Planning Minute/1 Resolved: That the report be noted. Members set out a need for Officers to go through the historic cases and resolve these cases to reduce the length of list.

Resolved: That the report be noted. In relation to item 7(e) Sarah Oswald confirmed she would be happy to replace Val Arnold as a Member of the Helmsley Joint Working Group. This was moved and seconded by Members. Members were also informed of the need for a representative for the Business Park Joint Working Group. Alison Fisher and David Chance both confirmed their interest. This was moved and seconded by Members.

48/13 Applications for Planning Permission

The following members of the public addressed the meeting regarding the Plans List Items indicated:

Plans List Item 1 – Councillor Coulson spoke on behalf of the Parish Council Plans List Item 2 – Mrs Mack spoke against the application. Plans List Item 3 – Mrs Mack spoke against the application. Plans List Item 6 – Mr David Read spoke in favour of the application. Plans List Item 8 – Mr Peter Arnott spoke in favour of the application.

Members also considered further information circulated on the Members’ Update Sheet at the meeting including; updated recommendations from the Director of Planning and comments received after the agenda was printed from: consultees, objectors and supporters.

Resolved: (a) That with regard to all applications listed in the report and subject to: (i) the amendments specified below; and (ii) the imposition of conditions in accordance with the relevant provisions of Sections 91-94 of the Town and Country Planning Act 1990, except in those instances where an alternative condition is contained in the Director of Planning’s recommendation or in an amendment referred to in (i) above; decisions be given in accordance with the Director of Planning’s recommendations:

Decision Jim Bailey informed Members that he had spoken with and received information from an objector. Approved as recommended subject to the Director of Planning to clear an additional condition relating to levels, the receipt of a signed Section 106 Agreement and receipt of satisfactory details in relation to visitor parking, provision of turning head and footpath along the development site frontage. Members agreed with Officers that the Highway Authority requirement for a footpath joining with the wider footpath network was unreasonable. 2. NYM/2013/0243/FL – Installation of 1 no. replacement western gable landing widow (retrospective) together with erection of gates and addition of charity collection plaque at Beacholme, Covet Hill, Robin Hoods Bay for Mr Graham Kemp, Beacholme, Covet Hill, Robin Hoods Bay, Whitby , YO22 4ST. Decision Approved as recommended. 3. NYM/2013/0264/LB – Listed Building consent for installation of 1 no. replacement western gable landing window together with erection of gates and addition of charity collection plaque at Beacholme, Covet Hill, Robin Hoods Bay for Mr Graham Kemp, Beacholme, Covet Hill, Robin Hoods Bay, Whitby, North Yorkshire, YO22 4SN. Decision Approved as recommended. 4. NYM/2013/0294/R3 – Application under Regulation 3 (Town and Country Planning General Regulations 1992) for creation of easy access footpath at land adjacent to Sutton Bank National Park Centre, Sutton Bank for National Park Authority, fao: Ms Jennifer Smith, The Old Vicarage, Bondgate, Helmsley, North Yorkshire, YO62 5BP. Decision Approved as recommended. 5. NYM/2013/0224/FL – Construction of single storey side extension at Aunums View, Westgate, Thornton le Dale for Mr Steve Barker, Aunums View, Westgate, Thornton le Dale, North Yorkshire, YO18 7SG. Decision Approved as recommended. 6. NYM/2013/0252/FL – Alterations and extensions, creation of underground wood pellet store, installation of solar PV cells together with creation of parking area and landscaping works at Bolton House, Ampleforth College, Ampleforth, for Ampleforth Abbey Trust fao: Mr David Read, Estate Department, Ampleforth, North Yorkshire, YO62 4EY. Decision Approved as recommended with additional conditions as set out on the Members Update Sheet: 7. HWAY00 Unless otherwise approved in writing by the Local Planning Authority, there shall be no excavation or other groundworks, except for investigative works, or the depositing of material on the site until the access to the site has been set out and constructed in accordance with the published Specification of the Highway Authority and the following requirements:

(i) The details of the access shall have been approved in writing by the Local Planning Authority in consultation with the Highway Authority.

Planning Minute/3 (ii) The existing access shall be improved by widening over the first 5 metres as shown on submitted Drawing Number Y-BSP-2824-SK01 Rev. A and shall be constructed in accordance with Standard Detail number E6d. (iii) Provision to prevent surface water from the proposed car park and access discharging onto the existing highway shall be constructed in accordance with details that shall be submitted, and agreed in advance, of the commencement of the development and maintained thereafter to prevent such discharges. (iv) The final surfacing of any private access within 10 metres of the public highway shall not contain any loose material that is capable of being drawn on to the existing or proposed public highway.

All works shall accord with the approved details unless otherwise agreed in writing by the Local Planning Authority. 8. Decision Approved as recommended. 8. NYM/2013/0289/FL – Construction of stone gabion walls, rebuilding of 2 no. footbridges, modifications to waterfall and stream bed and temporary access path (part retrospective) at land east and north of St Marys, Anserdale Lane, Lastingham for Ms J Heindricks, St Marys, Anserdale Lane, Lastingham, YO62 6TN. Decision Approved as recommended with the decision delegated to the Director of Planning to clear following the receipt of no adverse comments from the Sustainable Urban Drainage Systems Team at North Yorkshire County Council.
