Magistrate's Courts GENERAL NOTICE 8 No. 40753DEPARTMENT OF JUSTICEGOVERNMENT AND GAZETTE, CONSTITUTIONAL 31 MARCH 2017 DEVELOPMENT No. DEPARTMENT OF JUSTICE AND CONSTITUTIONAL DEVELOPMENT 2017 NOTICE 272 OF 2017 272 Magistrate’s Courts Act (32/1944): Intention to Create Magisterial Districts and Establish District Courts in the Free State Province as Part of the Rationalisation of Magisterial Districts 40753 MAGISTRATES' COURTS ACT, 1944 (ACT NO. 32 OF 1944): INTENTION TO CREATE MAGISTERIAL DISTRICTS AND ESTABLISH DISTRICT COURTS IN THE FREE STATE PROVINCE AS PART OF THE RATIONALISATION OF MAGISTERIAL DISTRICTS I, Azwihangwisi Faith Muthambi, Acting Minister of Justice and Correctional Services, hereby, intend to,in terms of section 2(1)(a) (f)(h)(j)(k) and (1) of the Magistrates' Courts Act, 1944 (Act No. 32 of 1944),- (a) create, in respect of the municipalities mentioned in Column "A" magisterial districts as reflected under Column "B" of Schedule 1 and declare that those magisterialdistricts be known by the names referredtointhe said Schedule; (b)detach portions of the magisterial districts under column "B" of Schedule 1 to form areas of jurisdiction of detached courts for sub -districts as reflected under column "E" of Schedule 1and declare that those sub -districts be known by the names referred to in the said column "; (c) establish, for the districts mentioned under Column "B" and sub -districts under Column E, courts as reflected under Column "C" and "F" of Schedule 1 for the purpose of- (i) the trial of persons accused of committing any offences which shall have jurisdiction contemplated in section 89 and 92 of the Magistrates' Court Act, 1944; and (ii) adjudication of civil disputes contemplated in section 29(1) of the Magistrates' Court Act, 1944; and (d) specify, in respect of each district mentioned under Column "C" seats of the magistracy as reflected under Column "D "; (e)appoint, in respect of the sub -districts mentioned under Column "E" of Schedule 1 to the notice, places for holding of the detached courts as reflected under Column "F" to this notice; This gazette is also available free online at www.gpwonline.co.za STAATSKOERANT,2 31 MAART 2017 No. 40753 9 (f) define, in respect of each districts mentioned under Column "B" of Schedule 1 to the notice, local limits as reflected under Schedule 2; (g)define in respect of each detached courts mentioned under Column "F" to this notice, the area of jurisdiction of the sub -districts concerned as reflected under Schedule 3; (h) appoint,within thedistricts mentioned under Column "B" and sub -districts mentioned under Column "E ",places for the holding of a court and periodical courts as reflected under Column "G" of Schedule "1 "; and (i) that the periodical courts mentioned under Column "F" of Schedule 1,shall exercise jurisdiction over the same area of jurisdiction of the districts.     Remembrance African Activist Archive Project Documenting Apartheid: 30 Years of Filming South Africa By Peter Davis During April 2004 and beyond we were constantly reminded that this is the tenth anniversary of the first democratic all-race elections in South Africa. I was shocked by the realization that last year also marked the thirtieth anniversary of my first visit to that country, of my first experience with apartheid. After that first trip in 1974 as part of an African tour I was doing for the American NGO, Care, I was to devote a large part of my working life to the anti-apartheid struggle. For those of us who were involved in that struggle, it was such an everyday part of life that it is hard to grasp that there is already a generation out there that does not know the meaning of “apartheid”. The struggle against apartheid took many forms, from protests, strikes, sabotage, defiance, guerrilla warfare within the country to boycotts, bans, United Nations resolutions, rock concerts, and arms and money smuggling and espionage outside. Apartheid, which was institutionalized by the coming to power of the white National Party in 1948, lasted as long as it did, against the condemnation of the world, because it had powerful friends. Chief among these were the United States, which saw a South Africa governed by whites as a useful ally in the Cold War; a Britain whose ruling class had close links with South African capital; and German, French, Israeli and Taiwanese commercial interests that extended even to sales of weapons and nuclear technology to the apartheid regime.

