Poslijediplomski Specijalistički Studij POSLIJEDIPLOMSKI SPECIJALISTI ČKI STUDIJ «PRAVO EUROPSKIH INTEGRACIJA» 1. UVOD 1.1. Razlozi pokretanja studija Svrha poslijediplomskog specijalisti čkog studija «Pravo europskih integracija» (nadalje: Studij) je stru čno obrazovanje diplomiranih pravnika, diplomiranih ekonomista i diplomiranih politologa. Dosadašnja iskustva su pokazala da u tijelima državne uprave, regionalne i lokalne samouprave, tijelima pravosu đa, javnim službama te u gospodarskim subjektima u Republici Hrvatskoj nema kadrova koji posjeduju specijalisti čka znanja iz europskog prava. Praksa zemalja, novoprimljenih članica Europske unije pokazuje da uspjeh u činkovitog pridruživanja ovisi prvenstveno o kvalitetnoj implementaciji europske pravne ste čevine. Poseban problem u vezi s ve ć implementiranim acquisom jest njegova provedba. Naime, ispravna provedba mogu ća je samo pod pretpostavkom postojanja institucionalnog okvira za provedbu preuzetih europskih rješenja.. Da bi se izgradila u činkovita institucionalna struktura potrebno je izgraditi ne samo sustav institucija, ve ć i podi ći razinu stru čne osposobljenosti i znanja svih involviranih u tom procesu. 1.2. Dosadašnja iskustva predlaga ča u provo đenju ekvivalentnih ili sli čnih programa Pravni fakultet u Rijeci ve ć ima respektabilnu tradiciju izu čavanja europskog prava. Valja naglasiti da je Pravni fakultet u Rijeci, prvi u Republici Hrvatskoj 1996. godine uveo na IV. godini dodiplomskog studija Europsko pravo kao obvezatan predmet. Kako je najvažniji segment približavanja Republike Hrvatske Europskoj uniji upravo harmonizacija hrvatskog pravnog sustava s europskom pravnom ste čevinom, Pravni fakultet Sveu čilišta u Rijeci podiže edukaciju iz podru čja europskog prava na višu kvalitativnu razinu. Tako, Pravni fakultet Sveu čilišta u Rijeci započinje 2000. godine, u suradnji s Pravnim fakultetom Sveu čilišta Tilburg (Nizozemska), Institutom za europska istraživanja pri Fakultetu politi čkih znanosti Sveu čilišta u Genovi (Italija), Pravnim fakultetom Sveu čilišta Macerata (Italija) te Europskim Institutom sa Sveu čilišta Saarbrücken (Njema čka), prvi poslijediplomski znanstveni studij «Pravo europskih integracija» (2000/2001 i 2001/2002), koji se financirao kroz Tempus program Europske Komisije, a djelomi čno od strane Deutsche Stiftung für internationale rechtliche Zussamenarbeit e.V, Bonn, Njema čka. Na Pravnom fakultetu Sveu čilišta u Rijeci djeluje Zavod za europsko i usporedno pravo koji je u posljednje tri godine organizirao više me đunarodnih znanstvenih skupova te veliki broj kra ćih dvotjednih edukacijskih te čajeva namijenjenih široj stru čnoj javnosti, a na kojima su se obra đivala pojedina pitanja iz podru čja europskog prava zna čajna za Republiku Hrvatsku. Poslijediplomski specijalisti čki studij «Pravo europskih integracija» vode: prof. dr. Vesna Tomljenovi ć i prof. dr. Nada Bodiroga-Vukobrat. O pitanjima bitnima za izvo đenje studija odlu čuje Vije će poslijediplomskog studija kojeg čine nositelji obvezatnih i izbornih predmeta nadpolovi čnom ve ćinom glasova prisutnih članova. Vije će poslijediplomskog studija sastaje se na poziv voditeljica studija, odnosno na prijedlog članova Vije ća. Voditeljice Studija imaju teorijska i prakti čna znanja i iskustva iz europskog prava. Bile su suvoditeljice poslijediplomskog znanstvenog studija «Pravo europskih integracija» u okviru Tempus programa. Prof. dr. sc. Vesna Tomljenovi ć je Voditeljica radne skupine za javno zdravlje i zaštitu potroša ča Pregovara čkog tima Republike Hrvatske, a prof. dr. sc. Nada Bodiroga-Vukobrat je član Radne skupine «Socijalna politika i zapošljavanje» Pregovara čkog tima Republike Hrvatske. Voditeljice Studija su organizirale više me đunarodnih znanstvenih skupova iz podru čja europskog prava te uredile knjige iz tog podru čja. Od 2008. godine Prof.dr.sc. Nada Bodiroga-Vukobrat voditelj je Jean-Monnet katedre za europsko javno pravo pri Pravnom Fakultetu Sveu čilišta u Rijeci. 1.3. Partneri izvan visokoškolskog sustava zainteresiranih za pokretanje poslijediplomskog stru čnog studija Mogu ći partneri su jedinice državne uprave, regionalne i lokalne samouprave, tijela pravosu đa, pravne osobe s javnim ovlastima te gospodarski subjekti na teritoriju Republike Hrvatske. 1.4. Otvorenost Studija prema pokretljivosti studenata Program osigurava potrebnu otvorenost Studija glede pokretljivosti studenata. Osnova mobilnosti je ECTS sustav bodovanja Studija, kojim se osigurava prijelaz ali i mogu ćnost sudjelovanja u pojedinim nastavnim sadržajima na drugim sveu čilištima. 2. OP ĆI DIO 2.1. NAZIV STUDIJA Poslijediplomski specijalisti čki studij «Pravo europskih integracija». 2.2. NOSITELJ I IZVO ĐAČ STUDIJA Pravni fakultet Sveu čilišta u Rijeci, Hahli ć 6, 51000 Rijeka 2.3. TRAJANJE STUDIJA Studij traje dva semestra. 