REPORT OF: Review of Licensing Act 2003 Service Director & Gambling Act 2005 Public Health & Protection

1. PURPOSE OF THE REPORT

The purpose of the report is to update Members on relevant issues, with regard to

. the Licensing Act 2003

. the Gambling Act 2005

2. RECOMMENDATION

Members are requested to: -

(i) note the contents of the report in respect of the Licensing Act 2003 which has been provided for information;

(ii) note the contents of the report in respect of the Gambling Act 2005, which deals which includes a Review of fees of Designated Premises Licences.

3. BACKGROUND

Members will be aware that a quarterly meeting is convened to review and discuss the implementation and progress of the Licensing Act 2003, together with any ancillary matters arising from responsibilities with which this particular Committee is charged.

Such ancillary matters include the Gambling Act 2005. (There may also be ancillary matters arising from the impact of the Smoke-Free Premises Regulations, which have the potential to affect all licensed premises).

4. LICENSING ACT 2003

4.1 Application Process

Applications received since the last update (21st March 2016 to 26th June 2016) are as follows:-

Matters to note this period are that the TEN's applications submitted have nearly doubled since the last period with Licensees taking advantage of increasing their licensable hours and other licensable activities over the two Bank Holiday weekends in May. Further TEN's have facilitated many Fete's or Charitable events for the provision of alcohol sales or entertainment across the Borough. Analysis of the TEN's applications indicate 33 were for Private Members Clubs, 55 for existing premises and 27 for community events. Many of the TEN's provided relate to extended hours for the Rugby International games which commenced at 8.30am in advance of most premises permitted licensable hours.

In accordance with the advice received in respect of data protection matters, the summaries of Personal Licences and Premises Licences issued under delegated authority are now reproduced for information as a Part II restricted item.

4.2 Contested Applications

Station Hotel, Ynyshir

The Sub Committee determined to grant a variation application to extend licensable activity i.e the retail sale of alcohol to the first floor of the premises. Members heard from one local resident who expressed concern as to the granting of the variation in view of music and patron noise nuisance he currently experienced.

Members believed that with the imposition of conditions suggested by Responsible Authorities that the variation for the additional hours for the retail sale of alcohol could be granted with the exception of Sunday which should remain outside the scope of the variation in view of the residential area and the views expressed by the local resident.

Broadway Social Club, Treforest

The Sub Committee determined to refuse the application from the Club Premises Certificate holders to extend licensable activity in respect of the retail sale of alcohol until 01.00hrs. Members expressed a lack of confidence in the management of the existing Club Premises Certificate concerning the admittance of Non Members and advocated that should the premises wish to hold charitable events with a later terminal hour then the Club could utilise Temporary Events Notices (TEN's).

Bargain Booze, Treforest

The Sub Committee determined to refuse the application for a grant of a premises licence for a new Bargain Booze off Licence on the Broadway, Treforest following objections raised by Responsible Authorities, Police, Child Protection, Trading Standards and Licensing Authority Officers and in addition a significant number of local residents, business and local member objections.

The Sub Committee were of a view that a licence could not be granted without compromise to the licensing objectives, in particular the prevention of crime and disorder and the protection of children from harm. Of particular concern were the objections raised by the Children’s Safeguarding Manager in respect of the need to protect children from harm, in view of the proximity of the local primary school. In addition the exposure of young persons who attended an existing neighbouring music store to attend music lessons from those who would purchase/consume alcohol at the prospective off licence.

The Sub Committee were mindful of identified non compliance at one of the applicant’s previous business' in Pontypridd and felt that the applicants had not demonstrated sufficient understanding of the concerns and existing issues within the locality.

White Dragon, Treorchy

The Sub Committee determined to refuse a Variation application by the applicant to extend the retail sale of alcohol and opening hours at the premises. Responsible Authorities , Environmental Health, Trading Standards and Licensing Authority Officers all concluded that they could not support the application given a number of resident objections and recent and historic complaints of music and patron noise. Members considered that the Management regime at the premises had demonstrated a lack of regard for the concerns of local residents and were mindful of the lack of confidence expressed by Responsible Authorities for the management adopt the change necessary to secure promotion of the licensing objectives.

New Inn Hotel, Ton Pentre

The Review of this premises licence was brought about by the Licensing Authority who identified that the Premises was engaging in non SIA Accredited door staff, contravening conditions of licence and the Private Security Industry Act 2001. Furthermore, the Licensing Authority expressed concerns over the lack of management control exhibited at the premises.

The Review was supported by South Wales Police who expressed concern in respect to delays in securing CCTV footage from management at the premises. The position of the Licensing Authority and South Wales Police was supported by Environmental Health and Trading Standards Officers.

