4 HISTORY OF WARREN COUNTY

Native people built in Warren County what is considered the oldest permanent structure east of the Mississippi River in North America, an eleven thou- sand year old ceremonial building, the archaeological remains of which are known today as the Thunderbird Site. The first documented European explorer to see Warren County and the Shenandoah Valley – John Lederer in 1670 – noted an almost eerie absence of Native people, who had been killed by warfare and disease. By the early 1700s when fur trapping and land prospecting began in the Shenandoah Valley the Cherokee, Iroquois and Shawnee were using the Val- ley as a collective hunting ground.

In 1729 a group of German immigrants led by Joist Hite purchased several thousand acres of land in the northern Shenandoah Valley. A community of Quaker families from Maryland led by Robert McKay came at the same time as Hite’s Germans. In 1734 Thomas Chester established a ferry service known as Chester’s Ferry at the juncture of the forks of the Shenandoah River, and in the 1740s an English Lord – Thomas, Lord Fairfax, the 6th Baron of Cameron – came to the area that is today Warren County to lay claim to his inheritance: a five million acre swath of the colony that extended from the Chesapeake Bay through the Shenandoah Valley and on to western Maryland. In 1754 a large extended family under the leadership of the son of a French Huguenot, Peter LeHew, settled at the foot of the Blue Ridge along the road leading from Chester’s Gap to Chester’s Ferry, and LeHewtown was established. During the French & Indian War LeHewtown was the Royal Frontier of the British Empire, hence the town’s name at the time of its charter in 1788: Front Royal.

By the coming of railroads and canals in the 1830s the overland migration routes changed, and when Warren County was incorporated in March of 1836 the community had settled into an agricultural

5 existence, with small farming villages surrounding Front Royal and Riverton.

When the war came in 1861, Warren County bore with the rest of Virginia much of the horrors of war. Great battles fought nearby meant a steady stream of wounded to be cared for and supplies to be collected. On May 23, 1862, the Battle of Front Royal took place in the streets and buildings of the county seat, and Warren County lost use of the bridges span- ning the forks of the Shenandoah. In 1864 the Union burned many mills in the Valley, Warren County in- cluded. The war’s end saw Warren in ruins, its economy shattered, and population drained. New bridges would not connect Front Royal to the rest of the county for another three decades.

The turn of the century saw new life breathed into Warren County, which had recovered during Reconstruction slowly with the development of the Bank of Warren and some light industry. By the 1890s the Front Royal-Riverton Improvement Company had incorporated, built new bridges, laid out new neigh- borhoods and encouraged new factories to locate in Front Royal and Riverton – Virginia’s “Twin Cities.” The county drew its labor pool from surrounding coun- ties that remained largely agricultural, and by the 1930s the American Viscose Corporation had con- structed an enormous rayon facility, which would employ over 80% of the county’s workforce by the 1940s. The Great Depression saw many public works projects in the county develop, the largest of which was Shenandoah National Park and its Skyline Drive. Tourism was now added to agriculture and industry as Warren County’s livelihood.

Today Warren County still stands at the nexus of sev- eral transportation routes, and has become part of the greater Washington, DC community and economy, both receiving visitors and new residents from North- ern Virginia as well as sending many residents in the opposite direction for work and school. Warren County continues to grow and change as a result, with its position as a transportation hub continuing to de- fine that growth as it has for centuries.

The County of Warren is governed by a five-member Board of Supervisors elected by district. The Board of Supervi- sors appoints a County Administrator who directs the County’s day-to-day operations. County Administrator Douglas P. Stanley has served in that post since 2000. The Board of Supervisors adopted a FY 2011-2012 budget to- taling $83,549,695. The largest component of the budget is public education at $45,892,555. The Board of Supervisors meetings are open to the public and are conducted the first Tuesday of the month at 9:00 a.m. and the third Tuesday of the month at 7:00 p.m. in the Boardroom of the Warren County Government Cen- ter located at 220 North Commerce Avenue, Front Royal, Virginia. TOWN OF FRONT ROYAL GOVERNANCE The Town of Front Royal is governed by an at-large six member Town Council and a Mayor. The Town Council appoints a Town Manager who serves as the executive and administrative head of the Town government. The Town Council adopted a FY 2011-12 budget totaling $36,959,129.

