¡ ADB-financed Yellow River Flood Management Sector Project Resettlement Monitoring and Evaluation (Report No. 3)

GENERAL 1.1 Project Brief The ADB-financed Yellow River Flood Management Sector Project includes 4 components: flood management, flood control works, village protection, and project management, with a total cost estimate of 2.935 billion RMB, including 1.694 billion RMB local funds and 1.241 billion RMB equivalent ADB loan proceeds, i.e. 58% and 42% respectively. In addition, 1.54 million RMB counterpart funds are financed by the local government[1]. The State approved 22 subprojects in 3 groups in 2003 and 2004, including 6 for floodplain safety development, 9 for dike consolidation, and 7 for dangerous dike section habilitation, together with 3 project management and 1 non-structural flood control schemes, with a total cost estimate of 1.93032 billion RMB. Resettlement monitoring and evaluation is involved in the 22 subprojects, with a total amount of 1.82881 billion RMB provided by the State, including 359.21 million RMB for land acquisition. Refer to Table 1 for details. 1.2 Implementation of Land Acquisition and Resettlement Each subproject has its own Employer, Implementing Agency, Designer, and Engineer, which meets the requirements of project management and basically satisfies the demands of land acquisition and resettlement. Land acquisition and resettlement have been started for 11 subprojects, including 6 dike consolidation subprojects, i.e. Yuanyang (left-bank 100+800~124+700, 142+400~148+350, referred to as “Yuanyang (left-bank)” hereinafter), Lankao (right-bank 152+600~156+050, referred to as “Lankao (152)” hereinafter), Lankao (135+738~138+400, referred to as “Lankao (135)” hereinafter), Kaifeng, Dongming, and Dongpinghu, and 5 floodplain safety development ones, i.e. Miaozhai, Wuqiu, Fanxian, Dongming, and Pingyin. Preparatory work necessary for the commencement of construction is performed except for Lankao Floodplain Safety Development which is waived already. It is noted that these 10 subprojects not started at the time of our field work were already commenced by the time of this report, so this report is prepared to reflect the progress achieved as of the time of field work. As planned, the said 6 dike consolidation subprojects involve a total number of 120 villages in 26 townships of 10 counties, requiring 11,080.74 mu for permanent use and 32,497.42 mu for temporary use and necessitating the resettlement of 312 households. The approved cost estimate is 1.2459 billion RMB, including 242.2 million RMB for land acquisition relating to resettlement. Work quantities completed by the time of this report include 9,072.34 mu for permanent use, 7,643.71 mu for temporary use, and 357 households from 119 villages in 24 townships of 8 counties, accounting for 81.87%, 23.52%, and 114.42% of the planned figures. Refer to Table 2 for detailed information. It was planned to have 15 shelters under the abovementioned 5 floodplain safety development subprojects, to receive 37,065 people of 9,028 households, but the number was adjusted to 13

International Engineering Company, November 7, 2001 ¢ ADB-financed Yellow River Flood Management Sector Project Resettlement Monitoring and Evaluation (Report No. 3) in the course of implementation. The work quantities completed by the time of this report include 4,402.74 mu for permanent use and 2,241.21 mu for temporary use, accounting for 95.27% and 26.55% of 4,621.5 mu and 8,411.64 mu included in the Implementation Scheme. It is planned to resettle 88 households, and the number actually completed is 5. Refer to Table 3 for details. 1.3 Monitoring and Evaluation Henan Huanghe Resettlement Economic Development Company, the resettlement monitoring and evaluation agency, started work in 2004 according to the contract and the land acquisition and resettlement schedule, and has prepared 2 reports in both Chinese and English. The work team prepared the TOR and questionnaires for the third monitoring and evaluation in April 2005, carried out field work in May, and then prepared this report (No. 3) in both Chinese and English on the basis of data interpretation, calculation and analysis. Refer to Table 1 for detailed information. Basis: national and local land management laws/regulations, national and local resettlement policies, plans and subproject proposals approved by the State, ADB resettlement policies, and contract signed with YRCC. Scope of work: implementation of land acquisition and resettlement, enforcement of letter of promise, payment of compensation costs, reconstruction of schools and other special facilities, income of resettlement families, and protection of rights and interests. Methodology: formulation of questionnaires and preparation of TOR; establishment of task teams and training of personnel; discussion with the city/county Yellow River Engineering Bureau and other responsible parties; collection of relevant data, performance of field visit; completion of questionnaires on the basis of interviews with villages, groups and households, with personal data kept secret; and preparation of the report in both Chinese and English based on interpretation, calculation and analysis of investigation results. 1.4 Settlement of Earlier Problems Problems identified in the previous monitoring and evaluation are mainly in the following aspects: compensation, production/livelihood reestablishment, shelter construction, cost control, resettlement information handbook, and school construction. Refer to Table 4. § ADB-financed Yellow River Flood Management Sector Project Resettlement Monitoring and Evaluation (Report No. 3)

