1 Europa-Institut 1.1 Development and Structure of the Europa-Institut The Europa-Institut was founded at Saarland University in 1951 and is the second oldest institute of its kind in Europe. For more than sixty years, the Europa- Institut, which is located at the axis of Strasbourg-Luxembourg-Brussels, has been educating young academics from all around the world in the context of European and International Law. On 6 November 1951 the Europa-Institut was first founded as the “European Institut” of Saarland University. Its aim was to participate in the design of Europe by providing academic classes that dealt with European questions and approached topics from a European perspective. Due to the political developments in Saarland from 1955 until 1957, the Institute shifted from a cultural and literary research institution to a legal and economic one, and finally turned into an almost entirely legally focused institution in 1964. In 1972, the Europa-Institut was fully integrated into the law department of the Faculty of Law and Economics of Saarland Univer- sity. In 1980, under the directorship of Prof. Dr. Michael R. Will (1979-1989) and Prof. Dr. Dr. Dr. h.c. mult. Georg Ress (1979-1998), the postgraduate program “European Integration” was introduced which gives university graduates from around the globe a more deepened academic insight into the legal and economic basics of European integration and European history. In 1990, a separate econo- mics department was formed. With its bilingual Master’s program “European and International Law”, which awards the title “Master of Laws” (LL.M.), the Europa-Institut offers a special study program in European and International Law with its own lectures and lec- turers. Since the winter semester of 2011/2012, five different modules are offered: Module 1 – Europäische Integration/ European Integration, Module 2 – Europäi- sches Wirtschaftsrecht/ European Economic Law, Module 3 – Außenwirtschaft und Investionsrecht/ Foreign Trade and Investment, Module 4 – International Dispute Resolution, Module 5 – Europäischer und Internationaler Menschen- rechtsschutz/ European and International Protection of Human Rights. Course content is directed at the specific demands of European and international markets and taught in a combination of theoretical knowledge and practical application. The lecturers of the Europa-Institut strive to include real-life experiences in their classes. Apart from the professors from Saarbrücken, many visiting professors from around the world, as well as top officials from the European Commission, the European Council, the European Parliament, and the European Court of Jus- tice teach at the Europa-Institut. Furthermore, leaders from the judiciary, econo- my, administration and politics give lectures. In the reporting year 2015, the Europa-Institut (law department) was led by its directors Prof. Dr. Marc Bungenberg, Chair for Public Law, Public International

Law and European Law as well as Prof. Dr. Thomas Giegerich, Chair for Euro- pean Law, Public International Law, and Public Law. The directors receive support from the managing board of the Europa-Institut, which deals in particular with questions of organisation and administration. The responsibilities of the managing board range from the administration of the curriculum, the organisation of the study program, and the maintenance of connections and cooperations (i.e. publici- ty work) to the editorship of the Institute’s own journal (ZEuS). The library of the Europa-Institut, which currently consists of 57,000 volumes, 180 periodicals and 40 continuance works, provides for an excellent research en- vironment. It is geared entirely toward European and International law and since 1972 constitutes one of 40 European documentation centres (EDC) in Germany, which are integrated into a network of EDCs across Europe. The Europa-Institut is not only well connected within the university, but also has built a large network through external cooperation. Furthermore, the Europa- Institut has committed itself to advanced trainings by providing Summer and Win- ter Schools for students and practitioners in the field of European and Internatio- nal Law, mainly in corporation with the German Academic Exchange Service (DAAD). Additionally, courses are offered to Saarland ministries. The Europa- Institut also profits from its close contacts to its alumni via the Alumni Associati- on of the Europa-Institut’s (EVER e.V.) law department, which helps in the deve- lopment of the curriculum and to adjust the study program to the requirements of the professional practice.

1.2 New Director of the Europa-Institut Prof. Dr. Marc Bungen- berg Prof. Dr. Marc Bungenberg LL.M. (Lausanne) started his professorship for Public Law, Public International Law and European Law at the Law and Economics Faculty at Saarland University 1 April 2015. He is the successor of Prof. Dr. Wer- ner Meng and is now Co-Director of the Europa-Institut. Professor Bungenberg studied law at the universities of Hannover and Lausanne, where he took his second state examination and graduated in the field of Euro- pean Law at the University of Hannover in 1999. Subsequently he was promoted to professor in the subject of business law at the Friedrich-Schiller-University Jena, where he was awarded with a venia legendi for the subjects of Public Law, Euro- pean Law, Public International Law and International Economic Law in 2006. Afterwards, he worked at the Ludwig-Maximilians-University in , TU Dresden, Friedrich-Alexander University in Erlangen and at the University of Siegen, where he was Professor for Public Law, European Law, Public Internatio- nal Law and International Economic Law from October 2010 until March 2015.

Professor Bungenberg is a visiting professor for German Public Law, European and International Economic Law at the University of Lausanne, a member of the research center for the Right of European Integration, LMU Munich, a member of the scientific advisory board of the International Investment Law Centre Cologne as well as a visiting professor for International Raw Material Law at the University of Lucerne. Professor Bungenberg is also a member of the Association of German Constitutional Law Professors, the International Law Association, a member of the Committee on Sustainability in Natural Resources Development, the German Association for International Law, the Scientific Association for European Law as well as a member of the working group of European Integration, the German- Swiss Association of Lawyers and the Forum Vergabe e.V. His main research fields lie within European and International Economic Law, especially in Foreign Trade and International Investment Protection Law as well as Public Procurement Law and State Aid.

1.3 CeQuInt Accreditation Procedure Completed In February 2015, the Master’s program in European and International Law at the Europa-Institut was awarded the “Certificate for Quality of Internationalisation” (CeQuInt) by the European Consortium for Accreditation (ECA) during a two- day conference in Paris. The certificate is awarded to institutions that manage to integrate an international and intercultural dimension into their teaching. Generally, the certificate is aimed at making the internationalisation process within higher education more transpa- rent. Students, higher education, as well as society in general should profit from this development.

1.4 SEE | EU Cluster of Excellence in European and Internation- al Law The “SEE | EU Cluster of Excellence in European and International Law” is a joint network of legal faculties from the Western Balkan region which is financially supported by the German Academic Exchange Service (DAAD) and the Federal Ministry of Education and Research (BMBF). The cooperation consists of the Europa-Institut of Saarland University and the legal faculties of Belgrade (Serbia), Podgorica (Montenegro), Tirana (Albania), Skopje (Macedonia) and Zagreb () as well as the South East European Law School (SEELS with its mem- bers from Sarajevo, Zenice, Mostar, Split, Osijek and Rijeka as well as Nis and Kraguejevac). The excellence network has set itself the aim of intensifying the cooperation in teaching and research in the field of European and public internati- onal law.

2 Research at the Europa-Institut 2.1 Research Areas of the Directors of the Europa-Institut 2.1.1 Research Focus of Director Prof. Dr. Marc Bungenberg LL.M. (Lau- sanne), Chair of Public Law, Public International Law and European Law As of 1 April 2015, Professor Bungenberg took over the Chair of Public Law, Public International Law and European Law at Saarland University. Before that, he was a professor at the University of Siegen, where he held the Chair in Public Law, European Law, Public International Law and International Economic Law. The focal point of his research is the analysis of current challenges in European and Public International Law in a time where globalisation, economization and competition among systems occur on several interacting levels. A particular rese- arch focus lies in the field of European and international economic law with its connections to and respective influences on the various national legal systems. Currently, a majority of papers and speeches deal with bilateral trade agreements of the European Union. The economic future of Europe depends on its positions in the international competition and the economic system in the 21st century. The basis for that is the legal arrangement of foreign (trade) politics. In the reporting year, Professor Bungenberg has held many talks on various events regarding this topic (see below). He is co-editor of the handbook regarding international invest- ment law, which was published in the Spring of 2015. Since summer 2015, he is also a senior fellow at the Canadian Centre for International Governance Innova- tion (CIGI). Apart from foreign trade law and public international law – here in particular in- ternational investment law and world trade law – Professor Bungenberg also publi- shes in the fields of public procurement, state aid and competition law. A new area of focus is being established in the field of international commodity law. In the upcoming years, a new European and international framework of rules on commodity trade will be established. Staff members of the Chair have therefore participated in an international conference on commodities in Saint Petersburg. A book regarding international commodity law (Permanent Sovereignty over Natural Resources), where Professor Bungenberg is co-editor, was published in Spring 2015. With regard to that, Professor Bungenberg has also held a lecture series at the University of Lucerne in March 2015. Further co-operations with other foreign universities are being planned. In the reporting year, Professor Bungenberg held the lecture “Übung im öffentli- chen Recht” (Exercise in public law), “Internationales Wirtschaftsrecht” (Interna- tional Economic Law), “Europarecht II” (European Law II), “International Trade, Investment and Raw Materials Law”, a WTO Moot Court on the island of Frauen- chiemsee as well as a seminar about European economic law. Students from both

4 the Europa-Institut’s Master’s program and students from the special focal point International Law, European Law and Human Rights Law have attended the se- minars. Furthermore, Professor Bungenberg held a guest professorship at the University of Lausanne.

Since summer 2015, he is also a senior fel- low at the Canadian centre for International Governance Innovation (CIGI). In the reporting year 2015, the employees of the Chair engaged themselves with administrative and scientific tasks, such as the supervising of exams, the preparati- on and correction of exams and seminar papers, assessing oral exams in the focus area of the first state exam, reporting duties, the preparation of applications etc.

2.1.2 Research Focus of Director Prof. Dr. Thomas Giegerich LL.M. (Uni- versity of Virginia), Chair of European Law, Public International Law and Public Law In the reporting year 2015, the Chair continued to exist as a Jean-Monnet-Chair of the European Commission, after this title was rewarded to Prof. Giegerich in Sep- tember 2013. Accordingly, the team of the Chair has conducted a number of acti- vities in order to meet the requirements of the Jean-Monnet-Programme. Primarily, the Jean-Monnet-Blog of the Chair has to be mentioned, which can be accessed at www.jean-monnet-saar.eu, as well as www.09051950.eu and by a direct link on the homepage of the Chair (www.uni- saarland.de/lehrstuhl/giegerich.html). The blog is constantly maintained and up- dated by employees of the Chair. It does not only contain a link to the latest press releases of the Court of Justice of the European Union, the European Court of Human Rights, the European Commission and from Eurostat, but also contains publications about current topics via the “Saar Briefs”, “Saar Expert Papers” and “Saar Blueprints”. The Saar Briefs provide a short and precise analysis of current topics in the field of European integration, European law and European politics. The authors of the Saar Briefs are not only employees of the Chair but also national and international experts and are published both in German and English. In the reporting year 2015, they covered topics such as the transatlantic free trade agreement (TTIP), the poli- tics of the European Central Bank (such as the OMT-decisions), the development of asylum law in Europe (e.g. the review the Khlaifia and others against Italy judgment of the ECtHR), but also the terror attacks in Paris. Apart from that, the developments of human rights protection, in particular the protection of privacy plays an important role. The “Saar Expert Papers” deal with German and English-speaking expert analyses in the field of European law and European integration, which publish their rese- arch results in the E-Paper-Series. The ISSN-Number of the said E-Paper is 2199- 0069. The topics were, among others, German and European Asylum law, data protection law and the deployment of German administrative civil servants in the so-called Hotspots as well as the TTIP-Agreement between the European Union and the United States of America Finally, the “Saar Blueprints” is an E-Paper-Series, which is primarily directed at young scientists who can make available to the public texts regarding the develo- pment of European integration. The ISSN of the Saar Blueprints is 2199-0050. In the reporting year 2015, the Saar Blueprints covered topics regarding the Bio- ethics-Convention, the latest European Bank-Insolvency Law and hate speech on Facebook.