Natura Viva cc, PO Box 12410 Mill Street, Cape Town 8010, RSA [email protected] January 2020 EXECUTIVE SUMMARY Ventura Renewable Energy (Pty) Ltd is proposing to develop up to four solar PV facilities, each of up to 100 MW generation capacity, on the farm Visserspan No. 40, c. 10 km northwest of Dealesville and 68 km northwest of Bloemfontein, in the Tokologo Local Municipality, Free State Province. Substantial direct impacts on fresh, potentially-fossiliferous Tierberg Formation (Ecca Group, Karoo Supergroup) bedrocks during the construction phase of the proposed PV solar projects are considered unlikely. The mapped outcrop areas of the Tierberg Formation within the PV solar project areas are small while the mudocks here are likely to be weathered near-surface and mantled by thick superficial deposits such as calcrete. In this region, the near-surface Ecca Group bedrocks are very often extensively disrupted and veined by Quaternary calcrete as well as baked by dolerite intrusions, compromising their palaeontological sensitivity. Potentially fossiliferous Pleistocene alluvial or spring deposits were not encountered in the study area, while pan and associated dune sediments here lie largely – but not exclusively - outside the development footprint. The calcrete hardpans encountered within the study area are of low palaeontological sensitivity. The only fossil remains recorded during the field survey comprise a few small blocks of petrified fossil wood – reworked from Tierberg bedrocks - among surface gravels around the margins of a pan in the SE corner of Visserspan No.

    Phase 1 Heritage Impact Assessment for proposed new 1.5 km-long underground sewerage pipeline in Paul Roux, Thabo Mofutsanyane District Municipality, Free State Province. Report prepared by Paleo Field Services PO Box 38806, Langenhovenpark 9330 16 / 02 / 2020 Summary A heritage impact assessment was carried for a proposed new 1.5 km-long underground sewerage pipeline in Paul Roux in the Thabo Mofutsanyane District Municipality, Free State Province. The study area is situated on the farm Farm Mary Ann 712, next to the N5 national road covering a section of the Sand River floodplain which is located on the eastern outskirts of Paul Roux . The proposed footprint is underlain by well-developed alluvial and geologically recent overbank sediments of the Sand River. Investigation of exposed alluvial cuttings next to the bridge crossing shows little evidence of intact Quaternary fossil remains. Potentially fossil-bearing Tarkastad Subgroup and younger Molteno Formation strata are exposed to the southwest of the study area. These outcrops will not be impacted by the proposed development. There are no major palaeontological grounds to suspend the proposed development. The study area consists for the most part of open grassland currently used for cattle grazing. The foot survey revealed little evidence of in situ Stone Age archaeological material, capped or distributed as surface scatters on the landscape. There are also no indications of rock art, prehistoric structures or other historical structures or buildings older than 60 years within the vicinity of the study area. A large cemetery is located directly west of the proposed footprint. The modern bridge construction at the Sand River crossing is not considered to be of historical significance.

Because of low confidence in the aquatic data that were available at the time of developing the plan, the aquatic component is not included herein and will be released as a separate report. The biodiversity plan was developed with cognisance of the requirements for the determination of bioregions and the preparation and publication of bioregional plans (DEAT, 2009). To this extent the two main products of this process are: • A map indicating the different terrestrial categories (Protected, Critical Biodiversity Areas, Ecological Support Areas, Other and Degraded) • Land-use guidelines for the above mentioned categories This plan represents the first attempt at collating all terrestrial biodiversity and ecological data into a single system from which it can be interrogated and assessed.
