KUALA LUMPUR: Nurul Izzah Anwar’s defamation suit against Ismail Sabri Yaakob was postponed after her lawyer questioned the rationale behind the Attorney-General’s Chambers (AGC) appearing as the UMNO minister’s defence lawyer. “He (Ismail) made a statement which we view as slander, in an Umno-organised event, not an official event or one that is related to his official duty as a minister,” Nurul Izzah’s lawyer, R Sivarasa told reporters at the Kuala Lumpur Court Complex here today. “The issue he spoke about had nothing to do with his ministerial duties. In that context, it is reasonable to question why the AG is representing him in this case.” Nurul Izzah is suing Rural and Regional Development Minister Ismail, along with Inspector-General of Police Khalid Abu Bakar, for allegedly defaming her by claiming she had committed “treason”. This came after she was photographed with self-styled Sulu princess Jacel Kiram – daughter of Jamalulail Kiram, who is said to have led the intrusion in Lahad Datu, Sabah in 2013 – in Manila, Philippines, on Nov 9, 2015. Both Ismail and Khalid had allegedly also accused her of being a “traitor”. Sivarasa said the court had instructed for both the plaintiff and the defendants to find a solution to their dispute through mediation before the trial commenced. “This case hasn’t gone through the mediation process. It is a normal practice in the High Court, where all cases need to undergo a mediation process before it goes for a full trial. “It’s an attempt to solve the case (amicably),” he said, adding that his party was ready for a trial. But if both parties couldn’t reach an agreement, the full trial will take place from Aug 9- 11 this year. Nurul Izzah, who is also vice-president of PKR, had previously apologised for taking the picture with Jacel. She said it was taken at an event hosted by the Council on Philippine Affairs & the Asian Institute for Democracy, the office of the City Mayor of Manila and the office of the Philippine vice-president, where she had no control over the guest list. She also explained that Jacel took the picture with her as a sign of support for the United Nations Working Group on Arbitrary Detention’s position, which was for (jailed former opposition leader) Anwar Ibrahim to be immediately released. "We ourselves have long pledged to form the RCI and give Sabah a 20 percent royalty from oil and gas," she said. Najib met with Zakir at a breakfast meeting at the PM’s residence, while Hadi met Zakir at an undisclosed venue in Putrajaya. “It is my hope that Zakir can tell the world that Malaysia is a moderate country which is always encouraging Muslim unity,” Najib said in a Facebook posting. He also uploaded a picture of him shaking hands with the Zakir, who is dressed in a suit. PAS meanwhile uploaded a picture of Hadi embracing Zakir in what they called a “historic meeting” of their own in Putrajaya. The meeting is part of the Indian national preacher’s Malaysia tour from April 15 - 18, PAS said in a Facebook post. Zakir, whom the Agong awarded 'tokoh maal hijrah' in 2013, courted controversy when inspector-general of police (IGP) Khalid Abu Bakar ordered the cancellation of the Malacca and Kuala Lumpur lectures, citing a threat to public peace. Hindu groups had lodged police reports against the lecture, saying that Zakir had previously made slanderous comments against other religions. Khalid retracted the ban on the Kuala Lumpur event, while Home Minister Ahmad Zahid Hamidi overturned the IGP’s decision on the Malacca lecture. However, the topic of Zakir's Malacca lecture has been changed from comparisons with Hinduism, to women’s rights in Islam.

He was found guilty on both counts and sentenced, in 1999 and 2000 respectively, to a total of 15 years in prison. The government increasingly targeted regime critics and those challenging conservative societal norms in 2014. In August and September alone, at least eight people faced sedition charges. In March, in a move that was widely viewed as politically motivated, the Court of Appeal reinstated the 2012 sodomy conviction of opposition leader Anwar Ibrahim. Also in March, authorities arrested 114 Shiite Muslims in Perak for attending a religious celebration. In June, Prime Minister Najib Razak and a political ally filed a defamation suit against editors Steven Gan and Fathi Aris Omar of the independent online outlet Malaysiakini for the publication of compilations of reader comments concerning Najib. In August, the Court of Appeal upheld a conviction of malfeasance against Inspector General of Police Tan Sri Khalid Abu Bakar and his subordinates in the cover-up of the high-profile torture and killing of Kugan Ananthan, who died in 2009 while in police custody. Despite the ruling, Khalid retained his post. Malaysia’s LGBT (lesbian, gay, bisexual, and transgender) community faces discrimination and hostility from both state and nonstate actors. In June, an Islamic law court in the state of Negeri Sembilan fined 16 transgender women and sentenced them to seven days in prison under a law that prohibits men from wearing women’s clothing in public.

Re- Mahathirisation refers to the increase in attachment towards the legacy of Malaysia's fourth Prime Minister, Dr. Mahathir Mohamad (1981–2003). Transpiring not long after Mahathir's relinquishment of official power, the process was seen as approaching a peak with BN-UMNO's campaign for the 13th General Elections (GE13) of May 2013. It was orchestrated especially by conservative elements in UMNO disillusioned with the political liberalisation began by his successor Abdullah Ahmad Badawi (2003–2009) and continued by Najib Razak. In line with an understanding of conservatism as characterised by resistance against radical change and by admiration of past values, re- Mahathirisation was employed by the BN-UMNO regime during the GE13 hustings to court the large pool of conservative-minded Malay voters. The successful dislodging of Abdullah Badawi from the party-cum-national leadership in 2009 signified a powerful return of Mahathirism to the foreground of UMNO and national politics. Although Najib Razak has pursued Abdullah's political liberalisation initiatives, he felt compelled to tolerate a rising public presence of Mahathir.

This is also known as pre-trial detention. However, under certain circumstances, the suspect can be remanded repeatedly depending on the number of police reports filed against him or her. Such a practice is also known as chain remand and is said to infringe on the rights of the arrested suspect. However, this practice is technically permissible under the law, as provided under section 117 of the Criminal Procedure Code (“CPC”). This article aims to study the application of the law with regards to chain remand and identify weaknesses in the existing legal provisions. Furthermore, this study also seeks to explore the justifications for practicing chain remand in Malaysia and its implications on the detainees at large. Through its findings, this study highlights the existing loopholes in the law that need to be addressed to ensure that justice is upheld.
