The Emergence of Space Law
THE EMERGENCE OF SPACE LAW Steve Doyle* I. INTRODUCTION Space law exists today as a widely regarded, separate field of jurisprudence; however, it has many overlapping features involving other fields, including international law, contract law, tort law, and administrative law, among others.1 Development of space law concepts began early in the twentieth century and blossomed during the second half of the century into its present state. It is not yet widely taught in law schools, but space law is gradually being accorded more space in law school curricula. Substantial notional law and concepts of space law emerged prior to the first orbiting of a man made satellite named Sputnik in 1957. During the next decade (1958-1967), an intense effort was made to bring law into compliance with the realities of expanding spaceflight activities. During the 1960s, numerous national and international regulatory laws emerged to deal with satellite launches and space radio uses and to ensure greater international awareness and governmental presence in the oversight of ongoing activities in space. Just as gradually developed bodies of maritime law emerged to regulate the operation of global shipping, aeronautical law emerged to regulate the expansion of global civil aviation, and telecommunication law emerged to regulate the global uses of radio and wire communication systems, a new body of law is emerging to regulate the activities of nations in astronautics. We know that new body of law as Space Law. * Stephen E. Doyle is Honorary Director, International Institute of Space Law, Paris. weep not for the future: the photographs of Sam Davis • Critical Essay by Elizabeth Howie Sam Davis’s work, in particular images from his portfolios Tragic Heroes, Rocketships, and Tin, consists of a variety of approaches to exploring our longstanding fascination with outer space. Utilizing such devices as pinhole, medium format and 4x5 cameras, as well as processing ranging from daguerreotypes to tintypes, silver gelatin, and Chromira C-prints, Davis shows us our memories, dreams, and fantasies about our hopes and fears of the universe around us. Tragic Heroes, consisting almost entirely of panoramic shots, brings us into the proximity of solitary moon-suit clad figures. They are reminiscent of spacemen of cinema and television, such as the 1939 Buck Rogers movie serial, the 1952 serial Commando Cody, Earth vs. the Flying Saucers of 1956, 1959’s When Worlds Collide, or the all-too-earnest space travelers of the original Star Trek, which ran from 1966-69. The gadgets and spacecraft (also made by Davis) evoke even earlier examples, such as ray-guns from the 1936 film Flash Gordon. The above classic early sci-fi vehicles utilized special effects, which now appear quite clunky, to try to demonstrate the wonders and threats of the future.[1] Despite their retro stylings, Davis’s heroes have arrived in that future, and strangely, things have not advanced all that much. But some things are definitely different. Countering the myth of the NASA astronaut as idealized he-man, someone who possesses “the right stuff,”[2] Davis’s figures—and perhaps" spacemen" is a better word than "astronauts," to suggest their relation to science fiction— demonstrate instead a kind of wistful vulnerability we would never have been permitted to observe in the Apollo age. -

Orbiting 400 kilometres above us, the ISS offers unique opportunities to observe our planet, carry out research in space and prepare for human exploration of the Solar System. ESA is responsible for two key elements of the International Space Station: the Columbus research laboratory, and the Automated Transfer Vehicle (ATV) that delivered precious supplies to the ISS during five flights from 2008 to 2015. A European Service Module based on ATV technology will provide four major system functions to NASA’s Orion spacecraft: propulsion, power, thermal control and vital resources for the astronauts, such as water and a breathable atmosphere. -

The SKYLON Spaceplane
The SKYLON Spaceplane Borg K.⇤ and Matula E.⇤ University of Colorado, Boulder, CO, 80309, USA This report outlines the major technical aspects of the SKYLON spaceplane as a final project for the ASEN 5053 class. The SKYLON spaceplane is designed as a single stage to orbit vehicle capable of lifting 15 mT to LEO from a 5.5 km runway and returning to land at the same location. It is powered by a unique engine design that combines an air- breathing and rocket mode into a single engine. This is achieved through the use of a novel lightweight heat exchanger that has been demonstrated on a reduced scale. The program has received funding from the UK government and ESA to build a full scale prototype of the engine as it’s next step. The project is technically feasible but will need to overcome some manufacturing issues and high start-up costs. This report is not intended for publication or commercial use. ICES-2020-333 Development of the Crew Dragon ECLSS Jason Silverman1, Andrew Irby2, and Theodore Agerton3 Space Exploration Technologies, Hawthorne, California, 90250 SpaceX designed the Crew Dragon spacecraft to be the safest ever flown and to restore the ability of the United States to launch astronauts. One of the key systems required for human flight is the Environmental Control and Life Support System (ECLSS), which was designed to work in concert with the spacesuit and spacecraft. The tight coupling of many subsystems combined with an emphasis on simplicity and fault tolerance created unique challenges and opportunities for the design team. During the development of the crew ECLSS, the Dragon 1 cargo spacecraft flew with a simple ECLSS for animals, providing an opportunity for technology development and the early characterization of system-level behavior. As the ECLSS design matured a series of tests were conducted, including with humans in a prototype capsule in November 2016, the Demo-1 test flight to the ISS in March 2019, and human-in-the-loop ground testing in the Demo-2 capsule in January 2020 before the same vehicle performs a crewed test flight. This paper describes the design and operations of the ECLSS, the development process, and the lessons learned. LUNAR NETWORK TRACKING ARCHITECTURE FOR LUNAR FLIGHT Shane B. Robinson∗ A trade study was conducted with the objective of comparing and contrasting the radiometric naviga- tion performance provided by various architectures of lunar-based navigations assets. Architectures considered consist of a compliment of two beacons located on the lunar surface, and two orbiting bea- cons that provide range and range-rate measurements to the user. Configurations of these assets include both coplanar and linked constellations of frozen elliptic orbiters and halo orbiters. Each architecture was studied during the lunar-approach, lunar-orbit, and landing phases of a South Pole lunar sortie mis- sion. Navigation filter performance was evaluated on the basis of filter convergence latency, and the steady state uncertainty in the navigation solution. The sensitivity of the filter solution to Earth-based tracking augmentation and availability of range measurements was also studied. Filter performance was examined during the build up of the lunar-based navigation system by exploring different combi- nations of orbiting and surface-based assets. 1 INTRODUCTION The objective of the work outlined in this document is to conduct a parametric trade intended to evaluate some proposed constellations of moon-orbiting navigation and communication beacons. These orbiting beacons are intended to support the lunar missions of NASA’s Constellation program. This study is sponsored by the flight performance systems integration group at JPL (FPSIG), whose work is funded by the NASA Constellation program office. The work outlined in this report will focus on investigating lunar network aided navigation performance during near lunar phases of baseline missions proposed by the Constellation program. -

Their ability to not only supply materials to space stations or deploy satellites, but also in atmosphere flight makes them versatile in their deployment and recovery. The existing design of vehicles such as the Space Shuttle Orbiter and X-37 Orbital Test Vehicle can be used to observe the effects of scaling existing vehicle geometry and how it would operate in identical conditions to the full-size vehicle.
