During his Wednesday briefing, de Blasio said it’s “crucial” that the MTA block off every other seat on trains and buses that would have “stated public capacity limits” — a proposal ridiculed by the transit agency. “Like many of the mayor’s ideas, this is nice in theory, but utterly un- workable,” said Abbey Collins, an MTA spokesperson. “The mayor’s plan would allow us to serve only a tiny percentage of our riders — likely around 8%.” A spokesperson for de Blasio said the top priority is to prevent a re- surgence of the virus that has killed more 21,000 people in the city. “It’s common sense that people shouldn’t sit directly next to each other on the subway in a pandemic,” said the spokesperson, Mitch Schwartz.

Maybe the only thing more popular than alcohol right now is flour for all the bread and cookies we are eating. This should not surprise us. Alcohol and carbohydrates, which release serotonin, make us feel better. But if drinking and eating are all we do to cope with the trauma of the COVID pandemic, our mental and physical health will suffer for years. The stress and despair of losing a job, struggling to pay rent, caring for an elderly or sick loved one, home schooling, and general anxiety about the future are real—and already taking a toll. Calls to the federal mental health crisis hotline are about 900 percent greater than this time last year. A Kaiser Family Foun- dation survey found that 50 percent of respondents report that the pandemic has impacted their mental health. We need more than cocktails and cookies. As government continues to address the crisis and plan for the recovery, it must incorporate steps to help Americans deal with the mental health impacts of the pandemic. Some of that is happening already. Governor Cuomo recent- ly signed an executive order requiring insurance companies to waive co-pays for mental health services. Prior to that, he es- tablished a volunteer-staffed hotline to offer free counseling to New Yorkers in need. Here are five additional steps policy makers and others should take: 1) Make sure primary care visits address mental health is- sues. Mental health and physical health are intrinsically linked: only when physicians learn more about a patient’s mental health can they have a full understanding of their overall health. 2) Address coping through schools. Kids are stressed and worried, too. Parents can talk with them, but often kids need to hear from someone else, like a trusted teacher or guidance counselor. School staff can fill that role now through online chats and activities. 3) As districts plan for reopening, they should incorporate mandatory mental health screenings for each student. Schools can then provide coping skills programs; and students whose assessments deem them to be at high risk should be connected to behavioral health providers without delay. 4) Develop public service announcements about coping. Re- search has shown that PSAs, as part of a comprehensive health campaign, are effective at altering behaviors. There are plenty of PSAs in regular rotation about washing hands and keeping physical distance. We need PSAs that address coping, and they need to come from the government or the nonprofit sector so there is no perception of ulterior motives. They should speak to kids and adults, singles and families, about strategies to get through this crisis. 5) Change the public health messaging to encourage phys- ical distance, not social isolation. Social isolation is incredi- bly unhealthy. We should encourage people to maintain and seek out social connections while remaining physically dis- tant. The stress on people and families, and the despair they feel, is likely to last long into the future. And while we want to keep the beverage and baking industries strong, we should do more to ensure they offer a complement to our daily lives, not a crutch on which we lean during di- sasters. Helping people deal with distress and make healthy choices is imperative to preventing much greater problems down the road. David Woodlock is president and CEO of the Institute for Community Living. Bishop Nicholas DiMarzio, whose Dio- cese also includes Queens, “repeatedly sexual- ly abused” Samier Tadros starting when he was about 6 years old, according to a March 9 letter that Tadros’ lawyer sent to the attorney represent- ing the Archdiocese of Newark. Friday, June 5, 2020 • SECOND DEPARTMENT/Brooklyn/Daily Eagle • 9 CLAIMS THAT ATTORNEY WASN’T RETAINED ARE REJECTED IN APPEAL Appellate Division, Second Department In July of 2009, Cenlar FSB foreclosed on a mortgage secured by property owned by Rechelle Shenker and Shimon Shenker. In the Kings County Supreme Court, Civil Term, attorney David Augenstein prepared and filed an answer on their behalf. Cenlar moved for summary judgment on the complaint as asserted against the defen­ dants, who did not oppose the motion. In an order dated Oct. 10, 2014, Hon. Lawrence Knipel granted Cenlar’s motion for summary judgment. Cenlar then moved for a judgment of foreclosure and sale and to confirm a referee’s report. In Hon. In an order dated March 1, 2017, Justice Knipel granted Cenlar’s motion and denied the defendants’ cross motion. Subsequently, the board of managers of Borough Park Towne House Condominium moved to amend the judgment of foreclosure to correct an error, specifi­ cally the failure to reference the board’s notice of appearance and demand for surplus monies. In an order dated Oct. 18, 2017, the court granted the motion. In the Appellate Division, Second De­ partment, the Shenker defendants appealed from the judgment of foreclosure and sale and the order dated Oct. 18, 2017. In their de­ cision, the appellate justices agreed with the Supreme Court’s de­ termination granting Cenlar’s motion and denying the defendants’ cross motion. In their appeal, the Shenker defendants contended that they never appeared in the complaint and that Augenstein was without authority to file an answer and thereby submit them to the jurisdiction of the court. The justices found that a fair inter­ pretation of the evidence adduced at the hearing demonstrated that Augenstein was authorized on their behalf when he filed the answer. They explained that, under the circumstances, the Supreme Court’s credibility determinations were entitled to sub­ stantial deference and declined to disturb them on the appeal. The justices also rejected the defendants’ contention that the Supreme Court should have denied the board’s motion to amend the judgment of foreclosure and sale explaining that the record demonstrated that the board filed a notice of appearance and de­ mand for surplus monies but the judgment of foreclosure and sale inadvertently failed to acknowledge the board’s appearance. —Cenlar, FSB v. Shenker, 2017‐06454 & 2017‐12152, May 13, 2020 CHURCH’S COMPLAINT BARRED BY STATUTE OF FRAUDS Appellate Division, Second Department IIn Kings County Supreme Court, Civil Term, the Roman Catholic Church of the Epiphany filed a complaint seeking a judgment declaring that it had entered into a 99­year, rent­free lease with the city of New York. The Church of the Epiphany is the former owner of land designated as Block 2146 or Lot 11, which is adjacent to its rectory building. That lot and several other nearby lots were acquired by the city through a condemnation proceeding in September of 1984 and turned into a park. After the city acquired it, the church continued to use a portion of the lot as a parking area as well as for access to its rectory building. In 2017, the city asked the church to vacate the disputed lot and, on Dec. 11, 2017, the church indicated that it would vacate the lot by Jan. 31, 2018. After the church failed to vacate the lot by the agreed deadline, the city issued a 10­day notice to quit the disputed parcel. In response, the church filed the complaint seeking a judgment de­ claring that the parties had entered into a 99­year, rent­free lease with respect to Lot 11, as well as related injunctive relief against the city and specific performance of the lease. In response to a motion by the church for an injunction, the city cross­moved to dismiss the complaint. The Supreme Court, after permitting the parties to engage in pre­answer discovery and to submit surreply papers, granted the branch of the cross­motion to dismiss the complaint. Upon the church’s appeal, the justices of the Appellate Division, Second Department affirmed the determination of the Supreme Court. The justices explained that the church’s claims were barred by the statute of frauds, as there was no written con­ tract between the parties establishing the existence of a 99­year, rent­free lease for the disputed lot. —Roman Catholic Church of the Epiphany v.
