Sir, This is with reference to letter no. IENGjEE(Projects)j110jDRPj Pt.1j743 dated 11.12.2013 forwarding along with application and subsequent letter dated 13.06.2014 seeking for Terms of Reference for the aforesaid project. 2. The proposal was considered by the EAC in its meetings held on 28th February to 1st March, 2014 and 25th - 27th August, 2014 and the proponent has informed that: 1. The proposal involves setting up of a new major Port at Durgarajapatnam, Andhra Pradesh. 11. It is proposed to be developed a major port at Dugarajapatnam along Andhra Coast in the East Coast of India at a distance of about 90 km north of Ennore port and 700 km south of Visakhapatnam port. 111. It is planned to develop the port with world class terminal facilities well suited to meet the present and future needs of the trades. Dugarajapatnam port once developed will have a unique distinction of being most modern green field major port in India with water depth up to 21 m, making it the deepest and capable of handling deep draft super cape size vessels to handle containers and bulk cargo. The port with its proposed facilities will become a gateway port for its entire hinterland spread over north, south, west and central India. IV. Dugarajapatnam Port will be an artificial deep-sea, harbour comprising of two rubble mound type breakwaters with concrete capping. v. The port is protected by providing south and north breakwaters. Hence, the master layout is developed in between a pair of break waters, one on the south side which is 4.56 km long and the other on the north side which is 2.4 km long. VI. The harbor is planned in between these two breakwaters and the shore. These breakwaters are placed in such a way to protect the harbor basin from predominantly easterly and southeasterly waves. They will also protect the basin from siltation due to littoral sediments. ToR__Dugarajapatnam_Port Page 1 of 4 ~ • vn. The area enclosed by the basin is 6.49 km-. This consists of berthing structures and future provision for a dry dock and a ship lift facility. Vlll. There will be a turning circle of diameter 780m. IX. An approach channel is provided to enable access from north-north east direction. The approach to the port is through a channel of 16 to 18 km in length, dredged to -21.0 m level and equipped with night navigational facilities. x. The permissible draught is 18.3m to handle super cape size vessels of 200,000 DWTto commercially carry bulk cargo of coal, ore, containers and other commodity raw materials from overseas and through coastal shipping. Xl. In the first phase, there will be 8 berths. Among these, 4 berths are for coal and four for containers and general cargo. The berths are laid out in such a way that the coal is segregated from the other clean cargo. The coal berths and conveyor corridor is provided along the south breakwater. The total area of berths is 1.31 km-'. xu. In the phase 2, there will be an addition of 10 berths with an additional berthing area of 0.93 km-. There could be two more berths along the outer arm of southern breakwater. These berths could be planned for future for handling of hazardous cargo or coal. X111. The overall project is proposed to be implemented through a joint venture (JV) between Visakhapatnam Port Trust (VPT)and the State Government of Andhra Pradesh. XlV. Dugarajpatnam village, proposed site for port development by Ministry of Shipping is a small village with 2500 inhabitants, is adjacent to Buckingham Canal and nearer to coast in Vakadu Mandalam of Nellore District of Andhra Pradesh. xv. Buckingham Canal of about 25-50 m width runs parallel to the coast near proposed port location. Along with the Buckingham Canal, a large stretch of water body from Pulicat Lake runs and joins the sea south of the proposed port. It is surrounded with marshy land influenced by sea tide at Kondurupalem inlet and Swarnamukhi estuary. XVI. Guduru is a nearest town located at a distance of 40 km and Vakadu at 10 km. Aquaculture, Fishing and Agriculture are major economic activities in the area. xvu. ISRO satellite launching station SHARis located at a distance of about 25 km south of the proposed site. Dugarajpatnam is connected to NH-5 (Chennai - Kolkata) at a distance of about 33 km at a place called Naidupet. The Krishnapatnam port is located about 20 km north of the proposed port location. XVlll. There are no court cases/violation pending with the project proponent. 