SCHEDULE—VILLAGE UNITS OF THE COUNTY OF SAMBURU The Samburu County Village Units Delineation Bill, 2015 THE SAMBURU COUNTY VILLAGE UNITS DELINEATION BILL, 2015 A Bill for, AN ACT of the County Assembly of Samburu to provide for the establishment And delineation of the village units in the county and for connected purposes. ENACTED by the County Assembly of Samburu as follows— PART I—PRELIMINARY Short title and Commencement 1. This Act may be cited as the Samburu County Village Units Delineation Act, 2015, and shall come into operation upon the expiry of thirty days from the date of publication. Interpretation 2. In this Act, unless the context otherwise requires — "Ward' means an electoral area within a County delimited in accordance with Article 89 of the Constitution and section 26 of the County Government Act, 2012; "Village Unit" means the decentralized unit of the County Government delimited in accordance with section 48 of the County Government Act, 2012. Object and purposes of Act 3. The object and purpose of this Act is to provide for the delineation and establishment of the village units in Samburu County so as to provide for the further decentralization of the functions and provision of services by the Samburu County Government in accordance with Article 176(2) of the Constitution. PART II—ESTABLISHMENT AND ADMINISTRATION OF VILLAGE UNITS Establishment of Village Units 4. The Village units of the description specified in the sixth column of the Schedule which comprise the Ward specified in the first column of the Schedule shall comprise the Village Units of Samburu County. The Samburu County Village Units Delineation Bill, 2015 3 Village Administrator 5. (1) Each of the Village Units referred to in section 4 shall be administered by a Village Administrator in accordance with section 52 of the County Government Act, 2012. (2) No person shall be appointed a village administrator unless such person– (a) meets the requirements of Chapter Six of the Constitution; (b) has attained a post secondary education with proof of certification; (c) is a resident of the County. PART III—MISCELLANEOUS PROVISIONS Rules 6. (1) The Member of the County Executive Committee may make rules for the better carrying out of this Act and such rules shall be approved by the County Assembly before gazettement. (2) Without prejudice to the generality of sub-section (1), the Rules shall provide for the boundaries of the Village Units in line with the requirements of the Constitution, the County Governments Act, 2012 and this Act. Provisions in the Act are complimentary 7. PART I of the Bill deals with preliminary matters Clause 1 of the Bill contains short title of the Bill and provides for the Act to come into operation upon the expiry of thirty days from the date of publication. Clause 2 provides or the interpretation to be attached to word used in the Act. Clause 3 sets out the objects and purposes of the Act. PART 2 of the Bill deals with the establishment and administration of the village units. Clause 4 establishes the several Village units set out in the Schedule. Clause 5 provides for the qualifications of the village administrator. PART 3 of the Bill contains miscellaneous provisions. Clause 6 empowers the Member of the County Executive Committee to make Rules for the implementation of this Act and such Rules shall be approved b y the County Assembly before implementation. The boundaries of the village units shall be specified in those Rules. Clause 7 provides for complementarity of this Act with the County Government act 2012 in relation to the establishment and administration of village units. Dated 5th May, 2015.
