For more information, please contact [email protected]. 1960] OBSCENITY IN THE MAILS Harvey Lyle Zuckman* For nearly one hundred years the federal government has had as one of its functions the suppression of mail trade in obscene and pornographic matter.' The first federal enactment in this field provided that the mailing of an obscene book, pamphlet, picture, print, or other publication with knowledge of its nature was a misdemeanor.2 The present postal obscenity law' dates back to 1873 and is sometimes referred to as the Comstock Law because of the support given its passage by the notorious Anthony Comstock, agent for the New York Society for the Suppression of Vice. While its original wording would seem to suggest that the statute was purely penal in nature,4 the Post Office Department inferred from it inde- pendent civil authority to restrain the mailing of obscene matter.' Thus, the federal government, by virtue of the Comstock Law, utilizes each of the two recognized means for the suppression of objectionable printed matter-criminal punishment subsequent to publication and administra- tive restraint prior to publication or distribution. Until quite recently little legal or lay attention was paid to the federal government's two-pronged attack on mail pornography and obscenity. However, two recent obscenity cases, one construing and upholding the validity of the Comstock Law's criminal provisions6 and the other ques- tioning the Post Office's system of administrative restraint,' have created much interest in this field. This article is devoted to an analysis of the present status of postal obscenity law and makes recommendations for legislative change where such action seems necessary or desirable. I. SUBSEQUENT CRIMINAL PUNISHMENT Section 1461 of the Criminal Code of the United States' declares "every obscene, lewd, lascivious, indecent, filty or vile article, matter, thing, de- vice, or substance" to be "nonmailable matter." Mailing of such matter with knowledge of its character is punishable by a fine of not more than 5,000 dollars or imprisonment for not more than five years, or both, for a first offense. While first amendment problems are implicit in the statute, until recently little constitutional law had developed around it.9 A. The Roth Decision The central constitutional issue raised by Section 1461 is, of course, whether obscene expression is within the protection of the first amendment guarantees of free speech and press. If it were, the government would likely have to prove in the particular prosecution that the obscenity created a "clear and present danger" of activity so inimical to the public interest that first amendment rights had to be subordinated." This would be a very nearly impossible task because of the necessarily subjective evaluation of allegedly obscene expression." However, the Supreme Court had long assumed that obscenity was outside the pale of constitutional protection. 2 In 1957 the question was squarely presented to the Court in 3 Roth v. United States.' Roth, a well-known publisher and seller of books, photographs, and magazines emphasizing sex,'4 was convicted in the Southern District of New York on four counts of violating Section 1461. His conviction was affirmed by the Second Circuit. Ignoring the jury finding that the matter sent by Roth through the mails was obscene, the Supreme Court stated that the dispositive question was whether obscenity is utterance protected by the first amendment. The Court answered this question in the negative, saying that "obscenity is not within the area of constitutionally protected speech or press."' 5 Therefore, there exists no constitutional infirmity in punishing individuals who send obscene matter through the mails, and Roth's conviction could not be set aside. 9In a sweeping dictum in Ex Parte Jackson, 96 U.S. 727, 737 (1878), the Supreme Court presumed to pass on the constitutionality of the act when it declared that "the only question for our determination relates to the constitutionality of the act; and of that we have no doubt." However, the sole issue before the Court was the authority of Congress under the postal power to establish post offices and post roads. No issue was raised or considered under the first amendment. United States, 161 U.S. 29 (1896), the Court seemed to hold that the statute was not void for vagueness. 1oCf. Abrams v. United States, 250 U.S. 616 (1919); Schenck v. The sole question before the Supreme Court was whether the first and fourteenth amendments protected books attacked as obscene. '5 Roth v. United States, 354 U.S. at 485. 19601 OBSCENITY IN THE MAILS This holding raises many difficult legal problems, some of which the Court anticipated. The Court neatly disposed of the argument that the statute punishes mere incitation to impure sexual thoughts not shown to be related to any overt antisocial conduct. Since obscentity is not within the area of constitutional protection, the "clear and present danger" issue is never reached. Hence, the federal government may punish any mailer regardless of the effect of the mailing so long as the matter is found to be obscene. It then became imperative for the Court to attempt to set some standard by which obscenity could be distinguished from constitutionally protected expression. This problem has long troubled the courts because obscene expression must, of necessity, be measured by the subjective reaction of the audience to whom the utterance or writing is directed." For its stand- ard the Court embraced the test, first laid down in United States v. One Book Called "Ulysses,"" of whether to the average person, applying con- temporary community standards, the dominant theme of the material taken as a whole appeals to prurient interest. 8 The Court made it quite clear that sex and obscenity are not to be treated as synonymous but that reference to sex is obscene only when made in a manner appealing solely to prurient interest.' Finally, the Court held in Roth that while the wording of Section 1461 lacks precision, the statute would not be struck down as void for vague- ness since the language of the statute gives sufficiently definite warning as to the type of conduct proscribed. Thus, today there is no longer any doubt 2GThe courts have not been the only organs of government so troubled.     RESEARCH NOTE Philatelic Propaganda U.S. Postage Stamps during the Cold War ✣ Matin Modarressi After the United States joined with eleven other countries in April 1949 to establish the North Atlantic Treaty Organization (NATO), U.S. officials had to convince the public that the formation of NATO was necessary to prevent another world war. This task, they believed, was likely to be difficult. After all, for more than 150 years the U.S. government had heeded George Washing- ton’s warning in his Farewell Address to “steer clear of permanent alliances.” One of the ways policymakers sought to increase public support for NATO was through the issuance of carefully designed postage stamps. Gov- ernments around the world have long recognized the potential for stamps to serve as tiny billboards for informing, educating, influencing, and sometimes even manipulating people. In the United States, proposals for stamp designs are typically considered two to three years in advance, demonstrating how much deliberation and planning goes into each stamp’s creation. During the Cold War, the U.S. Post Office Department (which was a cabinet-level de- partment until 1971) and the U.S. Department of State used stamps to help promote U.S. foreign policy. In 1952, for example, the United States issued a special commemorative stamp on the third anniversary of the formation of NATO. During a cere- mony at the White House, President Harry S. Truman, accompanied by the postmaster general and secretary of state, autographed a sheet of stamps to be presented to the leader of each of the other NATO countries.1 The stamp was then sold at post offices around the country for six months, in place of the regular 3-cent stamp (the domestic letter rate).2 The total number of NATO stamps printed was the second highest in U.S.