The various forms of publications of the blog are both directed at scientists and practitioners but also the broad public. The public is, however, not only informed via the blog about the latest developments in European law, European integration and European politics. On 5 May 2015, a considerable number of high school students came to the Europa-Institut in order to get an understanding about Eu- ropean integration and to discuss current events at the European level. After an introduction by Prof. Giegerich, the students attended a workshop, where they were able to take a closer look at specific areas of European law. Also, the Saar- land media reported on this event. The Jean-Monnet-Blog article concerning the visit can be accessed via http://jean-monnet-saar.eu/?p=790. Due to the positive feedback from the students and the employees of the Europa-Institut, a similar event is planned for May 2016. Apart from the “Europatag”, Prof. Giegerich and his employees regularly attend panel discussions regarding current European to- pics.

Prof. Giegerich’s teaching activities: In the reporting year 2015, Prof. Giegerich held lectures in European Law I, Public International law General Part and Special Part, Constitutional Law, Gene- ral Governmental Studies and International Protection of Human Rights. He also held block seminars concerning the universal and regional protection of human rights in Europe and other parts of the world as well as fundamental constitutional principles and their enforcement in the European multi-level governance system. The seminars were attended by students of the LL.M. program of the Europa- Institut but also by students from the special study unit 4 of general law studies at Saarland University (International law, European law and Human Rights Protec- tion). Furthermore, the Chair was in charge for an Online-Exam-Course in the special study unit 4 (International law, European law and Human Rights Protec- tion) in order to prepare them for the state exam in the special study unit. With regard to this, the students received three exams and outline solutions each semes- ter.

Prof. Giegerich’s examination activities: Contribution to a European law and international public law exam as well as first and second corrector of exams and oral examiner in the University part of the first legal state exam in the special study unit “Internationales Recht, Europarecht und Menschrenrechtsschutz” in Spring and Autumn 2015; Designing of a public law exam and oral examiner in the state part of the first state exam; Second assessor concerning a dissertation and participation at numerous doctoral oral exams in Saarbrücken. Further, Prof. Giegerich has worked as a Primary Reviewer and an oral examiner at two proceedings at the legal faculty of Christian-Albrechts- University Kiel, at which he taught from 2006 until 2012.

Miscellaneous: - On 13 January 2015, Prof. Giegerich held a lecture at the Winter School in European Integration in Saarbrücken with the topic “Charter of Fundamental Rights of the European Union and Human Rights

Protection in Europe.” - On 3 February 2015, Prof. Giegerich participated at a panel discussion regarding the topic “Die TTIP-Debatte: Worauf lassen wir uns ein?” at the Saarland chamber of commerce in Saarbrücken and on 19 May 2015 at another panel discussion concerning TTIP at the Europa-Institut. - In March 2015, Prof. Giegerich, together with American colleague from Washington and Lee University (Virginia) Prof. Russel Miller, held a one week long seminar concerning the topic “European Legal Institutions.” - On 21 July 2015, Prof. Giegerich held a lecture on the topic “Human Rights in the EU” at the European Summer Course in Otzenhausen. - On 7 September 2015, Prof. Giegerich held a lecture concerning the topic “Antidiscrimination Law” at the Summer School “EU Open Markets” in Split. - On 5 and 6 November 2015, Prof. Giegerich held a lecture at the Université Pierre Mendès-France in on the topic “Protection of Fundamental Rights in the EU: The Charter and the European Convention” and another lecture on the topic “Between Europhilia and Euroscepticism: A Critical Survey of the German Federal Constitutional Court’s Case-Law on European Integration.”

Activities of employees of the Chair: In the reporting year 2015, the employees of the Chair engaged themselves with administrative and scientific tasks, such as the supervising of exams, the preparati- on and correction of exams and seminar papers, the supervision of students, asses- sing oral exams in the focus area of the first state exam, maintaining the homepage of the Chair, reporting duties, the preparation of applications etc. Furthermore, the employees conducted a considerable amount of research, out of which resulted the following publications in the institutional journal ZEuS as well as on the Jean-Monnet-Blog of the Chair.

Teaching activity, conference participation and other activities of the em- ployees of the Chair: The employees were active in teaching: tutorials in European Law were held in January 2015, as well as tutorials in public international law (general part and speci- al part) and exam tutorials in public international law. The seminars held in the winter semester 2014/2015 and summer semester 2015 were also prepared and conducted by the employees of the Chair. In addition, an online exam course was offered. During the Europatag, the employees of the Chair held workshops for a number of high school students (more information on this topic as well as the presentation can be accessed via http://jean-monnet-saar.eu/?p=790). Also, the employees organised and corrected the exams in European Law I, Public International Law General Part and Special Part. In detail, Helen Küchler and Sabrina Lauer held a tutorial in Constitutional Law II (fundamental rights), Helen Küchler and Sebastian Zeitzmann held the ERAS- MUS-lecture European Integration I and II in the winter and summer semesters, which can also be attended by students obtaining the Europaicum-Certificate. Oskar Gstrein, Helen Küchler, Sabrina Lauer and Sebastian Zeitzmann also taught during the European Summer Course of the Europa-Institut in cooperation with the ASKO Europe-Foundation at the European Academy of Otzenhausen as well as in other international study programs at the European Academy of Otzenhau- sen. Oskar Gstrein and Sebastian Zeitzmann undertook the supervision of the Europa- Institut EuroSim Team under the leadership of Prof. Stein. In 2015, EuroSim was held in Saratoga Springs (NY, USA), where three students from the Europa-

Institut were awarded with the “Best Students Award”. Sabrina Lauer and Desirée Schmitt also supervised the seminar “European Legal Institutions”. Together with American students, excursions were made to the German Constitutional Court and the European Court of Justice. Pieter Gryffroy held a tutorial on European law at the Europa-Institut. Oskar Gstrein was in charge of a lecture on European law at the University of Coopera- tive Education ASW Neunkirchen. On 15 January 2015, Helen Küchler conducted a case study in the field of “Four Freedoms” within the scope of the winter school. Furthermore, Helen Küchler participated as a lecturer in the course “Introduction to scientific work” at the Europa-Institut. Sebastian Zeitzmann held a lecture in the scope of the autumn university at Saar- land Universitty (European Integration). Sebastian Zeitzmann also held another lecture “Europarecht für Wirtschaftswissenschaftler” at the legal faculty. Desirée Schmitt participated in the Geneva Conference on Comparative Foreign Relations Law from 10-11 July 2015 in Geneva. In the course of 2015, Oskar Gstrein parti- cipated in the following conferences and courses: 4th DialogCamp of the journals MMR and ZF at the FOM Munich in February with a lecture on the topic “Kas- kade des informationellen Verfalls”; 4th forum K&R in Karlsruhe; participation at the “General and Specialized Courses on Human Rights Law” at the European university Institute in Florence in June. Furthermore, in November 2015 Oskar Gstrein was able to finish his dissertation with the topic “Das Recht auf Vergessenwerden als Menschenrecht – Hat Men- schenwürde im Informationszeitalter Zukunft?” with the grade summa cum laude. The dissertation will be published in the publication series of the Europa-Institut at the Nomos Verlang in 2016, which is currently in progress. Oskar Gstrein and Desirée Schmitt are Web-Administrators for the Jean-Monnet- Blog of the Chair. Sebastian Zeitzmann is member of the editorial team of ZEuS and Oskar Gstrein is member of the ordering commission of the Europa-Institut library. In addition to that, Sebastian Zeitzmann and Oskar Gstrein were academi- cally and administratively involved in the colloquium of the Europa-Institut regar- ding the current jurisdiction of the Court of Justice of the European Union.

Sebastian Zeitzmann gave an interview in the “Aktueller Bericht” of SR TV on 17 November 2015 regarding the official request of France following the terrorist attacks in Paris for assistance of the EU within the scope of Art. 42(7) TEU, which was applied for the first time in history. On 25 November 2015, he held a talk on the perspectives of Europe with regard to the refugee and migration crisis as part of the Afrika-Forum 2015 at the European Academy of Otzenhausen (EAO). Since January 2014, Sebastian Zeitzmann is working freelance as a transla- tor at the European Court of Justice. Since May 2014, he is a full-time director of studies at the European Academy of Otzenhausen.

2.3 Publications 2.3.1 Zeitschrift für Europarechtliche Studien (ZEuS) Since 1998, the legal journal “Zeitschrift für Europarechtliche Studien” (ZEuS) has been published by the current and former directors of the Europa-Institut. It is an internationally established forum for articles from the academic as well as practical field which is also intended to motivate young researchers and students to publish articles. The journal is published four times a year with the ISSN 1435- 439X. Since 2014, the journal is published at Nomos Verlagsgesellschaft Baden- Baden, which is also responsible for the subscription service. With regard to content, ZEuS is broad in scope. The contributions deal with cur- rent and general problems in European integration, European law, and Internatio- nal law. Publications are available in German, English, French and Spanish. The examination and selection of contributions occurs via an extensive and thorough evaluation procedure (peer review) by the editorial team and the publishers. It is particularly important for ZEuS that not only well-known scholars but also young academics can contribute to the journal. Contributions by young academics as well as exceptional Master’s theses and seminar papers from students are explicitly encouraged. 2.3.2 Schriften des Europa-Instituts der Universität des Saarlandes – Rechtswissenschaft Apart from the Institut’s own journal ZEuS, the Europa-Institut of Saarland Uni- versity is also responsible for the series “Schriften des Europa-Instituts der Uni- versität des Saarlandes – Rechtswissenschaften”. The series is published by Prof. Dr. Marc Bungenberg, Prof. Dr. Thomas Giegerich, Prof. Dr. Werner Meng, Prof. Dr. Dr. Dr. h.c. mult. Georg Ress and Prof. Dr. Torsten Stein at Nomos Verlags- gesellschaft. To date, the series encompasses 100 volumes. With this series, the Europa-Institut provides an ideal forum for various publications, mainly focused on conference papers and dissertations. The aim of the series is the publication of general or current topics on European Law, including both the European Union and the Council of Europe (especially the system of human rights’ protection). Monographs dealing with the intersection between European Law and Public International Law as well as Public Internatio- nal Business Law (in particular in regards to the WTO) can be published. In addi- tion to that, the series is open to the publication of research results from the Eu- ropa-Institut as well as guest lectures, which were held during conferences organi- sed by the Europa-Institut. The series also aims to provide young researchers with the opportunity to publish their research results. Therefore, outstanding dissertations are published and on rare occasions also Master’s theses. Even though the majority of monographs and conference proceedings originate from the Europa-Institut or Saarland University, this is not a requirement to publish.

