1.0 INTRODUCTION Trans Mountain Pipeline ULC (Trans Mountain) submitted a Facilities Application (the Application) to the National Energy Board (now the Canada Energy Regulator (CER)) in December 2013 for the Trans Mountain Expansion Project (the Project or TMEP).

On June 18, 2019, the Governor General in Council, on the recommendation of the Minister of Natural Resources, directed the National Energy Board to issue CPCN OC-065, and various Amending Orders, to Trans Mountain to permit the Project to proceed, subject to 156 conditions.

CER Condition 94 requires Trans Mountain file with the CER, at least two months prior to commencing construction, and on or before 31 January of each year during construction and for the first five years after commencing operations, a report (Consultation Report) on Trans Mountain’s consultations with municipalities and regional districts, communities, and Indigenous groups related to the protection of municipal and community water sources, including those sources currently relied upon and sources identified for potential future use.

Previous Consultation Reports include:

• The first Consultation Report, which included all consultation completed with local governments up to April 28, 2017 and Indigenous groups up to May 1, 2017, was submitted to the CER on June 16, 2017 (Filing ID: A84464); • The second Consultation Report, which included consultation with local governments and Indigenous groups up to December 31, 2017 (Filing ID: A89712-2); • The third Consultation Report, which included consultation with local governments and Indigenous groups up to November 1, 2018 (Filing ID: A97722-1); and • The fourth Consultation report, which included consultation with local governments and Indigenous groups up to December 31, 2019 (Filing ID: A7D0Z6).

This Consultation Report summarizes the CER Condition 94 consultation and engagement efforts from January 1, 2020 to December 31, 2020.

1.1 Commitment Management Trans Mountain made a number of commitments regarding the Project during the OH-001-2014 proceedings and engagement activities up to December 2020. Commitments were made to improve and optimize Project planning and mitigation measures. Trans Mountain has consolidated its commitments into a Commitments Tracking Table in accordance with CER Condition 6 and therefore the Table of Commitments in each plan has been removed. Information Requests (IRs) and engagement activities that raised discussion, but did not result in a commitment, are not included in the Commitments Tracking Table.

The updated Commitments Tracking Table has been filed with the CER pursuant to CER Condition 6 and will continue to be updated as per the condition requirements; the document is available on Trans Mountain’s website at www.transmountain.com. Trans Mountain continues to monitor and track compliance with its commitments and will update, post to its website, and file with the CER updated versions of the Commitments Tracking Table according to the timeframes outlined in CER Condition 6. Commitments with specific relevance to this Consultation Report have been considered and incorporated in the report.

2.0 PUBLIC CONSULTATION AND ENGAGEMENT 2.1 Public Consultation – January 1, 2020 to December 31, 2020 The Project engagement and communications program was designed according to Section 3.4 of the NEB Filing Manual (NEB 2013) and is described in detail in Volume 3A of the Application (Filing ID A55987), as well as four subsequent consultation updates filed with the NEB during its regulatory review of TMEP (Consultation Update No. 1 and Errata (A59343), Consultation Update No. 2 (A62087 and A62088), Consultation Update No. 3 (A4H1W2 and A4H1W8) and Consultation Update No. 4 (A72224).

Engagement is ongoing, and Trans Mountain continues to follow up with local governments to identify and resolve issues or concerns in relation to water sources, or to confirm there are no outstanding concerns or issues regarding municipal water sources. A summary of issues and concerns raised through engagement during this reporting period is included below in Table 2.

Trans Mountain will continue to work with local governments along the pipeline route to address interests regarding the protection of local water sources. Trans Mountain will report on on-going engagement activities in future filings pursuant to Condition 94.

3.0 INDIGENOUS ENGAGEMENT Since April 2012, Trans Mountain has engaged with Indigenous groups who might have an interest in the Project or whose territory may be potentially affected by the Project. This is based on the proximity of their community and their asserted traditional and cultural use of the land along the pipeline corridor to maintain a traditional lifestyle. The objectives of Trans Mountain’s Indigenous engagement program are to:

• have an open, transparent and inclusive process that seeks to exchange information in a respectful manner;

• address concerns shared by those who might have an interest in the Project or have Indigenous interests potentially affected by the Project;

• incorporate feedback into Project planning and execution; and

• provide opportunities to maximize Project benefits to Indigenous groups.