RESETTLEMENT FOR DIKE CONSOLIDATION 1.5 General Altogether 9 dike consolidation subprojects are approved by the State in 3 groups, including Yuanyang (left-bank), Lankao (135), Lankao (152), Kaifeng, Puyang, Juancheng, Mudan, Dongming, and Dongpinghu. The former 5 are located in Henan and the latter 4 in . Construction of these has been started except for Puyang, Juancheng and Mudan by the time of this report. 1.6 Resettlement and Compensation According to the planning, the 6 subprojects in scope of monitoring and evaluation do not involve resettlement except for Lankao (135) and Dongming. Lankao (135) Dike Consolidation This subproject involves a total resettlement population of 278 people, 67 households from 2 villages. With verification done during implementation, the number is finalized as 278 people, 66 households. Identification of homestead: The mode of centralized back-move resettlement is proposed, but decentralized resettlement is allowed where the environmental capacity is limited. Land adjustment and homestead identification at the new sites are not carried out by villages. New homesteads are required for 6 households, including 1 to make use of the old homestead, 30 to exchange, and 29 to buy, but not required for 3 to need compensation for properties only, 1 to live with parents, and 2 to buy new houses. Construction of house: At the time of this report, 34 households have completed new houses, 12 are building, and 14 have not started. Our investigation of 5 sample households having completed their new houses indicates a homestead area of 1.04 mu and a main housing area 229.7 m2 per household, versus 0.7 m and 136.2 m2 before resettlement, including 64 m2 brick and concrete structures that they did not have before resettlement. Relocation: Altogether 25 households have moved into new houses, 2 bought, 27 borrowed, and 12 in other old houses. Details are shown in Table 5 and Appendix 3. A total amount of 2.2101 million RMB has been paid as housing compensation, taking up 97.44% of the amount 2.2686 million RMB included in the Implementation Scheme. This basically meets the progress of housing. Evaluation: Relocation of houses basically meets the schedule of construction. Compensation for house is paid as agreed. Improvement is achieved in housing conditions, floor areas, and structures as compared with the situation without resettlement. Major problems: Where the proposed mode of centralized resettlement within the villages is changed to decentralized resettlement in the course of implementation, temporary power lines

provided by villagers themselves represent potential risks. In addition, there are problems in  ADB-financed Yellow River Flood Management Sector Project Resettlement Monitoring and Evaluation (Report No. 3) drinking water supply and sewage discharge. Dongming Dike Consolidation The planned resettlement population is 1,062 people, 242 households in 20 villages. During implementation, it is changed to 1,278 people, 291 households in 21 villages, with centralized resettlement is 9 villages and decentralized resettlement elsewhere. Land acquisition and leveling are completed in the villages where the mode of centralized resettlement is adopted, with the exception of Guozhuang in Changxing Township. Power supply and street greening in new sites are not implemented, but wells are dug by individual households for drinking water supply. Relocation: A total number of 264 households have completed relocation, while the rest 27 have not for the time being, because their houses will not be occupied until roads are restored upon completion of the subproject. Identification of homestead: Each of these 264 has 0.3-0.6 mu homestead by use of their own contracted lands, internal land adjustment within the villages, or paid land allocation in adjacent villages, except for one house used for the custody of a fishpond and not needing any new homestead. Housing: Among the 263 households having got their homesteads, 164 have completed new houses, 78 are building, and 21 have not started (including 20 in Guozhuang Village, mainly because the homestead is identified in a 6 m deep puddle). The Employer, Implementing Agency and Contractor have agreed to equally share the costs for backfill soil works, so as to solve this problem. An amount of 100,000 RMB is paid to the township government by the Contractor, and 80% soil works are completed. As judged from the completed houses, the average platform, homestead, and floor area are changed from the previous 1.3 m, 0.52 mu, and 90 m2 to 1.4 m, 0.46 mu, and 87 m2 respectively. There was no brick-concrete structure before resettlement, but 6 m2/household now. Resettlement in Fanzhuang: The subproject was originally planned to involve 4 resettlement families in Fanzhuang. Since the subproject will result in such a case that the other residents will be surrounded by the dike on 3 sides and a brook (a drainage canal on the landside) on the rest side, as strongly requested by the villagers and coordinated by the local government, the design was changed during implementation to the extent that 73 households would be resettled as a whole. With 0.4 mu homestead identified for each, 34 have completed housing, and the others are doing it. Resettlement: The total number of 264 households having completed relocation includes 145 new houses, 81 borrowed, 9 rent, 10 shacks, and 19 other old houses.

