One of the most exciting accomplishments for 2012 was the addition of two new satellites to our growing fleet through the successful launches of EchoStar XVI and EchoStar XVII, bringing our total number of owned, leased and managed spacecraft to twenty-two. EchoStar operates the world’s fourth largest commercial geostationary satellite fleet and we continue to solidify our position as a premier global leader in satellite communications and operations. EchoStar ended 2012 with revenue of $3.1 billion, a growth of 13% over 2011. EBITDA in 2012 was $794 million, a growth of 64% over 2011. We generated a healthy $508 million of cash from operating activities in 2012 as a result primarily of the strong net income in 2012 and ended the year with a strong balance sheet with $1.5 billion of cash and marketable securities. EchoStar reached two very important long-term North America goals in 2012 with the market implementation of the HughesNet Gen4 service and the roll-out of the Hopper Whole Home DVR solution for DISH. Both solutions are garnering high praise and rapid adoption by consumers, a glowing testament to the capabilities and ingenuity of the EchoStar team. From 1523 objects for which orbital data are available (of which 0 are outdated, i.e. the last available state dates back to 180 or more days before the reference date), 519 are actively controlled, 795 are drifting above, below or through GEO, 189 are in a libration orbit and 19 are in a highly inclined orbit. For 1 object the status could not be determined. Furthermore, there are 59 uncontrolled objects without orbital data (of which 54 have not been cata- logued). Thus the total number of known objects in the geostationary region is 1582. Such reports shall be made available immediately to the public. (b) CONTENTS OF REPORTS - The reports submitted pursuant to subsection (a) shall include the following: (1) Progress with respect to each objective since the most recent preceding report. Progress as to Objectives and Purposes The purpose of the ORBIT Act is “to promote a fully competitive global market for satellite communication services for the benefit of consumers and providers of satellite services and equipment by fully privatizing the intergovernmental satellite organizations, INTELSAT and Inmarsat.”2 The ORBIT Act, as originally passed in 2000: (1) mandates the privatization of INTELSAT and Inmarsat; (2) establishes criteria to ensure a pro-competitive privatization; (3) requires the Commission to determine whether INTELSAT, Inmarsat, and the INTELSAT spin-off New Skies Satellites N.V.
