MINUTES OF PARISH COUNCIL MEETING HELD AT VILLAGE HALL ON WEDNESDAY 18 TH JULY 2018

18/074 Apologies for Absence Apologies were received and accepted from Parish Councillors R Airey, B Dawson, G Gardner & T Wilson and PCSO H Firth.

18/076 Declarations of Interest None.

18/077 Minutes of the Last Meeting Resolved The acceptance of the minutes of the meeting held on 6th June 2018 was proposed by Councillor Keith, seconded by Councillor Rawsthorn, agreed unanimously and signed by the meeting Chair (Councillor Ryland).

18/078 Public Participation (at the Chairman’s discretion) None.

18/079 Police PCSO Firth was absent, but he has sent a report on calls for Police service over the past 30 days: Flookburgh (17) - ASB 3, Sex Offences 1, Damage 2, Assault 2, Burglary 2, Suspicious Incident 1, Domestic 2, Concern For Welfare 1, Missing Person 1, Theft 1, Pets 1 - Domestic 1.

18/080 District and County Councillors a) District Councillor Michael Cornah introduced himself to the Parish Council as one of the two District Councillors representing the new Cartmel ward. He has had a property in Ayside since 1983, where he now lives. He is a retired orthopaedic surgeon from the Fylde area who plays in an orchestra. He is currently also Councillor on Fylde Borough Council and his term ends in 2019. He has experience on the Planning Committee at Fylde Borough Council and has already attended two Planning Committee meetings at District Council where the development of the Crown Inn in Flookburgh into dwellings was approved and the development of 61 extra-care apartments in Flookburgh was refused. He gave his apologies for the September 2018 meeting. Councillor Keith raised concerns about a deteriorating wall on Cark House which was converted into 6 dwellings in 2003. b) County Councillor Sue Sanderson reported: i) She has again reported the white lining issue by a resident’s house where inconsiderate parking is preventing him being able to get out and has reminded CCC Traffic Engineer Victoria Upton about lining generally and asked for possible timescales ii) Traffic issues at Fell Foot have meant police intervention discussions with Highways are underway about double yellow lines due to parking on both sides of the road blocking access on the A592. Police are attending on Sundays. iii) She has raised issues about the River Eea in Lower Holker. They are aware of the problems. The Environment Agency and United Utilities have talked to the businesses in Cartmel about measures to reduce the amount of fat they release into the sewage system.

iv) The final report on the flooding and recovery after Storm Desmond will be presented at Cabinet next week. She was interviewed by the report author again this week following comments about the roles Elected Members played in supporting communities through the phases of response and recovery. v) She continues to work with a range of agencies in my cabinet role. She visits schools and works closely with maintained schools and academies, Ofsted, Regional Schools Commissioner and the DFE. vi) She has been asked to speak at an Education Forum in London in December about supporting children with SEN as a Local Authority. The Council won an award for all the work it has done supporting and developing apprenticeships. The introduction of apprenticeships has lowered the age profile of CCC staff. They will develop a Traineeship for those without 5 GCSEs which can then lead to an Apprenticeship.

18/081 Planning Application procedural changes – South Lakeland District Council The Clerk reported that South Lakeland District Council the Parish Council that they would no longer be sending paper copies of Planning Applications to Parish & Town Councils and they would be notified by email. David Cooper, SLDC Development Control Team Leader, will be attending all Parish and Town Council meetings to discuss these changes, meeting dates have been provided but no notification has been received as to when he will attend Lower Holker Parish Council’s meeting. As not all the Councillors use email or computers, the clerk outlined possible options so Councillors could see the plans: Printing application forms (A4) – on Parish Council Printer. Printing Plans then photocopying to A3 size (plans for July meeting cost £16.20) Projecting plans from a laptop onto a screen/suitable wall – projector cost from £60 to £1,200. Screen cost from £30 to £50. Resolved To defer a decision to the next meeting.

18/082 Planning Applications The following Planning Applications were considered: a) SL/2018/0479. West Plain Marsh, Flookburgh, Modification of saltmarsh habitat to create saline lagoons to support breeding and wintering birds. Resolved To comment that the Parish Council has no objection to this application, provided the vehicular access to the shore is maintained on the indicated track (or otherwise) and to walkers on the footpath line indicated. b) SL/2018/0482. OS Field No 2379 and part OS Field No 4872, Flookburgh. Formation of a farm track. Resolved To fully support this application as it will improve access for the farmer to his land and reduce the number of large vehicles travelling through the villages of Ravenstown and Flookburgh. c) SL/2018/0490. Land adjacent to 55 Jutland Avenue, Ravenstown. Dwelling, formation of vehicular access and connection to foul sewer. Resolved To fully support this application for a dwelling for a local family, however do not want it to create a precedent for further development on the adjoining land. d) SL/2018/0520. Willow House, Willow Water, Moor Lane, Flookburgh. Erection of malt storage silos and boiler chimney in connection with proposed brewery. Resolved To fully support this application as it will provide increased employment in the Parish, however raise concerns that the increased height of the development would not be in line with the other industrial buildings on the site. e) SL/2018/0539. The Garden House, Holker Grange-over-Sands LA11 7PN. Single storey artist studio and study extension. Resolved To support the application as the development replaces another building in the same location and does not adversely affect any other properties. f) SL/2018/0584. 3 Field Head Place Flookburgh LA11 7LW. Detached garage. Resolved To fully support the application as it will provide off street parking for residents and does not impinge on other dwellings.