3. The Expert Appraisal Committee (EAC)has considered the proposal in its meeting held on 25th - 27th August, 2014 and recommended for the TOR with the following specific TOR with general conditions for preparation of the Environment Impact Assessment (ElA)Report and Environment Management Plan (EMP) in respect of the Setting up of a new major Port at Durgarajapatnam, Andhra Pradesh by M/s Vishakhapatnam Port Trust: (i) The newly proposed location should not interfere with eco- sensitive zone of pnt. Port authorities should submit EIA with ToR_Dugarajapatnam_Port ~ Page 2 of 4 duly notified eco-sensitive zone of Pulicat and all necessary • clearances from concerned authorities. (ii) Since, the proposed site is located south of Swarnamukhi River and Pulicat lake, a study to assess the impact of proposed port on coastal morphology should be conducted. (iii) Since, the area is prone to cyclone and Tsunami, a study to assess its impact on port and adjacent area should be conducted. (iv) Traffic forecast and possible type of cargo and its impact to be assessed. Area being close to Pulicat lake, possibility of operating clean cargo to be explored. General Guidelines (i) The EIA document shall be printed on both sides, as for as possible. (ii) All documents should be properly indexed, page numbered. (iii) Period/ date of data collection should be clearly indicated. (iv) Authenticated English translation of all material provided m Regional languages. (v) The letter/application for EC should quote the MoEF&CC File No. and also attach a copy of the letter prescribing the TOR. (vi) The copy of the letter received from the Ministry on the TOR prescribed for the project should be attached as an annexure to the final EIA-EMP Report. (vii) The final EIA-EMP report submitted to the Ministry must incorporate the issues in TOR and that raised in Public Hearing. The index of the final EIA-EMP report, must indicate the specific chapter and page no. of the EIA-EMP Report where the specific TOR prescribed by Ministry and the issue raised in the P.H. have been incorporated. Mining Questionnaire (posted on MoEF&CC website) with all sections duly filled in shall also be submitted at the time of applying for EC. (viii) Grant of TOR does not necessarily mean grant of EC. (ix) Grant of TOR/EC to the present project does not necessarily mean grant of approvals in other regulations such as the Forest (Conservation) Act 1980 or the Wildlife (Protection) Act, 1972. (x) Grant of EC is also subject to Circulars issued under the EIA Notification 2006, which are available on the MoEF&CC website: www.envfor.nic.in. T'R_DUgm~"pa'nam_p,~ Page 3 of 4 • (xi) The status of accreditation of the EIA consultant with NABET/QCI shall be specifically mentioned. The consultant shall certify that his accreditation is for the sector for which this EIA is prepared. (xii) On the front page of EIA/EMP reports, the name of the consultant/ consultancy firm along with their complete details including their accreditation, if any shall be indicated. The consultant while submitting the EIA/EMP report shall give an undertaking to the effect that the prescribed TORs (TORproposed by the project proponent and additional TOR given by the MoEF) have been complied with and the data submitted is factually correct (Refer MoEF office memorandum dated 4th August, 2009). (xiii) While SUbmitting the EIA/EMP reports, the name of the experts associated with/involved in the preparation of these reports and the laboratories through which the samples have been got analysed should be stated in the report. It shall clearly be indicated whether these laboratories are approved under the Environment (Protection) Act, 1986 and the rules made there under (Please refer MoEF office memorandum dated 4th August, 2009). The project leader of the EIA study shall also be mentioned. (xiv) All the TOR points as presented before the Expert Appraisal Committee (EAC)shall be covered. 4. A detailed draft EIA/EMP report should be prepared in terms of the above additional ToRs and should be submitted to the State Pollution Control Board for conduct of Public Hearing. Public Hearing to be conducted for the project in accordance with the provisions of Environmental Impact Assessment Notification, 2006 and the issues raised by the public should be addressed in the Environmental Management Plan. The Public Hearing should be conducted based on the ToR letter issued by the Ministry and not on the basis of Minutes of the Meeting available on the web-site.
