WALNUT CITY COUNCIL MEETING

CALL TO ORDER: Mayor Pacheco called the meeting to order at 7:02 p.m.

PLEDGE OF ALLEGIANCE: M/Pacheco led the flag salute.

ROLL CALL:

Also present were City Manager Wishner; Administrative Services Director Ogawa; Community Development Director Weiner; Community Services Director Rooney; City Attorney Leibold; City Planner Carlson; Deputy Director of Community Services Jensen; Interim Finance Officer Cortez; Associate Planning Vasquez; Senior Management Analyst Layman, Senior Management Analyst Womble; Management Analyst Barcelo; Assistant Planner Julve; Administrative Assistant Markel, and City Clerk De Dios.

INVOCATION - NON-DENOMINATIONAL: The invocation was led by Pastor Robles of On a Mission Church.

PRESENTATIONS:

• NJB Championships – First place for 2nd Grade Boys Team; 5 & 6 Grade Boys Team

Council commended the accomplishments of the two National Junior Basketball teams that went on to win national championships.

• Older American of the Year 2016 Honoree – Claudine Stines

Council presented the honor of “Older American of the Year” to Claudine Stines; a long time Walnut resident and active community member.

• Arbor Day Presentation by West Coast Arborists

In honor of Arbor Day, Council presented Parks and Recreation Vice Chair James Swartz with a proclamation.

Andy Trotter, Vice President of West Coast Arborists, provided an update on trees throughout the City as it relates to subjects such as drought effects and technological integrations to better serve the City.

• San Gabriel Valley Mosquito & Vector Control Presentation – Carol Anne Hagele, Education Specialist

Carol Anne Hagele provided the community with information on mosquito related matters including: West Nile Virus, abatement, and bite prevention.

ORAL COMMUNICATIONS FOR THE CITY COUNCIL:

Mansfield Collins congratulated the newly elected Councilmembers and asked that Council place items on future agendas; such topics included: future development, public safety, and communication.

Three Oaks residents expressed their concerns regarding home burglaries in their neighborhood; they requested that a gate and security booth be constructed at the entrance to their community.

Resident suggested that Three Oaks residents be more vigilant and call the sheriff at the first sign of suspicious activity.

There being no further input, it was moved by MPT/Su to close oral communications; seconded by C/Ching. Motion carried.

CM/Wishner suggested that Council ask CA/Leibold to examine the legal issues surrounding the requests of Three Oaks residents before Council makes a policy decision.

M/Pacheco requested a study session to discuss the requests made by Three Oaks residents.

1. Approval of the April 27, 2016 City Council/WHA Minutes.

MOTION ON ITEM 1 MPT/Su made a motion to approve Item 1; seconded by C/Ching. Motion carried by the following electronic vote:

2. Resolution No. 16-19 - Public Hearing Regarding Setting 2016-17 Lighting and Open Space Maintenance District No. 1 (LOSMD) Assessments

Recommendation: That the City Council: 1. Open the public hearing; 2. Close the public hearing; and 3. Adopt Resolution No. 16-19 – “A Resolution of the City Council of the City of Walnut, County of Los Angeles, Ordering the Maintenance Work, Approving the Engineer’s Report, and Confirming the Diagrams and Assessments within Lighting and Open Space Maintenance District No. 1, Zones 1, 2, 3, 4, 5, 6, 7, 8, 9, 11 and 12 for Fiscal Year 2016-17.”

RKA Engineer Cody Howing provided a staff report.

Discussion took place between Council and staff regarding the assessment of Zone 9 as well as the LOSMD subsidy.

M/Pacheco asked staff to look into the possibility of the City being overcharged for its street lighting and the option of using more efficient lighting.

There being no one present wishing to speak during the public hearing, it was moved by MPT/Su to close the public hearing; seconded by C/Ching.

MOTION ON ITEM 2 C/Ching made a motion to adopt Item 2; seconded by MPT/Su. Motion carried by the following electronic vote:

COUNCIL CONSENT CALENDAR:

Item 10 was pulled for discussion.

3. Resolution No. 16-20 – “A Resolution of the City of Walnut Allowing Certain Claims and Demands in the Amount of $490,018.61 Demand No. 150912 through No. 151011, Both Inclusive.”

Recommendation: That the City Council adopt Resolution No. 16-20.

