France to the Council of Europe presents its compliments to the Secretariat General and, in reply to the corrigendum to the Secretariat's notification dated 13 August 1997 concerning the modification of the Appendix to the European Agreement on Regulations governing the Movement of Persons between Member States of the Council of Europe (ETS No. 25) requested by the government of the Federal Republic of Germany, has the honour to inform that the French authorities reiterate their request to obtain information about the main characteristics of the "provisional identity card", its period of validity and the reasons for putting it into circulation.

There are some translation difficulties: the titles of travel documents issued, for example by the Land of Berlin, have probably been inadequately translated into French ("carte d'identité provisoire et attestation de photo d'identité d'enfant"). The title in German of these documents and their present conditions of validity should be specified. In addition, it would be desirable to know whether a child with a "child's travel certificate" of the FRG, valid or expired within the last year, may leave the country without any other documentary evidence, or whether such a child must also be provided with a parental permission to leave the territory.

Furthermore, the French authorities renew their request to receive two samples of all the travel documents issued by the German authorities. They are grateful to the Secretariat to maintain the suspension of the term of tacit approval of the amendments. Period covered: 17/10/1997 - The preceding statement concerns Article(s) : 11

The Permanent Representation of France is pleased to inform the Secretariat of the Council of Europe, in connection with the European Agreement on Regulations Governing the Movement of Persons Between Member States of the Council of Europe (ETS no.25), that a new standard passport was brought into circulation on an experimental basis on 28 April 1999 by the Prefecture of Montpellier. The experiment will be extended in May to the Prefecture of Dijon and the Paris Prefecture de Police.

The passport takes the form of a booklet of dimensions 125 mm x 88 mm. The burgundy- coloured cover, made of soft synthetic material, is inscribed with the national coat of arms in the centre, the wordsMigrationsrecht.net "Union européenne/République française" (/Republic of France) at the top and "passeport" (passport) at the bottom. It has 36 pages, numbered from 1 to 36 inclusive. The personal particulars and photograph of the bearer appear on page 2, which is printed in landscape format (sideways), with a 23 mm-high bar code at the bottom. The document is valid for 5 years and is not renewable.

The French authorities have stated that the old passport design is still valid. It will continue to be issued by Prefectures which do not have the special equipment needed to produce the new passport, by the French High Commissioners in the overseas territories and by embassies and consulates abroad.

The 1953 Germano-Turkish agreement on visas has been terminated.

This step was considered necessary for reasons of "ordre public". The number of Turkish nationals crossing the frontier of the Federal Republic of Germany with the intention of circumventing residence and domicile regulations by abusing the right to asylum increased extremely sharply in the first few months of 1980. Closer supervision of entry into the territory of the Federal Republic of Germany is therefore essential. After a period of three years the Federal Republic of Germany will reconsider whether it is still necessary to make visas compulsory for Turkish nationals. With reference to the notification of ratification by the Republic of Slovenia of the European Agreement on Regulations governing the Movement of Persons between Member States of the Council of Europe of 13 December 1957, to which was appended the document by which the Republic of Slovenia, pursuant to Article 11 of the said Agreement, included a declaration with the list of travel documents, and concerning these travel documents, the Government of Spain, in accordance with the said Article 11, raises objections to the following travel documents :

With regard to the identity card, the Government of Spain can not accept it as it is in contradiction with community law to the extent that it prevents the affixing of a stamp confirming border crossing , therefore making it impossible to determine the effective maximum duration of allowed stay.

With regard to the emergency passport, the Government of Spain can allow border crossing only in case of departure from the Schengen zone, as it is equivalent to a laissez-passer but can not be considered as a document accrediting the entry and the departure(*)

Finally, with regard to the group passport, the Government of Spain can only accept the document known as "young persons collective passport" which corresponds to the European Agreement on Travel by Young Persons on Collective Passports between the Member Countries of the Council of Europe, done in Paris on 16 December 1961, since the Common Consular Instruction, drawn up for the application of the Schengen Agreement regime on visas, refers only to this document.

The Kingdom of Spain and Ukraine are contracting Parties to the European Agreement on Regulations governing the Movement of Persons between Member States of the Council of Europe, signed in Paris on 13 December 1957. The Kingdom of Spain, basing upon Article 7 of such Agreement, has decided to suspend, temporarily and immediately, its implementation with regard to Ukraine.

Such a measure has been considered necessary for reasons referred to public order. The application of the Agreement to Ukraine is contrary to the Regulation EC No. 539/2001, which concerns the issuing of visas : its annex I stipulates that Ukraine appears within the group of third countries whose citizens must have a visa to be enabled to cross the external borders of the European Union. I have the honour to inform you that during today's session, the Swiss Federal Council decided to reintroduce visa obligations into its relations with Turkey with effect from 15 July 1982, except for holders of diplomatic, service or special passports, Turkish nationals resident in Switzerland by virtue of a valid residence permit, Turkish aircrews and young Turks travelling on collective passports in accordance with the European Agreement on Travel by Young Persons.

In accordance with Article 7.1 of the European Agreement of 13 December 1957 on Regulations governing the Movement of Persons between Member States of the Council of Europe, the Federal Council has decided, on grounds relating to "ordre public", temporarily to suspend, from 15 July 1982, the provisions of Article 1.1 and 1.2 of the said Agreement in respect of Turkey.

Under the Agreement of 6 November 1963 between Switzerland and the Principality of Liechtenstein on immigration regulations applicable to nationals of third party States in the Principality of Liechtenstein and co-operation in the immigration field, the decisions taken by the Federal Council also apply to Turkish nationals in the Principality of Liechtenstein. Partial objection contained in a letter from the Permanent Representative of Switzerland, dated 17 December 2001, registered at the Secretariat General on 19 December 2001 - Or. Fr.

By notification of amendment of Appendix, dated 26 October 2001 and sent under reference JJ5004C Tr. 25-26, the Secretariat transmitted to the States Parties to the Agreement a declaration contained in a Note verbale, dated 21 September 2001, from the Ministry for Foreign Affairs of the Netherlands.

Pursuant to Article 11 of the Agreement, and within the two months delay provided by this provision, the Swiss authorities approve the inclusion, in the scope of application of this treaty, of the following Dutch documents : national passport,

Dutch identity card, business passport, diplomatic passport, official passport, laissez-passer, provisional passport.

On the other hand, the Swiss authorities can not accept that the refugee's passport and the alien's passport, listed also in the above-mentioned declaration, be covered by this convention. Indeed, so far as the holders of these documents are not nationals of one of the Contracting Parties, the facilities relating to the entry in the territory of the other Parties provided by the Agreement do not apply to them (see Article 1, paragraph 1, of the Agreement).

Moreover, the Agreement stipulates, in its Article 5, that "(e)ach Contracting Party shall allow the holder of any of the documents mentioned in the list drawn up by it and embodied in the appendix to this Agreement to re-enter its territory without formality even if his nationality is under dispute". However, there is no information enabling to consider the refugee's passport and the alien's passport as being also valid documents for re-entering the Netherlands without condition and without formality.

As a consequence, Switzerland objects to the considered modification of the Appendix in so far as it concerns the refugee's passport and the alien's passport. Period covered: 19/12/2001 - The preceding statement concerns Article(s) : 11

Switzerland and Ukraine are Parties to the European Agreement of 13 December 1957 on Regulations governing the Movement of Persons between Member States of the Council of Europe. In accordance with Article 7 of this Agreement, Switzerland has decided to suspend temporarily, with immediate effect, its application with regard to Ukraine, with the exception of the provisions of Article 5.
