Chapter 9.18 RIGHT-OF-WAY*

9.18.010 Vehicles approaching or entering intersection. A. When two vehicles approach or enter an intersection from different streets at approximately the same time, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on the right, except that the driver of a vehicle on a terminating street shall yield the right-of-way to the driver of any vehicle on the intersecting continuing cross street. B. The right-of-way rule declared in subsection A of this section is modified at through streets and otherwise as stated in this chapter. C. For the purposes of this section, the term "terminating street" means a street which intersects, but does not continue beyond the intersection, with another street which does continue in each direction beyond the intersection. 9.18.020 Vehicles turning left. The driver of a vehicle intending to turn to the left within an intersection or into an alley, private or shall yield the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard. 9.18.030 Stop or yield signs at through streets. The municipal engineer may designate and describe through streets, and when so designated it shall be the duty of the municipal traffic engineer to place and maintain a stop or on each and every street intersecting such through street or intersecting that portion thereof described and designated as such, unless traffic at any such intersection is controlled at all times by traffic signals; provided, however, that at the intersection of two such through streets or at the intersection of a through street and a heavy traffic street not so designated, stop or yield signs shall be erected at the approaches of either of the streets as may be determined by the traffic engineer on the basis of engineering and traffic study. 9.18.040 Stop or yield signs at other intersections. The municipal traffic engineer is authorized to determine and designate intersections where particular hazards exist upon other than through streets and to determine: A. Whether vehicles shall stop at one or more entrances to any such intersection, in which event he shall cause to be erected a at every such place where a stop is required. B. Whether vehicles shall yield right-of-way to vehicles on a different street at such intersection, in which event he shall cause to be erected a yield sign at every place where obedience thereto is required. 9.18.050 Vehicles entering stop or yield intersection. A. Preferential right-of-way at an intersection may be indicated by stop signs or yield signs as authorized inSection 9.18.030. B. Except when directed to proceed by a police officer or traffic control signal, every driver of a vehicle approaching a stop intersection indicated by a stop sign shall stop at a clearly marked stop line, but, if none, before entering the crosswalk on the near side of the intersection, or, if none, then at the point nearest the intersecting roadway where the driver has a view of the approaching traffic on the intersection roadway before entering the intersection. After having stopped, the driver shall yield the right-of-way to any vehicle which entered the intersection from another street or which is approaching so closely on the street as to constitute an immediate hazard during the time when such driver is moving across or within the intersection. No vehicle may follow another vehicle through a posted stop intersection without coming to a complete stop in its turn at the stop line, crosswalk or point nearest the intersecting roadway. C. The driver of a vehicle approaching a yield sign shall, in obedience to such a sign, slow down to a speed reasonable for the existing conditions and, if required for safety to stop, shall stop at a clearly marked stop line, but, if none, before entering the crosswalk on the near side of the intersection, or, if none, then at the point nearest to the intersecting roadway, where the driver has a view of approaching traffic on the intersecting roadway. After slowing or stopping, the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another street so closely as to constitute an immediate hazard during the time such driver is moving across or within the intersection. 9.18.060 Vehicle entering street from alley, public or private property or building. A. The driver of a vehicle about to enter or cross a street from an alley, public or private property or building shall: 1. Stop before crossing a or bikepath, or, if none, shall stop before entering the roadway. 2. Yield the right-of-way to any or bicyclist who may be approaching on the sidewalk or bikepath so closely as to constitute an immediate hazard. 3. Yield the right-of-way to any vehicle which is approaching so closely on the street to be entered as to constitute a hazard during the time such driver is moving across or entering traffic on the street. Any vehicle turning right onto a street from any alley or public or private property shall make the turn as close as practicable to the righthand or edge of the roadway. Any vehicle turning left onto a street from any alley or public or private roadway shall complete the turn into the extreme lefthand lawfully available to traffic moving in that direction upon the roadway being entered. B. The driver of a vehicle about to enter or cross an alley from a public or private property, or a building, shall yield the right-of-way to all vehicles approaching on the alley to be entered. 9.18.070 Operation of vehicles on approach of authorized emergency vehicles. A. Upon the immediate approach of an authorized emergency vehicle making use of an audible signal meeting the requirements ofSection 9.36.360.D, and visual signals meeting the requirements ofSection 9.44.190, or of a police vehicle properly and lawfully making use of an audible or visual signal only, the driver of every vehicle shall yield the right-of-way and shall immediately drive to a position parallel to, and as close as possible to, the righthand edge or curb of the roadway clear of any intersection and shall stop and remain in such position until the authorized emergency vehicle has passed, except when otherwise directed by a police officer. B. The driver of any motor vehicle who is being requested to stop, for a suspected or actual violation, through the use of visual signals meeting the requirements ofSection 9.44.190, on an authorized emergency vehicle of the police department, shall comply with the requirements of subsection A of this section and shall remain stopped until otherwise directed by a police officer. C. This section shall not operate to relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the street.