2.3.3 Europa-Institut of Saarland University – Selected legal documents The Europa-Institut is the publisher of a series of legal documents in English, which currently consists of six volumes. Originally, the reason for publishing these legal documents was the fact that existing legal texts did not satisfy the specific requirements necessary to successfully complete the various study units of the Europa-Institut. To fill this gap, the Europa-Institut decided to publish its own series of legal documents to equip students of the Europa-Institut as well as practi- tioners, policymakers, and international lawyers with the necessary materials in those specific interest areas. In the past years, volumes on “International Dispute Resolution”, “European Law”, “International Trade Law” and “Public Internatio- nal Law” were published. In 2014, the second revised and extended edition of the volume “European Law”, as well as a new volume called “Public International Law” was published as the 4th volume. The 5th volume focused on “International Human Rights Law” will be finished by spring 2015. There are already plans to publish two additional volumes. The series “Europa-Institut of Saarland University – Selected legal documents” is published in the Alma Mater Verlag Saarbrücken.

2.3.4 SEE | EU Cluster of Excellence in European and International Law • Series of Papers The Europa-Institut, under the leadership of Prof. Dr. Thomas Giegerich and research assistant Mareike Fröhlich, in cooperation with the Centre for SEELS, is responsible for the publication “SEE-LAW NET: Networking of Lawyers in Ad- vanced Teaching and Research of EU Law post-Lisbon, Outcome of the SEE Graduates EU Law Teaching & Research Academy 2013, Collection of Papers” (ISBN 978-608-4608-06-0). This publication compiles the scientific contributions of the participants of the Summer Academy “SEE Graduates EU Teaching & Research Academy” which took place at the Europa-Institut in June/ July 2013. The contributions deal with the accession process of Balkan states, European legal questions, European Private Law, and human rights aspects. The SEE | EU Cluster of Excellence in European and International Law • Series of Papers is a new publication series in English, published by the thematic network „SEE | EU Cluster of Excellence in European and International Law.“ The net- work consists of the Europa-Institut and the law faculties of the universities Bel- grade (Serbia), Podgorica (Montenegro), Sarajevo (Bosnia and Herzegovina), Skopje (Macedonia), Tirana (Albania) und Zagreb (Croatia) as well as the East European Law School Network (Center for SEELS). The Cluster of Excellence is financially supported by the German Academic Exchange Service (DAAD) and the Federal Ministry of Education and Research until 2018. 3.2 Courses The Master’s program consists of a nine-month study program and a subsequent three-month period to complete the Master’s thesis. The lectures are offered in German or English and are completed with a written or oral exam. Credit Points are given out for almost all courses. In order to successfully complete the Master’s program, 60 Credit Points are necessary. A minimum of 45 Credit Points are ob- tained from the study program and an additional 15 from the Master’s thesis. The program is divided into five modules and offers a great freedom of choice with regard to the individual courses. The interconnection of the various modules enables students to select courses both from within and across the research focus. The different study units enable students to specialise in rapidly expanding new professional areas already during their studies at the Europa-Institut. The study

44 units only start in the winter semester and they always extend over a period of two semesters. If a minimum of 12 Credit Points are obtained, the completion of the study units is referenced on the Master’s degree. From the five study units offered, a maximum of two can be chosen. Module 1: Europäische Integration/ European Integration Module 1 focuses on the basics and foundations of European Law. Aside from the more classical fields of European Law, lectures will also cover subjects such as European Private Law, and the EU Common Foreign and Security Policy, in order to provide students with a basic understanding of and an insight into the legal inter-connectedness of the European Union and its institutions. Through a variety of practical simulation courses, such as the ECJ-Moot Court or EUROSIM, stu- dents are able to put their acquired theoretical knowledge into practice.

Module 2: Study Unit Europäisches Wirtschaftsrecht/ European Economic Law The study unit comprises various areas of law which are of fundamental im- portance not only in Europe but in a global perspective, with regard to both busi- ness and legal practice. The courses convey sound knowledge of the general framework that characterizes economic activity in the European Union (the Eco-

45 nomic and Monetary Union, Banking Law and European Tax Law). Students may additionally opt to deepen their knowledge of more particular regulations which economic activities in the EU might be subject to (e.g. European Competition Law, Economic and Competition Policy) or that potentially accompany such acti- vities (e.g. Intellectual Property Law). The challenges of economic globalization are taken into account in such courses, in which the subject matter extends beyond EU borders. In addition, numerous case studies are offered as part of the study unit, which allow students to put their theoretical knowledge into practice. Moreo- ver, students have the opportunity to focus on European Management.

Module 3: Study Unit Außenwirtschaft und Investitionsrecht/ Foreign Trade and Investment The study unit deals with economic globalization, especially in the areas of trade, investment and capital transactions. Courses such as International Trade, Invest- ment and Raw Materials Law and further selected parts of public international business law convey essential knowledge of key material in International Econo- mic Law. Special attention is given to the interplay between economics and law, a relationship that is becoming increasingly important in both international and European legal practice. Courses that delve more deeply into the subject matter include lectures based on the foreign trade law of the European Union and its member states, substantive WTO Law (particularly focusing on the GATT, the GATS and the TRIPS Agreement) and the harmonization of national trade laws. Certain courses are centered on legal areas that are gaining importance as a result of increased international trade (such as laws relating to financial supervision). In addition, courses are offered on international economic and monetary policy as well as on international economic sanctions laws.

Module 4: Study Unit Internationale Streitbeilegung/ International Dispute Resolution The study unit International Dispute Resolution familiarizes students with typical problems and the basic concepts of international commercial arbitration, internati- onal investment arbitration and alternative dispute resolution. The program focu- ses on efficient and fair dispute resolution in a transnational context, in a world where commercial courts are national institutions. Hereto the study unit offers, in addition to the named lecture topics, complementing lectures for increased under- standing and insight, for instance in “International Business Transactions”, a lec- ture focusing on students acquiring specialized expertise as well as insight into the many cultural perspectives and aspects relevant to doing business across borders, in order for students to get an enhanced understanding of the complexity of cross- border trade. Case studies, as well as negotiation and procedural training, are an

46 important part of the study unit and provide an ideal addition to the lectures on offer. This enables students to obtain an ideal mix of theoretically minded lectures, equipping students with the necessary analytical abilities, and more practically applicable courses, allowing students to put their acquired theoretical knowledge into practice. Distinguished guest lecturers form an integral part of the program. Furthermore, excursions to International Institutions (such as the ICC in Paris) are on the agenda.

Module 5: Study Unit Europäischer und Internationaler Menschenrechts- schutz/ European and International Protection of Human Rights Participants in this study unit will focus on the main features, limits and develop- ments in human rights protection and will be shown how to put this knowledge successfully into practice. The study unit deals with the development and realizati- on of human rights in public international law and in international treaties on a global level as well as on a regional European level and their respective interrelati- ons. Moreover, the study unit focuses on the relationship between the European Union and the European Convention on Human Rights as well as on the practice of the bodies of the United Nations, the European Court of Justice, the European Court of Human Rights and the Council of Europe. The practical application of human rights law is of particular relevance and interest for the purposes of this study unit. The courses cover both past and pending case law which addresses current issues. Moreover, the study unit is also about more general questions such as those relating to the rights of individuals in relation to the sovereignty of the European Union.

Module 6: Masterarbeit/ Master’s thesis The Master’s thesis constitutes an independent academic dissertation in the fields of European or international law. The Master’s thesis may be written in English or German. Students have a deadline of three months to write and submit their the- sis. Pursuant to its successful completion, an additional amount of 15 credit points will be awarded. Students are free to choose when to start working on their Mas- ter’s thesis. Thus, the Master’s thesis can also be written at a later stage, for examp- le when the student is already working. Once it has been successfully approved and graded by a nominated lecturer, the title “Master of Laws” is awarded to the student.

3.3 Special Courses 3.3.1 Moot Courts Moot Courts provide our students with the possibility to put theoretical know- ledge into practice. Fictional cases are debated and students have the opportunity to assume the role of one of the proceeding’s parties under real-life conditions. Corresponding to their respective roles, students develop written submissions, learn to work under time pressure, and draft and defend arguments in oral hea- rings.

VIS Moot Court, 26 March to 3 April 2015 The 22nd WILLEM C. VIS – International Commercial Arbitration Moot Court Vienna was organised by the Association for the Organization and Promotion of the Willem C. Vis International Commercial Arbitration Moot in collaboration with UNCITRAL (United Nations Commission on International Trade Law), renowned arbitral institutions, and the law faculty of Vienna. The arbitrators in the competition are judges, lawyers and professors from around the globe. Its aim is to promote the studies of international civil and commercial law and to learn about arbitration in the international economic arena via the concrete application of a problem. Over a period of six months, the students participating in the competiti- on focused on International Sales Law and Arbitration Law and had to prove their research abilities, excellent argumentation and quick learning skills, as well as their ability to work in a team. Between October and January, the students jointly drafted two complex English memoranda which were presented to an international jury. Starting in February, the students focused on developing concise and detailed presentations of the legal arguments. Practice pleadings were held in law firms in Frankfurt, Cologne and Düsseldorf; preliminary pre-moots took place in Stuttgart, Düsseldorf, Paris, Bel- grade and Tiflis. Participation in the Moot Court is only possible for students after the completion of their studies, so one student from the 2013/2014 class participated in the Vis Moot together with four students from the law faculty of Saarland University.

WTO Moot Court, 14-18 June 2015 The WTO Moot Court 2015 took place in the Abbey of the Benedictines Frauen- wörth on the Fraueninsel in Lake Chiemsee, under the academic supervision of Prof. Dr. Marc Bungenberg, director of the Europa-Institut, and Prof. Dr. Werner Meng, former director of the Europa-Institut. Twelve students were divided into 3 groups – complainant, respondent and panel – and were part of a realistic simula-

55 tion of a dispute settlement procedure. Therefore they had first, to hand in a plea- ding and secondly, to argue their position in an oral proceeding during the hearing at the Fraueninsel. This year’s proceeding dealt with the mutual sanctions between EU and Russia in the context of the Crimea Crisis. On European side the sanctions concerned the freezing of bank accounts, travel bans and prohibition on the export of dual-use- goods. As a counter measure Russia forbade the import of agricultural products, raw materials and aliments with the origin of some European countries. Throug- hout the Moot Court the students had to deal with the WTO-conformity of these measures and particularly with the security exceptions of Article XXI GATT. With the participation at the WTO Moot Court the students deepened their know- ledge in International Trade Law and could practice their pleading skills under real- life conditions. Furthermore they experienced working in a multinational team.