Household Hazardous Waste Disposal (HHW) Warren County sponsors an annual household hazardous waste collection event at the Front Royal Fire Department located on Commerce Avenue from 8:00 a.m. to 2:00 p.m. Acceptable Items: Used motor oil and antifreeze pesticides, insecticides, pool chemicals, drain cleaners, paints, solvents, strippers, aerosols, battery acid, household cleaners, dry cell batteries, car batteries, paint thinners, adhesives, and fluorescent light bulbs. Unacceptable Items: Tires; explosive materials, biological or radioactive waste, and asbestos-laden materials. All businesses must pay per ton fee during scale operation hours. Grass Clippings & Leaves cannot be accepted at any convenience site or at the Transfer Station. These organic materials are not permitted to be land filled; i.e. taking up limited space for solid waste. We recommend placing grass clippings and leaves in wooded areas to act as natural humus and fertilizer. Stumps, Roots, Tree Trunks & Limbs over 12 inches in diameter may be brought to the Warren County in Bentonville. A fee of $30.00 per ton is charged. All vehicles must go over the scale. 16 Disposition of Dead Animals · Any dead animal observed or found in the road, ditch, or shoulder of a Virginia Department of Transportation primary or secondary road, residents may call the Warren County Sheriff’s Office at 540-635-4128 for removal. · Dead animals found on one of our many sub-division maintained roads should contact their homeowner’s association. · Dead animals found on private property are the responsibility of the land owner. Special arrangements may be made with Warren County Staff to remove the animal at a fee. · Small dead animals and deer carcasses may be wrapped in a heavy plastic bag, sealed and brought to the Warren County Transfer Station for disposal.

1. Where can I find the Warren County Zoning Ordinance online? Log on to the County website at www.warrencountyva.net/ and from the main tool bar select Resources and scroll down to “Warren County Code”, this will hyperlink you to the “eCode360” website for Warren County and the Zoning Ordinance can be found in Chapter 180.

2. Where can I find out what my property is zoned? The two sources are the County’s GIS website: http://www.warrengis.org/ or by contacting our office at (540)-636-3354.

3. What are the zoning requirements to construct a single family dwelling on my vacant property? Construction of a single family dwelling must meet the setback requirements for the underlying zoning district and the well and septic requirements as defined by the Virginia Department of Health rules and regulations and Warren County Code section 179.

4. What are the zoning requirements and fee for getting a business license for a home business? A certificate of zoning must be issued by the Planning Department prior to the Commissioner of the Revenue issuing a business license. This is in order to determine if the use qualifies as a home occupation as found in County code section 180-17.

The current fee for this is $15.00 and payment must be made in check or cash.

5. How do I report a violation for trash and debris or inoperable vehicles in my neighborhood? Contact the Planning Department or Zoning Administrator and we will fill out a Zoning Violation Complaint form

20 with pertinent information. If it is determined to be a violation, the Zoning Administrator will send a “Letter of Inspection” to the violator usually giving 30 days to bring the property into compliance.

6. How do I determine if my property is located in the floodplain? Look on the County’s GIS website and select the “Flood Zones” layer in the layer control panel or request a floodplain determination from the County Floodplain Manager.

7. Can I construct a single family dwelling if my property is in the floodplain? Warren County Code Section 180-16 defines the zoning criteria and requirements for approval to construct in the Special Flood Hazard Area (SFHA). A meeting with the County Floodplain Manager is advised prior to starting any construction plans or the building permit process.

8. How do I get an address for new construction of single family dwelling or commercial-industrial structures? Once an application for a building permit has been received by the Building Inspections Department they will submit a new address request to the GIS Coordinator after the foundation is constructed and inspected.

