  • Save Our Screens Missouri
SAVE OUR SCREENS MISSOURI Missouri movie theater owners and operators thank our lawmakers for their leadership throughout the COVID-19 crisis. The state’s movie theaters are among the hardest-hit industries and need help to ensure they will continue operations, rehire workers, and return to profitability (and pay taxes on those profits) after the public health crisis abates. Please support financial relief for struggling movie theaters of all sizes in Missouri. With your help, our cinemas will play an important role in rebuilding the state’s economy and continue to bring the shared cultural experience of moviegoing to our communities. ___________________ Economic and Cultural Engines. From Main Street to the state’s urban centers, cinemas are business anchors and economic multipliers in the communities they serve. Cinemas (1) invigorate and revitalize neighborhoods, (2) drive foot traffic to local small businesses, (3) foster cultural vibrancy, and (4) create employment opportunities in communities across Missouri where jobs can be few and far between. Unprecedented Industry Disruption. Prior to the pandemic, Missouri had a robust movie theater market that generated more than $230 million in revenue in 2019. Capacity limitations combined with a lack of new movie releases, however, have caused cinema revenues to plunge by 80 percent industrywide. Cinemas Need Help. There are approximately 65 cinema companies operating more than 810 screens at over 125 locations across the state. Each passing day without help, however, is another day closer to more cinema owners in Missouri reaching their breaking point. Grant and Tax Relief Programs. A grant program of up to $8.5 million and tax relief would provide critical lifelines to help movie theaters bridge the pandemic and contribute to the state’s broader economic recovery when new movies return to our screens later this year.

Introduction To show a film, a movie theater must obtain a license from the film’s distributor. The case before the Court involves the competitive market between theaters for exclusive licenses to show specialty films. Plaintiffs—2301 M Cinema d/b/a West End Cinema (“West End Cinema”), the Avalon Theatre Project, Inc. (“the Avalon”), the Denver Film Society, and the Cinema Detroit (collectively, “plaintiffs”)—bring this action against Silver Cinemas Acquisition Co. d/b/a Landmark Theatres and its parent corporation 2929 Entertainment, LP (collectively, “Landmark”). Plaintiffs allege that Landmark violated federal antitrust law by using its national market power to coerce film distributors into granting Landmark exclusive licenses, preventing plaintiffs and other independent theaters from showing specialty films. Plaintiffs’ four-count complaint charges Landmark with: (1) 1 Case 1:17-cv-01990-EGS Document 21 Filed 09/28/18 Page 2 of 30 circuit dealing in violation of Section 1 of the Sherman Act; (2) using its monopoly power in violation of Section 2 of the Sherman Act; (3) attempting to use its monopoly power in violation of Section 2 of the Sherman Act; and (4) interfering with plaintiffs’ business relations. Pending before the Court is Landmark’s motion to dismiss plaintiffs’ complaint. See Defs.’ Mot., ECF No. 16.