A comprehensive Indigenous engagement program is led by experienced Indigenous Relations Advisors in Alberta and British Columbia, specialized in the areas of Indigenous relations, law, economic development, education, training, employment and procurement. Trans Mountain’s Indigenous engagement efforts remain flexible, allowing each community and group to engage in meaningful dialogue in the manner they choose and in a way to meet their objectives and values.

Indigenous groups had the opportunity to engage with Trans Mountain, depending on Project interests and potential effects. The following opportunities to engage have been provided:

• Project announcement;

• initial contact with the Indigenous group;

• meetings with the Chief and Council, including staff;

• community information session(s);

• conduct Traditional Land Use (TLU) studies and socio-economic interviews, including sharing of Traditional Ecological Knowledge (TEK);

• identify interests and concerns; and

• identify mitigation options.

Detailed information on Indigenous engagement activities specifically related to the protection of municipal water supplies that were conducted from January 1, 2020 to December 31, 2020, are summarized in Table 3. The engagement activities generally occurred at Indigenous community offices, open houses and mutually agreed-upon locations. However, following the March 19, 2020 World Health Organization (WHO) declaration regarding the COVID-19 pandemic, Indigenous engagement activities continued virtually, and in compliance with travel and in-person meeting restrictions. When possible, and with strict adherence to COVID-19 guidelines, in-person meetings occurred in the field during collection of TEK, concurrent with biophysical field studies.

Trans Mountain’s complete record of Indigenous engagement is available within its various CER Condition 96 filings. The most recent Condition 96 Report was filed in January 2021, covering the period of January 1 to June 30, 2020 [Filing ID C11031-1].

Team Member advised the field work, consisting of fish and fish habitat assessments along the proposed alternate pipeline route would be three days. Team Member advised the crew would consist of two contractor employees, plus a participant from Esh-kn-am Cultural Resources Management Services and potentially other participants from other interested communities. Team Member requested that if they were able to find a participant to join the aquatics crew, to let her know by June 15, 2020 to allow time for planning. Team Member advised that Trans Mountain had developed COVID-19 protocols to help ensure the safety of crew members during the field program Boston Bar First Nation Groundwater Letter/Email March 9, 2020 N/A Team Member emailed a letter and a map to Boston Bar First Nation representative. The letter dated March 9, 2020 N/A was regarding the Potential Western Alternative Route Around Coldwater Reserve No. 1. The letter detailed background information, the Western Route Feasibility Work, and the Timeline for Assessment. The letter concluded that Trans Mountain appreciated receiving any input by March 20, 2020 and would follow up in the interim to further discuss the matter.

Team Member emailed Boston Bar First Nation representative and followed up on the correspondence sent regarding the Potential Western Alternative Route. Team Member mentioned that Trans Mountain was looking for initial feedback on the alternative routing in the Coldwater area. Team Member inquired whether the Chief had any initial feedback or would like to set up a meeting. Team Member stated the primary goal of the Western Alternative Feasibility Study was to determine whether the alternative route was technically feasible from a construction perspective and to identify any major issues with the route option. Boston Bar First Nation Groundwater Letter/Email June 2, 2020 N/A Team Member emailed the Boston Bar First Nation representative and informed that Trans Mountain’s contractor would N/A like to invite a member to participate in field studies for the Trans Mountain Coldwater West Alternate route in early July 2020. Team Member advised the field work, consisting of fish and fish habitat assessments along the proposed alternate pipeline route would be three days. Groundwater Contractor mentioned information packages were prepared for each potentially affected member, from the reports prepared by them and Trans Mountain. Groundwater Contractor noted that they were of the understanding that membership engagement, and subsequent approval of the Section 28 permit by the Band Council, would complete the planning stage of the project. Groundwater Contractor stated that they had received authorization from the Band to assist Water Drilling Contractor with design and fabrication of drilling discharge collection tanks and diffusers, and assist with pipeline designs and placement, which were to be implemented by Excavation, Trucking and Site Preparation contractor.