We still do not know exactly how many civilian colonial prisoners were interned during the war, but the number of Indians among them exceeded 860 out of a total 2.5 million prisoners approximately in German camps (Oltmer 2006: 68; Davis 1977: 623). This may seem like an almost negligible number in terms of quantity but a study of these men can enrich our understanding of 63 the German ‘campscapes’ and of the structures that were constitutive in forming the experiences that Indian prisoners communicated to those outside the camps during and after the war.2 Among these are the shifting hierarchies and networks in the camps, the tension between German expectations of prisoners’ behaviour and their own life worlds, as well as their conscious adaptation to and subversion of German official knowledge about them. In the Great War as the first ‘total war’, propaganda played an important role, and technical advancements such as the advent of the cinema and cheap reproduction of photographs accelerated the propa- ganda war. Internally, many warring states endeavoured to influence their prisoners in some way, especially those from colonial back- grounds or ethnic minorities. For instance, while Germany publicly decried France’s and Britain’s supposed crime against civilisation by letting non-white, barbaric “half-monkeys” or “dogs” fight ‘white men’, it attempted to win over these colonial prisoners at the same time (Koller 2001: 101-24).

The End of Obscenity was written, the author tells us, in "an at- tempt to offer an insight, to those who are not a part of it, into how our legal system works."' This slows the book considerably for the legal reader,2 but should not dissuade him. It offers insights of other sorts to lawyers and to law students, since it is one of those all-too-rare books in which a lawyer unfolds the history of an important piece of litigation. The book begins with the author's retention by Grove Press in 1959 to defend Lady Chatterley's Lover3 and ends in 1966 with his successful defense of Fanny Hill4 for Putnam before the Supreme Court.

    Update: 21/04/2020 COVID – 19 Response from Postal Administrations and Trade Unions around the World Introduction The following document sets out an overview of the response by postal administrations and trade unions around the world to the coronavirus crisis. Trade unions across the globe been pushing for the introduction of robust health and safety measures, including personal protective equipment and social distancing in the workplace. They have also called for a reduction in non- essential delivery and greater involvement in the provision of emergency services such as the delivery of food and medicines. This document is being updated periodically and new information added since the previous version (on 3rd April 2020) is highlighted in red. UNI Global Union and the Universal Postal Union - the UN agency for the postal sector – have issued a joint statement urging postal operators and postal unions to put key measures in place to protect the health and safety of postal workers around the world as they continue to serve during the coronavirus health pandemic.1 Many postal operators have responded positively, with Francereducing delivery services to three days a week, although these are being stepped up again after customer complaints.Spainhas scaled back over the counter services to mornings only. The United States Postal Service has promised to make surgical masks and gloves available on demand following criticism that it was not doing enough.China Post has disinfected entire post offices, processing centres and vehicles. UruguayPost reduced staff numbers at postal facilities and introduced teleworking where possible. The operator also reduced physical contact, closed post offices with large numbers of customers and created special collection points.