The Warren County Building Inspections Department is the enforcement authority for the State of Virginia’s Uni- form Statewide Building Code and the Virginia Erosion and Sediment Control Handbook, having jurisdiction for all of Warren County including the Town of Front Royal. The building code was adopted by the Commonwealth of Virginia to ensure the health and safety of citizens of the Commonwealth. Certification by the County for compliance with the building code is helpful for insur- ance purposes and property re-sale. A building permit is required for: New buildings, additions, decks, porches, detached resi- dential accessory buildings larger than 150 square foot, attached or detached garages, above ground or in-ground pools, finishing a basement, interior alterations (remov- ing walls, adding walls, enlarging windows). 2. What are the setback requirements? Please contact the proper zoning department for the set- back requirements. The town of Front Royal Zoning Department can be contacted at 540-635-3732. The Warren County Zoning Department can be contacted at 540-636-3354. 3. What information do I need to bring with me in order to obtain a building permit? Bring a copy of your latest tax receipt for the property (the receipt will have your correct tax map number), a copy of the contractor’s Virginia State Contractor’s li- cense, a copy of the survey of the property showing the new construction and the number of feet to the prop- erty lines, a copy of the health department construc- tion permit, and two (2) sets of structural plans. If the property is located in the Town of Front Royal, you will first need to go to the Town of Front Royal Zoning Department for approval. 4. When do I need Health Department approval? Except for projects within the Town of Front Royal, a valid Warren County Health Department Construction Permit will be required for construction of a Single-Fam- ily Dwelling. All other construction projects will re- quire a copy of the original construction permit from the Warren County Health Department. In some cases a walk-over performed by the Warren County Health Department may be required. If the proposed construction is a Single-Family Dwell- ing located in the Town of Front Royal, a copy of the receipt for payment of tap fees will be required. 5. What fees are involved? Building permit fees are calculated on the square footage of the new construction. Permit fees are payable at the

22 time you make application. Our office accepts cash, check or credit card. 6. Where can I purchase a code book? Code books are available at www.iccsafe.org. 7. How long will it be before I get my permit? Residential building permits are issued in approximately two weeks. The process may be delayed for additional information. Our commercial permit process usually takes a minimum of two weeks. This may be longer depending on the plans that need to be reviewed and if additional information is needed. 8. What inspections are required? When you receive your permit, you will be provided with a list of required inspections. 9. How do I schedule an inspection? You may schedule an inspection by calling our office at 540-636-9973 the prior day, before 4:00 p.m. to schedule your inspection. You must provide the permit number, permit name, site address and the type of inspection(s) that you are requesting. Contact the Commissioner of the Revenue’s office to report the sale or purchase of a vehicle (registration card requested for new purchase).

2. What do I need to purchase a Warren County decal or Town of Front Royal decal? To obtain a Warren County or Town of Front Royal decal, please first register the vehicle with the Commissioner of the Revenue by bringing in the registration card and then a decal can be purchased from the Treasurer’s offices. Town of Front residents will need to purchase their decal from the Town offices.

3. Can I get a discount for high mileage vehicles? You may file for high mileage on a vehicle within 30 days of purchase or if a new resident 30 days from the move in date to Warren County. All other established residents will need to file by the yearly deadline of February 15.

4. If I have a vehicle that is off the road do I still have to pay taxes? Personal Property taxes are based upon ownership per the Code of Virginia. If you have a vehicle that you intend to never title again through DMV then you may contact the DMV and get a demolished certificate. Upon proof of the certificate at the Commissioner of

25 the Revenue’s Office, they will stop taxing the vehicle as of the date of demolished certificate.

5. What is PPTRA and what is a qualified vehicle? “Personal Property Tax Relief Act” was capped by the State of Virginia effective for the tax year 2006. The County of Warren must therefore divide the capped amount among the qualified vehicles. For tax year 2010 taxpayers who have qualified vehicles will be paying 53% of their tax bills on these vehicles. A qualified vehicle is non-business use vehicles, trucks less than 7501 lbs. and motorcycles. Motor homes, business use and farm vehicles do not quality.