The letter indicated Trans Mountain had suggested regular meeting dates to focus on those studies, which would provide some predictability for the Coldwater Indian Band Council members. The letter added that, to ensure Coldwater Indian Band did not incur a financial burden for substantive engagement on those matters, Trans Mountain continued to be prepared to address reasonable capacity needs. The letter concluded with Trans Mountain’s President and CEO stating his sincere willingness to continue meaningful engagement with Coldwater Indian Band in parallel and as part of the study plans, and that he looked forward to seeing the Chief soon and working towards a solution that met Trans Mountain’s and Coldwater Indian Band’s respective needs.

Coldwater Indian Band Groundwater Email January 2, 2020 N/A Team Member emailed representatives of Coldwater Indian Band and provided an updated site plan, which indicated N/A the road that could be used for the drilling program. Team Member noted that some roads that provide alternative access to certain boreholes had been added and highlighted. Team Member addressed Coldwater Legal Counsel’s query regarding the BC Ministry of Transportation and Infrastructure (MoTI) Permits. Team Member informed that Coldwater Indian Band was notified via email on November 7, 2019 of the Permit Applications and Trans Mountain's intent to use the Chief's Letter of Support. Team Member attached the email for reference.

Coldwater Indian Band Groundwater Conference Call January 10, 2020 N/A Team Members held a conference call with representatives of the Department of Justice, Indigenous Services Canada, N/A and Coldwater Indian Band, and discussed Section 28 Permitting for the hydrogeological study.

Coldwater Indian Band Groundwater Email January 10, 2020 Legal Counsel, Coldwater Indian Band emailed Team Members and representatives of the Department of Justice N/A N/A (DOJ), Indigenous Services Canada (ISC), BC Ministry of Forests, Lands, Natural Resource Operations and Rural Development (FLNRORD), Groundwater Contractor for Coldwater Indian Band, and Coldwater Indian Band Councillors, and provided a map of Certificate of Possession (CP) land holdings on Coldwater Indian Reserve No 1 and a title search for CP holders. Legal Counsel, Coldwater Indian Band requested Trans Mountain's confirmation, to maintain the confidentiality of those documents and ensure they are not posted or filed publicly, including with the Commission of the Canada Energy Regulator. Legal Counsel, Coldwater Indian Band confirmed that the Band had provided ISC with a draft of Coldwater Indian Band’s Timber Permit Application, and that Legal Counsel, Coldwater Indian Band had contacted the DOJ about the possibility of drafting the Permit while any technical requirements were being finalized. Legal Counsel, Coldwater Indian Band stated the Band would be providing additional comments to FLNRORD, further to Trans Mountain Consultant’s December 19, 2019 memo, by January 17, 2020. Legal Counsel, Coldwater Indian Band listed what was expected to be discussed at the January 24, 2020 conference call, in order to finalize the Permit or continue to move the drilling program forward.

Coldwater Indian Band Groundwater Email January 17, 2020 Department of Justice emailed Legal Counsel for Coldwater Indian Band, Groundwater Contractor for Coldwater Indian N/A N/A Band, Indigenous Services Canada, and Team Member, and notified that she had been including an incorrect individual on emails pertaining to the Section 28 Permit and Timber Permit, when they should only have been sent to a specific contact within Indigenous Services Canada and apologized for any inconvenience it may have caused.

Coldwater Indian Band Groundwater Email January 20, 2020 Groundwater Contractor for Coldwater Indian Band emailed BC Ministry of Forests, Lands, Natural Resource N/A N/A Operations and Rural Development (FLNRORD) and copied Team Members and provided the memo to supplement the December 19, 2019 submittal by Trans Mountain and its contractor regarding the hydrogeological field program. Groundwater Contractor stated Coldwater Indian Band had authorized Groundwater Contractor to submit the memo on their behalf to FLNRORD.

Chief mentioned that Coldwater Indian Band was still awaiting details from Trans Mountain on the drilling and geophysical work and to review the drill cuttings and boreholes that Trans Mountain had undertaken off-reserve, and until then Coldwater Indian Band would not be in a position to have an informed discussion about the Table of Contents with NRCan or the hydrogeologist. Chief requested to know why there would be separate meetings with Coldwater Indian Band and Trans Mountain. Chief inquired if it would be possible to have an observer from Coldwater Indian Band on the call, to listen and take notes. Chief also inquired about the status of the March 10, 2020 request for a meeting with the Minister to discuss the need for the agreed study of aquifer as part of Condition 39.

