PRESIDENT'S DUTY TO BE MERCIFUL OF PARDONS, POLITICS AND COLLAR BUTTONS: REFLECTIONS ON THE PRESIDENT'S DUTY TO BE MERCIFUL Margaret Colgate Love* [Pardon] has never been crystallized into rigid rules. Rather, its function has been to break rules. It has been the safety valve by which harsh, unjust, or unpopular results of formal rules could be corrected.1 INTRODUCTION Few provisions in the Constitution are as misunderstood and underestimated as the President's power to pardon.2 Most people today associate pardons with politics and controversy, and do not know that for much of our nation's history the pardon power was exercised regularly and without fanfare to give relief to ordinary people convicted of garden-variety federal crimes. Once an integral part of the justice system, pardon is considered anachronistic in an age devoted to rules and wary of discretion, a vestige of a simpler time whose occasional exercise is either capricious or pointless, or both. Indeed, until quite recently the prevailing view among criminal justice practitioners and philosophers was that the time had come for pardon "silently to fade away — like *Lecturer in Law, Columbus School of Law, The Catholic University of America. All rights reserved. http://journals.naspa.org/jcc Instilling an Ethic of Leadership at Fisk University in the 1950s Marybeth Gasman Abstract In many cases, student activism on college campuses stems from alienation – alienation of one generation from another, alienation of students from administration. The atmosphere in Nashville, Tennessee, at Fisk University during the early 1950s included neither of these ingredients. Most students admired their professors and respected the University president. In the case of Fisk, activism grew out of a shared sense of values and demonstrated leadership – as well as a response to outside oppression. This leadership and these values were passed on to students by Fisk’s charismatic president, Charles S. Johnson. The purpose of this historical research is to explore the approach to activism that Charles S. Johnson advocated and instilled in the students at Fisk University. How did Johnson develop his values and convictions? On which principles were they based? How did he pass them on to others? And, how can Johnson’s example help today’s college presidents contribute to a renewed sense of activism among their students? Through the use of archival materials, interviews, and secondary sources, I will highlight Johnson’s “sidelines” approach and discuss his student’s reactions to it. Welcome ear colleagues in history, welcome to the one-hundred-fi rst annual meeting of the Organiza- tion of American Historians in New York. Last year we met in our founding site of Minneap- Dolis-St. Paul, before that in the national capital of Washington, DC. On the present occasion wew meet in the world’s media capital, but in a very special way: this is a bridge-and-tunnel aff air, not limitedli to just the island of Manhattan. Bridges and tunnels connect the island to the larger metropolitan region. For a long time, the peoplep in Manhattan looked down on people from New Jersey and the “outer boroughs”— Brooklyn, theth Bronx, Queens, and Staten Island—who came to the island via those bridges and tunnels. Bridge- and-tunnela people were supposed to lack the sophistication and style of Manhattan people. Bridge- and-tunnela people also did the work: hard work, essential work, beautifully creative work. You will sees this work in sessions and tours extending beyond midtown Manhattan. In 2005, after a career as a journalist, an editor, a book publisher, and a school- teacher, Morris began writing books full-time. Among his works are Jailhouse Journalism: The Fourth Estate Behind Bars; The Rose Man of Sing Sing: A True Tale of Life, Murder, and Redemption in the Age of Yellow Journalism; Pulitzer: A Life in Politics, Print, and Power; Eye on the Struggle: Ethel Payne, The First Lady of the Black Press, which was awarded the Benjamin Hooks National Book Prize for the best work in civil rights history in 2015; and The Ambulance Drivers: Hemingway, Dos Passos, and a Friendship Made and Lost in War. 1 REMEMBERING MARTIN LUTHER KING, JR. David Levering Lewis NYU Washington 1307 L Street, NW Sunday, 5 PM January 20, 2013 Fifty years ago next August, two hundred fifty thousand Americans gathered in this city to protest racial discrimination as un-American. Martin Luther King, Jr., 34, leader of the successful Montgomery Alabama Bus Boycott, president of the Southern Christian Leadership Conference (SCLC), engaged in a bitter campaign to desegregate police chief Bull Connor’s Birmingham, Alabama, spoke last. His speech was one for the ages, an oration whose eloquent content matched the Gettysburg Address. Unlike Abraham Lincoln’s address, carefully prepared well in advance of his trip to a battlefield dedication, Martin Luther King’s speech was a masterpiece of eleventh-hour composition and inspired improvisation. He tells us that he only finished it at 4 AM on the morning of the 28th. The famous speech commenced with a Lincolnesque flourish: “Five score years ago, a great American, in whose symbolic shadow we stand, signed the Emancipation Proclamation.” As his fine baritone rolled over the great crowd, “the audience response was wonderful,” Dr. King recalls. “All of a sudden, this thing came to me.” “I have a dream,” the phrase that he had used many times before. At that point, “I just turned aside from the manuscript altogether and didn’t come back to it., ”he says.[Auto-223] The powerful cadences, 2 the edifying biblical allusions, the hypnotic iteration of the leitmotif---“I Have A Dream”---would spellbind the nation. “Now is the time to make real the promise of democracy.