EuGH-Moot Court, 21 July 2015 The European Law Moot Court was conducted by Prof. Siegbert Alber, Dr. Jean- Christophe Puffer-Mariette, and Dr. Sibylle Seyr in collaboration with Marc Bie- nert. In the reporting year 2015, the Moot Court took place for the 16th time al- ready. The Moot provides students with the opportunity to debate a case in the actual courtroom of the European Court of Justice and to assume the role of one of the parties in the proceedings under real-life conditions. The Moot Court is a hands-on experience that provides students with an insight into the dealings of the European Court of Justice. While working on a real pen- ding case or a variation of such a case, the acquired theoretical knowledge from the lectures at the Europa-Institut is broadened and complemented with practical experience. This year’s proceeding dealt with the field of free internet access. The students had to find arguments with regard to their role concerning the question of liability in the case of an infringement.

3.3.2 Eurosim Eurosim is a political simulation which is academically supervised by Prof. Dr. Torsten Stein, Oskar Gstrein and Sebastian Zeitzmann. In the annual simulation, the decision-making process of current EU legislation is simulated by approxi- mately 160 students from about 20 international universities. In 2015, Eurosim took place from 25 until 29 March 2015 in Saratoga Springs (NY, USA). The par- ticipating universities came from, among others, Germany (Saarbrücken, Ham- burg), Belgium (Antwerp), the Netherlands (among others Maastricht and Twen-

56 te), Scotland and USA (predominantly from Pennsylvania and New York as host university). The participating students assumed the roles of the European Com- mission, the Council of the European Union, the European Council, the members of the European Parliament, and independent experts in order to develop a legisla- tive act in the field of data protection in the European Union. Apart from intensi- ve engagement with current legal questions of the EU and its politics, Eurosim also imparts rhetorical skills and competence in intercultural communication. In addition, practitioners, academics and politicians are invited to share relevant background knowledge with the participants.

3.3.3 Soft Skills The Europa-Institut offers the following courses to improve the soft skills of its students.

Language Courses (at the Europa-Institut) The Europa-Institut offers language courses in German and French at all levels. Apart from the general deepening of language skills, the courses also focus on legal terminology of the respective language.

Communication Training/ Presentation Skills In order for students to improve their rhetoric skills, the Europa-Institut offers communication trainings which are conducted by experienced communication and language consultants in both German and English. The students’ communication skills are tested under realistic (pressure) situations, recorded, and then analysed in order to identify strengths and eliminate weaknesses. The focus points of the trai- ning are:  Function of speech;  Communication styles and meta-communication;  Communication in conflict situations;  Control and use of body language;  Rhetoric in conversation, discussions and speech;  Speech techniques, breathing and voice control;  Rhetorical style tips and other aids for conversation, discussions and spe- ech;  Rules and use of dialectics in conversation, discussions and speech.

Due to its high practical relevance, communication training is part of the basic education of the Master’s program. In 2015, it was offered in German as well as in English. The English session “Negotiation Training” was conducted by Marcus Delacor (euphorum). Typical multi and bilateral negotiation situations were practised in several role-plays. The workshop covered four decisive areas of a successful nego- tiation and gave the participants the opportunity to develop their individual skills as, for example, the correct preparation of a negotiation; the ability to defend posi- tions and interest; the ability to choose the right strategy and offer trade-offs, prac- tice persuasion skills or build networks and communicate effectively. The students’ communication skills are tested under realistic (pressure) situations, recorded, and then analysed in order to identify strengths and eliminate weaknes- ses.

A career in an EU institution – Training for the EPSO selection procedure Careers with the European Union On 26 May 2015 EVER, in cooperation with euphorum, prepared more than 50 students for an ongoing AD open competition of the European Personnel Selec- tion Office (EPSO). EPSO, which is in charge for selecting staff to work for the Institutions and Agencies of the European Union, was looking for 149 administra- tors who are typically engaged in drafting policies and implementing EU law, ana- lysing and advising one of the EU institutions. In 2015 more than 30,000 people applied Europe-wide for the yearly AD- generalists open competition. In order to increase the chances of the students of the Europa-Institut to pass the first phase of that highly competitive selection process, during a one day workshop the students trained to successfully take all the computer based tests. Marcus Delacor, who has been analysing the EU recruitment policy for many years and successfully passed one EPSO selection procedure, acted as trainer.

Negotiating successfully In order to improve their negotiation skills, more than 50 students participated in a workshop on 26 and 27 November 2015. By several role-plays they were placed in typical bi or multilateral situations of deliberation, negotiation and bargaining. The workshop covered four key factors of successful negotiations and stimulated the development of individual skills: (1) Correct preparation & momentum targeting – to be familiar with the process; (2) defending positions and interests; (3) choosing

58 the right strategy– bargaining, convincing or networking and (4) effective commu- nication. Video recording was also used to produce learning points and work on handy dos and don’ts. The workshop was conducted by Marcus Delacor (euphorum).

Advocacy Practice In order to give students the opportunity to practice their advocacy skills, each semester the Europa-Institut offers advocacy practice in conjunction with the CJEU Moot Court. Students are coached and supported by lecturers and research staff of the chairs. The students practice presenting their arguments and learn to give tactical thought to their presentation. They are not only being prepared for giving closing speeches in front of a court, but also for cross-examinations with the opposing party. In 2015, the students were instructed by Jean-Christophe Puf- fer-Mariette from the European Court of Justice and Sibylle Seyr from the Euro- pean Parliament.

Introduction into Academic Research In the reporting year of 2015, the Europa-Institut continued to offer an introduc- tion into academic research with the support of research assistants from the pro- fessorial chairs and the Institute as such. Apart from studying the basics of acade- mic research, the students also learned about the different research possibilities at the Europa-Institut, and the particular formalities when drafting a seminar and Master’s thesis.

3.4 Excursions The students at the Europa-Institut had the opportunity to participate in the fol- lowing excursions:

South Tirol, 6-11 January 2015 Following the Christmas holidays, the annual seminar regarding the current case law of the European Court of Justice took place in Maria Saalen in South Tirol. Students familiarised themselves with recent case law, put it into context with older cases from the same field, and analysed the developments in each specific area. Results were presented in written submissions and oral presentations, follo- wed by intensive discussions. Special focus was always put on the current signifi-

59 cance of each case law. In their free time, students were able to ski and hike, as well as participate in night sledding and the local sport of Broomball.

Strasbourg, 16 March 2015 During a day trip to the Alsatian capital, the students visited two of the various European institutions in Strasbourg. The first stop was the European Court of Human Rights where the students met up with a lawyer in the Chamber of ECHR. He explained to the students the workflow at the European Court of Human Rights and answered their questions. Then the students had the opportunity to visit the various sights of the city, such as the cathedral of Strasbourg, the Temple Neuf, and the beautiful historic district. Following the sightseeing tour, the stu- dents visited the Council of Europe, where they first toured the building. In the plenary hall Dr. Jörg Polakiewicz, Director of Legal Advice and Public Internatio- nal Law, who is also a lecturer at the Europa-Institut, held a speech about the work of the Council of Europe and about the everyday business of a jurisconsult in the Council of Europe.

Paris, 15-17 May 2015 From 15 until 17 May 2015, the seminar “Financial Damages Analysis” took place in Paris under the academic leadership of Prof. Dr. Stefan Weber. After an intro- ductory lesson on 14 May in Saarbrücken, the students travelled to Paris, where they first continued with the seminar lessons. After the presentations they visited the International Chamber of Commerce (ICC) where they got an introduction into the activities of the ICC. The students also visited the law-firm Eversheds, where they gained insight into the daily work of state-to-state-litigation. The se- cond day in Paris was at the disposal of the students in order to visit the famous sights in Paris.

Berlin, 20-24 May 2015 Every year, the Federal Foreign Office in Berlin organises the “Europatag” which took place in 2014 in the premises of the Foreign Office at Werderschen Markt. Students from four different universities, which had been awarded the title of “Musterstudiengang Europawissenschaften” in 1998 by the Foreign Office, parti- cipated in the “Europatag” (universities of Saarbrücken, Berlin, Hamburg and Bonn). Following the welcome address by Julia Tschernych, the students listened to a talk about the Common Foreign and Security Policy. Furthermore, four for- mer students of the various study programs presented on their respective field of activity and answered questions.

The trip was complemented by a visit to the WDR-Europaforum, to which im- portant politicians such as the German Chancellor Angela Merkel, the President of the European Parliament Martin Schulz, the German Federal Minister of Finance Wolfgang Schäuble, as well as the Hungarian Prime Minister Viktor Orbán were invited. The Europaforum, which was broadcasted live, took place in the Foreign Office. In addition, the students visited the German Chancellery, where they were able to talk to the Federal Minister of the Saarland and head of the Federal Chan- cellery Peter Altmaier. Following the discussion, the students toured the German Chancellery. Apart from the official program, the students also had sufficient time to explore the German capital and to meet up with former students of the Europa- Institut.

Luxembourg, 30 April 2015 The excursion to the European Court of Justice in Luxembourg is an inherent part of the annual program. After a tour organised by the Visitors’ Service, an introduc- tion to the case C-215/14 “Nestlé” was provided to the students. The students were then able to watch the oral proceedings in this case in the Grande Salle d’Audience which allowed them to gain insight into the work of the Court of Jus- tice of the European Union. The oral proceeding was followed by an informative discussion about current case law and working procedures at the court with Dr. Maria Berger, Judge at the European together with Mr. Bayanov.

Brussels, 5/6 November 2015 At the beginning of each academic year, the Europa-Institut offers a two-day-trip to Brussels for the new students in order to visit the most important European institutions. During the visit to the European Commission, the students listened to an introductory talk from Gyorgy Foris, a member of the speaking team of the directorate-general of communication, as well as a speech by Dr. Manuel Keller- bauer, Dr. Gero Meeßen (both members at the Legal Service of the European Commission) and Corneliu Hoedlmayr (Directorate-General for Communications Networks, Content and Technology) on the topic “Working as a lawyer in the European Commission”. In the evening, all students attended an information session on job opportunities in Brussels organised by the Alumni Association of the Europa-Institut EVER e.V. Five alumni presented on their respective areas of work and answered the students’ questions. The information session was followed by a reception, during which students had the opportunity to get in touch with other alumni of the Eu- ropa-Institut.

The following day, the students visited the European Parliament and were greeted by a member of their visitors’ service in the Paul Henri Spaak building. The Stu- dents were given an insight into the daily work at the European Parliament and had the opportunity to ask questions.

Valedictory lecture Prof. Dr. Christian Kohler, 17 Dezember 2015 On 17 Dezember 2015, Prof. Dr. Christian Kohler, a lecturer and honorary pro- fessor at the Europa-Institut for many years, held his valedictory lecture on the topic “Vertrauen und Kontrolle im europäischen Justizraum.” The lecture took place in the lecture hall of the Europa-Institut. Professor Kohler was a civil serv- ant at the European Court of Justice in Luxembourg from 1976 to 2008. Since 1980 Professor Kohler has been a lecturer at the Europa-Institut. He was appoint- ed as honorary professor in 1994.