2.4. UVJETI UPISA NA STUDIJ Opći uvjeti Upis u prvi semestar Studija ima osoba koja je završila dodiplomski četverogodišnji studij ili osoba koja je završila diplomski petogodišnji studij. Polaznik mora poznavati jedan svjetski jezik do razine mogućnosti praćenja stručne literature i osnovne stručne komunikacije. Predviđene su dvije skupine polaznika. U prvoj skupini su diplomirani pravnici koji se upisuju bez dalje navedenih posebnih uvjeta. Drugu skupinu čine osobe koje su završile dodiplomski ili diplomski studij društvenih znanosti (npr., studij ekonomije, politologije, sociologije, psihologije, povijesti, filologije i sl.). Posebni uvjeti Polaznici iz druge skupine moraju prije upisa položiti slijedeće predmete: Ustavno pravo i Građansko pravo – opći dio. Polaznici iz druge skupine moraju položiti gore navedene ispite u roku od 45 dana od prihvaćanja prijave za upis i uplate iznosa za troškove konzultacija i ispita koje određuje Vijeće poslijediplomskog studija (nadalje: Vijeće). 2.5. KOMPETENCIJE KOJE STUDENT STJEČE ZAVRŠETKOM STUDIJA Završetkom Studija stječu se specijalistička znanja iz područja europskih integracija. U osnovi ta su znanja produbljena i detaljna znanja u području prava te specifična znanja iz doticajnih izvanpravnih područja europskih integracija koja su neophodna za rad na poslovima prilagodbe sustava te prilagodbe prava pravnoj stečevini EU, posebice za poslove izgradnje sustava institucija te podizanja na višu razinu stručne osposobljenosti i znanja svih involviranih u tom procesu. Program posebno ima u vidu dopunsko obrazovanje i osposobljavanje službenika, namještenika, sudaca i odvjetnika koji će u periodu koji slijedi imati znanja iz područja europskih integracija i europskog prava neophodna za obavljanje njihovih svakodnevnih profesija u izazovima pridruživanja Republike Hrvatske Europskoj uniji. 2.6. AKADEMSKI NAZIV KOJI STUDENT STJEČE ZAVRŠETKOM STUDIJA Završetkom Studija student stječe naziv Sveučilišni/a specijalist/ica europskih integracija – univ.spec.iur. 3. OPIS NASTAVNOG PLANA I PROGRAMA 3.1 a) Obvezni sadržaj Nastavnog programa Nastavni program Studija organiziran je na način da je prvi semestar obvezan za sve polaznike, dok se u drugom semestru polaznici mogu opredijeliti za jedan od ponuđenih modula: Europsko javno pravo i Europsko privatno pravo. U svakom semestru polaznik mora odslušati i položiti obvezne predmete. Pored toga polaznik mora u prvom semestru položiti najmanje jedan izborni predmet, a u drugom semestru izabrati najmanje dva izborna predmeta. Pored obveznih i izbornih predmeta nastavni program Studija predvi đa i obvezu pisanja istraživa čkog seminara, rada koji predstavlja case study te završne radnje. Da bi se nastava mogla organizirati iz pojedinog izbornog predmeta nužno je da najmanje pet polaznika izabere taj predmet. U protivnom, u dogovoru i uz suglasnost predmetnog nastavnika, predavanja može zamijeniti mentorski rad s polaznikom. Ukoliko nema suglasnosti za mentorski rad, polaznik se mora pridružiti onim izbornim kolegijima kod kojih je taj uvjet ispunjen. Način studiranja reguliran je ovim Programom, a podredno Pravilnikom o studijima Sveu čilišta u Rijeci. b) Dopunski sadržaj Nastavnog programa U okviru Studija omogu ćeno je poha đanje posebnih te čajeva engleskog jezika pod nazivom «Engleska terminologija prava EU – javno pravo» i «Engleska terminologija prava EU – privatno pravo» u II. semestru Studija u opsegu od 30 sati. 3.2.     Appendix: The Information Crisis and the Need to Improve the Availability and the Use of Relevant Statistics The international monetary and financial crisis has also been a major information crisis at both the national and international level. This was true for Stage I of the crisis (the “subprime crisis”) and for Stage II (the “debt crisis”). Decisions are about the future—information is about the past. There is a broad agreement that the availability, the quality and the timeliness of qualitative and quantitative information have a major impact on the quality of the decisions of both private and public actors in the modern economy. Yet, the general disaffection following the outbreak of the financial crisis in 2007–8 for the so-called theory of rational expectations has to do with the (belated) dual recognition that (1) all information (or the most relevant information) is not available or correct, and (2) statistics from the past are far from being a perfect guide for the future, especially when it comes not only to projecting “trends” but predicting major “events” that disrupt trends. The importance of this information and expectation issue has been dramatically demonstrated on two occasions since 2008: the suddenness and magnitude of the “subprime crisis” and the outbreak and brush-fire effect of the following “debt crisis.” The so-called information age or information society has been as much of a problem as an improvement when dealing with data relating to the com- plex economic structures of a globalized economy. As noted in Chapter 1, the great progress in hardware and software for collecting, storing, process- ing and distributing information that has occurred during the last 20 years has not prevented serious gaps in information or outright misinformation at the macro as well as at the micro level.