18/083 Planning Decisions The following Planning Decisions were noted: a) SL/2018/0310 Airfield Farm, Moor Lane, Flookburgh. General purpose agricultural building. Granted. b) SL/2018/0231.Greenacres, Green Lane, Flookburgh LA11 7JT. Single storey extension and raised terrace. Granted with conditions relating to plans, materials and advice from Network Rail. c) SL/2017/0715. Land off Manorside, Flookburgh LA11 7JS. Erection of extra care residential development consisting of 61 apartments and communal facilities together with access, car parking and communal landscaped garden. Refused.

18/084 Standing Orders Review The Parish Clerk outlined the draft revised Parish Council Standing Orders, which are based on the NALC Model Standing Orders 2018. These revisions comply with new regulations for Parish Councils in relation to Smaller Authorities (Transparency Regulations) 2015, Transparency requirements, Amendments to the Public Bodies (Admission to Meetings) Act 1960, United Utilities Contract Regulations 2016 and General Data Protection Regulations 2018. Resolved To adopt the revised Parish Council Standing Orders.

18/085 Financial Reports Resolved The Financial report, including budget comparison and bank reconciliation as at 24 June 2018, was accepted unanimously.

18/087 Highways a) Reports requiring Highways Maintenance – none b) Highways matters in process with County Council – damaged 30 mph sign on Allithwaite Road has been replaced. c) Damaged wall outside Engine Inn, Cark – no response from Brewery. d) Grassed area south of Stockdale Farm – County Councillor Sanderson will investigate with Cumbria Highways. Clerk with make enquiries with former Councillor Jack Manning as to who is responsible for maintenance.

18/088 Speed Monitoring The Police have monitored on Moor Lane, Flookburgh as requested and fined a driver travelling over 40 mph.

18/089 Street Lighting The Clerk reported that she had attended a CALC Street Lighting meeting in Grange on 18th June 2018. Different Parishes appear to have different arrangements, some manage their lighting independently, some (like Lower Holker) pay electricity costs direct and pay Cumbria Highways for maintenance, others are invoiced via South Lakeland District Council. No conclusion was reached about best or preferred practice.

18/090 General Data Protection Regulations (GDPR) Parish Council documents and contacts continue to be checked by the Clerk.

18/091 Environment Agency Report on the River Eea The Clerk had requested that the Environment Agency undertake a further survey around race days to monitor the water quality. They responded advising that previous monitoring in February, May and July had similar results, so it would not appear necessary to undertake another survey. Councillors Keith & Rawsthorn raised concerns about the low level of the River Eea and that a visitor was fishing in one of the pools without a fishing licence.

18/092 Holiday Let Property Nuisance in Cark The Clerk reported that she had spoken to the owner of the property who eventually agreed to have a meeting with the Parish Council and local residents. She then spoken to Kate Lennox who advised that the property is up for sale, therefore it did not seem appropriate to meet with the current owner as there would be a change in management The meeting was therefore cancelled.

18/093 Public Toilets Nothing to report.

18/094 Flookburgh & District Recreational Charity The Clerk reported that the sign at the Playground entrance has finally been installed completing the Kompan works. The final cheque to pay Kompan has therefore been posted. Grass cutting has been undertaken by James Rawsthorn (mowing) & James Prescott (strimming) and the sit on mower is now working. The Clerk reported that a child had fallen off a piece of equipment and been injured. Advice was sought from South Lakeland District Council Principal Community Spaces Officer who advised that the appropriate safety surface was in place and no further action is required. Resolved to write to the parent of the child and advise the results of the investigation.

18/095 Correspondence The following correspondence was noted: a) South Lakeland District Council Notification that Grange Neighbourhood Plan to proceed to Referendum. South Lakeland District Council and Eden District Council Older Person’s Housing Strategy 2018 to 2025. b) Cumbria Association for Local Councils (CALC) Monthly newsletter and training courses. North West Coast Access update ( Coast Path – Silecroft to Silverdale at Stage 2 (develop) of 5 stages – Stage 5 is open). c) Neighbourhood Alerts Courier Fraud – call from supposed ‘officials’ eg bank/police asking to withdraw money from the bank and hand over to a courier. Fake texts about EE bills. Computer software service fraud – call saying there is a problem with the computer then charging to fix it. Unsolicited calls from organisation falsely stating it is the Telephone Preference Service. Bogus cold callers about water pressure. Fake Argos texts offering refunds. d) MP Summer Surgery Tour (7 th September, 2.30 pm Flookburgh, 3.15 pm Cark) Autumn Advice Surgeries (4 to 5 pm on 19 th October – Victoria Hall, Grange). e) Information Commissioner’s Office Newsletter.

18/096 Date of Next meeting The following meeting was noted: The next Parish Council meeting will be held at 7 pm on Wednesday 5th September 2018 in Lower Holker Village Hall.