3.5.4 Refugee Law Clinic Saarbrücken The Refugee Law Clinic Saarbrücken e.V. was founded in May by students of Saarland University. The club’s aim is to offer a free consultation and support for refugees and asylum seekers with legal matters and other challenges in Germany. At the same time students of law as well as students of other subjects should be given the opportunity to apply their theoretical knowledge in a practical context.

The club intends to promote social cohesion, a practical legal education and care services for the benefit of foreigners and asylum seekers in Saarbrücken and Saar- land. In order to pursue this goal, lectures on the topic of asylum law have been offered since winter semester 2015/2016. The Refugee Law Clinic Saarbrücken e.V. is a non-profit club, all members are working on a volunteer basis. The Euro- pa-Institut offered the lecture hall of the Europa-Institut for the lecture of the Refugee Law Clinic Saarland.

4 Cooperations of the Europa-Institut The Europa-Institut is not only well connected within the University but also via various external cooperations.

4.1 Cooperations within the University Within the University, the Europa-Institut conducts an intensive exchange with its own faculty as well as other faculties.

4.1.1 Cooperation with the Europa-Institut, Economic Department (MBA School) The Europa-Institut’s law department cooperates with the economic department of the institution, which offers the study program “European Management” that concludes with the award of the degree “Master of Business Administration” (MBA). Every year, several selected students from the law department of the Eu- ropa-Institut are able to attend certain lectures from the MBA program. After successful completion of the MBA courses, the specialization “Study Unit Euro- pean Economic Law (Track European Management)” is shown on the LL.M. certificate.

4.1.2 Cooperation with the Faculty of Law and Business As of the winter semester of 2011, the Europa-Institut introduced a special certifi- cate “Europäisches und Internationales Recht (EIus)” for students who are en- rolled at the law faculty at Saarland University. It is the goal of the certificate to offer students an additional qualification in the areas of European and Internation- al Law. Undergraduate students are able to attend selected lectures from the Euro- pa-Institut’s LL.M. program. After successful completion of the classes, the certifi- cate is awarded to the students. Credit points from the EIus certificate can be counted towards the required credit points in the LL.M. program after completion of the first state exam. The certificate is open to students with an outstanding grade in the exam “European Law I” (third semester) and is usually completed within four semesters. In order to receive the certificate, the students have to ob- tain a total of 20 credit points (calculation based on the credit point system of the Europa-Institut).

A close relationship is also maintained with the Erasmus office of the law faculty. Students who are participating in the Erasmus program are able to attend selected lectures from the LL.M. program. The same applies to students from non- European countries (overseas students).

4.1.3 Cooperation with the Centre Juridique Franco-Allemand (CJFA) The Europa-Institut and the Centre Juridique Franco-Allemand (CJFA) jointly offer selected German and French students of the CJFA the possibility to take courses at the Europa-Institut during their studies. There are two different options for the students:  Certificate in European and International law (EIus): The certificate EIus enables students to obtain a special qualification in European and Inter- national Law. The certificate “Europäisches und Internationales Recht (EIus)” is awarded to the students after successful completion of the clas- ses. The credit points acquired during this program can later be counted towards the required credits in the LL.M. program.  LL.M. program at the Europa-Institut: Every year, the CJFA suggests to the Europa-Institut suitable graduates who would like to acquire an LL.M. at the Europa-Institut after the successful completion of their Licence or Master 1. The final selection of candidates is reserved for the Europa- Institut on the basis of academic record and individual qualification. German and French students of the CJFA can already take selected cour- ses at the Europa-Institut during their basic studies. The credit points ac- quired can then be counted towards the required credits in the LL.M. program.

4.1.4 Cooperation with the “Collegium Europaeum Universitatis Sara- viensis” (CEUS) The “Collegium Europaeum Universitatis Saraviensis” (CEUS) is a joint academic institution of three philosophical faculties and the faculty of law and business at Saarland University. It encompasses the Europa-Institut as well as other institu- tions such as the Centre Juridique Franco-Allemand, the Center for historic Euro- pean research, the Institute of European Law, the European Institute for Rhetoric, the European Institute for legal informatics, the Frankreich-Zentrum, the Atelier Europa, and the European guest professorship. Via CEUS, students can partici- pate in lecture series, conferences and meetings.

Furthermore, the Europa-Institut is a member of the transnational consortium TACEUSS (Trans-Atlantic Consortium for European Union Simulations and Studies), which consists not only of European universities (from Belgium, the Netherlands, Germany and Scotland), but also of universities from New York State and Pennsylvania. This consortium holds an annual simulation of the Euro- pean decision-making process (Eurosim).

4.3 Cooperation with Ministries, Administration, Private Business and European Union Funding Programs The Master’s program is actively supported as “Musterstudiengang Europawissen- schaften” by the German Foreign Office, the Federal Ministry of Education, Sci- ence and Research, the European Commission, and the Association for the Pro- motion of German Science and Humanities (Stifterverband für die Deutsche Wis- senschaft). The Europa-Institut also cooperates with administrative entities of the Saarland. It is committed to the judicial traineeship (Referendarausbildung) and offers advanced trainings in European Law for employees of Saarland ministries in collaboration with the Saarland Interior Ministry. The Europa-Institut also has close ties to many private entities, e.g. the law office Kapellmann & Partner or Norton Rose in Brussels, Linklaters in Luxembourg and Freshfields Bruckhaus Deringer in Frankfurt a.M. The activities of the Europa-Institut are supported by a number of foundations, which provide financial support, grant scholarships, or help planning educational trips. These include, for instance, the Bosch-Foundation, the ASKO Europa- Foundation, the Herman and Dr. Charlotte Deutsch Foundation, the Villa Lessing Liberal Foundation e.V., the Union Foundation, the Prof.-Dr.-Osthoff Founda- tion, the StudienStiftungSaar, as well as the Alumni Association of the Europa- Institut EVER e.V.

4.4 Cooperation with the ASKO Europa-Stiftung For several years now, the Europa-Institut has been cooperating closely with the ASKO Europa-Stiftung. This cooperation goes far beyond mere financial support and also encompasses intensive participation in the events organized by the ASKO Europa-Stiftung. Furthermore, joint summer schools are organized (see further also under 6.6.)

4.5 Cooperation with Europa-Institut Consult e.V Europa-Institut Consult e.V., which was founded in 2011 as a training facility of the Europa-Institut, offered several trainings and continued education courses for employees of the Saarland ministries, mostly in European law. Furthermore, Eu- ropa-Institut Consult e.V. offered a two-week intensive German course at the beginning of the winter semester 2015/2016.

5 SEE | EU Cluster of Excellence in European and In- ternational Law The “SEE | EU Cluster of Excellence in European and International Law” is a joint network of legal faculties from the Western Balkans which is financially sup- ported by the German Academic Exchange Service (DAAD) and the Federal Min- istry of Education and Research (BMBF). The cooperation consists of the Europa- Institut of Saarland University and the legal faculties of Belgrade (Serbia), Podgori- ca (Montenegro), Tirana (Albania), Skopje (Macedonia) and Zagreb (Croatia) and the South East European Law School (SEELS with its members from Sarajevo, Zenice, Mostar, Split, Osijek and Rijeka as well as Nis and Kraguejevac). The ex- cellence network has set itself the aim of intensifying the cooperation in teaching and research in the field of European and public international law. The excellence cluster is divided into three pillars: teaching, research and project management. With regard to teaching, eLearning modules are being planned (in- cluding a corresponding summer school), which should enable all partners to offer lectures on a variety of topics on European and public international law. Further- more, the topic of research encompasses the publication of books and a series of papers, a Graduate School with doctoral colloquia and Spring courses, research stays and a cooperation among the libraries of the respective partner faculties. The aim of the SEE | EU Cluster is a comprehensive cooperation in teaching and research in the field of European and public international law. The SEE | EU Cluster of Excellence in European and International Law was first launched in 2015 with an opening ceremony and an academic conference at the Europa-Institut at Saarland University. Apart from professors and employees of Saarland University and the partner faculties, also representatives of embassies and consulates of the South Eastern European partner countries, representatives of the state and representatives of several Saarland foundations attended the ceremony. Dr. Doris Pack, former Member of the European Parliament and expert for South East Europe, held a lecture on the prospect of accession of the countries from the Western Balkans to the European Union. In addition to that, an academic confer- ence with the title “Current Research and New Challenges in European and Inter- national Law” took place which enabled professors and employees of the partner faculties to exchange ideas on various topics on European and public international law. After the successful opening of the SEE | EU Cluster of Excellence, a number of events took place such as the organisation of workshops and conferences, the publishing of papers and publications as well as the conduct of research stays of foreign guest researches. The SEE | EU Cluster of Excellence was founded in the first place to enable visiting stays of external guest researchers as well as the scientific exchange across

74 the border. In 2015, doctoral candidates from the Europa-Institut, the universities of Zagreb, Belgrade, Skopje and Tirana as well as faculty members of the Center for SEELS and two professors from the legal faculties in Belgrade and Tirana profited from the program and its scholarships. The guest researchers who stayed at the Europa-Institut used their stay to research in different areas of European and international Law. The topics covered public international law, consumer protection in European law, contract law on a Euro- pean level, Democracy and Referenda, Dispute Resolution and the UN Security Council, Comparative Law with regard to the principal of legality in criminal law and Timeshare-contracts. During their stay, the library of the Europa-Institut as well as the other university libraries were extensively used, especially since many publications available in Saarbrücken cannot be accessed at the respective home universities. In addition, the guest researchers were able to attend the lectures from the LL.M.-program and highly valued the professional discussions they were able to have with employees of the Europa-Institut. In order to support research and teaching, the book “European Law – Selected Documents Concerning South Eastern Europe” that compiles the most important documents in European Law in consideration of the south east European partner countries as well a publication series were published in the reporting year 2015. The book contains the following documents: The Treaty on the European Union, the Treaty on the Functioning of the European Union, the Treaty of the Charter of Fundamental Rights, the stabilisation and association agreements of the Repub- lic of Albania, Bosnia and Herzegovina, the former Yugoslav Republic of Mace- donia, the Republic of Montenegro and the Republic of Serbia. The statute book should be used when implementing the various measures of the SEE | EU Clus- ter. In addition, a first publication series “SEE | EU Cluster of Excellence in Eu- ropean and International Law – Series of Papers” with the title “South Eastern Europe and the European Union – Legal Aspects” was published in 2015. The series is meant to provide a forum for professors and young scientists of the part- ner faculties as well as the Europa-Institut and the legal faculty of Saarland Univer- sity, in which they can publish their research results regarding relevant questions on European and public international law. The first issue encompasses twelve papers from authors from Belgrade, Osijek, Rijeka, Skopje and Tirana and deals with various topics on European and public international law, in particular refugee law, company law and comparative law. The 2015 issue does not only include contributions which originated in the research stays at the Europa-Institut, but also includes revised presentations held at the opening ceremony of the Cluster. In order to support the research and scientific work from the German doctoral candidates, a workshop was organised in Belgrade/ Serbia, which is to take place in January 2016. At this workshop the doctoral candidates are provided with the opportunity to participate in two lectures held by two renowned professors about

