Zygmunt Bauman RESUMO O presente trabalho se foca no estudo acerca de dois criminosos nazistas encontrados no Brasil: Franz Stangl e Gustav Wagner, com o anseio de pesquisar quem eram estes nazistas, quais crimes cometeram e como chegaram ao Brasil, além de analisar os processos de extradição realizados contra eles e de que forma a descoberta destes nazistas no país e os resultados dos processos de extradição impactaram na imprensa do sudeste. Stangl foi Comandante dos campos de extermínio de Sobibor e Treblinka, além de ter trabalhado anteriormente no Instituto de eutanásia de Hartheim, sendo que, desta forma, participou ativamente do assassinato de milhares de pessoas, em especial judeus. Wagner, que também havia laborado em Hartheim, foi sub-comandante do campo de extermínio de Sobibor, sendo conhecido por sua crueldade e tendo assassinado pessoalmente dezenas de pessoas de origem hebraica. Ambos, após o fim da guerra, fugiram da Europa com auxílio de membros da igreja católica e, após um período na Ásia Ocidental, acabaram por se refugiar no Brasil. Stangl foi encontrado no país em 1967 e sofreu pedidos de extradição da República Federal da Alemanha, Áustria e Polônia, sendo que, após o julgamento destes pedidos pelo Supremo Tribunal Federal, o nazista foi entregue à Alemanha. Wagner foi encontrado no Brasil onze anos depois e também teve sua extradição solicitada pelos governos da República Federal da Alemanha, Áustria, Polônia e Israel. O entendimento do Supremo Tribunal Federal no caso Wagner, porém, foi diferente, sendo que a extradição do nazista foi negada. A pesquisa se concentrou, em um primeiro momento, na análise de ambos os sujeitos e seus crimes, assim como os locais onde cometeram os delitos de que foram acusados para, posteriormente, abordar como os nazistas foram encontrados no Brasil e o impacto destes fatos nos jornais do sudeste. No último momento do trabalho, passou-se a estudar o tratamento dado ao instituto da extradição no ordenamento pátrio vigente à época dos julgamentos, os processos em si e seus resultados, finalizando com uma análise acerca da repercussão do resultado dos julgamentos nos jornais de São Paulo e Rio de Janeiro. Para a realização da pesquisa foi utilizada bibliografia específica, entrevistas realizadas com sobreviventes dos campos de extermínio de Treblinka e Sobibor, os processos de extradição na íntegra e jornais da época. Estas etapas foram realizadas para buscar subsídios para se responder o problema principal da pesquisa: Quais foram os motivos jurídicos que embasaram os resultados diferentes nos dois julgamentos naquele momento histórico, diante da aparente equidade dos casos? Chegou-se, então, à conclusão de que isto ocorreu em virtude da análise estritamente legalista realizada pelo Supremo Tribunal Federal do caso Wagner, em detrimento das normas internacionais de repressão aos criminosos que participaram de genocídio e da própria justiça. ABSTRACT This work focuses on the study about two Nazi criminals found in Brazil: Franz Stangl and Gustav Wagner, with the will to research who this Nazis were, which crimes they commited e how they arrived in Brazil, besides analyzing the extradition processes against them and in what way impacted on the press of the southeast region of Brazil the discovery of this Nazis in Brazil and the results of the extradition processes. Stangl was Commander of Sobibor and Treblinka death camps, and also worked in the euthanasia institute of Hartheim, and participated actively on the murder of thousands of persons, specially Jews. Wagner, that also had worked in Hartheim, was second in charge on Sobibor death camp, being known for his cruelty and having assassinated personally dozens of persons of Hebrew origin. Both, after the war, escaped from Europe with the aid of members of the catholic church and, after a period in East Asia, they fleed to Brazil. Stangl was found in the country in 1967 and suffered extradition requests from the Federal Republic of Germany, Austria, and Poland, and, after the trial of this requests by the Brazilian Supreme Court, the Nazi was turned over to Germany. Wagner was found in Brazil eleven years after and also had his extradition requested by the Federal Republic of Germany, Austria, Poland and Israel. The understanding of the Brazilian Supreme Court on the Wagner case, however, was different, being that the extradition of the Nazi was denied. The research concentrated, in a first moment, in analyzing both the subjects and their crimes, as well as the places where they committed the felonies that they were charged to, after, describe how the Nazis were found in Brazil and the impact of these facts in the newspapers from the southeast region of Brazil, being able to, at this moment, start to study the treatment given to the institute of extradition on the Brazilian laws of the time of the judgments, the processes and their results, ending with an analysis about the repercussion of the results of the trials in the newspapers from São Paulo and Rio de Janeiro. In the execution of the research were utilized specific bibliography, interviews with survivors from Sobibor and Treblinka death camps, the extradition processes and newspapers of the time. This steps were made to solve the main problem of the research: What were the legal reasons that based the different results on both trials on that historical moment in front of the apparent equality of the cases? It came to the conclusion that this happened because of the strictly legalist analysis made by the Brazilian Supreme Court in the Wagner case, despite the international laws against criminals that participated in genocide and justice itself.     Biography of Franz Stangl (1908-1971) Childhood and Early Life Franz Stangl was born on March 26, 1908 in a small town in Austria called Almunster. His father worked as a night watchman, and believed that Stangl was not his child (implying his wife cheated on him). Stangl was petrified of his father because he was continually beaten by him. When Stangl was eight years old his father died of malnutrition, and a year later his mother re- married. When he was fourteen, his step-father wanted him to leave school and work at a local steel mill. At fifteen, he left school and became an apprentice weaver. He finished his apprenticeship in three years and when he was eighteen and a half became the youngest master weaver in Australia. At twenty-three years old he discovered there was no further career advancement, so he applied for a job with the police force, as he was always attracted to the job of policemen, liking the safety and security it represented. Several months later he was told to report to the Kaplanhof (police training barracks in Linz) for training where he started out as a rookie for the Austrian police force, working as a traffic policeman and on the riot squad. He volunteered for ‘special duties’, which included in participating in street battles in Linz against socialists. He earned a silver medal for removing socialists from a local Cinema where they had been entrenched. In 1934, the Nazi’s assassinated the Chancellor of Austria, but it was clear that the Austrian police criticized this action.

