Dicks Ranking Member REPORT TO CONGRESS ON SALES OF SIGNIFICANT MILITARY EQUIPMENT TO FOREIGN ENTITIES FISCAL YEAR 2010 Under Secretary of Defense for Acquisition, Technology and Logistics June 2011 Preparation of this report/study cost the Department of Defense a total of approximately $13,347 in FY 2011 Generated on 2011Jun031434 ReflD: 1-E421404 REPORT TO CONGRESS DEPARTMENT OF DEFENSE SALES OF SIGNIFICANT MILITARY EQUIPMENT TO FOREIGN ENTITIES FISCAL YEAR 2010 June 2011 Under Secretary of Defense for Acquisition, Technology and Logistics Background Section 1231 of the John Warner National Defense Authorization Act for FY 2007, (public Law 109-364), requires the Secretary of Defense to submit an annual report to Congress on foreign military sales (FMS) and direct sales to foreign entities of significant military equipment manufactured in the United States during the preceding calendar year. The report is to identify all sales of significant military equipment in excess of $2,000,000, including: (1) the nature of the equipment and the dollar value of the sales; (2) the country to which the equipment was sold; and (3) the manufacturer of the equipment and the State in which the equipment was manufactured. The law defines the term "significant military equipment" as having the meaning given the term in section 47(9) of the Arms Export Control Act (22 U.S.C. 2794(9) note). The Department of Defense is able to obtain and report information on FMS only. It should also be noted that the data required to satisfy the FMS reporting requirements of section 1231 is not readily available in a single database and must be requested from each of the Components on a manual data call basis. Further, although section 1231 requests data on a calendar year basis, the Department of Defense collects its data on a fiscal year basis. Therefore, the enclosed data reflects FMS purchases for FY 2010. Information on direct commercial sales is only available through Department of State's Licensing Division. While the Department of State was able to provide most of the requested information, it does not track the state in which the equipment was manufactured and does not provide the manufacturer. Per the Department of State, the Arms Export Control Act and its implementing regulations, the International Traffic in Arms Regulations, do not require the state of manufacture for equipment to be exported under the direct commercial sales program. Additionally, while they do require information on the manufacturer of equipment to be exported, their forms and collection methods are not designed so that the manufacturer is specifically identified. The enclosed direct commercial sales data is for FY 2010 as well. FMS Purchases FY 2010 Forty-seven countries procured significant military equipment that exceeded $2,000,000 through the FMS system in FY 2010. The total value of these purchases was $9,451,945,114.17. These purchases were made through the Air Force, Army, Navy, and the Defense Logistics Agency. A detailed breakout of the purchases by Military Service, contract number, manufacturer, dollar value, type of hardware, and state of performance is contained in Attachment 1. Direct Commercial Sales FY2010 Fifty-two countries procured significant military equipment that exceeded $2,000,000 through direct commercial sales in FY 2010. The total value of these purchases was $13,497,4 77,100. A detailed breakout of the approved sales of significant military equipment, the relevant license/case number, the country, dollar value, and description is contained in Attachment 2.