75 the European Union’s accession and neighbourhood policy as well as international and European refugee law and the concept of a safe third country from a Serbian perspective. Furthermore, the participants will have the opportunity to exchange thoughts about their doctoral thesis as well as the research conditions at the Euro- pa-Institut. Within the framework of the SEE | EU Cluster of Excellence, not only research is being supported but also other measures, in particular the development of eLearn- ing modules as well as a Graduate School. In December 2015, a strategic meeting for the development of a Graduate School took place in Belgrade. The participants were professors and policymakers of the respective partner faculties from South East Europe, the representatives of SEELS (South East Europe Law School Network) as well as the project coordinators from the Europa-Institut. The participants were first presented with the SEE | EU Cluster of Excellence as well as its goals and measures and subsequently with the concept of the Graduate School as a method of cooperation in the supervision of doctoral candidates. The meeting in Belgrade aimed at exchanging thoughts about the various doctoral programs at the faculties as well as discussing the implementa- tion of the Graduate School into practice. In December 2015, the first eLearning Workshop was organised at the Europa- Institut. At this workshop, the eLearning-representatives from the partner faculties came to Saarbrücken in order to study further about the different possible uses of eLearning in teaching and to further develop the contents of the respective mod- ules. Dr. Zimmermann, an expert in this field, held various extensive lectures on this topic. Subsequently, the participants of the workshop agreed on the further steps to be taken with regard to the development of the eLearning-modules in the framework of the Cluster. After the successful start of SEE | EU Cluster of Excellence in European and International Law 2015, the continuance and implementation of new measures are being planned for 2016.

6 Summer Schools 6.1 SEE-LAW NET: Network Europa-Institut – SEELS Since 2012, the Europa-Institut has received financial support from the German Academic Exchange Service (DAAD) in order to organize the project “Academic Reconstruction of South-East Europe.” Since 1999, this special program by the DAAD, which is funded by the Federal Foreign Office (originally in the context of the “Stability Pact for Eastern Europe”), has contributed to a sustainable devel- opment of academic education and research, the promotion of young academics and transnational cooperation in South-East Europe. The project supports the permanent networking of students, graduates, and researchers of various universi- ties in the region through a cooperation network, the qualification of young aca- demics and their integration into the project and network. In doing so, the project aims at achieving a lasting improvement and internationalisation of teaching and research conditions at the partner universities in South-East Europe, which should persist even after the end of the DAAD-funding. On the Balkans, the Europa-Institut cooperates with the network SEELS (South East European Law School), an association of 13 law schools including the law faculties of Mostar, Osijek, Sarajevo, Belgrade, Nis, Kragujevac, Zagreb, Rijeka, Zenica, Skopje, Tirana, Podgorica and Split. The network was founded by the German Society for International Cooperation (GIZ) in 2011 and is aimed at cre- ating a cluster of excellence in the region to foster the collaboration between the faculties. In the context of the cluster, a SEE-EU Law Network is supposed to be estab- lished where researchers can deepen their knowledge about European law based on the Treaty of Lisbon. This network is also supposed to promote the academic exchange between Germany and the Balkans with regards to teaching and re- search. It is for this purpose that Master’s students from Germany and the Balkan region came together for a two-week-long Summer School on the “EU Opens Markets” at the Universities of Zagreb and Split in Croatia from 30 August until 12 Septem- ber 2015. Students deepened their knowledge on European law based on the re- forms brought about by the Treaty of Lisbon and learned about current develop- ments, scientific issues and special research skills. An intensive exchange between the participants and scientific discussions were expressively encouraged. This also applied to the lecturers, who had the opportunity to teach in a team and to thereby exchange knowledge on substantive as well as methodological issues. Following last year’s project, which supported research assistants with a specialisa- tion in European law, some of the participants worked together with professors during a workshop to develop new courses with a theoretical and a practical part. The workshop and the academy promoted the dialogue between the various pro-

77 ject partners. In the future, this project should serve as a forum for permanent exchange with regard to research and teaching. The Summer School courses included not only introductory lectures about the EU-Institutions and their legislative power, which was demonstrated via a simula- tion of the legislative process in front of the Council of the European Union, but also several other fields of European Law. The professors and lecturers of the Europa-Institut and the SEELS-partner universities highlighted in particular the Fundamental Freedoms, Competition Law, European Private Law, and Minority Protection. Reference to current case law of the European Court of Justice was established in all classes. The lectures were rounded off with several group and research works, where the students were able to apply the acquired knowledge into practice. One of the highlights was the Moot Court, a simulated hearing about the legitimacy of the German road user charge (PKW-Maut) before the European Court of Justice. In 2016, the project SEE-EU Law Net will once again be financially supported by the German Academic Exchange Service (DAAD). The fourth Summer School “Graduates for Academia” is already being planned and will introduce master- students in current questions about European Law as well as promoting a PhD in this area. 6.2 European Summer Course: Mapping EU´s Current and Future Tasks The Europa-Institut, in cooperation with the ASKO Europa-Stiftung and the European Academy Otzenhausen, successfully organised the 5th European Sum- mer Course (ESC) in July 2015. During the course, 18 international students came together to learn about various aspects of European Integration. The ESC is an annual event for students from around the world who get the opportunity to learn about Europe from different perspectives in a relaxed atmosphere. A unique expe- rience is guaranteed due to several field trips, various interactive elements, and the international mix of participants. During the twelve-day course, students from Germany, Sudan, Kasakhstan, South Korea, Kosovo and the Netherlands intensively engaged with various aspects of the European Union. First, the students attended introductory lectures concerning the history, politics, and law of the European Integration, in order to then apply this knowledge in a simulation game about the decision-making process in the EU. Later on, the students studied economic aspects of the European Union, in partic- ular the advantages of a single market and a common currency. In addition, the participants examined the role of the European Union in the world focusing on world trade, human rights, migration issues, and climate change policies. The course was framed by the topic “European Integration”, which was the common theme of all the classes and events of the course. A highlight of the course was an excursion to the European Court of Justice in Luxembourg and to the European Parliament and Commission in Brussels as they enabled the students to experience the institutions first-hand. Alongside the vari- ous lectures, workshops, and simulations, the students were also able to enjoy the beautiful surroundings of the European Academy Otzenhausen, play sports and make friends with people from all over the globe. The program supports an intensive knowledge exchange through a balanced mix- ture of lectures, workshops, simulations and excursions. Furthermore, the partici- pants visited Brussels and Strasbourg in order to obtain a more profound insight

81 into the functioning of the most important European and International Institu- tions and Organisations.The students also had the opportunity to visit Trier, which is known as the oldest city in Germany. The international participants discussed the political, economic, and cultural di- mension of the EU with renowned lecturers and experts, deepened their knowledge about Europe in international research groups, and broadened their intercultural understanding. Besides the ambitious academic program, students were also able to widen their network and make friends during the social activities. The ESC is an important event with which the Europa-Institut intends to intro- duce issues of European integration and its hurdles to an interested youth. The 6th European Summer Course is already being planned for 2016.

6.3 Winter School in European Integration: Democracy and Hu- man Rights in the European Union The Winter School “Democracy and Human Rights in the European Union” took place from 11 to 20 January 2015 at the Europa-Institut. The Winter School was supported within the frame of the support program “Reinforcement of the coop- eration with civil societies of Ukraine, Republic of Moldova, Georgia and Belarus”, supported by the German Academic Exchange Service DAAD as well as the German Federal Foreign Office.

During this ten-day event, 35 researchers from the Ukraine, Republic of Moldova, Georgia and Belarus engaged with the basics of the European Union, the regional human rights protection, the work of the various institutions, the most important principles of European Law, as well as the European Neighbourhood and En- largement Policy. Daily lectures, interactive workshops, and simulations were part of the program. The participants were actively involved through group work and were able to use the library of the Europa-Institut for research that went beyond the activities of the Winter School program itself. In order to facilitate this re- search, a detailed introduction to the available resources, such as databases on European law, was provided. Furthermore, participants had the chance to visit the institutions in Strasbourg (European Court of Human Rights and European Council) and Luxembourg (Court of Justice of the European Union). The application process for the Winter School was very successful. The Europa- Institut received almost 370 applications, from which the most qualified applicants were chosen. Eleven of the participants held a Master’s degree, fifteen were PhD students, and nine already had a doctoral degree and were both lecturers at univer- sities and experts in their field in their respective home countries. There were five participants from Belarus, six from the Republic of Moldova, and twelve partici- pants each from the Ukraine and Georgia. The project serves as a stimulus for additional projects of its kind and is, in the long term, directed at the creation of an academic network of European integra- tion which coordinates and supports related activities via a joint institution across country borders. It further promotes the mobility of its participants and enables a transnational exchange of experiences.

6.4 Seminar “European Legal Institutions” in cooperation with the Washington and Lee University In cooperation with the Washington and Lee University, the Europa-Institut held a one week seminar for students from both universities. The aim of the seminar was to reveal the significance of institutional design and practice—as part of a contextual analysis—for proper work in comparative constitutional law. Therefore, the responsbile professors, Prof. Dr. Thomas Giegerich and Prof. Dr. Russell Miller aimed to achieve the best possible learning effect for the German- American group. The structure of the tutorial was a combination of theoretical teaching of the basic legal systems as well as group discussions, in which the stu- dents could compare the differences and contrasts of the German and the Ameri- can legal systems. The students had the opportunity to visit the German Federal Constitutional Court in Karlsruhe and the European Court of Human Rights in Strasbourg. The visits also involved seminar-style discussions of assigned readings with law clerks and judicial assistants presently working at the courts.

6.5 EU China Summer School The Europa-Institut of Saarland University, the European Centre of Economic and Financial Law (ECEFIL) of the Panteion University of Athens, Greece and the Centre International de Formation Européenne (CIFE) jointly organised the Summer School 2014 “China and Europe as Partners – Law, Politics, Economics” that took place on the island of Spetses close to the Greek capital Athens. All courses were held in English by professors from the Europa-Institut, the Eu- ropean Centre of Economic and Financial Law of the Panteion University of Ath- ens, the Centre International de Formation Européenne, the Law School of the National University of Athens and the Institute of European Politics in Berlin. The Professors focused their lectures on their respective field of specialization, included their practical experience in the classes and discussed various topics with the students. As the name of the Summer School indicates, its purpose was to present to the students a number of lectures on the current affairs within the European Union. The interdisciplinary schedule was focused on legal, political and economic aspects of the EU as well as the relationship between the European Union and China, which has gained increasing importance over the last few decades. The students had the opportunity to visit Athens as well as have excursions to Mycenae, Nafplio and Epidavros.

