COENEN* Few tales from human experience are more compelling than that of the mutiny on the Bounty and its extraordinary after- math. On April 28, 1789, crew members of the Bounty, led by Fletcher Christian, seized the ship and its commanding officer, William Bligh.' After being set adrift with eighteen sympathiz- ers in the Bounty's launch, Bligh navigated to landfall across 3600 miles of ocean in "the greatest open-boat voyage in the his- tory of the sea."2 Christian, in the meantime, recognized that only the gallows awaited him in England and so laid plans to start a new and hidden life in the South Pacific.' Law School Student Scholarship. 596. https://scholarship.shu.edu/student_scholarship/596 Copyright Ownership and the Need for Implied Licenses in the Realm of Tattoos Kyle Alan Ulscht This article argues that there is a need for an implied license to be issued when an individual is tattooed. In spite of a rich history spanning millennia, the legal community has not come up with an adequate system of determining copyright ownership in affixed tattoos. Complicating this lack of certainty in the field of copyright rights in tattoos is the general unwillingness of courts to invoke the de minimus use exception in cases of copyright violation. This unwillingness coupled with the ubiquitous nature of technology and social media could lead virtually every tattooed person to be held to be an infringer and prevent them from a variety of activities ranging from appearing in advertisements, or movies, to more common activities such as posting photos on Facebook, without a complicated trial or trail of paperwork and accounting. Fortunately courts, relying on theories of equity, have invented the concept of implied licenses for instances when a party commissions a work but does not meet the more formal requirements to own the copyright rights of that work. -

4 Nordhoff and Hall’s Mutiny on the Bounty: A Piece of Colonial Historical Fiction Sylvie Largeaud-Ortega University of French Polynesia Introduction Various Bounty narratives emerged as early as 1790. Today, prominent among them are one 20th-century novel and three Hollywood movies. The novel,Mutiny on the Bounty (1932), was written by Charles Nordhoff and James Norman Hall, two American writers who had ‘crossed the beach’1 and settled in Tahiti. Mutiny on the Bounty2 is the first volume of their Bounty Trilogy (1936) – which also includes Men against the Sea (1934), the narrative of Bligh’s open-boat voyage, and Pitcairn’s Island (1934), the tale of the mutineers’ final Pacific settlement. The novel was first serialised in the Saturday Evening Post before going on to sell 25 million copies3 and being translated into 35 languages. You have fun with it, and nobody else can control (sup- posedly) what you do with it. —Don Ed Hardy1 INTRODUCTION The practice and ritual of tattooing human skin has existed in all parts of the world and in most cultures for thousands of years.2 The modern his- tory of tattooing in Western cultures can be traced to the voyages of Captain James Cook to the South Pacific, where sailors encountered various Polyne- sian tribes among which tattooing was, and remains today, an important cul- tural practice and spiritual ritual.3 When these sailors, many of whom had adorned their bodies with tattoos, returned to Europe, they ignited an inter- est in tattooing known as the “tattoo rage,” which spread through nineteenth- century Europe. -

A Long Walk Home: The Role of Class and the Military in the Springsteen Catalogue Michael S. Neiberg United States Army War College and Robert M. Citino National World War II Museum1 Abstract This article analyzes the themes of class and military service in the Springsteen canon. As a member of the baby boom generation who narrowly missed service in Vietnam, Springsteen’s reflection on these heretofore unappreciated themes should not be surprising. Springsteen’s emergence as a musician and American icon coincide with the end of conscription and the introduction of the All-Volunteer Force in 1973. He became an international superstar as Americans were debating the meaning of the post-Vietnam era and the patriotic resurgence of the Reagan era. Because of this context, Springsteen himself became involved in veterans issues and was a voice of protest against the 2003 Iraq War. In a well-known monologue from his Live 1975-85 box set (1986), Bruce Springsteen recalls arguing with his father Douglas about the younger Springsteen’s plans for his future. Whenever Bruce provided inadequate explanations for his life goals, Douglas responded that he could not wait for the Army to “make a man” out of his long-haired, seemingly aimless son. Faculty & Coordinator of Human Resource Management Program, Merrimack College, North Andover USA Rachel Silsbee, M.Ed Assistant Director of Student Success: Writing Center Merrimack College, North Andover USA Abstract This article focuses on the impact that face and/or neck tattoos may have on the employment screening process. With some estimates placing the number of possible candidates with tattoos as high as 28%, and the increase in social acceptance of tattoos, reveals that this research may play a significant role for the employer and the candidate during the employment screening process. Tattoos today can be found on men and women, with no limits on professional status and the tattoo designs can hold profound meaning to the wearer. This qualitative study analyzed data from 243 participants. The data was broken down into gender responses when it comes to assessing a candidate with a face/neck tattoo during the employment screening process. One significant theme that emerged is that 50% of the participants reported that they would hire a candidate with a visible face/neck tattoo depending on the position, revealing that employment screeners still feel that a visible tattoo may be acceptable for some positions and not acceptable for other positions. Introduction A great deal of research in the field of Human Resource Management, Industrial-Organizational Psychology and Social Psychology has focused on the impact that tattoos have in the employment arena when it comes to bias, stigma, prejudice, visual cues, social class, recruitment, taste-based discrimination, and/or attitudes (Burgess & Clark, 2010; Larson, Patterson & Markham, 2014; Mendez, 2016; Miller, Nicols & Eure, 2009; Seiter & Hatch, 2005;Swanger, 2006;Totten, Lipscomb, & Jones 2009). -

Fashioning Tattooed Bodies: An Exploration of Japan’s Tattoo Stigma By John Skutlin, Chinese University of Hong Kong Abstract: This article uses a cultural anthropological approach to examine tattooing stigma in contemporary Japan, particularly in terms of how the stigma has developed and how tattooed individuals engage in various legitimation maneuvers to cope with it. Tattooing has a long history in Japan, and tattoo culture saw a major efflorescence in the Edo period (1603-1868). However, unlike many Western countries, where most tattoos are widely accepted as expressions of individual style and aesthetics, a confluence of historical and cultural factors have resulted in a general antipathy to the practice in Japan, particularly due to its association with yakuza organized crime groups. As increasing numbers of young people go under the needle for what they see as artistic “fashion tattoos,” reconciliatory strategies must be deployed in order to maintain social cohesion and assure adherence to group norms even while violating them. Through historical accounts and ethnographic data, this paper thus elucidates the complicated nature of stigma in Japan and the specific ways in which individuals fashion both their bodies and their strategies to legitimize themselves, showing how efforts to conceal tattoos – even when only partially successful – can be an effective means of reconciling themselves with the general society around them.