In response Management from the premises apologised for the breach of licence conditions and admitted having been lax in not checking door staff properly at the premises. The Licensees representative stated that there was no objection to the imposition of the conditions as set out by the Licensing Authority.

Members advised the Licensee that they were sufficiently concerned about management practices and had considered the Suspension of the premises licence in addition to the imposition of conditions as detailed within the Committee report. However they determined that on this occasion the matter would be determined by a warning, together with imposition of conditions.

Appeals

In the last report the following Appeal was pending but the Appellant withdrew his Appeal on the actual day of the Court Hearing.

Members may recall that the Sub Committee determined to remove the live and recorded music as both licensable and deregulated activity, following a history of intervention by Environmental Health and Licensing Authority Officers, following the hearing held on the 9th October 2015.

Following a protracted legal process, the matter was due to be heard on the 7th April 2016. However, on the day of the Hearing, the licensee decided to withdraw his Appeal meaning that no entertainment could be held at the premises in the absence of an authorisation i e a licence or Temporary Event Notice (TEN) .

Following the conclusion of court proceedings, liaison with the Licensee who is keen to reintroduce entertainment at his premises for his customers and Officers of the Licensing Authority / Environmental Health Pollution Team has subsequently resulted in a number of Temporary Event Notices (TENS’s) for entertainment being held at the premises. To date it is noted that none of these events have resulted in any further complaint from local residents.

The Licensee is currently engaging with the Licensing Authority with a view to making a variation application to include the provision of live music at his premises.

4.5 Compliance & Enforcement

(i) Prosecutions

There have been no prosecutions concluded in the period. .

(ii) Test Purchasing

There have been no underage sales Test Purchases conducted in respect of alcohol during the period.

Following complaints Officers have conducted a Test Purchase at a premises selling hot food in the absence of a Late Night Refreshment licence. Following a succesful test purchase, the food business proprietor was advised as to his legal obligations and to date no further complaint has been received.

(iii) Premises Inspection & Infringements

35 premises in the Borough were inspected in the last period.

A summary of infringements arising from inspection is reproduced as Appendix 1B.

Whilst the majority of infringements have been dealt with via written advice or warning. There are three infringement reports on going as a result of inspection or complaint. Two relate to Late Night Refreshment establishments selling hot food beyond their permited hours. The third relates to the unauthorised off sales of spirits. An update in respect of these matters will be provided for Members in due course.

(iv) Complaints, Advice and Guidance

Cynon Valley

Advice has been provided to the Prospective Licensees of a licensed premises due to reopen in , after is closure for a number of years.

A community engagement exercise was undertaken in the area following anonymous complaints in respect of crime and disorder, anti social behaviour and noise nuisance. As a result of the information obtained, a meeting was held with the club concerned and written Lic Act Cttee 13/07/16

advice provided to club officials. As a result the club have submitted a number of TEN's and no further complaints have been received.

A Premises in Mountain Ash received a letter of warning following complaints of noise nuisance and anti social behaviour of patrons. The cause appeared to be the poor management of windows and doors at the premises. Following intervention, no further complaints have been received.

A meeting has been held with a private members club in the Mountain Ash area in order to remind them of their wider social responsibilty under the Licensing Act 2003 particularly in respect of neighbouring residential premises.

A number of premises in Mountain Ash have been visited by Police and Licensing Enforcement Officers following an increase in the number of complaints that appeared to be linked to a period of fine weather. Work in this area with licensed premises will continue over the next few months.

Rhondda

Following information received concerning a public house advertising bottles of spirits on social media in the absence of the appropriate authorisation. Officers arranged for a test purchase to be undertaken which confirmed the allegation the premises licence holder and designated premises supervisor have both been subsequently formally interviewed and an infringement report will be submitted in due course.

A complaint was received about a premises in Treorchy open beyond its permitted hours and indeed until 3am. It was also identified that there was an absent Designated Premises Supervisor at the premises. Both matters were addressed following a joint visit by Police and Licensing Officers.

The Licensing Authority received a complaint from a resident living in close proximity to a licensed premises selling hot food to local school children about litter arising from such sales. The Licensee was encouraged to provide further waste bins to ensure that waste was kept to a minimum, the matter was also referred to the Street Care Team. To date there have been no further complaints received.

A prospective lessee of an empty premises had sought advice from the licensing team and police licensing over the feasibility of opening a nightclub in the Tonypandy area. Approriate advice was given at a visit to the prospective premises. To date no application has been received.

Complaints were received of a pizza and kebab shop opening later than 11pm without a licence. A warning letter was sent to the proprietor but the premises continued to open beyond its permitted hours. A Test Purchase evidenced the position and was brought to the attention of the proprietor, since that time no further complaints have been received Lic Act Cttee 13/07/16

A multi agency meeting was held with applicants for a new bistro style premises in Treorchy was conducted in advance of an application as advocated by the Authority's Licensing Policy. The subsequent application received no adverse comments and the licence later granted.