A sanitary district is a special taxing district allowed by the Code of Virginia and has the following powers and duties: • To construct, maintain and operate water supply, sewerage, garbage removal and disposal, heat, light, fire- fighting equipment, power, gas, streets, parking lots, curbs, gutters, sidewalks, community buildings, commu- nity centers and other recreational facilities for the use and benefit of the public in such sanitary district. • To levy and collect an annual tax upon all property. • The power to abate nuisances within the district. How is a Sanitary District created? The Circuit Court, upon the petition of 50 qualified voters. We offer fire, emergency medical, rescue, hazardous materials, and water rescue to our citizens. We consist of 10 stations; five staffed with career personnel (Companies 1 & 10 are staffed with a 24 hour ALS & BLS provider, Co.s 2, 3, & 4 are staffed 12 hours a day with Co.s 2 & 4 staffing daytime and Co. 3 staffing nights) and five volunteer stations. We offer many services to our community in addition to emergency response services. Through our Fire Prevention Division, we provide a "Smoke Detector Program" for the elderly and disadvantaged, Home Safety Inspection Program, Courtesy Business Inspection program, standby for community functions and events, fire prevention demonstrations in the schools and at functions, etc. We conduct these public relation activities by utilizing a cooperative staff of career and volunteers.

30 Our Training Division offers classes that make our Department self sufficient for both fire and EMS training and certifications including Firefighter I and II, EMT, Pump Operations, Truck Operations, EVOC, EMT B/I/P recertifications, Vehicle Extrication, Rural Water Supply among others. In January 2006, Warren County adopted a “compassionate billing” policy called the Cost Recovery Program. This policy allows the Department to obtain financial reimbursement for the cost of necessary emergency medical transports. Reimbursement comes directly from Medicaid, Medicare and other private insurance companies who already include this service in the coverage they offer to the policy holders. For those who do not have insurance, Warren County Fire and Rescue will work with the residents to ensure no one suffers financial hardship as a result of ambulance transport. A hardship waiver form will be sent to patients transported and therefore their bill will be written off. No one will ever be denied county ambulance service based on their ability to pay or lack of insurance. When residents need emergency help, they should call 911 without hesitation. In December 2011, the Board of Supervisors approved the position of Fire Marshal in the Department of Fire & Rescue. They also approved the enforcement provisions of the Statewide Fire Prevention Code. The Fire Marshal will also manage the Fire Prevention Division of the Department as well as investigate fire incidents.

38 The Circuit Court Clerk’s Office preserves and maintains records from 1836 and includes: land records, marriage licenses, wills and estate records, limited birth records from1853 - 1916, civil and criminal records, judgments, financing statements, business names, induction and discharges from the armed forces, confidential juvenile and adoption files.

The Clerk’s Office provides application forms for concealed handgun permits, business names, notary public, releases for judgments, certificates of satisfaction for deeds of trust, garnishments, restoration of driving privileges, and adult and minor name changes. We manage court dockets for Circuit Court, jurors, assessment and collection of criminal fines, costs and restitution, give oaths to constitutional officers, members of local boards, election officials, and law enforcement officers.

1. How do I file for a divorce? Divorces can be very complex cases and if you choose to represent yourself, you will be expected to follow the same procedures as an attorney. Court personnel are prohibited by state law to give legal advice. Forms are not available.

2. How do I petition the Court for a restricted license or for restoration of my operator’s license? Forms are available in our office and we do offer assis- tance in completing the forms, if needed. A current driver history report from DMV is required at the time of filing the petition.

3. How do I look up my property or get a copy of the plat to my land? Our staff will assist the public in quick researches and copying of the records. Copies are $.50 per page.

4. Where does the family go to probate a will or qualify as personal representative on an estate? We prefer the family to schedule an appointment be cause the probate procedure or qualification as Admin- istrator or Executor may be lengthy. Pamphlets are available in our office and have been distributed to our local funeral homes providing information about estates. Contact our office for additional information not covered in the pamphlet.

40 5. What are the requirements to obtain a Marriage License? The minimum age to obtain a marriage license with con- sent of the parent or guardian is sixteen for both the bride and groom. See Virginia Code § 20-48 for provi- sions to obtain a marriage license if the female is under the age of sixteen. The fee is $30.00. There are no blood test requirements and there is no waiting period. The license is valid for sixty days. A list of civil marriage officiates is available in our office. All arrange- ments for the performance of the marriage ceremony are the responsibility of the applicants. Certified copies of marriage licenses are $2.50.

