Tale plauso rafforza la nostra determi- nazione e il nostro impegno a proseguire nella realizzazione di un prodotto editoriale che continui a stimolare e a coin- volgere l’interesse del mondo accademico-universitario, scientifico, giuridico, sociologico e storico, quale strumento di linguaggio interdisciplinare. Il prosieguo della missione redazionale sarà quindi orientato alla divulga- zione di contributi di pensiero e di spunti di riflessione che possano ulterior- mente ingenerare il confronto intellettuale, attraverso un proficuo dibattito dot- trinale nel vasto panorama delle tematiche trimestralmente proposte. Come Direttore Responsabile della Rassegna, facendomi portavoce anche dei sentimenti del Redattore Capo e della Redazione tutta, intendo pertanto esprimere la più profonda gratitudine a tutti coloro che, con passione e convin- to sentimento, hanno con noi personalmente condiviso il percorso logico-giu- ridico intrapreso. Presentiamo in questo fascicolo un originale inserto - impreziosito da una copertina artistica che vuole preannunciarne il contenuto - compendio del- l’esperienza maturata dal Generale di Brigata Giuseppe Vadalà quale “Commissario straordinario per la realizzazione degli interventi necessari all’adeguamento alla normativa vigente delle discariche abusive presenti sul ter- ritorio nazionale”. Attraverso la preziosa premessa del Consigliere Pasquale Fimiani, l’approfondimento descrive le attività eseguite nel contesto del risana- mento ambientale di quelle aree seriamente danneggiate dallo sviluppo indu- striale intensivo e incontrollato sul territorio. Il censimento e la bonifica delle discariche abusive, con la messa in sicu- rezza o la decontaminazione delle zone ecologicamente compromesse, diviene un’attività preventiva, dissuasiva e rigenerativa indispensabile. 3 In particolare, nell’ambito di questa azione risanatrice opera, in stretta col- laborazione con il Commissario, una speciale task-force dell’Arma dei Carabinieri. Per l’apertura del nuovo numero della Rassegna, esordiamo in “Dottrina” con il contributo del Consigliere Giuseppe Corasaniti, magistrato e docente universitario, che porta alla nostra attenzione il dettame normativo sulla confi- sca delle “cose di interesse culturale”, con una dettagliata argomentazione sulla più significativa giurisprudenza di legittimità in materia. L’evoluzione legislativa dello specifico istituto ha consentito di contrastare e di arginare, nel tempo, diverse forme di esportazione clandestina di beni di interesse artistico, storico, archeologico ed etnoantropologico appartenenti al demanio pubblico e al patrimonio indisponibile dello Stato, diversamente desti- nati alla dispersione. Riguardo ad un tema che appartiene ad un campo del tutto diverso, la Dottoressa Silvia De Blasis propone una pregevole disamina sulla disciplina che reprime lo scambio elettorale politico-mafioso, con un richiamo alla recen- te novella legislativa che ha ampliato la configurazione dello specifico reato, laddove si dimostri la mera disponibilità a soddisfare gli interessi e le esigenze dell’associazione malavitosa. Segue poi la trattazione dell’abuso d’ufficio, a cura del Professor Marco Naddeo e del Tenente Colonnello Vincenzo Ferrara, che esamina i precetti di tale tipologia di reato che, con le sue distorsioni interpretative e applicative, evi- denzia il concetto di infedeltà nei confronti della Pubblica Amministrazione per effetto della violazione di norme di legge e di regolamenti. Come è noto, la tutela della privacy suscita sempre grande attenzione, atte- so che l’argomento attiene ad una garanzia fondamentale del diritto alla libertà individuale. Il Dottor Nicola Rumine ed il Tenente Julian Colamedici, in questo ambito, affrontano nel loro elaborato gli aspetti di quella che viene definita la “sorveglianza planetaria” ovvero il monitoraggio continuo di ciascun movi- mento, azione o scelta dei singoli soggetti. Considerando contestualmente la sua estensione negli ambiti investigativi, l’esigenza di normare analiticamente l’utilizzo degli strumenti che consentano legalmente tali interferenze nella vita privata appare, ormai, una necessità imprescindibile. Nel recentissimo passato, ha suscitato un vasto clamore la vicenda “Occhionero”, che ha avuto come protagonisti un ingegnere nucleare e sua sorella, rei di accesso abusivo a sistemi informatici e di intercettazione illecita di comunicazioni telematiche. Il Capitano Gianni Cavallo, traendo spunto dai dettagli del caso giudiziario, 4 ne delinea gli aspetti giurisprudenziali più rilevanti, con riferimento alla pronuncia della Corte Suprema di Cassazione in merito alle esigenze cautelari richieste nella fase delle indagini preliminari sull’impiego del cosiddetto “captatore informati- co”, quale valido strumento d’investigazione. Al riguardo, la preziosa pronuncia della Corte concorre in modo dirimente alla formulazione della prospettata disci- plina dell’utilizzo legale di software spie, applicabile a più reati e per più funzioni, superando certe presunte limitazioni nell’uso di strumenti tanto invasivi. Alcune interessanti considerazioni sulla politica europea in materia di asilo e di immigrazione ci vengono offerte dal Professor Luigi Daniele. Per la com- plessità delle sue norme e per la successione degli interventi legislativi emanati, le direttive attinenti possono considerarsi ancora insufficienti, a causa dell’as- senza di un’unanime e definitiva soluzione a livello comunitario. Troppo spesso la gestione di queste specifiche emergenze umanitarie è stata lasciata ad inizia- tive autonome e spesso scoordinate degli Stati membri più coinvolti nell’arrivo di consistenti afflussi di migranti, in ragione della loro peculiare morfologia geografica e per la mancanza di un equo sistema di ricollocamento, recente- mente riconsiderato. Restando ancora con lo sguardo verso orizzonti che vanno oltre i confini nazionali, ospitiamo - nuovamente e con vero piacere - l’elaborato del Dottor Andrea Giannotti, che riprende l’analisi delle attività che hanno caratterizzato l’intelligence sovietica negli anni di Andropov, capo indiscusso del KGB, tradizio- nalmente riconosciuto

