For Today's (08/04/2009) enquiry, the petitioner Thiru B.Srdharnath, is present. On behalf of the Public Authority, Thiru G. Gulaur Jeelani Papa, Headquarters Deputy Tahsildar, Mylapore-Triplicane Taluk, Chennai, is present.
2. The petitioner has filed a petition under the Right To Information Act, 2005 on 28.02.2008. He filed an appeal to the Appellate Authority on 26.05.2008 as he has not received any information from the Taluk Office. In the meantime, separately he applied for information from the Assistant Director, Survey and Records. The Assistant Director, Survey and Records has given a 2 reply on 24.03.2008 stating that on item No. I (b), I (c) and copies of the F.M.B. Sketch 219, 221, 222 and 223 can be obtained from Tahsildar, Mylapore- Triplicane. The Tahsildar, Mylapore-Triplicane Taluk, has informed the petitioner on 17.04.2008 that reply will be given after getting the inspection report. Again on 12.05.2008 it was informed that the individual was given a reply on 17.04.2008. On 05.06.2008 a reply was given to the petitioner by the Public Information officer, Mylapore-Triplicane Taluk Office, stating that F.M.B. Sketch for Survey Nos.219, 221, 222 and 223 are not available in his office. He also informed the petitioner that the town survey has been carried out in the said village in the year 1987 and was completed in the year 1997. The old survey number will be correlated with the Town Survey Numbers and black numbers furnishing the names of the holders as far as practicable. The petitioner was also informed that 'A' registers for the above Survey Numbers are not available. The Assistant Director, Survey and Land Records has given copy of the extract of 'A' register in his letter dt.24.03.2008.

The Public Information Officer during the hearing has told this Commission that consequent on the completion of land acquisition proceedings by the Tamil Nadu Housing Board, the details of the changes carried out in the Taluk and Village Accounts stand in the name of the Housing Board. But the Public Information Officer could not give this Commission the correct Town Survey Number and F.M.B. Sketch and Block Map for the concerned T.S.No. correlating with the old Survey Numbers found in the 'A' Register.
4. Since the information furnished to the petitioner is not complete and correct, the Commission directs that the R.T.I. petitioner be given correct and full information within 15 days from the date of receipt of this order by the Public Information Officer. Since the petitioner was not given full and correct information within 30 days of the petition, the Public Information Officer is directed to show cause why penalty of 3
Rs.25,000/- should not be imposed on him, through the District Collector, Chennai, within 30 days from the date of receipt of this order.
