The Committee is meeting today to hear testimony on H.R. 831 and H.R. 2793. They are intended to settle land claims asserted by the Bay Mills Indian Community and the Sault Ste. Marie Tribe of Chippewa Indians. The bills are

Expanding through the years, it has played a significant part in the lives of many Kappas both young and old. These borrowed words of a prominent fraternity man exemplify its merit: "This service alone would make any organization worthwhile." Kappa Kappa Gamma assists others in the local communities through the Rehabilitation Services established at the 1952 convention. Through our various alumn~ groups and university chapters we have adopted many worth-while projects which include material aid and service. Through this overall ph,ilanthropic program Kappa is fulfilling a vital service and civic responsibility. Each of us has an instrumental role in the continued success of these valuable endeavors. On January 7, 2003, and April 30, 2003, we wrote your Band about this issue and provided you with the opportunity to recommend to us the designation, attainment/unclassifiable or nonattainment, of the 8-hour ozone standard, that you believe to be appropriate for your lands. As the next step in this designation process, we have reviewed the available information on the air quality in your area and, consistent with Section :t07(d)(1) of the Clean Air Act (CAA), by this letter are informing you that we intend to designate Calhoun County, Michigan, including all tribal lands therein, as nonattainment, i.e. not meeting the 8-hour ozone health standard. The EPA is obligated by the CAA to designate air quality for all areas of the United States, including Indian country. It is EPA's responsibility under Section 107(d) (1) to determine if the population within a given area is exposed to unhealthy levels of specific air pollutants, in this case ground-level ozone. We implement this responsibility by identifying the areas that experience the unhealthy air and any nearby areas that are contributing to the air quality problem.

    CHAPTER V CONSULTATION PROCESS MAP‐21 and the FAST Act require that BCATS consult with federal, state and local entities that are responsible for the following: •Economic growth and development • Natural resources • Environmental protection • Conservation •Airport operations • Historic preservation •Freight movement •Human service transportation providers •Land use management The goal of this process is to eliminate or minimize conflicts with other agencies’ plans and programs that impact transportation, or for which transportation decisions may impact them. Since the intent of the consultation, according to FHWA, is to exchange information, and not just ask for comments on the BCATS Plan or TIP, BCATS began the consultation process for its overall program with the distribution of a general letter to the involved parties many years ago with a letter making contact in January 2007.
