ORDER

MOTOR VEHICLE TRAVEL AND DEVELOPED TRAIL RESTRICTIONS

ARAPAHO & ROOSEVELT NATIONAL FORESTS AND PAWNEE

Pursuant to 36 CFR 261.50(a) and (b), the following acts are prohibited on the areas, roads, and trails described in this order within the Arapaho & Roosevelt National Forests and the Pawnee National Grassland until further notice:

I. VEHICLES

A. Using or possessing a motorized vehicle off numbered Forest Development roads or designated travel routes. 36 CFR 261.56.

B. Using a motorized vehicle on a closed Forest Development Road. 36 CFR 261.54(a).

C. Operating a vehicle carelessly, recklessly, or without regard for the rights or safety of other personnel or in a manner or at a speed that would endanger or be likely to endanger any person or property. 36 CFR 261.54(f).

D. The use of all motorized vehicles on Forest Development Roads that do not display a current and valid State license plate as required by state law. 36 CFR 261.54(b).

E. Use of an O.H.V.* on Forest Development Roads that does not display a current and valid State off-highway vehicle registration as required by Colorado State law. 36 CFR 261.54(b).

F. Operating an O.H.V.* on a Forest Development Road when such road has not been designated as an off-highway vehicle route or open road. 36 CFR 261.54(a).

G. Operating any vehicle on a Forest Development Road that emits a noise level in excess of 99 dba as measured by the SAE standard 20-inch test. 36 CFR 261.54(a).

H. Operating any vehicle on a Forest Development Trail that emits a noise level in excess of 99 dba as measured by the SAE standard 20-inch test. 36 CFR 261.55(b).

I. Use of a snowmobile** on Forest Development Roads that does not display a current and valid State snowmobile registration as required by Colorado State Law. 36 CFR 261.54(a).

J. Operating a vehicle in violation of speed, load, weight, height, length, width limitations as posted on Forest Development Roads. 36 CFR 261.54(d). Order No. 10-00-03 Page 2 of 15

* O.H.V. - "Off-highway vehicle" means any motorized vehicle which is designed to travel on wheels or tracks in contact with the ground, is generally and commonly used to transport persons for recreational purposes, and is not required to be licensed under Colorado Revised Statute (C.R.S.) Title 42-3-102 (1).

** Registered Snowmobiles and other over-the-snow vehicles operating on snow and where not otherwise prohibited are exempt from this order.

II. PETS

A. BOULDER RANGER DISTRICT *

1. Possessing or transporting a dog is prohibited on the following trails from December 1 through April 30. 36 CFR 261.58(s):

* Exceptions will be made for hunting dogs while hunting during legal seasons.

B. CANYON LAKES RANGER DISTRICT

Pets must be on a hand-held leash no longer than six feet at all times on the following trails outside the Indian Peaks and Rawah Wilderness areas. 36 CFR 261.58(s):

IV. ROAD AND TRAIL CLOSURES

Motor vehicle travel is permitted only on Forest Roads that are marked by posts showing the road number, and not otherwise posted closed. Travel by motor vehicle cross country, or on roads or trails posted closed to motorized travel is prohibited; except for over-the- snow vehicles operating on snow where they have not been specifically prohibited. (Travel is permitted by direct access up to 300 feet from authorized travel routes to suitable parking sites for camping or picnicking where such travel will not cause damage to the resource.)

A. BOULDER RANGER DISTRICT

1. The following roads are closed year round to travel by wheel-to-ground motorized vehicles. 36 CFR 261.54(a):

Pursuant to 36 CFR, Section 261.50(e), the following persons are exempt from the order:

1. Persons with a permit specifically authorizing the otherwise prohibited act or omission.

2. Any Federal, State, or local officer, or member of an organized rescue or firefighting force in the performance of an official duty.

Violation of these prohibitions is punishable by a fine of not more than $5000 for an individual or $10,000 for a legal entity other than an individual, or imprisonment for not more than six (6) months, or both.