The total amount of house compensation costs paid as of this report is 4.4998 million RMB, accounting for 77.79% of the amount 5.7842 million RMB included in the cost estimate. This basically meets the progress of housing. Evaluation: Relocation of houses essentially meets the schedule of construction. Housing compensation costs are paid, in full and in time, against the rates published by the counter government. The increased height of platforms and floor area of brick-concrete structures provide better resistance to flood events. Homestead and floor areas are reduced to some extent, but basically comply with the provincial land regulation and policies. The housing conditions are better than the situation without resettlement. Outstanding problems: (1) slow progress in filling the 6 m deep puddle where the homestead for 21 households in Guozhuang of Changxing Townshp is identified, (2) delay in power supply and road construction in some villages. 1.7 Land Acquisition, Compensation and Production Reestablishment Yuanyang (left-bank) Dike Consolidation This subproject involves 29 villages of 7 townships and a farm operated by the army, with a total area of 3,782.38 mu for permanent use, including 2,360.73 mu for dike consolidation and 1,311.65 mu for canal reconstruction by categories of works, or 2,760.55 mu farmland and 911.83 mu non-productive land by types of land. The area for temporary use is 11,622.24 mu, totally farmland for the use of dike consolidation. The areas completed by the time of this report include 2,413.86 mu farmland for permanent use and 200.43 mu for temporary use, i.e. 87.44% and 1.7% of the planned areas respectively, 34 villages and a farm operated by the army. This total area for permanent use includes 1,446.47 mu for dike consolidation and 967.39 mu for canal reconstruction, taking up 99.8% and 73.8% of the planned areas. Agreements on permanent land use are concluded with 33 villages and the farm, except for Lougudui Village of Guanchang Township. A total amount of 22.3769 million RMB is settled, including 22.01 million RMB disbursed to townships and partly paid to households. Also, 0.44 million RMB is disbursed as compensation for temporary land use, 0.95 million RMB for appurtenances, 1.42 million RMB for special facilities, and 0.17 million RMB for other purposes. The total amount of disbursements is 24.99 million RMB, taking up 35.54% of the planned amount of 70.3169 million and 93.22% of the settled amount of 26.8089 million RMB. Land adjustment and compensation for the purpose of production reestablishment involved in permanent land use are implemented as arranged by townships and villages. Recultivation of the farmland for temporary use is not implemented. Refer to Tables 2 and 6 for details.

Agreements are completed for 1,323.58 mu for permanent use, with an agreed amount of 17.1133 million RMB. By the time of this report, 1,323.58 mu has been completed and 16.6618 million RMB disbursed to townships. According to the vouchers presented by the Implementing Agency and the villages, a total amount of 12.1253 million RMB has been paid to households. Agreements are completed for 46.814 mu for temporary use, with an amount of 7.2335 million RMB. Refer to Table 2 and Appendix 2. There is a delay in compensating for permanent land use in Liuyuankou Township of Kaifeng Outskirts, mainly because of disputes between villages regarding the ownership and quantity of land for the use of canals. Land for temporary use is leveled by the contractors, except where there is a large excavation depth, and partly cultivated by the farmers. The agreements of Kaifeng County, which are completed by the Implementing Agency as entrusted, do not include the quantities by villages, so it is temporarily impossible to evaluate the progress of implementing. In some cases, compensation for temporary land use is arranged by villager representatives, without complete formalities and proper compensation. Compensation costs are paid to villages for resettling 912 people by improving irrigation facilities, optimizing cropping structures, developing aquacultural and processing activities, and vegetable sheds. Such costs are paid in different ways during implementation, without overall arrangements for production reestablishment: paid to land losers directly, without land adjustment; paid to land losers, but the paid area will be deducted from the receivable land area at the time of future land adjustment; and shared by all villagers, with land adjustment carried out in the group. According to our investigation of 62 households, the money is used for production by 51.6%, for living expenses by 32.2%, for repayment by 6.5%, and for saving by 9.7%. More details are discussed in Appendix. Lankao (135) Dike Consolidation The planning involves 3 villages in a single township, with 358.92 mu for permanent use and 796.5 for temporary use. Lankao Yellow River Engineering Bureau has signed agreements with the relevant villages about 404.33 mu for permanent use and 276.58 mu for temporary use, with an amount of 4.1915 million RMB and 0.4747 million RMB respectively. The total area completed by the time of this report includes 404.33 mu for permanent use and 183 mu