ABSTRACT Recent years have seen an increasingly sophisticated debate take place with regard to the armies on the Western Front during the Great War. Some argue that the British and Imperial armies underwent a ‘learning curve’ coupled with an increasingly lavish supply of munitions, which meant that during the last three months of fighting the BEF was able to defeat the German Army as its ability to conduct operations was faster than the enemy’s ability to react. This thesis argues that 8th Division, a war-raised formation made up of units recalled from overseas, became a much more effective and sophisticated organisation by the war’s end. It further argues that the formation did not use one solution to problems but adopted a sophisticated approach dependent on the tactical situation.

It argues that as the largest New Zealand amphibious operation of the Second World War, ‘Squarepeg’ holds a key place in identifying the development of amphibious and jungle warfare doctrine within the New Zealand Army during the war. As such, it can indicate the abilities of the 3rd NZ Division to conduct combat operations in the South Pacific in 1944. The thesis shows that the New Zealand Army was unprepared for operations in the South Pacific, as it had neglected relevant inter-war developments. The hasty formation of the 3rd NZ Division in 1942, as a response to Japanese expansion in the South Pacific, served to highlight the challenges that the division and its commander, Major-General Harold Barrowclough, had to overcome. The studying of foreign doctrine to supplement the dearth of New Zealand material was vital for the 3rd NZ Division’s preparations for deployment.