The General District Court handles most traffic violations. The General District Court also hears minor criminal cases known as misdemeanors and conducts preliminary hearings for more serious criminal cases called felonies.

General District Courts have exclusive authority to hear civil cases with claims of $4,500 or less and share authority with the Circuit Courts to hear cases with claims between

General District Court Judges are elected by the General Assembly for 6-year terms. General District Court Clerks are appointed by the Judge. 1. Which form do I need? 2. What information do I need to file a civil warrant? Name and address of person you are suing, amount of claim, reason for suit. Fee is $25.00 + $12.00 sheriff’s fee for each defendant.

3. How do I put a lien on someone’s property? After receiving judgment wait 10 days (appeal period) request abstract and take abstract to Circuit Court Clerk’s office.

4. How do I garnishment someone’s wages? After receiving judgment and appeal period over, you may file a suggestion for garnishment. You must know the name and address of the defendant’s employer or his bank ac- count information. Garnishments can last up to 180 days. The employer takes 25% of net pay.

TRAFFIC AND CRIMINAL 1. Why do I have to pay court costs if I don’t go to Court? A processing fee is added to each case whether you appear in Court or not.

2. How do I get a court appointed attorney? You must appear on your Court date, and if you are charged with a jailable offense the Judge will ask if you intend to hire your own attorney or want a court appointed attor- ney. If you need a court appointed attorney you will fill out a financial affidavit and the Judge will determine if you are eligible. If eligible he will appoint an attorney to represent you with a trial date.

42 3. How do I know how much I owe? For traffic infractions the officer should give you a prepayment sheet with the citation.

4. What if I can’t pay the fine? You have 15 days from your court date to pay the fine and costs. If the fine is not paid and payment arrangements are not made your privilege to drive will be suspended. The Court accepts Visa, Mastercard, and personal checks.

5. What if I can’t be in Court on the date the officer gave me? Continuance requests must be in writing. One continu- ance may be granted. If you do not appear and do not request a continuance a show cause may be issued resulting in penalties.

1. What cases are heard in the Juvenile and Domestic Relations Court?

In Virginia, a juvenile is any person under 18 years of age. The juvenile and domestic relations district court hears all matter involving juveniles such as criminal or traffic matters. Juvenile delinquency cases are cases involving a minor under the age of 18 who has been accused of committing an offense that would be considered criminal if committed by an adult. Other juvenile offenses may be referred to as status offenses. Status offenses are those acts that are unlawful only because they are committed by a minor.

In addition, this court handles other matters involving the family such as custody, support and visitation. The

43 court also hears family abuse cases, cases where adults have been accused of child abuse or neglect, and criminal cases where the defendant and alleged victim are family or house- hold members.

1. What do I need to do to get custody, support or visitation? Please call our office at 540-636-4189. You will be asked some questions to help us determine jurisdiction/venue. If our court is the appropriate court, you will be given an appointment and asked to pick up a packet of paperwork to complete before the intake appointment. The com- pleted packet will facilitate the intake process. 2. Once I file a petition will I then have custody? The answer is no. After the petition is filed a court date will be set by the Clerk of the Juvenile and Domes-

After hearing all of the evidence the Judge will determine who will be awarded custody. 3. I am having problems with my son or daughter. Where can I get help? After hearing all of the details of your complaint, the intake officer may refer you to the appropriate community resource for help, meet with you and your child and hold an informal diversion or advise you of your right to file charges against your child if appropriate.

The state maintained roadway system with in the County includes approximately 14 miles of Interstate 66, 36 miles of primary highways which includes routes 79, 55, 340, and 522, and 205 miles of local secondary roads. Of the local secondary roads,

46 approximately 54 miles are un-surfaced gravel roads. All state maintained roadways can be identified by the route signs normally installed at an intersection. Warren County has a large number of private subdivision streets which are not maintained by VDOT. Also, the Town of Front Royal maintains their own roadway system.

VDOT strives to have all state maintained roadways at least plowed within 48 hours after a snow storm has ended. Inter- state 66 and primary routes are cleared first. Then higher volume local roadways are addressed next, with low volume local roadways and subdivision streets being plowed last.