for temporary use, with a separate amount of 4.1915 million and 0.4014 million RMB. Refer  ADB-financed Yellow River Flood Management Sector Project Resettlement Monitoring and Evaluation (Report No. 3) to Table 2 and Appendix 2 for details. Problems and recommendations: The range, area, excavation depth, and compensation rates of temporary land use are changed considerably. The depth is increased, as compared with the planned value of 1.5 m, to about 7 m and even over 10 m in a few cases. Further, the 30cm topsoil is not moved to 50 m beyond prior to excavation, for the use of future recultivation. This has aroused many complaints. The approved compensation rates are increased due to the larger excavation depth, but the degree of difficulty in recultivation is increased accordingly. On the other hand, some agreements neither state whether recultivation costs are included in the rates, nor identify the responsibility for cultivation, which will probably give rise to disputes in the future. It is recommended that the agreements (already discussed in our Report No. 2) be improved as soon as possible, to determine whether recultivation costs are included in the rates and who are responsible for recultivation upon completion of the subproject. It is planned to resettle 270 people in 3 villages by improving irrigation facilities, optimizing cropping structures, developing aquacultural and processing activities and vegetable sheds. As found in the investigation, land compensation costs are paid to households directly in the process of “village-group-household” or “village-household” process, and land for temporary use is recultivated by the contractors, where the excavation depth is about 1 m, and partly cultivated by the farmers. Refer to Appendix 3. Lankao (152) Dike Consolidation This subproject involves 7 villages in 3 townships governed by Lankao County of Henan and Dongming County of Shandong Province, with 414 mu for permanent use (including 11.4 mu productive land) and 1,699.06 mu for temporary use, and an amount of 4.7104 million RMB and 2.4325 million RMB respectively. Agreements are completed for 358.57 mu permanent land use and 1,428.35 mu for temporary use, with a separate amount of 3.7171 million RMB and 2.4757 million RMB. Permanent land acquisition and compensation are totally completed as agreed, while the completed area for temporary use is 1,381.96 mu, with an amount 2.4655 million RMB. Refer to Table 2 and Appendix 2. Dongming Dike Consolidation There are altogether 32 villages and 1 farm in 7 townships are involved, with 6,370.06 mu (including 5,520.16 mu for warping works and 849.45 mu for break forests) for permanent use and 13,026.7 mu for temporary use, and a total number of 2,738 people in the need of production reestablishment. Agreements are completed for a total amount of 52.903 million RMB compensation costs for permanent land use, 46.2732 million RMB of which is settled. Land acquisition for the use of warping works is totally finished, with a total area of 5,432.66 mu and a total amount of 51.3654 million RMB. Surveying of permanent land use for break forests is finished, but quantities are counting by the Land Bureau. The completed area for temporary area is 1,096.89 mu, i.e. 8.42% of the planned figure. Land compensation costs are disbursed to villages via townships, and, except for Yulou and Pangqiao, paid to villagers in

full. Land adjustment is carried out in a few cases. Refer to Table 2 and Appendix 4.  ADB-financed Yellow River Flood Management Sector Project Resettlement Monitoring and Evaluation (Report No. 3)