6.6 Summer Schools in International Commercial Law and Inter- national Protection of Human Rights Since 2014, the Europa-Institut has offered a summer school in International Commercial Law and International Protection of Human Rights in cooperation with Prof. Dr. Iris Canor from the College of Management in Tel Aviv as well as the ASKO Europa-Stiftung and the European Academy Otzenhausen. Professor Canor and several Israeli students came to Otzenhausen to learn about various aspects of International Law. Besides numerous lectures, simulations and speeches, the participants had the opportunity to visit several European cities. This year the students visited institu- tion in Strasbourg and Brussels as well as the oldest city of Germany, Trier.

7 Library of the Europa-Institut 7.1 Library Report The library was founded in 1951 at the same time as the Europa-Institut. It is a special legal library focused on European and Public International Law and is used primarily by students and employees of the Europa-Institut but also serves all researchers of Saarland University as well as the general public. The library’s comprehensive stock of literature includes the latest versions of legal documents and is aligned with the research needs of the employees of the Europa- Institut and the content of the various lectures of the Master’s program with its study units European Integration, European Economic Law, Foreign Trade and Investment, International Dispute Resolution, International and European Protec- tion of Human Rights, International Law and International Economic Law.

7.1.1 Library Stock The library of the Europa-Institut currently consists of almost 57.000 volumes, 180 periodicals and 40 continuance works, which are placed in friendly and mod- ern rooms. The publicly available print stock consists of specialised books, loose- leaf collections, reference works, dictionaries, journals, seminar papers and Mas- ter’s theses, which are stocked systematically and can be found via the online- catalogue of Saarland University and the State Library. The majority of the library’s stock is in German, however the English stock has risen disproportionately over the last couple of years. There are also increasingly available publications in other languages of the European Union, particularly in the languages of the new member states. Apart from classic sources of information, the library also offers free access to many E-books and more than 10.000 E-journals, which can be accessed via the online catalogue from all around campus. Furthermore, the users can make use of the most important electronic legal sources of information, online bibliographies, union and meta-catalogues and data banks. These encompass in particular Lex- isNexis, Westlaw, Beck, Juris and Kluwer Arbitration Law, which are partly fi- nanced by the Europa-Institut. Apart from these campus-wide offers, the library also offers access to various E-Journals (EWS) and data banks (e.g. HeinOnline, Dante) to staff and members of the Europa-Institut only. In collaboration with both chairs, the library was able to win new exchange part- ners for the institution’s own series of scripts and the journal ZEuS. In addition, the library exchanges its stock Germany-wide via the platform ELTAB.

7.1.2 Service In the reporting year 2015, library tours were regularly offered in German and English. Apart from these introductory tours, the students also received an intro- duction into scientific work, the composition of a scientific paper, and literature research in the electronic catalogue and data banks in English. Specialised literature research seminars, focused on the various study units of the Master’s program, were also offered. To offer and maintain a high standard of academic research, the library staff members support, with their function as research assistants, the Euro-

96 pa-Institut, its students and the increasing number of visiting scientists in their work. Due to the wide-spread network and the big offer of data banks, our library provides intensive aid to the visiting scientists, who are coming from all over Eu- rope with their research.

7.1.3 Equipment There are three rooms for group work on the library premises with a total of 25 workspaces. During the opening hours of the library, the students are able to use them to work in a team. The rooms are located within the library itself, so that students are able to research and use the other offers of the library at the same time. Since the rooms can be closed, other library users are not disturbed by con- versations. All rooms are equipped with a whiteboard or a flipchart. There are 16 computers in the CIP-Pool and within the library building which can be used for online research. Students and guests can also reserve one of the 40 study spaces in the two reading rooms of the library if they are looking for an undisturbed work space. All study spaces can be used by students during the open- ing hours of the library. Furthermore, the library is equipped with a small and separated lounge-area. Since the purchase of mobile filing pedestals, the visiting scientists have the possibility to arrange their personal workplace in our library. Finally, the students are able to use two photocopiers/ printers, one of which has the capacity to copy/ print in colour. Since 2013, the photocopying and printing costs are charged via the UdS-card. The library is further equipped with a vending machine that sells earplugs.

7.1.4 Tasks The head librarian is responsible for the development and definition of the inven- tory (selection and acquisition of journals, monographs, data banks, E-journals and E-books) and the coordination of acquisitions with both departments. She is sup- ported by the ordering commission, which consists of research assistants of the respective chairs of the Europa-Institut and the head librarian herself. In addition to publications acquired from the local bookstores, publishing compa- nies and academic mail-order bookshops, a number of publications were also re- ceived as gifts from lecturers, professors and private donors as well as via ex- change agreements with other libraries. The Alumni Association of the Europa- Institut EVER e.V. also contributed to the library’s collection with a generous donation. Additional fields of duty are the inventory, subject indexing (systematic ordering within the library itself as well as content indexing based on RSWK for the online

97 catalogue), cataloguing, and further editing of the new acquisitions. The literature inventory on public international law was partly reorganized and duplicates and old editions were removed from the library’s collection. The library’s own special cataloguing system was edited and updated. The new English index is being regularly updated in parallel with the German index. The shelves of the library are labelled in German and English. The administration of journals and all the organisational and administrational tasks within the library, such as the planning and organisation of workflow and staff roster, the training of new employees, the statistical evaluation of the occupancy of the library, as well as the annual evaluation by the students, is also managed by the library staff. Furthermore, the library of the institute is in cooperation with the professorships (Lehrstühle), other libraries of the campus and is nationally and internationally very well connected. The library of the Europa-Institut is, in general, a non-lending library. In spite of that, employees of the Institute and other institutions have the opportunity to borrow books via “Dienstausleihe”, which means that the books can be used in the employee offices at the Europa-Institut. Students are also able to borrow books that they need urgently over the weekend when the library is closed. The library was open 62 hours per week but reduced opening hours only in September (45 hours, closed on Saturdays). This is supplemented by information desk duties for general and more specific questions from students as well as for professional research help in the data banks and catalogues. Since 2014, the library also participated in interlibrary loan programs and ex- changed publications and duplicates of the Europa-Institut’s stock with 20 estab- lished exchange partners and via the internet platform ELTAB. Furthermore, regular newsletters with information regarding new acquisitions of monographs, E-books, data banks and journals were sent to the employees of the Europa-Institut. This also included the compilation of the table of contents of the latest journals, which were sent to the employees of the Europa-Institut on a weekly basis. In addition, the new acquisitions section in the library was newly assembled every other week. The new acquisitions could also be accessed online via the catalogue. The newly acquired E-books were included with placeholders in the new acquisi- tions section in the library and were later sorted in their respective places in the library so that students are still able to browse through the collections as an alter- native to a search in the online catalogue. The placeholder has a QR-Code so that

98 the user can directly download the E-book on an electronic device after scanning the code. The maintenance and updating of the homepages of the library and the European Documentation Centre and of the publication lists of lecturers and professors of the Europa-Institut also fall within the duties of the library employees. Furthermore, the employees of the library researched and obtained material for the various lectures of the Europa-Institut and gave this information out to the stu- dents. The library also provided for a small exhibition of relevant literature for the respective lectures. The library of the Europa-Institut is a member of the “Deutschen Biblio- theksverband/ Arbeitskreis Spezialbibliotheken” and of the “Arbeitsgemeinschaft für juristisches Bibliotheks- und Dokumentationswesen.” In addition, the head librarian is on the management board of the Saarland “BIB-Landesverband”, a member of the commission for One-Person Libraries, and a member of the Stand- ing Committee of the Library Services to Multicultural Populations Section, a sec- tion of the International Federation of Library Associations and Institutions (IFLA).

7.2 European Documentation Centre (Europe Direct) Since 1972, the library has been one of 40 European Documentation Centres (EDC) in Germany and belongs to a European network (Europe Direct) of infor- mation facilities, which were founded in 1963 by the European Commission with- in the scope of its information and communal politics. It is the aim of the EDC at the Europa-Institut to make information about the European Union and its poli- tics available to students, university staff and the general public, to support the research and teaching about “European Integration”, and to generally inform about the European Union itself. The centre collects, systemizes, and catalogues the official publications of the Eu- ropean Union (official journal of the European Union, documents of the Europe- an Commission, jurisprudence of the European Court of Justice). Additionally, free access to a number of EU data banks and an increasing number of electronic documents are offered. Since 2013, the data bank ESO (European Sources Online) can be accessed free of charge by all interested persons. Another field of duty of the centre is research and research support, as well as trainings on literature and information in the data banks of European institutions. The EDC Saarbrücken is responsible for the archiving of electronic texts (in par- ticular studies and working papers) of the DG Competition in the context of Ar- chiDok, a joint project of the European Documentation Centres (founded in 2003).

The head librarian is regularly trained on the latest developments in the EU and its information policy, transparency, and access to documents by the European Commission in Brussels and by the regional representation office in Germany. Together with the Jean-Monnet-Chair, the EDC organised a workshop with the title “Europa verstehen” (Understanding Europe). It is a special offer for the pu- pils of several secondary schools in Saarland. The workshop took place during the “Europawoche” (European Week) 2015 at the Europa-Institut which was a great success and will be offered again in 2016. The European Documentation Centre is not only active within the European network Europe Direct, but also in the regional network “Communicating Euro- pean Policy”, and the European regulars’ table of the Saarland, which was founded in 2012.

8 Awards and Scholarships A number of scholarship holders and laureates are amongst the students of the Europa-Institut.

Civil Society Leadership Award The Civil Society Leadership Awards provide fully funded master’s level scholar- ships at a network of universities across Asia, Europe and North America. These awards support one to two year graduate programs for students who demonstrate both academic and professional excellence and have potential to become civil society leaders in their home communities. This year we have one student from Ethiopia, one from Turkmenistan and one student from Uzbekistan who are sup- ported through this scholarship.

Dr. Angela Merkel Scholarship – Jawaharlal Nehru Award for International Understanding, Master’s Scholarship for European Law The Europa-Institut has been selected as one of three German institutes, where students can apply for the Dr. Angela Merkel Scholarship – Jawaharlal Nehru Award for International Understanding, Master’s Scholarship for European Law. The scholarship is directed at Indian students, who want to acquire an LL.M. in European Law. There were two students in the study year 2014/15 and two stu- dents in the study year 2015/16, who received this scholarship. The scholarship is awarded to highly qualified graduates with a Bachelor degree, who would like to contribute to the academic and economic development of their native country. The scholarship is awarded for one year and covers the outbound and return flight as well as 750 Euro per month. The students also do not need to pay for the tui- tion fees and receive support for their studies in terms of research, health insur- ance and a two-month language course in German, where they also do not need to pay any fees and where they receive support for their accommodation and living costs.

Deutschlandstipendium In winter semester 2011/2012, the so-called Deutschlandstipendium was awarded for the first time at Saarland University. The Germany Scholarship provides finan- cial support for young talents in the amount of 300 Euro per month. The Alumni Association of the Europa-Institut EVER e.V., with help of its member Dr. Har- ald Schneider, is a supporter of this scholarship. Two students from the study year 2014/15 and two students from the study year 2015/16 also received the Germa- ny-Scholarship.