4. Resolution No. 16-21 - Acknowledging and Confirming a Court Order in the Matter of Los Angeles SMS, A Limited Partnership DBA Verizon Wireless vs. the City of Walnut.

Recommendation: That the City Council: 1. Acknowledge and Confirm the Federal District Court Order issued April 5, 2016; and 2. Adopt Resolution No. 16-21, “A Resolution of the City Council of the City of Walnut, California, Repealing Resolution No. 15-49 and Approving Site Plan Case and Architectural Review (SPC/AR) 2014-054 For a Wireless Telecommunication Facility In Accordance with a Court Order in the Matter of Los Angeles SMS, A Limited Partnership DBA Verizon Wireless vs. The City of Walnut.”

5. Resolution No. 16-22 – Adoption of Measure A – Term Limits

Recommendation: That the City Council adopt Resolution No. 16-22, “A Resolution of the City Council of the City of Walnut, California, Codifying the Ordinance of the People of the City of Walnut, California, Limiting the Number of Terms a Member of the City Council May Serve”

6. Professional Services Agreement with Rincon Consultants, Inc. to Prepare an Environmental and Technical Studies for the Proposed 49 Acre Site Specific Plan.

Recommendation: That the City Council: 1. Authorize the City Manager to enter into an agreement with Rincon Consultants, Inc. for a not to exceed total of $98,742.00 at this time; and 2. Issue a Purchase Order to Rincon Consultants, Inc. for said amount.

7. Tract No. 73294 Final Acceptance (Shea)

Recommendation: That the City Council: 1. Approve Tract No. 73294; 2. Accept on behalf of the public, all streets, highways, and other public ways so designated on the Final Tract Map; 3. Accept on behalf of the public, the dedication of easements for public utility and ingress and egress purposes so designated on the Final Tract Map; 4. Accept on behalf of the public, the dedication of easements for emergency access & fire lane purposes so designated on the Final Tract Map; 5. Abandon those streets acquired per “offer of dedication” recorded October 29, 1969 so designated on the Final Tract Map; 6. Authorize the City Clerk and City Treasurer to endorse the certificates as shown on the Final Tract Map; and 7. Authorize the Mayor to execute the Subdivision Agreement.

Recommendation: That the City Council: 1. Approve Tract No. 71977; 2. Accept on behalf of the public, all streets, highways, and other public ways so designated on the Final Tract Map; 3. Accept on behalf of the public, the dedication of easements for public sidewalk and public utility purposes so designated on the Final Tract Map; 4. Authorize the City Clerk and City Treasurer to endorse the certificates as shown on the Final Tract Map; and 5. Authorize the Mayor to execute the Subdivision Agreement.

9. Revision of the Fixed Asset Capitalization Policy

Recommendation: That the City Council approve the revised Fixed Asset Capitalization Policy effective for the Fiscal Year 2015-16.

11. Walnut Youth Softball Request for Two Additional Tournaments

Recommendation: The Walnut Parks and Recreation Commission is recommending the City Council approve the request by Walnut Youth Softball (WYS) to conduct an additional two tournaments per calendar year.

12. Mayor’s Agency Representatives Appointments to fill Vacancies

Recommendation: That the City Council receive and file this informational report.

10. Website Policy

Recommendation: That the City Council adopt the City of Walnut Website Policy.

SMA/Layman provided a staff report.

Discussion took place between Council and staff regarding the portion of the policy that speaks to determining approval of information to be posted on the website.

CA/Leibold stated that the policy allows for anything that is of general public interest and of benefit to the community to be posted.

SMA/Layman announced that there will be a formal presentation of the new City website at a future City Council meeting.

MPT/Su provided information on L.A. Metro’s proposed ballot measure project list.

C/Ching shared that Council will be bringing back information from the Contract Cities of California Association Conference.

M/Pacheco shared information from a Southern California Association of Governments regarding Edison lighting improvements.

B. Individual Members’ comments and updates

C/Rodriguez thanked the residents that made it to his office hours earlier in the week.

MPT/Su thanked Captain Scroggin for attending a meeting with Three Oaks residents and for his level of concern for public safety in Walnut.

C/Tragarz invited the community to attend the ribbon cutting for the new Creekside Park playground on May 27th at 8:30 A.M.