Dongpinghu Box Dam Rehabilitation The original design is revised in light of the actual conditions during implementation. This scheme involves 31 villages in 5 townships governed by Liangshan, Wenshang and Dongping Counties, with 166.61 mu for permanent and 314.23 mu for temporary use, and total amount of 3.61 million RMB. The areas completed by the time of this report include 106.73 mu and 98.03 mu, or 64.1% and 31.2% of the planned figures. Refer to Table 2 and Appendix 5. The amounts are disbursed to the Employer in full. Dongpinghu Management Bureau has disbursed 2.23 million RMB to the county project office, which, in turn, has disbursed a total amount of 2.0542 million RMB (with a balance of 0.1758 million RMB) to the townships and organizations concerned, including 1.2025 million RMB for permanent, 0.2149 million RMB temporary land use, 0.1896 million RMB for sparse trees, 0.3482 million RMB for special facilities, and 80,000 RMB for overhead charges. These amounts have been paid to villages or households by townships. Refer to Appendix 5. 1.8 Schools This component involves 3 primary schools at Liuzhuang in Kaifeng and Yantan and Xuji in Dongming. Compensation costs have been disbursed by the time of this report. Liuzhuang Primary School is planned to have a plot area of 9.7 mu, with an approved cost estimate of 0.762 million RMB. The new site is identified between Liuzhuang and Bandi. The teaching building was put into service in December 2004. Land leveling and access road are not completed, which affects the extracurricular of pupils, but improvement is achieved in the campus and school buildings. Norma orders are basically resumed. Yantan Primary School used to have a campus of 15 mu, with 7.92 mu used for the subproject. With 2 mu added as a result, the campus is now 9.08 mu. The approved cost estimate of 0.3603 million RMB is adjusted to 0.2505 million RMB. By the time of this report, 15 old rooms are removed and 12 new ones completed. Relocation is nearly finished and normal orders are resumed, but without finishing land leveling, completing water/power supply, painting the inner wall of new classrooms, building an access road is not built, and providing a playground, which affects the normal teaching and extracurricular as a consequence. The approved cost estimate for reconstructing Xuji Primary School is 0.2088 million RMB. The new site is identified, but implementation is not yet started. With old school rooms removed in March 2004, 4 classes are arranged in the villager committee and 2 in borrowed rooms. Normal schooling has been affected adversely for long. 1.9 Special Facilities The special facilities affected by Yuanyang Dike Consolidation mainly include canals, roads, power facilities, and cables through the dike. The approved cost estimate for this purpose is 27.4833 million RMB, including 10.0997 million RMB disbursed by the time of this report, i.e. 36.75%. Except that the compensation costs for some poles and roads are disbursed to the villages, the amounts for structures are paid the villages in full, and the amounts for canals are disbursed by 35.5%, other special facilities are not implemented as they do not cause any impact on the progress of construction as time being. Lankao (135) Dike Consolidation: Power, telecommunications and transport facilities are

involved, with an approved cost estimate of 0.11 million RMB. Implementation is not started.  ADB-financed Yellow River Flood Management Sector Project Resettlement Monitoring and Evaluation (Report No. 3)

Lankao (152) Dike Consolidation: Power, telecommunications, transport, and irrigation facilities are involved, with an approved cost estimate of 0.45 million RMB. Compensation for bridges and power facilities is completed by 58.07%. Kaifeng Dike Consolidation: Power facilities and roads are involved, with an approved cost estimate of 0.38 million RMB. Agreements are completed for 49,900 RMB as compensation for poles. Dongming Dike Consolidation: Power, telecommunications, and irrigation facilities and oil pipes are involved. These are not yet implemented except that poles are completed upon the receipt of payment to villages. Dongpinghu Box Dam Rehabilitation: Power and telecommunications facilities and roads are involved. Completed portions include 35kv high-voltage lines, low-voltage lines, roads, 66.7% 10kv high-voltage lines, and 95.5% telecommunications facilities. RSETTLEMENT FOR FLOODPLAIN SAFETY DEVELOPMENT 1.10 General As previously planned, Miaozhai, Wuqiu Fanxian, Dongming, and Pingyin Floodplain Safety Development Subprojects include a total number of 15, which is adjusted to 13 during implementation, to receive 37,065 people of 9,028 households from 40 villages. The planned areas include 4,621.5 mu for permanent use and 8,441.64 mu for temporary purposes, with an approved total cost estimate of 2.0938 million RMB. The completed areas include 4,402.74 mu for permanent and 2,241.21 mu for temporary use, i.e. 94.09 and 24.71% respectively. Refer to Table 3. Placement of shelters for Miaozhai in Changyuan and Changxing (south and north shelters) in Dongming is approaching to the end, while that for Tanjing in Tanjing is going on. Box and dividing dikes for Luji in Fanxian are completed. Clearing of appurtenances in Sanyi of Wuqiu is almost finished. Land acquisition in Pingyin is started. Shelters are not completed, without involving resettlement at this moment. Therefore, the focus of our work is placed on the enforcement of the letter of promise and the impacts on farmland and housing. 1.11 Letter of Promise The financial sources of floodplain safety development subprojects include: State investments and ADB loans to cover the construction of shelters; local counterpart funds to cover the resettlement of people, compensation for appurtenances and green crops, construction of public facilities, and relocation of poor families; and own money to cover the costs for housing. Henan/Shandong Provincial Government and the local governments at all levels have made a promise, as required by the ADB, regarding “completion of houses for the poor families and public facilities in association with shelter subprojects within 2 years after the completion of new shelters”. This promise is being enforced step by step. As required in the letter of promise, Henan Provincial Government has promised to provide 5 million RMB as counterpart funds for Changyuan (Miaozhai and Wuqiu) and Fanxian subprojects in the minutes of the governor’s working conference (ref No. [2004]93). By the time of this report, an amount of 1.5 million RMB has been disbursed to the counties. Based on the local government’s promise to provide counterpart funds for the use of land acquisition, relocation of very poor families, and reconstruction of schools, hospitals and water/power supply facilities, compensation costs for green crops are paid for temporary land use for pipes