On April 2, 2020, Natural Resources Canada (NRCan) copied Team Members on an email to the Chief, Coldwater Indian Band and stated that NRCan was aware that Chief had asked Trans Mountain for the details regarding the off- reserve drilling and geophysical work. The NRCan representative indicated they were looking forward to seeing Trans Mountain’s response. The letter informed Coldwater Indian Band that Trans Mountain was not seeking a change to the scope of work for the on-reserve drilling program. The letter noted that Trans Mountain had offered to discuss possible changes to the scope with Coldwater Indian Band given the program was decoupled from CER Condition 39. The letter identified Trans Mountain's commitment to the on-reserve field program in its letter of March 13, 2020, and that it would provide a draft execution plan on or before April 9, 2020. The letter advised that Trans Mountain provided its comments on the latest draft of the Section 28 Permit on March 27, 2020 and trusted that the Permit could be finalized. • Section 28 Permit - Both parties were awaiting confirmation on the fully-signed Permit. • Baseline Monitoring and Trans Mountain Consultant’s Proposal - Coldwater Indian Band accepted Trans Mountain Consultant’s pumping tests as proposed in 2019 and suggested a meeting between the technical teams in May 2020. • Certificate of Possession Holder Consent - Trans Mountain confirmed that they would proceed to obtain necessary Ministry of Transportation and Infrastructure (MoTI) Permits for the alternate discharge route. • Reclamation Criteria - Trans Mountain confirmed that their concerns regarding the reclamation standard are to be dealt with in the Section 28 Permit. • Outstanding Groundwater Contractor Invoices, Cost Estimates Moving Forward and Coldwater’s Ongoing Costs - Trans Mountain proposed a meeting on April 29, 30 or May 1, 2020 regarding a proposed approach to address both the Groundwater Contractor invoice and Coldwater Indian Band generated costs.

Groundwater Contractor noted in the execution plan that Trans Mountain proposed to only have one drill pad fully constructed in advance of the drill rig. Groundwater Contractor stated that Groundwater Contractor continued to strongly suggest three pads be fully constructed before mobilizing the drill rig to the site as not only was this in the best interest of Trans Mountain's financial considerations, but it also provided flexibility to move to the next drill site that was appropriate for conditions at the time. Groundwater Contractor mentioned the discharge plan proposed at EB-1 into the upper reaches of the drainage leading to J. Antoine’s property was the most reliable discharge option and Groundwater Contractor had provided cost estimates to Coldwater Indian Band to finish discussion and receive J. 4.0 GROUNDWATER MODELLING OR MONITORING Trans Mountain is currently in the process of preparing a Groundwater Monitoring Plan as required under CER Condition 130. The Groundwater Monitoring Plan includes a focus on drinking water resources sourced from vulnerable aquifers.

Trans Mountain completed a hydrogeological assessment of the Coldwater Aquifer underlying the Coldwater Indian Reserve No.1 (Coldwater IR) and submitted that report as required under CER Condition 39. The Condition 39 report was submitted to the CER on May 15, 2020 [C06341]. A summary of consultations and field work activities completed at Coldwater IR was included in the CER Condition 39 filing.

Trans Mountain will continue to encourage feedback from Indigenous groups and local governments under CER Condition 94. Feedback obtained will be reviewed and will be considered to guide groundwater modelling or monitoring efforts to ensure the potential for impact on water sources is minimized as the Project moves forward. All modelling or monitoring completed to ensure the protection of municipal and community water sources will be summarized and included in future CER Condition 94 filings.

5.0 CONCLUSION Trans Mountain will continue to consult with communities, municipalities, regional districts, counties and engage with Indigenous groups regarding the protection of their water sources. In addition to ongoing engagement, Trans Mountain has filed the Groundwater Management Plan with the CER, as part of Condition 72 [C01961]. As required by CER Condition 94, information that related to municipal and community water sources that is collected as part of the Groundwater Monitoring Plan (NEB Condition 130) will be included in future updates to this report.

This Consultation Report represents the 2020 engagement as an addition to several previous annual reports which are filed with the CER. Future reports will be filed on or before January 31 of each year during construction and of the first five years after commencing operations.
