Nous étudions la jurisprudence importante dans ce domaine, provenant majoritairement de la Cour suprême du Canada et la possibilité, pour les juges, de faire avancer une norme d’autonomie pour les francophones hors Québec (FHQ). La thèse démontre que l’interprétation des droits linguistiques par les juges est contrainte par des éléments contextuels comme les traditions étatiques du compromis politique et du fédéralisme. Ces traditions étatiques conditionnent les représentations que se font les juges des droits linguistiques et créent des effets de « dépendance au sentier » dans le domaine de la jurisprudence, limitant la possibilité, pour les juges, de faire avancer une norme d’autonomie pour les FHQ. Les juges peuvent toutefois réviser ces éléments de dépendance au sentier afin de présenter de nouvelles représentations des droits linguistiques dans la jurisprudence, instigatrices de « points tournants », voire de nouveaux paradigmes d’interprétation, dans l’évolution des droits linguistiques. La thèse permet de voir que l’activisme judiciaire dans le domaine des droits linguistiques demeure soumis aux éléments structurants du régime linguistique canadien. En conséquence, les juges ont répondu, de façon graduelle, à certaines revendications des minorités francophones du Canada, sans toutefois combler toutes leurs aspirations d’autonomie. Afin de réaliser cette recherche, nous avons proposé une analyse herméneutique de la jurisprudence. Nous avons aussi mobilisé les outils théoriques de l’institutionnalisme historique et la notion de représentations afin de montrer les facteurs de continuité et de changement dans le domaine des droits linguistiques. Ces outils nous ont permis de compléter l’approche personnelle aux décisions des juges en arrimant l’analyse de la jurisprudence à son contexte institutionnel d’énonciation et d’observer la dépendance au sentier et les points tournants dans l’interprétation des droits linguistiques sur trois décennies. Cette recherche contribue à l’avancement des connaissances en participant au débat normatif et à l’analyse institutionnelle des droits des minorités linguistiques. D’abord, la thèse met en dialogue les disciplines du droit et de la science politique, grâce à une analyse institutionnelle de la jurisprudence canadienne dans le domaine des droits linguistiques. Elle contribue aussi au domaine d’étude de la judiciarisation de la politique canadienne et la mobilisation judiciaire des « citoyens de la Charte » - où les FHQ brillent par leur absence. Ensuite, sur le plan normatif, la thèse montre comment l’évolution de la jurisprudence pose de nouveaux jalons pour penser l’autonomie des FHQ. Cette discussion nourrit aussi le débat international sur les droits auxquels les minorités linguistiques peuvent aspirer, dans le sillon des travaux de Cardinal (2008), de Cardinal et González Hidalgo (2012), de Foucher (2012), de Léger (2015) de Kymlicka (2012), et de Poirier (2012). Finalement, au plan théorique, en tentant de démontrer l’existence d’éléments contextuels contraignant l’évolution de la jurisprudence de droit linguistique au Canada, notre thèse confirme l’utilité de l’approche néo-institutionnaliste historique pour l’étude de la question de la « judiciarisation de la politique » au Canada, un domaine dominé par les approches instrumentalistes. En effet, nous avons fréquenté Oxford au même moment, nous avons tous deux enseigné le droit, pendant une brève période en même temps à l'Université de Montréal, et nous avons été doyens exactement au même moment. Nous avons tous deux participé très activement au processus constitutionnel dans les années 1960 et 1970, travaillant en étroite collaboration à la rédaction de la Charte de Victoria. Puis, nous avons tous deux été nommés juges, lui à la Cour d'appel du Québec et moi à celle du Nouveau-Brunswick, pour enfin nous retrouver collègues à la Cour suprême du Canada. Bien que nous ayons tous deux fréquenté Oxford, Jean de 1950 à 1952 et moi de 1949 à 1951, chose curieuse je ne me souviens pas de lui à cette époque, ni lui ne se souvenait-il de moi. Toutefois, c'est à Oxford qu'il rencontrait un autre étudiant, Julien Chouinard.

Introduction The sigh of relief on the Atlantic coast could be heard all the way to Ottawa on October 17, 2016. On that day, Prime Minister Justin Trudeau announced the nomination of Justice Malcolm Rowe of the Newfoundland and Labrador Court of Appeal to the Supreme Court of Canada seat vacated by Justice Thomas Cromwell. Justice Cromwell’s replacement was to be the first appointed pursuant to a new process put in place by the Trudeau government. When that process was unveiled on August 2, 2016, Trudeau announced that the position would be open to any qualified Canadian lawyer or judge who was functionally bilingual and “representative of the diversity of our great country.” A further clarification stated that “[a]pplications are being accepted from across Canada in order to allow for a selection process that ensures outstanding individuals are considered for appointment to the Supreme Court of Canada,” confirming that Atlantic Canadians did not have a lock on the position.1 People on the east coast generally take most things in stride, but this proposed change created a considerable outcry.

Rosenthal and Albert H. Yoon♠ Revised: August 2012 Abstract In contrast to other branches of government, the Supreme Court of Canada operates with relatively lean staffing. For most of the Court’s history, its justices alone determined which cases to review, heard oral argument, and wrote opinions. Only since 1967 have justices have been aided in these responsibilities by law clerks. While interest abounds in the relationship between justices and their clerks – particularly the writing of opinions – very little is known. This article analyzes the text of the Court’s opinions to better understand judicial authorship. We find that justices possess distinct writing styles, allowing us to distinguish them from one another. Their writing styles also provide insight into how clerks influence the writing of opinions.     10 A New Beginning 1975-1982 No previous statutory enactments had greater impact on the institutional development of the Supreme Court than the two that occurred during the years between 1975 and 1982. The first, in 1975, was the culmination of a long series of amendments to the Supreme Court Act eliminating appeals as of right and granting the Court almost complete control over its docket. The second was the historic adoption in 1982 of a new constitution in which the Court was virtually entrenched and given a vital new mandate. The first development had been sought eagerly by the Court for many years; the second event was thrust upon the justices by federal and provincial politicians. Throughout these years the Supreme Court was caught in the crossfires of federal-provincial disputes more frequently than in any previous period. As well, the composition of the Court changed with the departure of several justices. Between the summer of 1977and the winter of 1980 five members of the Court retired or resigned. Prime Minister Trudeau gave little indication in the selection of the replacements that he was particu- larly sensitive to the Court's emerging new public-law mandate. The appointments followed traditional regional considerations. Wilfred Jud- son, an Ontario representative, was replaced by Willard Z. Estey from Toronto;' and Yves Pratte of Quebec City replaced Louis-Philippe de Grandprk. Estey was born and educated in Saskatchewan; after complet- ing graduate studies at Harvard, he practised law in Toronto.