in Miaozhai Subproject, an amount of 0.3027 million RMB is disbursed for recultivating 86  ADB-financed Yellow River Flood Management Sector Project Resettlement Monitoring and Evaluation (Report No. 3) mu farmland and clearing appurtenances in Sanyi involved in Wuqiu Subproject, and the costs for appurtenances compensation and site clearing for Fanxian Subproject are partly disbursed and paid to households. According to the letter of promise, the total amount of 52 million RMB local counterpart funds is split in the minutes of Shandong Provincial Government (ref No. [2003]67), with 20 million RMB from the provincial government, including 12 million RMB for Dongming Subproject and 8 million RMB for Pingyin, and the rest 32 million RMB from City, Dongming County, City, Pingyin County, and relevant townships. By the time of this report, 9 million RMB provincial funds have been disbursed to Dongming Subproject and 6 million RMB to Pingyin Subproject, with a separate outstanding amount of 3 million RMB and 2 million RMB confirmed. Completed work quantities include 90% soil works, with 554.03 mu in Mayezhuang, Gaozhuang and Heluzhang for permanent use, and 792.91 Mayezhuang, Gaozhuang, Heluzhang and Weizhai for temporary purposes, a part of compensation for green crops occupied by pipes, and recultivation of land for the temporary use of construction equipment, but such compensation for other land uses it not implemented. Heluzhang has started to cultivate 40 mu from Weizhai, and Gaozhuang has accepted 93 mu from Mayezhuang, but refused to accept 28 mu from Weizhai, which is not allocated as agreed. Altogether 2 households are affected, one in Mayezhuang and the other in Gaozhuang. Both are living with neighbors or parents temporarily after having received their compensation or rent. Refer to Table 3 and Appendix 6. Wuqiu: It is planned to have 2 shelters, one in Jingtan and the other in Sanyi, to hold 4,651 people of 1,181 households in Tanqiu, Jingzhai, and Sanyi of Wuqiu Township. With 368.79 mu acquired, cofferdams for Tanjing shelter are completed and placement is underway. Jingzhai has received 56 mu farmland provided by Tanqiu, but internal adjustment is not finished. This issue is to be settled first by the new villager committee. The area for the use of Sanyi shelter is 223.02. The placement of cofferdam is underway. Land adjustment between villages is finished, and internal adjustment is to be started soon. Local counterpart funds are