These mass murders were allegedly perpetrated at the Sobibór “death” camp in east- ern Poland. According to mainstream historiography, 170,000 to 250,000 Jews were exterminated there in gas chambers between 1942 and 1943. The corpses were buried in mass graves and later incinerated on an open-air pyre. But do these serious claims really stand up to scrutiny? In Sobibor: Holocaust Propaganda and Reality, the official version of what transpired at Sobibór is put under the microscope. It is shown that the histori- ography of the camp is not based on solid evidence, but on the selective use of eyewitness testimonies, which in turn are riddled with contradictions and out- right absurdities. This book could exonerate John Demjanjuk. For more than half a century, mainstream Holocaust historians made no real attempts to muster material evidence for their claims about Sobibór. Finally, in the 21st century, professional historians carried out an archeological survey at the former camp site. Zeitspiel – aus den Tiefen der Ebene zum Ende Für die Berichterstattung über den Demjanjuk-Prozess hatte ich mich im Spätsommer 2009 freiwillig gemeldet, obwohl es für einen fest angestellten Redakteur der ARD eher ungewöhnlich ist, langfristig Reporteraufgaben zu übernehmen. Mir schien das Verfahren zeithistorisch interessant, auch wenn niemand wusste, wie lange es sich hinziehen würde. Allerdings gab es später auch Tage, an denen ich die Freiwilligkeit bereute. Vor allem wäh- rend der Beweisaufnahme, als scheinbar nichts vorwärts ging im Gerichtssaal. Andererseits war das Geschehen auch faszinierend: Das stete Kräftemessen zwischen Anklage, Richterbank und Verteidigung, die Prozessführung, die juristische Anwendung der Täterforschung zum Holocaust. Ein Neugier- Faktor mag auch das Gerichtsgebäude als solches gewesen sein. Der neue Münchner Justizpalast, eine grau-grüne Betonburg aus den 1970er Jahren, bot jeden Tag ein Kaleidoskop unserer Gesellschaft. Es genügte, sich still diejenigen anzuschauen, die morgens an der Sicherheitsschleuse standen. Wer war als Zeuge geladen, wer kam als Beschuldigter? Wenn nur ein Ende absehbar gewesen wäre! Anfangs hatte das Gericht nur bis Mai 2010 geplant. Danach begannen die Verlängerungen: Diese Verhandlungstage wurden durch Gerichtsmitteilungen bekannt gegeben: am 3. März und am 24. No- 1 vember 2010, am 3. Februar 2011 und am 18. März 2011 . Obwohl Straf- prozesse immer wieder Unwägbarkeiten mit sich bringen, war dies doch eher ungewöhnlich – und das umso mehr, als die Ungewissheit sogar bis zum letzten Prozesstag anhielt. Denn erst am Mittag des 12. Mai 2011 war allen klar, dass sie an diesem Tag auch das Urteil hören würden. Bis zuletzt hoffte ich mit anderen Zuhörern und Prozessbeteiligten, den einen historischen Augenblick zu erleben, wenn John Demjanjuk sein Schweigen brechen und berichten würde, was sich ereignet hatte nach seiner Gefangennahme durch die Wehrmacht im Frühjahr 1942.

    7 The Bureaucracy of Annihilation RAUL HILBERG We are, all of us who have thought and written about the Holocaust, accustomed to thinking of this event as unique. There is no concept in all history like the Final Solution. There is no precedent for the almost endless march of millions of men, women, and children into gas cham­ bers. The systematization of this destruction process sets it aside from all else that has ever happened. Yet if we examine this event in detail, ob~ serving the progression of small steps day by day, we see much in the destruction of Jewry that is familiar and even commonplace in the con­ text of contemporary institutions and practices. Basically, the Jews were destroyed as a consequence of a multitude of acts performed by a phalanx of functionaries in public offices and private enterprises, and many of 'these measures, taken one by one, tum out to be bureaucratic, embedded ih habit, routine, and tradition. It is almost a case of regarding the whole upheaval in all of its massiveness as something incredible, and then ob­ serving the small components and seeing in them very little that one could not expect in a modem society. One can go further and assert that it is the very mundaneness and ordinariness of these everyday official actions which made the destruction process so crass. Never before had the total experience of a modem bureaucracy been applied to such an undertaking.