Hans Werner Osthoff Award Each year, on the occasion of the opening ceremony of the new study year, the Hans Werner Osthoff Award is awarded to the student with the best Master’s thesis. This year, the prize was awarded to Erin DuBose (study year 2013/2014) for her Master’s thesis “The Implementation of the 2005 Hague Convention on Choice of Court Agreements in the European Union: An Analysis of its Relation- ship with the Brussels One -bis Regulation.“ The Hans Werner Osthoff foundation was founded on 7 December 1990 as a special asset of Saarland University and aims at supporting outstanding young researchers of the Europa-Institut (section law and economics) by awarding the Hans Werner Osthoff Award. The prize is awarded annually during the graduation ceremony by Dr. Claudia Osthoff, daughter of the foundation’s founder, and has a value of 1,500 Euro.

Villa Lessing European Award On 5 March 2015, three graduates from the Europa-Institut received the “Europa- Preis der Villa Lessing” (Villa Lessing European Award). This award, which was granted for the fifth time in 2014, grants prize money of 1,500 Euro each and is awarded to up to four students of the Europa-Institut from the specialised fields of “European Law” and “European Economics.” The prize is awarded to gradu- ates whose Master’s thesis deals with the development of law and the economy in Europe, in particular with the strengthening of freedom and competition in Eu- rope, the European integration on a liberal basis, as well as the strengthening of a European civil society. This year’s laureates were Loreta Poro (“Is National Sovereignty Restraint a Fair Price to pay to Achieve the Fiscal Union? Analysis of the Federal Constitutional Court Decision 2BvR 1390/12“), Franziska Prillmann (“Patenting Human Life Reflections on the Legal Status Quo of Patents on Human DNA Sequences in Europe and the United States”) und Nataša Vujinović (“The CISG’s scope of application ratione materiae with special reference to software transactions”). Mi- chael Theurer MdEP, Chair of the Budgetary Control Committee of the European Parliament, held the honorary speech before Prof. Dr. Dr. h.c. Joachim Zentes und Prof. Dr. Torsten Stein held the laudatory speeches for the respective laure- ates. After the certificates were awarded to the student laureates, Christian Graf Dohna held a short closing speech and invited everyone for a drink back at Villa Lessing. Villa Lessing – Liberale Stiftung Saar is an association which has devoted itself to the support of a democratic and civic education, to further science, research and

102 culture on a liberal basis, and to promote international understanding and Europe- an unification.

Award of an accommodation grant by Villa Lessing Villa-Lessing – Liberale Stiftung Saar e.V. awarded a scholarship to a Bosnian student from the Europa-Institut in the form of an accommodation grant at Villa Lessing, which is the seat of the association. The accommodation is free of charge and is usually granted for a period of three semesters.

9 Study Fairs and Events The Europa-Institut was also represented at a number of fairs and events.

International Day in Bergen, 14/15 January 2015 In January, the Europa-Institut was represented at the 7th International Day at the University of Bergen. The fair was directed at students of the University of Bergen and other Norwegian students who are interested in going abroad during their studies. Equipped with an exhibition stand, the representatives of the Europa- Institut answered questions and presented the Master’s program in a short speech. In addition, representatives of the Europa-Institut had the opportunity to com- municate with international colleagues and to discuss new possibilities of coopera- tion.

EU Studies Fair in Brussels, 6/7 February 2015 In February 2015, the Europa-Institut was represented at the 15th EU Studies Fair in Brussels. The studies fair was directed at students with an academic degree, who are interested in a postgraduate degree in the fields of International Relations, EU Politics, Economics and Law. Over the course of two days, the fair brought to- gether potential students and academic institutions who offer programs in these fields. A special guest of the event was the European Commissioner for Educa- tion, Culture, Multilingualism, and Youth Androulla Vassiliou. Another special guest was the European Commissioner for Education, Culture, Youth and Sport, Tibor Navracsics.

Open house at the Centre Juridique Franco-Allemand in Saarbrücken, 24 April 2015 The Centre Juridique Franco-Allemand organised an open house on 24 April 2015 during which the Europa-Institut presented its study program and the possibility for students of the CJFA to register for the program.

Open house at Saarland University, 4 July 2015 On 4 July 2015 the open house at Saarland University took place. During this event, students were able to inform themselves about academic programs, student life, laboratories, research projects and institutes at Saarland University, ranging from Engineering and Science to Medicine, Humanities, Economics and Law. The

Europa-Institut took the opportunity to introduce itself to potential future stu- dents.

6th Career Day of the Faculty of Law and Business at Saarland University, 18 November 2015 On 18 November 2015 the 6th career day of the faculty of law and business at Saarland University took place which was organized in cooperation with MYJOB- FAIR GmbH. Students and graduates had the opportunity to meet representatives from law firms and companies, which were offering positions in their respective fields (permanent positions, student jobs, internships and trainee jobs among oth- ers). Prior to the career day, a job application training was offered and the partici- pants were able to send their curriculum vitae to companies via an online applica- tion tool. The Europa-Institut participated in the career day to inform students about its study programme and the resulting professional possibilities.

10 Alumni Association of the Europa-Institut The Alumni Association of the Europa-Institut (law department) – EVER e.V. was founded in 1996 by then current and former students of the Europa-Institut (law department). EVER aims at maintaining and advancing contact between former students of the Europa-Institut, as well as involving current students of each year in their events. Via numerous events, a network of alumni is being established which allows for information exchange beyond the duration of the program. Furthermore, regular meetings between current students and alumni, as well as guest lectures are organ- ised in various European cities. EVER also informs alumni about the latest devel- opments and upcoming events at the Europa-Institut. Members of EVER profit from the extensive experience and engagement of the association and can take advantage of the always growing offer and international network in order to ad- vance their professional careers. In 2015, EVER was able to fund one scholarship within the context of the Ger- many Scholarship (Deutschlandstipendium) for a current student of the Europa- Institut. Since summer semester of 2011, the Germany Scholarship has provided financial support for young academics with exceptional achievements in their stud- ies in the amount of 300 Euro per month. Half of this monthly budget is provided by the federal government, the other half by EVER as a private sponsor. This enables students to either generally finance their studies at the Europa-Institut or to financially support themselves while they write their Master’s thesis at the Eu- ropa-Institut. The second scholarship was made possible through a generous do- nation by an alumnus. Apart from that, EVER also helped acquire specialised literature for the library of the Europa-Institut. This donation was particularly important considering the increasing costs of important specialised literature in English language. It also funded the purchase of practical see-through library bags for the students and contributed to the printing costs for the series “Selected legal documents” that is published by the Europa-Institut. Furthermore, EVER financially supported the event which was held at the Euro- pa-Institut in order to prepare for the EPSO-Concours. Finally, the extensive work to create a new members’ book was successfully finished in 2015. Last but not least, EVER and the Europa-Institut jointly and successfully applied for a Call of the DAAD (the German Academic Exchange Service) and are going to receive financial support to hold a several day-long alumni advanced training seminar which is going to take place in 2016.

10.1 EVER Job and Internship Pool The EVER job and internship pool supports current students and alumni in find- ing their first job or when professional change is sought. EVER already offers students at the Europa-Institut access to a job and internship pool during their studies. This pool includes job and internship offers that are constantly updated and tailored to the particular requirements of the students at the Europa-Institut. Most job opportunities are forwarded to EVER by alumni. The offers are published both in German and English on the homepage of the Europa-Institut under the section for the Alumni Association. Apart from job placement, EVER also consults with students on their professional development and gives tips during the job application process. This is supplemented by scholarship and workshop announcements as well as events, during which current students can get in touch with alumni and have re- cruiting meetings with representatives of large law firms.

10.2 EVER Events EVER holds a series of regular events for its members and current students of the Europa-Institut, which are intended to facilitate the networking of the members and to foster their professional development and intercultural exchange. Apart from the regulars’ tables in Luxembourg, Brussels, Frankfurt a.M., and Berlin, the following special events were organised:

EVER Event “Job opportunities in Luxembourg”, 25 June 2015 At the end of June 2015, EVER organised another event in the highly successful series “Job opportunities in Luxembourg” to introduce job profiles and opportuni- ties in Luxembourg to current students of the Europa-Institut. Lina Goffin (Alken Fund), Shira Becker-Alon (Vistra), Rupert Steinlein (Artelis), Rainer Grosshans (Mitsubishi Bank) and Rüdiger Sailer (Kaufhold & Réveillaud, Avocats) answered the students’ questions. The event was moderated by Rupert Steinlein, a member of the EVER-board, and rounded off with a get-together.

EVER General Meeting and Graduation Party, 11 July 2015 On 11 July 2015 the annual general meeting of the association took place. The annual report was presented by chairwoman Claudia Schäffner and the audit re- port was discussed. The protocol of the general meeting can be requested at the EVER office.

The EVER PROFession- als ended up winning over the students. Besides the football match, students and alumni also played beach volleyball. In the evening, a graduation party was hosted in the “Ausländer-Café” during which alumni, students and employees were able to reminisce about the previous year over good food and drinks.

EVER Barbecue, 14 August 2015 Following the last exam of the students from the LL.M. program, EVER organ- ised a barbecue just outside the Europa-Institut. The event enabled current stu- dents to better get to know the Alumni Association.

EVER Guided City Tour, 20 Oktober 2015 In the beginning of the academic year 2015/2016, EVER organised the traditional guided tour through Saarbrücken. While walking through the city centre, alumni informed the new students about the city and showed them the most important meeting points, shops, and offices. The guided tour finished at the “Stiefel Bräu” at the St. Johanner Markt where the students ate traditional food from the Saar- land.

EVER Welcome Party, 26 October 2015 In October of 2015, the traditional “Welcome-Party” for the new students took place in the pub “Manhattan” in Saarbrücken. The party enabled the students to get to know each other in a less formal environment while enjoying cocktails and music.

EVER Event “Job Opportunities in Brussels“, 5 November 2015 In the context of the annual visit of the Europa-Institut to Brussels, EVER organ- ised an event regarding job opportunities in Brussels which took place in the Goe- the-Institute in the Rue Belliard located in the “Europa-District.” At the event, alumni of the Europa-Institut talked about their professional experiences; namely Kristaps Sikora (lawyer at Bird & Bird), Jani Ringborg (European Commission), Diego Sevilla Pascual (lawyer at Fieldfisher) and Eleftherios Petropoulos (intern at the European Commission). The event was moderated by EVER board member Robin van der Hout. The event ended with a get-together which gave the partici- pants the opportunity to network.

EVER Christmas Event, 10 Dezember 2015 At the end of the year, the EVER Christmas Party took place in the SOHOclub in Saarbrücken. The program was organised by current students and employees of the Europa-Institut who sang Christmas songs from around the globe.

Information Event about the European Commission, 15 December 2015 Also this year, the popular event “How to apply for an internship at the European Commission” took place. The alumnus Marco Uccelli, who works at the European Commission, talked about the opportunity to do an internship at the institution.