arranged for recultivating 85 mu land in low-lying depressions. By the time of this report,  ADB-financed Yellow River Flood Management Sector Project Resettlement Monitoring and Evaluation (Report No. 3) such funds have been paid to villager groups in bankbooks. The total number of households affected by Tanjing shelter is 3, including 2 in Tanqiu and 1 in Jingzhai. They are living in temporary housing or with their parents temporarily after having received the due amounts. Land use for Sanyi shelter involves 3 households, which are not yet compensated and relocated. Compensation costs for green crops are not disbursed. Refer to Table 3 and Appendix 6. Fanxian: It is planned to have one shelter, with 1,001.76 mu for permanent and 2,867.57 mu for temporary use, to receive 8,704 people of 2,178 households in 9 villages: Beiyangzhuang, Qianwanglou, Wanggengbai, Caozhuang, Baizhuang, Zhangdouhuan, Houshi, Luji, and Malukou. Box and dividing dikes are completed. The completed area is 1,030 mu, involving Qianwanglou, Caozhuang, Baizhuang, Luji, and Sunlou (not to be moved). The Bureau of Finance has disbursed 0.4504 million RMB to the Rural Credit Cooperative as compensation for land acquisition, housing, and tomb clearing, with an account established for each household. Land adjustment and resettlement are not stated. Refer to Table 3 and Appendix 7. Dongming: It is planned to have 2 shelters in Changxing Township, one in the south and the other in the north, to accommodate 9,594 people of 2,297 households in 11 villages. They are Qianzhaizhuang, Houzhaizhuang, Xindianji, Guanzhai, Yangzhuang, Linkou, Dongzhulin, Xizhulin, Maozhuang, Xinliuxiang, and Laoliuxiang. The completed work quantities include 92% soil works for the south shelter and 86% for the north one. Edging and covering works are partly stated. For the purpose of the south shelter, 462.3 mu is acquired for permanent and 134.2 mu for temporary use, involving Qianzhaizhuang and Houzhaizhuang. Internal land adjustment is finished, but that between villages is not started. The area for the north shelter includes 593.5 mu for permanent and 206 mu for temporary use, involving Maozhuang, Dongzhulin, Xizhulin, and Xinliuxiang. Land adjustment inside and between villages is not carried out. Except in Xinliuxiang, the compensation costs for green crops and appurtenances are paid to households in full. House relocation and compensation are not involved in this stage. Refer to Table 3 and Appendix 8. Pingyin: It is planned to have 7 shelters for 10,128 people of 2,482 households in 4 townships, with 1,365.66 mu for permanent and 1,932.16 for temporary use. Production reestablishment is required for a total number of 1,072 people. During implementation, the scheme is adjusted to the extent that 7 shelters are provided for 13 villages: one for Lingzhuang, one for Houzhai, one for Xinboshi and Laoboshi, one for Qianruaner, one for Dingkou and Wangxiaozhuang, one for Liuhejuan, and one for Dahekou, Xiaohekou, Liuzhuang, Tieyang, and Suqiao. Land acquisition is just started, but resettlement is not. Measurement of land areas for temporary purposes, nonproductive land in most cases, is not implemented. According to the “Circular Letter on Publishing the Guiding Compensation Rates for Green Crops and Appurtenances” issued by the county project office in April 2005, a total amount of 1.449 million RMB is disbursed to the township field project offices, with the exception of Lingzhuang shelter. The inventory and registration of appurtenances are completed in terms of administrative villages. Compensation for Liuhejuan and Houzhai is started. Payment is generally made against the rates as published, except that adjustment is made to few categories and rates, such as trees.

INCOME LEVELS Since the incomes in 2004 are not affected by Yuanyang (left-bank) and Pingyin Subprojects commenced in 2005, and Dongpinghu Subproject whose design changes were approved in October 2004, this chapter only discusses the income impacts by Miaozhai, Wuqiu, Fanxian, Dongming, Lankao (135), Lankao (152), Kaifeng, and Dongming, altogether 8 subprojects. A total number of 418 households with 2,027 people are selected for investigating the family incomes in 2004, including all sample households from 50% sample villages involved in dike consolidation subprojects and 10% from over 50% groups involved in floodplain safety development subprojects, one third for each of high, middle and low income levels (with low levels selected from vulnerable groups such as families of enjoying “five guarantees”, those with physical disabilities, and others without labor forces and mainly depending on women). The subprojects included in this follow-up investigation of family incomes were all started in 2004. As result of autumn floods in the Yellow River, farming incomes in the fall 2003 were affected significantly. For the data collected to be more comparable, the baseline data in 2003 are calculated as those in a normal year. At the time of counting and summarizing, the incomes of 15 households with 65 people in 2 groups of Yuanzhai Village involved in Lankao (152) in 2003 and 2004 are excluded. Based on statistical and analysis results of the rest 403 households with 1,962 people, the per capita farmland area in 2004 was 1.11 mu, or 0.25 mu less than 1.36 mu in 2003, and the income was 1,270 RMB, almost equal to the value 1,271 in the previous year. The contribution by farming was reduced by 146 RMB, i.e. 34 RMB/mu, due to the reduced farmland and the delayed seeding in spring 2004 as a result of autumn floods in 2003. Details are shown in Table 9 below. WILLINGNESS AND PROTECTION OF RIGHTS AND INTERESTS A total number of 25 indexes oriented to the right to know, participate and appeal in respect of compensation rates, resettlement information handbook, dissemination, channel and result of complaint management, and willingness to move are developed for our investigation. The total number of people investigated is 7,683. Regarding the right to know, there are 8 indexes regarding whether to know the compensation rates, resettlement planning, and resettlement information handbook, etc. As indicated by the investigation results, 88.54% know the rates for permanent land use, while 2.6% do not; more than 55% know house compensation rates and their own entitlements, while 5.45 and 11.96% do not; over 30% choose not to make any comment, mainly because they are not involved in land acquisition or house relocation; and more than 80% have no idea about resettlement planning and information, consequently 51.34% have no comment on the implementation of resettlement policies. Refer to indexes 1-9 and 23 listed in Tables 10-1 through 10-5. In respect of the right to participate, 54.91% clearly say they have participated in measuring the land/housing and making inventory of appurtenances in the stage of implementation, 47.77% have not participated in surveying their own properties in the stage of planning, and