    Views and opinions Letting Clausewitz Go: The Lesson the Canadian Army Must Learn From AFghanistan by Andrew godefroy rubs this imposed Clausewitzian intellectual touchstone, there is, in reality, very little to be gained from trying to re-invent ourselves as 19th Century Prussian philosophers and general staff officers. Still, to simply chastise the Canadian Army for clinging to the ‘square peg’ of Clausewitz, and trying to stuff his wisdom into the round holes that are our real-life strategic, operational, and tactical problems, would be somewhat unfair. For Canada, as a traditionally supporting actor in the Cold War era NATO and ABCA land force juggernaut, having Clausewitz jammed down our collective throats by our larger and more influential allies was largely unavoidable. Yet now, especially after the Canadian campaign in Afghanistan, where the Army has repeatedly demonstrated its ability to achieve success by its own example, the Army must learn to let this dated and increasingly obtuse European philosopher that was forced upon us go. It is time to refocus more upon its own indigenous and arguably much more relevant strategic, operational, and tactical agents of military change. Abstract 350 words maximum: (PLEASE TYPE) Australian First World War historiography tends to focus on the ordinary soldier: his background, character and involvement in the war. This is a legacy left by Charles Bean who, following the history from below approach, believed in the need for soldiers’ stories to be told. On the other end of the spectrum, attention is given to political leaders and the British high command. British commanders and, by extension, other Allied commanders are too often portrayed as poor leaders who were reluctant to adapt to modern warfare, and did not demonstrate a sense of responsibility for the men under their command. The evidence shows that this perception is not accurate. A comprehensive understanding of the progression of Australian forces on the Western Front cannot be gained without investigating the progression of those in command. This thesis examines the brigade commanders of the Australian Imperial Force who held that level of command for a substantial period while on the Western Front.

    THE PRIVATE SIDE OF A PUBLIC FAMILY: THE HENEKER ALBUM AND DIARY Eva Major-Marothy Documentary Art and Photography Division National Archives of Canada Richard William Heneker (1823–1912) does not need much introduction in the Eastern Townships.1 A very important figure in the nineteenth century economic development of Sherbrooke, he combined his position as commissioner for the British American Land Company, from 1855 to 1902, with various busi- ness ventures. He was President of both the Eastern Township Bank and the Paton Manufacturing Company, Mayor of Sherbrooke, Chancellor of Bishop’s University and founder and first president of the Sherbrooke Protestant Hospital. This paper, however, will look at his more private side using his diary in the Manuscript Division and the Heneker album in the Documentary Art and Photography Division of the National Archives of Canada.2 Heneker began to keep the diary when he embarked for Canada in April 1855 and recorded his impressions of the crossing, of his few days in New England, and of the first weeks in Sherbrooke. He mentioned names of several residents whom he visited, or had business dealings with which will be of interest to local historians. In the penultimate entry, on July 30, Heneker recorded making his first sketch, A View of the Lowest Falls of the Magog from the Railway Bridge. Although this particular sketch is not in the album, there are two watercolours of the Heneker residence which used to stand on Factory Street in Sherbrooke and several unidentified views, which upon closer study may turn out to be from the Townships.

In the penultimate entry, on July 30, Heneker recorded making his first sketch, A View of the Lowest Falls of the Magog from the Railway Bridge. Although this particular sketch is not in the album, there are two watercolours of the Heneker residence which used to stand on Factory Street in Sherbrooke and several unidentified views, which upon closer study may turn out to be from the Townships.

    Major General The Honourable Sir William GLASGOW KCB, CMG, DSO [1876 – 1955] Major General Sir William Glasgow was a life-long member of the United Service Club and a distinguished soldier, politician and diplomat. The Club’s dining room is named The Glasgow Room in his honour. Thomas William Glasgow was born at Tiaro near Maryborough Queensland on 6 June 1876, the fourth child of an Irish farmer. He was educated at One Mile State School in Gympie and at Maryborough Grammar School. After leaving school he went to work as a junior clerk in the office of a mining company in Gympie. Later he worked as a clerk in the Queensland National Bank in Gympie. (Sir) Brudenell White, a clerk in a rival bank, was among his friends Bill Glasgow joined the Wide Bay Regiment, Queensland Mounted Infantry, while still a teenager, giving up most of his week-ends to soldiering. In 1897 he was selected with nineteen others and he travelled to London to represent Queensland at the Diamond Jubilee of Queen Victoria. Glasgow volunteered for service in South Africa and served as a Lieutenant in the 1st Queensland Mounted Infantry Contingent. He participated in the relief of Kimberley, the capture of Cronje's laager on the Modder, and the occupation of Bloemfontein in 1900. On 16 April 1901 he was Mentioned in Dispatches and awarded the Distinguished Service Order (DSO).