Following complaints of noise and disorder arising from a Ton Pentre on licensed premises. The Licensee met with Responsible Authorities and following that meeting determined to make a variation application to remove unenforceable conditions and replace the same with conditions agreeable to responsible authorities.

Following an inspection of a Nightclub in the Pentre area, Officers observed a burger van selling hot food in the absence of the appropriate Late Night Refreshment licence. Following advice provided to the Licensee of the venue concerned, the Authority is now in receipt of an application for a Late Night Refreshment licence and the matter undergoing the standard 28 day consultation.

A Rugby club in the area has purchased a premises holding a Premises Licence and has moved its club house and transferred the licence appropriately. .

Following events authorised by a Temporary Event Notice at a local community establishment that generated a number of complaints of entertainment noise and disturbance. A meeting was held with Licensing Authority, Police Licensing and Environmental Health to give appropriate advice regarding any further events that may take place at the venue.

A multi agency meeting was held with the applicants for a new premises licence in Rhondda Fach that had generated a large number of objections to the proposed hours. A response is awaited from the applicant following proposals by Responsible Authorities.

A joint meeting was held with Police and representatives from a premises in lower Rhondda following two incidents that occurred at a Charity Event which required Police intervention. A noise nuisance complaint was received from a local resident during the same event. Written advice was given to the Premises concerned and complainant advised of the outcome.

Taff Area

Advice and guidance has been provided to a local brewery in concerning alterations to their business premises and licensable activities permitted at the same. The Licensing Authority subsequently received the required Grant application.

A meeting was held a with club officials from a workingman's club to advise on use of TEN's for events and admittance of non-members.

Advice was also given regarding small society lotteries. Guidance notes and applications were given to the club representatives in order for them to make the necessary applications.

A complaint was received from a local resident in regarding music noise from a speaker fixed on the outside wall and beer garden of the premises. Officers was visited the premises and the speaker subsequently removed. Following this intervention a compliment was received by the authority from the complainant.

An Absent DPS was identified at an Off licence in Tonyrefail during a routine inspection. Licensing staff returned to the store the following morning to ensure that the premises was not selling alcohol until the appropriate applications received and permissions in place.

An Absent DPS was identified at a store in , this was remedied following advice and guidance from Licensing Officers.

An Absent DPS was identified in a pub in , Officers visited the premises following a complaint of noise nuisance from a resident. Advice and guidance was given and a Vary DPS application was received. No further noise nuisance complaints have been received.

An advice meeting took place at a private members club in the area following allegations of unauthorised licensable activity, i.e supply of alcohol beyond permitted hours. This premises is currently being monitored.

An advice meeting took place at a private members club in the Taffs Well area, following a complaint of loud music noise from a local resident. The club management have since moved their music to another area of the club which appears to have alleviated the problem.

A Temporary Event Notice was Granted at Ynysangharad Park to allow for a charity football match to include the retail sale of alcohol. Officers attended the event to inspect the TEN and everything required was found to be in place. Officers also attended planning meetings prior to the event to offer their experience of such events.

On 11th June 2016, Licensing Officers attended Pontypridd town centre in conjunction with South Wales Police Officers to conduct inspections of licensed premises on an extremely busy day of sporting events. Officers were pleased with the high level of compliance at the time of their visits and this information was passed back to the trade during a recent Pubwatch meeting.

Officers have maintained their approach of utilising the power of Suspension under the Licensing Act in respect of Premises Licence Holder or Club Premise Certificates (CPC's) to ensure that fees are paid promptly This is reflected in the level of outstanding fees as detailed above.

There are currently two premises licences suspended, however it would appear that neither premises is currently trading.

5.2 Trade profile – Gaming Permits

Complimentary to Premises Licences are a wide range of Gambling Permits that allow lower level gaming in primarily alcohol licensed premises. A summary of existing permissions is as follows:-

5.2 Enforcement

One complaint has been received in the period in respect of illegal betting alleged to be facilitated by an on-licence Premises in the area. The licensee was advised in writing as to his obligations under the Gambling Act and the Gambling Commission notified accordingly. The licensee responded to the Licensing Authority and denied the allegation.

Two joint visits in conjunction with the Gambling Commission were conducted in the Borough in the period. Further visits have been diarised for the next quarter.

5.3 Recovery of Annual Fees

As a result of the static nature of the trade, there is little change to the position, where 100% recovery of annual fees is the standard, primarily due to the robust provisions contained within the legislation which allow for withdrawal of the licence/permit for non-payment of appropriate fees.