66.89% have not participated in site selection, mainly due to the small quantity of properties  ADB-financed Yellow River Flood Management Sector Project Resettlement Monitoring and Evaluation (Report No. 3) and the limitation of site selection. Refer to indexes 10-12 listed in Tables 10-1 to 10-5. In respect of dissemination, there are 6 indexes regarding the awareness of the organizations and targets, and the degree of satisfaction with the content, method and effect. Only 8-28% are unsatisfied or unaware, while the majority express awareness or satisfaction. Refer to indexes 13-18 in Tables 10-1 to 10-5. With regard to the channel and result of complaint management, there are 4 indexes regarding availability of channels, timely management of complaints, and degree of satisfaction with the process and result of complaint management. As many have not raised any complaint up to now, there is a higher percentage of “no comment”, including 90% not making any comment on the timely management of complaints and the degree of satisfaction with the process of management. Refer to index 19 to 12 shown in Table 10-1 to 10-5. For the purpose of investigating the willingness to move, 2 indexes are developed regarding the willingness to move and the ability to build a house in time. As indicated by investigation results, 76.87% are willing to move, but 85.02% say they are unable to complete new houses within 2 years after completion of the shelters. EVALUATION AND RECOMMENDATION 1.13 Evaluation Livelihood reestablishment: (1) Homesteads are identified for the households in the need of new houses. Lankao (135) and Dongming Dike Consolidation Subprojects necessitate the resettlement of 357 households, including 330 having relocated their old houses and received homesteads. (2) House compensation essentially meets the progress of house construction. A total amount of 6.7104 million RMB is disbursed against the published or agreed rates, taking up 83.33% of the amount of 8.0528 million RMB included in the Implementation Scheme. (3) Completed new houses are better than old ones. (4) The higher percentage of raised platforms the brick-concrete structures represents higher resistance to flood events. (5) New houses are not totally completed. The overall progress of housing is as follows: 60% have completed, 27.27% are constructing, 4.55% do not need new houses but have received compensation costs, and 8.18% have not started. The scenarios of resettlement include: 51.52% have moved into new houses, 0.61% have bought, 9.39% live in other types, 32.73% have borrowed, 2.73% have rent, and 3.03% live in simple shacks. (6) Water/power supply facilities and roads in new sites are not all completed. Compensation and resettlement involved in floodplain safety development are not started except for 2 families in Miaozhai and 3 in Tanqiu, who are living in temporary houses or with their neighbors or parents temporarily after having received their compensation or rent. Various types of compensation costs for the permanent use of dike consolidation are paid in succession. Production reestablishment is not implemented as planned. Some villages share land compensation costs and adjust the farmland, while others pay to the households and do not arrange land adjustment. The counterpart funds promised by the local government are disbursed step by step. Since shelters are not completed, implementation of infrastructures is not started, but compensation for land use is started. The situation of compensation considerably differs from one place to another. In some subprojects, payment is made in a timely manner, but this is not the case in others despite of the fact that the land losers have suffered from the loss of 2 crops. Some

Refer to Appendixes 1 to 9. 1.14 Problems and Recommendations Besides the outstanding problems encountered in the last round of monitoring and evaluation, some others are found this time in the following aspects: housing, compensation, livelihood

reestablishment, construction, and school reconstruction. These are detailed in Table 11.
