Forum: Security Council Issue: The Israeli-Palestinian conflict Student Officers: President: Mohamed El Habbak Chairs: Adam Beblawy, Ibrahim Shoukry Introduction: Beginning in the mid-20th century, the Israeli-Palestinian conflict is the still continuing dispute between Israel and Palestine and part of the larger Arab-Israeli conflict, and is known as the world’s “most intractable conflict.” Despite efforts to reach long-term peace, both parties have failed to reach a final agreement. The crux of the problem lies in a few major points including security, borders, water rights, control of Jerusalem, Israeli settlements, Palestinian freedom of movement, and Palestinian right of return. Furthermore, a hallmark of the conflict is the level of violence for practically the entirety of the conflict, which hasn’t been confined only to the military, but has been prevalent in civilian populations. The main solution proposed to end the conflict is the two-state solution, which is supported by the majority of Palestinians and Israelis. However, no consensus has been reached and negotiations are still underway to this day. The gravity of this conflict is significant as lives are on the line every day, multiple human rights violations take place frequently, Israel has an alleged nuclear arsenal, and the rise of some terroristic groups and ideologies are directly linked to it. U.S. Foreign Aid to the Palestinians Jim Zanotti Analyst in Middle Eastern Affairs August 12, 2010 Congressional Research Service 7-5700 www.crs.gov RS22967 CRS Report for Congress Prepared for Members and Committees of Congress U.S. Foreign Aid to the Palestinians Summary Since the signing of the Oslo Accord in 1993 and the establishment of limited Palestinian self- rule in the West Bank and Gaza Strip in 1994, the U.S. government has committed over $3.5 billion in bilateral assistance to the Palestinians. Since the death of Yasser Arafat in November 2004, U.S. assistance to the Palestinians has been averaging about $400 million a year. During the 1990s, U.S. foreign aid to the Palestinians averaged approximately $75 million per year. Despite more robust levels of assistance this decade, Israeli-Palestinian conflict and Hamas’s heightened role in Palestinian politics have made it more difficult to implement effective and lasting aid projects that serve U.S. interests. U.S. aid to the Palestinians has fluctuated considerably over the past five years, largely due to Hamas’s changing role within the Palestinian Authority (PA). After Hamas led the PA government for over a year, its forcible takeover of the Gaza Strip in June 2007 led to the creation of a non- Hamas government in the West Bank—resulting in different models of governance for the two Palestinian territories. Since then, the United States has dramatically boosted aid levels to bolster the PA in the West Bank and President Mahmoud Abbas vis-à-vis Hamas. The United States has appropriated or reprogrammed nearly $2 billion since 2007 in support of PA Prime Minister Salam Fayyad’s security, governance, development, and reform programs, including $650 million for direct budgetary assistance to the PA and nearly $400 million (toward training, non-lethal equipment, facilities, strategic planning, and administration) for strengthening and reforming PA security forces and criminal justice systems in the West Bank. -

I. Introduction to the Topic A. General Background As early as 1947, Palestinian Arabs and Jews have wanted to undertake peace negotiations under the auspice of the United Nations. However, 1991 was the start of the series of peace negotiations between Israel and Palestine.1 The series of peace negotiations have produced a collection of peace plans, international summits, secret negotiations, UN resolutions, think tanks, initiatives, interim truces and state-building programmes, etc that have all failed. The reasons for why each peace negotiation has faltered is because each peace plan has failed to address key issues at a local, regional and global level for all parties involved. The main players in these negotiations include the Palestinian government, political parties of Palestine, the Israeli State, and members of the Arab League and United Nations. The most recent peace plan between one of Palestine’s prominent political parties, Hamas, which governs Gaza, took place with Israel in Cairo, Egypt. Currently, Egypt is finalizing the details of a one year truce that could extend to four years.2 Although this can be considered progress, it is only short term. A truce up to four years is not sustainable and does not resolve the larger issues at hand which include: Palestinian statehood, border placement, rights of Palestinian refugees and diaspora, Israeli settlements and the role of Arab League and United Nations. -

THE ARAB-ISRAELI CONFLICT FROM THE PERSPECTIVE OF INTERNATIONAL LAW Yoram Dinstein* The Washington agreement of September 1993 between Israel and the Palestinians,1 has raised hopes worldwide that the Arab-Israeli conflict which has been raging for many decades (and in fact precedes the birth of the State of Israel) is drawing to a dose. In reality, while the Washington agreement undoubtedly represents a major breakthrough, it is premature to regard the conflict as settled. Many more agreements, not only with the Palestinians, will be required in order to augur a comprehensive peace in the Middle East. In the meantime, numerous issues remain unresolved and there is still much opposition in many circles to the idea of Arab-Israeli reconciliation. The need to study the international legal aspects of the conflict is, therefore, as topical today as it was in earlier days. The following observations on the Arab-Israeli conflict will be based on international law. No attempt will be made to examine “historical rights”. Moreover, no reference will be made here to justice or morality. History, justice and morality are constantly invoked by both parties to every conflict and, as a rule, they are neither helpful nor unequivocal. Being subjective perspectives, they are more conducive to the definition of the problem than to its solution. Unfortunately, the arguments heard on both sides of the Arab-Israeli conflict are frequently grounded on a confusing (not to say confused) combination of law, justice, morality and history. If the conflict is to be probed in a rational and hopefully productive way, it is imperative to identify the level on which the analysis is to be conducted. -

THE EDITORS Middle East Israel A ALL aspects of Israel's life in 1967 were dominated by the explosion of hostilities on June 5. Two decades of Arab-Israel tension culminated in a massive combined Arab military threat, which was answered by a swift mobilization of Israel's citizen army and, after a period of waiting for international action, by a powerful offensive against the Egyptian, Jor- danian and Syrian forces, leading to the greatest victory in Jewish military annals. During the weeks of danger preceding the six-day war, Jewry throughout the world rallied to Israel's aid: immediate financial support was forthcoming on an unprecedented scale, and thousands of young volunteers offered per- sonal participation in Israel's defense, though they arrived too late to affect the issue (see reviews of individual countries). A new upsurge of national confidence swept away the morale crisis that had accompanied the economic slowdown in 1966. The worldwide Jewish reaction to Israel's danger, and the problems associated with the extension of its military rule over a million more Arabs, led to a reappraisal of atti- tudes towards diaspora Jewry. -

Israel and Turkey: From Covert to Overt Relations by Jacob Abadi INTRODUCTION Diplomatic relations between Israel and Turkey have existed since the Jewish state came into being in 1948, however, they have remained covert until recently. Contacts between the two countries have continued despite Turkey's condemnation of Israel in the UN and other official bodies. Frequent statements made by Turkish officials regarding the Arab-Israeli conflict and the Palestinian dilemma give the impression that Turco-Israeli relations have been far more hostile than is actually the case. Such an image is quite misleading, for throughout the years political, commercial, cultural and even military contacts have been maintained between the two countries. The purpose of this article is to show the extent of cooperation between the two countries and to demonstrate how domestic as well as external constraints have affected the diplomatic ties between them. It will be argued that during the first forty years of Israel's existence relations between the two countries remained cordial. Both sides kept a low profile and did not reveal the nature of these ties. It was only toward the end of the 1980s, when the international political climate underwent a major upheaval, that the ties between the two countries became official and overt. Whereas relations with Israel constituted a major problem in Turkish diplomacy, Israeli foreign policy was relatively free from hesitations and constraints. For Israeli foreign policy makers it was always desirable to establish normal relations with Turkey, whose location on the periphery of the Middle East gave it great strategic importance.
